The availability, cost and use of fuel and electricity for the cement industry is difficult to predict with a great degree of accuracy because the historical pattern of factors affecting energy was disrupted during the years 1972, 1973 and 1974. Forecasting is both an art and science and is based on .the premise that the best indicator of the future is the past. Statistical data is used to guide economists and businessmen in their predictions of the future. Even though the energy picture is changing, it is believed that electricity and fuel will be available for the cement industry in the foreseeable future, and this energy will be more costly in relation to the other items that are part of the manufacturing costs for portland cement.

I appreciate this opportunity to discuss with you OPIC's new policies designed to assist U.S. minerals companies in developing new sources of minerals overseas. A comparison of recent figures on U.S. investment in mineral exploration, development and production gives results which are remarkable --and disturbing. Through the 1960's the flow of U.S. foreign direct investment in mining and smelting in the developed and less developed countries were nearly equal. However, by 1973, roughly 80% of all exploration expenditures by mining companies was taking place in the developed countries and principally in the U.S., Canada and Australia. Clearly it is to the interests of both the developing countries and the United States to put these figures back in better balance. As you may be aware, the administration as a whole is examining systematically what can be done by government to reduce the disincentives and increase the incentives to mineral investment in the less developed countries --the LDCs. A subgroup of the National Advisory Council chaired by the Treasury Department has been formed to coordinate U. S. Government policy and program efforts relating to mineral and energy development in these countries. Among other matters, this subgroup will examine how public policies could positively influence the private investment decision-making process in the minerals industry.

Titanium is a metal of increasing worldwide strategic importance. The Center for Advanced Mineral and Metallurgical Processing (CAMP) at Montana Tech of the University of Montana is currently directing two titanium research initiatives. The first program, Titanium Extraction Mining and Process Engineering Initiative (TEMPER), is focused on producing low cost titanium through the identification and development of new mining, beneficiation and extraction technologies which will significantly reduce the cost of titanium production. This will directly benefit worldwide commercial applications. Secondly, CAMP is evaluating new technologies for fabrication of titanium utilizing the Free Form Titanium Fabrication (FFTF) initiative. These technologies may drastically reduce the cost and time to manufacture titanium components. Because of the high strength to weight ratio of titanium coupled with its superior corrosion characteristics, these programs will be of vital importance to expanding the commercial and strategic applications of titanium. An overview of these two new titanium initiatives will be presented in this paper.

The purpose of this paper is to outline the advantages and disadvantages of single tube and twin tubes for subway systems. Different aspects such as diameter of the tunnel (tunnel spaceproofing), configuration of subway line and stations, impacts on passenger safety and evacuation, ventilation system as well as rail system for each solution were evaluated and compared. In addition, a multi-criterion approach is established to facilitate the decision making for these two different subway systems. The practical example of a mega project has been discussed and the details of the decision-making process has been explained. This proposed multicriterion can be used to facilitate selecting the best subway system in any urban areas.

Compared to coal or many metals industries, talc must be considered a small, specialty market catering to niches and dependent primarily on the physical attributes of the mined and processed mineral rather than the chemical attributes with copper, lead or uranium concentrate, the primary objective is the percent metal that ultimately is refined by the smelter, as opposed to the brightness, particle size distribution, trace impurities or morphology. The latter constitute the important determinants of where, how and why talc and similar industrial minerals are used. This paper addresses the talc market-place: where it is, how much of a market there is, who the producers are, available capacity, market growth, and marketing techniques.

