Abstract

Pursuant to the Federal Surface Mining Act of 1977 and the Illinois Surface Mining Act of 1980, Illinois has adopted revegetation success standard regulations that include the Agricultural Land Productivity Formula. The Formula establishes yield goals and standards to measure the success of meeting yield goals for reclaimed prime farmlands. The formula compares the quality of the pre-mining soils in the permit area and the county, to the crop production achieved on the reclaimed permit area and the county crop yield in a given crop year. The regulations also specify acceptable crops, erosion control requirements and time frames for demonstrating success.
