Abstract

The Environmental Protection Agency ("EPA") has been attempting to develop a federal regulatory program for mine waste under Subtitle D of the Resource Conservation and Recovery Act since 1986. Recent regulatory and legislative events are now bringing this goal closer to reality. This paper discusses the mining industry's perspective on a number of the issues currently being addressed at EPA's Policy Dialogue Committee and in Congressionally-sponsored negotiating sessions.