Introduction Millions of tons of coal are shipped by rail each year in the US. Loading those trains efficiently is a topic being studied by coal producers and railroads. Alternatives range from volumetric loadouts to systems that weigh the product, using either belt conveyor scales, track scales, or weighbins. Each system has its proper application and each has pros and cons, depending on the volume, nature, and layout of the specific loading facility. In recent years, a batch weighing system has been developed that offers significant benefits to higher volume operations shipping by a unit train. The Unitrain Loadout System (ULS) features a precision electronic batch weighing system married to a mechanical loadout system by a microprocessor-based digital control system. A batch weighing loadout could be designed using analog electronics or even a mechanical weighbin. But it is the adaption and use of a microprocessor that provides the primary benefits of a unit train loading facility. Those benefits are accurate weight determination, optimum car use, overload prevention, speed in loading, optimum labor use, and documentation of the loading process. Unitrain History The first ULS was erected for iron ore applications in Canada during the 1960s. The first domestic system on coal was installed at Pittsburg and Midway Coal Co.'s McKinley mine at Gallup, NM, in 1978. At present, there are more than 20 Unitrain Loadout Systems in operation worldwide. They are loading minerals, concentrates, and coal. Eleven systems are presently in service or under construction in the US. In the last several years, a number of comparable systems have also been installed. As a result, the concept has been well proven and is now commercially available from several sources. Unitrain Operation The basic operation of a ULS involves loading a unit train with individually weighed batches of coal while it moves slowly under a loadout tower. Typical coal systems are designed to load at rates of 2.7 to 6.3 kt/h (3000 to 7000 stph). The contents of each car can be accurately weighed. This meets the requirements of the National Bureau of Standards Handbook No. 44 for static weighing. Also, cars can be loaded within very close tolerances. This optimizes railcar usage and prevents overloads. Principal components of the loadout system are the main feed conveyor, the surge bin, surge bin gates, weighbin, weighbin gate, flood loading chute, control room, calibration weights, and hydraulic and electrical systems (Fig. 1). Main feed conveyor: Coal is delivered from a storage area by the main feed conveyor. The conveyor fills the surge bin. It should be capable of conveying coal at the same rate at which it is being loaded. Usually the feed conveyor is equipped with a conveyor scale that can display rate in the control room and control feed to the belt. The surge bin will typically store 227 to 272 t (250 to 300 st) of coal. If the loadout is installed in an over-the-track silo, there is no need for a surge bin. Four double-bladed, hydraulically actuated gates are incorporated into the bottom of the surge bin. These gates open to fill the weighbin. Automatic pre-act points are selected by the control system. They shut these gates as the desired weight is approached. The final amount of coal is added by a single gate that closes. This results in a weighed batch of coal within ± 0.5% of the selected optimum load per railcar. Thus, if loading 91-t (100-st) capacity cars, the system is set to batch up 90.2 t (99.5 st) batches. "A booster fan is an underground mechanical ventilation equipment installed in series with a main surface fan that is used to boost the air pressure provided by the surface main fan passing through it. As mining continues to expand and go deeper, the need for improved and efficient ventilation increases. This has led to the use of booster fans and other auxiliary ventilation devices in underground mines. This paper details experiments and results carried out at Missouri S&T Experimental Mine that investigated air leakage and recirculation caused by the use of booster fans. The results were compared with the situations where booster fans are used and not used.The variables considered were the booster fan blade angle and the fan combinations. Air quantity measurements were taken at each individual stopping under a number of scenarios and across four blade angle settings. The first set of situations examined were; the main surface Joy fan only running, the main Joy, and the west booster fan running, and the main Joy fan and east booster fan running. Observations were made which lead to the conclusion from the experimental analysis that booster fans affect the behavior of leakage and recirculation. The locations of the booster fan and the blade angle setting have the most effect on leakage and recirculation. To limit the potential for system leakage and recirculation, the location and size of a booster fan in a ventilation system should be thoroughly evaluated.INTRODUCTION Missouri S&T Experimental Mine ventilation system The Missouri S&T Experimental Mine has two shafts. One currently serves as the main intake shaft. Air is forced through the main shaft by a Joy Manufacturing Vane Axial fan and follows the direction shown on the map on Figure 1. The air is currently naturally exhausted through the Wheeler portal. As indicated on the map there are eight stoppings in the mine, with stoppings number 2 and 8 fitted with man doors. The mine also consists of three raises which are either fully or partially blocked, two portals with one acting as an exhaust and the other generally closed by a hydraulic Kennedy door."

Introduction During the last decade, the metallic minerals segment of the industry could be categorized as a "feast-or-famine" business. It is no secret that metallic minerals are cyclical. Employment opportunities greatly depend on the supply and demand for its mineral products. It is also not unusual for there to be a lag between the industry's manpower requirements and academia's ability to produce new graduates. Due to this lag, there will be years with manpower shortages, as in the mid-1970s. At other times, supply will exceed demand. The question is where will the jobs be in the years to come? This presentation will review reasons why employment opportunities have declined within the metallic minerals industry. It will also predict future demand for mineral engineering graduates. And it will outline strategies for obtaining an employment offer. Historical Review - Employment From 1977 through 1983, about 75% of all metal mining employees were directly engaged in production activities, down from 83% in 1965. This decline reflects increased use of labor saving equipment, and more government regulation and foreign competition. Metal mining's employment decreased from 74,000 jobs in 1982 to fewer than 68,000 in 1983 - an 8% decline. The overall industry is having these problems because of the general downturn in the economy. For example, at the beginning of this decade, US automobile and steel industries were in trouble. Interest rates were too high and volatile. This adversely affected construction, housing starts, and manufacturing. All these industries, being large users of base metals, drastically affected the metals industry. US copper companies are still having problems. Reports indicate that many copper employers have cut production, laid-off workers, and permanently closed mines, refineries, and smelters. A decline in the demand for US produced metal products, such as copper, obviously affects some mineral engineering employment opportunities. Other factors to consider when looking at employment opportunities and why it has become difficult for US metal producers to compete in the world market include: • The grades of ore bodies of many US minerals are considerably lower than the grades of ores being mined elsewhere in the world. • The grades of ore bodies currently being mined in the US are steadily declining. • Foreign producers are largely government controlled and are not necessarily subject to the realities of supply and demand. • US environmental regulations have considerably added to production costs. Foreign producers in most countries do not have to worry about these additional costs. • US mines are getting deeper. This adds to the cost of production because of the increasing distance the ore has to be transported. • Plants and equipment are outdated. Many companies find themselves operating with equipment and plants that need modernizing or replacing. This obviously hinders competitive productivity. • Labor and management have had problems. Work stoppages in certain mining businesses and high wage and benefit costs in relation to foreign producers place US producers at a disadvantage. • Much land is unavailable. The US government owns most of the land considered to have the best potential for minerals development. Most of this land is unavailable for mining or exploration. Therefore, it appears that finding employment with a company whose primary business is mining and processing most metals, such as copper, in the US will be quite restricted and competitive. Future Demand It is difficult to anticipate what key employment opportunities within the next few years will be available to mineral engineering graduates. The Engineering Manpower Commission estimated that US engineering schools awarded 72,471 undergraduate degrees in 1983 vs. 66,990 in 1982. This was the eighth consecutive year in which the number of baccalaureates awarded has increased. On a brighter note, the US government's Occupational Outlook Quarterly stated that the growth rate through 1995 for all engineers is an encouraging 49% over present levels. The use of solid state track deters allows totally passive, integrating measurements of 222Rn (radon) or of 220Rn (thoron) plus radon. A track-detecting solid is placed in a holder that is closed by a selective membrane and exposed to the atmosphere of interest to produce an accurately time-averaged record over times of interest that range typically from a week to a year. By selection of the proper membranes, dosimetry can be done for radon or for the sum of radon and thoron. A different membrane is appropriate for measuring radon under humid conditions such as are found in the ground. Large numbers of measurements have been made with these systems both in the ground, where radon levels are high, and in indoor environments, where levels are orders of magnitude less. Calibrations have been carried out at both high and low concentrations of radon. New results in the air at the site of the Shirley Basin mine and mill give reproducible results with month-long integrating periods. The off-site background levels are in the range 0.7 to 1.0 pCi/l (26-37 Bq/m3). The average yearlong on-site level is 1.5 pCi/l (56 Bq/m3); at the mill it is 2.6 pCi/l (96 Bq/m3); and the level measured at the backhoe in the open pit mine is 3.9 pCi/l (144 Bq/m3). The region of significantly elevated radon levels is confined to a radius of 1.6 km of the mine and mill. All of the on-site radon concentrations are less than but comparable to the typical values found in the living areas of modern energy-efficient homes.

Environmental pressures on waste disposal are forcing pigment producers to use higher content TiO2 feedstocks with lower levels of trace elements. Despite this, 50% of the worlds TiO2 comes from ilmenite concentrates with only 37 -54 % TiO2 An industry growth rate of 25 % in the next ten years combined with trends to diminishing resources and lower grades for rutile (95 % TiO2) and leucoxenized ilmenite (55 to 90% TiO2) mean that unless new discoveries are made soon, the industry will become even more reliant on ilmenite. A hypothetical ideal feedstock is presented and strategies to obtain it are suggested. Reasons for some of the mineral specifications are given.

Lignin, the second most abundant natural polymer and bi-product of the pulp and paper industry, has been commercially available in a number of forms since 1940. This growing industry is fueled by demand in traditional applications. Reagents that offer unique solutions in various mineral process applications are examples of advanced uses that also fuel growth. These applications include flotation reagents in fluorspar, bastnäsite and potash, as well as in the zinc pressure leach process. Due to the fact that no concerted effort has been made to find applications for modified lignosulfonates, it is quite possible that this natural material will find use in other benefication processes.

The estimated total energy demand for the U. S. is 60 quadrillion BTU for 1970 and is expected to more than double by the year 2000. Today the energy crunch is here. It is evidenced by brownouts to conserve electrical energy, and the shortage of gas and oil. Many such headlines, including suggestions for energy rationing, are in the news today. Paradoxically we have an abun¬dant source of energy in the form of coal. Energy consumers, however, are geared to use fuel in other forms. It is the intent of this presentation to discuss processes under development for conversion of the energy contained in these vast coal reserves to more usable forms. Coal conversion to synthetic fuels should be of particular interest to those engaged in mining. Coal consumption in a single conversion plant is expected to range from 10,000 to 40,000 tons per day. Plants will be located at the mine mouth and will operate continuously 24 hours per day, seven days per week. Further, many such plants will be needed., For example, looking at natural gas only, the supply/demand gap is estimated to reach 13 trillion cubic feet per year by 1985. Assuming that gas from coal conversion were to fill only 101, of this gap, 15 plants producing 250 MMSCFD would be required. These plants would consume about 90 million T/Y of coal or 135 million T/Y of lignite. It will indeed be a challenge to mine, suitably prepare, and transport coal at these projected volumes without interruption. Many ideas have been conceived for better utilization of coal and these are in various stages of development. Those supported by public money are covered by the Annual Report of the Office of Coal Research (OCR), Department of Interior. The two processes to be discussed, the Consolidation Coal Company's (Consol) C02 Acceptor Process (1)(2)(3) and The Pittsburg and Midway Coal Mining Company's (PAMCO) Solvent Refined Coal Process (4)(5) are both sponsored by OCR.

Two porphyry copper orebodies, the North and Central MM orebodies, have been found through regional and structural geologic works, about 5 Km south of Chuquicamata, under a gravel bed of approximately 100 m and in the west side of the West Fissure. The mineralization is emplaced in a coarse granodioritic porphyry, predominantly with sericitic alteration. In the North MM ore-body, with 200 million metric tons of 1.0% Cu, the mineralization is mainly chalcopyrite, bornite, digenite and molibdenite. In the central MM orebody, with 700 million metric tons of 1.3% Cu, there are large veins of enargite, chalcocite and bornite, the last one increasing in depth, separated by chalcopyrite and pyrite zones; in these veins there are interesting gold and silver values. Both orebodies have an upper enrichment of chalcocite and covellite, with pyrite envelope. According with these characteristics, the MM orebodies could he the upper part, with sericitic alteration, of the Chuquicamata porphyry copper system, displaced by the West Fissure system movements, but we couldn't eliminate the possibility that MM can be a new orebody, different of Chuquicamata.

"Newmont Mining Corporation operates the Yanacocha mine in Perú and the gold milling section of the property includes a Sulfidization-Acidification-Recycle-Thickening (SART) plant to remove copper from pregnant leach solution. Since its commissioning in 2008, the plant has been intermittently operated as needed to remove copper upstream of a carbon adsorption circuit. However, starting in 2015 Newmont expects the plant to operate on a more continuous basis in response to higher copper ores that will be processed in the gold mill. In anticipation of this, Newmont conducted a campaign in May 2014 with stockpiled high-copper ore to evaluate performance of the SART plant with elevated levels of copper in feed solution. Results from the campaign demonstrated the SART plant is capable of efficiently treating high-copper leach solution. During the campaign, leach solution copper levels ranged from about 100 to 700 mg/L, and copper removals ranging from about 56% to +99% were achieved. The median copper removal efficiency observed during the campaign was about 94%. The primary plant modification determined necessary following the campaign was the need to improve consistency with sulfide dosing. INTRODUCTION Copper removal from cyanide leach solution can be affected through the addition of sulfide at acidic pH to precipitate copper sulfide as a solid. There has been renewed interest in the process in the past several years due to the increasingly common issue of high copper levels in cyanide leach solutions. The term Sulfidization- Acidification-Recycle-Thickening (SART) is used as an acronym for the process according to the primary unit operations utilized. At a pH of approximately 4.0 to 5.0, the addition of soluble sulfide to a copper-bearing leach solution will result in the precipitation of copper sulfide (Cu2S) solid. The overall acidification and sulfidization reaction is (assuming the use of sulfuric acid for pH adjustment): 2Cu(CN)3-2 + 3H2SO4 + S-2 ? Cu2S(s) + 6HCN(aq) + 3SO4-2 The above reaction is written relative to the copper-cyanide complex 2Cu(CN)3-2, though analogous reactions also take place with the other common copper-cyanide complexes Cu(CN)2- and Cu(CN)4-3. Sulfide in the above reaction (S-2) is normally supplied as sodium hydrosulfide (NaHS) purchased in solid or concentrated liquid form. Two characteristics of this reaction that are beneficial to a leaching operation are: 1. Copper is removed from solution as Cu2S (synthetic chalcocite) solid, which can then be sold to a smelter for its copper value. 2. Cyanide that is complexed with copper in the leach solution is released as free cyanide, thereby regenerating cyanide that can be recycled to the leaching operation for continued use."

Although gold's market price dropped considerably from 1980's all time high, exploration for the precious metal remained a particularly bright spot last year, especially in the western US. For example, in Nevada-the nation's largest gold producer-further exploratory drilling at Louisiana Land & Explorations Co.'s deposit at Round Mountain and Newmont Mining Corp.'s find near Carlin resulted in sharp boosts in estimated reserves at both sites. Louisiana Land said its deposit is well on the way to being one of the largest gold reserves in the US. Based on further drilling, Newmont said its Gold Quarry property near Carlin could now produce 4.7-6.2 t/a (150,000-200,000 oz/ year). Reserves at Newmont's two properties near Carlin and a third property in southeast California are reportedly at least 218 t (7 million oz), up from the previously announced 128 t (4.1 million oz). Gold exploration activities were brisk in many other states, including a noticeable effort to explore and reopen dormant properties. Although the return on investments didn't appear as favorable last year as they did in 1980, the gold price was apparently sufficient to spur healthy exploration activity. Outside precious metals, market conditions, and subsequent exploration activity, appeared much more bleak. In the molybdenum market, for example, prices continued to slide, and Amax Inc. tightened its exploration budget. (Amax supplies 60% of the domestic market and 45% of the world demand for molybdenum.) The company spent 16% less on exploration during the first six months in 1981, compared to the same period in 1980. Copper and many other base metal producers appeared in similar straits throughout the year. Uranium exploration activities continued to suffer last year also due to depressed market conditions. Among others, Gulf Minerals Resources and Amoco Minerals Co. suspended uranium exploration activities in the West. Despite current unfavorable conditions, some companies continue uranium searches, confident that market conditions will rebound. On a brighter note, interest in exploring for some industrial and strategic minerals appeared on the upswing last year. Minerals used for oil and gas drilling, such as barite and special sands, were especially noteworthy. In geophysical activity, significant developments were achieved for electromagnetic techniques in both frequency-domain and time-domain systems. Geophysical logging activity declined due to decreased uranium exploration, and computer hardware continued to impact the way mining geophysical data are being acquired. Many presentations and papers were given last year to help exploration geochemists develop new techniques to locate concealed ore bodies. Among techniques described were statistical and computer modeling for enhancing anomalies over blind deposits.

In January of 1966, during the annual session of Georgia's General Assembly, Representative Paul E. Nessmith of Statesboro, Georgia, walked into my office and asked me what I thought of the advisability and feasibility of a law which would require the mining operators to reclaim their mined out lands. My answer to him was, as a one time mine superintendent and operator, that I probably would not think very highly of the added cost which reclamation would impose on the operation; but that since assuming the job of Chief Geologist and Assistant Director of the Georgia Department of Mines, Mining and Geology, and in retrospect, I could recommend it very highly, particularly in view of the increased pressure being applied by the Federal government along these lines. I stated then and still emphatically state that this sort of administration should be done on the State level rather than the Federal level. He asked me if I would conduct him on a tour through some of the mining country in which I had worked and to this I readily agreed. The result of this trip was that he was adversely impressed by the devastation which the mining operations had wreaked on that area of middle Georgia along the fall line known as the kaolin belt. Very little except talk was done for the remainder of 1966.

Pea Ridge Iron Ore Co., previously Meramec Mining Co., a joint venture by Bethlehem Steel Corp. and St. Joe Minerals Corp., mines and pelletizes iron ore at the Pea Ridge mine. The Pea Ridge property, now wholly owned by St. Joe, is located near Sullivan, MO, about 112 km (70 miles) southwest of St. Louis. The ore body was delineated in the mid-1950s by St. Joe during a lead exploration program. The first test holes drilled on the Pea Ridge magnetic anomaly revealed the presence of a large magnetite deposit; further drill¬ing in 1956 and 1957 confirmed that the ore body was minable. Meramec Mining Co. was incorporated in 1957 and shaft sinking began late in the year. Pro¬duction commenced in April 1964. The ore body is overlain by about 396 m (1300 ft) of flat-bedded sediments. It is tabular, about 792 m (2600 ft) long, and up to 182 m (600 ft) thick. It dips about 1.39 rad (80°) and is of unknown depth. The ore is mainly high grade magnetite with small zones of specular hematite. The wall rock is a Precambrian rhyolite porphyry. The mine was initially started with five major levels on 45-m (150-ft) intervals. Crosscuts were driven across the ore body on 58-m (190-ft) centers. Banks of stopes were mined between the crosscuts by a modi¬fied shrinkage stoping method (Fig. 1). This was done by undercutting a 12 m (40 ft) wide by 45-m (150-ft) long block and blasting horizontal "lifts" drilled on 1.5-m (5-ft) intervals. A 20-m (65-ft) sill was left between levels which contained the slushing drift, fin¬gers, crown pillar, and adequate thickness for support. By 1971 a "lattice" of pillars had been left and mining had progressed to the point that an orderly pillar re¬covery program was necessary (Fig. 2). INITIAL PILLAR RECOVERY PROGRAM The program was started in the upper western por¬tion of the ore body, furthest from the shafts. Due to the fact that the ore body narrows in the western extremity, the stope orientation was changed to mini¬mize required development. This left pillars 18 to 24 m (60 to 80 ft) wide and up to 79 m (260 ft) in length. The area selected for the start of the program had been developed between the uppermost level at 419 m (1375 ft) below surface and the 510-m (1675-ft) level. Due to the 91-m (300-ft) difference in depth, sublevels were driven on 15-m (50-ft) intervals and the ore was taken by rather classical sublevel stoping methods (Fig. 3). This left a structure with accesses compatible with drilling with 114-mm (41/2-in.) bore drifters mounted on columns. Most holes were drilled 63.5 mm (21h in.) diam and reamed to 100 or 127 mm (4 or 5 in.). Practical depth capability was about 21 m (70 ft) for holes above horizontal and 13 to 15 m (45 to 50 ft) for holes below horizontal. The interdependence of these long pillars necessitated that several of them be blasted simultaneously, making large blasts the only practical approach. Due to the required length of such loading cam¬paigns, it was necessary to select an explosive which could stand in the hole in an underground mine for a 4 to 6 week period. After some consideration a pump¬ able water gel was selected for both uphole and down¬hole loading. This afforded a high velocity, high density explosive which could be handled in large quantities. Loading the downholes was a fairly straightforward process. The holes were lined with an 8 mil polybutylene plastic sleeve and water gel was pumped into them with a double diaphragm pump mounted on the bottom of a stainless steel tub with a 81-kg (180-1b) capacity. Views about the proper aim of public policy are, of course, matters of perspective and debate. Regardless of perspective, one would assume some consensus around the view that public policy ought to encourage mine operators to seek independent and critical assessments of worker safety and health at their operations through voluntary auditing. However, a review of the law on this topic shows that there is little to no manifestation of such a policy. Indeed, the balance of this paper, with a couple of exceptions, is devoted to the existing legal pitfalls that should be considered before a safety and health audit is conducted at a mine. While attorneys, particularly litigators like the author, might tend to focus on the potential problems that could arise from any given situation, the fact that most of this paper is devoted to potential legal concerns associated with auditing is a realistic reflection of the current state of the law. Specifically, this paper addresses the interplay between voluntary safety and health audits conducted at mines regulated by the Mine Safety and Health Administration (MSHA), and the administrative and civil legal issues related to such audits. The paper first provides an explanation of how and by whom an audit is conducted. The paper also addresses whether voluntary safety and health audits may be considered privileged and kept confidential in administrative and civil proceedings. Finally, selected legal issues related to such audits that could arise in administrative and civil litigation are discussed.1

Quartz has been of interest in occupational health for years because it can cause silicosis after prolonged exposure. New OSHA regulations (Air Contaminant; Final Rule) list perlite as a nuisance dust. They conclude that perlite is nontoxic when air-borne total particulate concentrations are 15 mg/m3 or below and when quartz content is less than 1% crystalline silica. OSHA has established an 8-hour PEL of 15 mg/m TWA for total perlite dust containing less than 1% quartz. OSHA has established a 5 mg/m3 TWA PEL for respirable perlite. These limits will protect workers from significant risk of eye, skin, or other physical irritation. This regulation is based on a Group 2A classification as a probable carcinogen in humans, at the 0.1% crystalline silica level, by the International Agency for Research on Cancer (IARC 1987a, b). IARC found sufficient evidence for carcinogenicity of crystalline silica in animals and limited evidence in humans. Perlite is not listed as a carcinogen by OSHA or the National Toxicology Program.
