This paper discusses the author?s work identifying international law norms of consultation with indigenous communities and poses a potentially counterintuitive argument that corporate stakeholders? interactions with indigenous communities may have effects on the content of those norms. The claim is counterintuitive because the international law of pertinence is customary international law, which arises from consistent state practice and opinio juris (a belief by states that they are acting in a way they are legally bound to do so). Customary international law traditionally has no reference to corporate conduct per se. The paper first surveys several sources on developing international law on consultation obligations. Then it references the impact these norms can have on corporate stakeholders in industries like mining. Then, it poses an argument as to an economic ratcheting effect that can occur through various agreements between corporate stakeholders and indigenous communities that then feeds through into international law via several mechanisms. The consequences for mining companies are diverse and include the possibility that conduct by one company can have longer-term implications for the obligations of other companies and, indeed, of states. The effects will differ in the context of different competitive environments and may actually have effects on the economics of different competitive models.

THE petroleum economics session," held on Wednesday morning, Feb. 20, 1929, presided over by Campbell Osborn, chairman, proved to be of un- usual interest and resulted in serious and constructive discussion of the papers presented. The first paper on the program, "Gasoline Economics and Refinery Operation," was by H. J. Struth, petroleum economist of the Gulf Publishing Co., Houston, Tex. While this paper was intended to cover the re- finery situation, it also presented the author's reasons for believing that the oil producer should give cognizance to gasoline demand as a most reliable barometer by which to parallel the production of crude petroleum. The discussion which followed brought out some interesting points in connection with the immediate outlook for the industry as a whole during the present year. Some advanced the opinion that, regardless of the out- come of proration efforts, the refiner is in a position to conduct his operations on a reasonably profitable basis, provided that he exercises control over them. This would mean running less crude and resorting to wider utilization of cracking to produce the gasoline demand. Thus, if the refiner uses diligent care in scheduling his still runs, the producer will be obliged to carry over a large stock of crude this year, unless he is able to keep production below the limits prescribed by the demand for gasoline.

The kinetics of the thermal decomposition of MgCO3 was investigated using isothermal experiments performed in a thermogravimetric analyzer under a nitrogen atmosphere at 380¦, 400¦, 450¦ and 480¦C. The weight loss data as a function of time were modified to give the fraction that reacted (ß) and the rate of reaction (dß/dt) vs. time (t). Kinetic analysis of the experimental results, using three different methods, showed that diffusion predominates the MgCO3 decomposition over the investigated temperature range, with the data being best fitted by JanderÆs equation ([1−(1−ß)1/3]2=kt). The activation energy was estimated by Arrhenius plots using both the initial reaction rates and rate constants from fitting the above equation. The values estimated were 27.1 and 171.4 kJ/mol respectively.

Os aços carbono são materiais metálicos muito importantes na fabricação de peças para a indústria metal-mecânica. Parafusos, hastes, eixos, pistões, engrenagens são fabricados a partir desse tipo de aço, mais especificamente do aço SAE1040. O objetivo desse trabalho foi de avaliar a influência da presença de 0,2% em massa de cromo nas propriedades mecânicas e metalúrgicas de um aço com 0,4% em massa de carbono. A liga padrão SAE1040 e esta liga modificada com cromo foram submetidas a tratamentos térmicos de normalização, recozimento, têmpera e revenimento, e comparadas às durezas e microdurezas das diferentes amostras entre si. Os resultados obtidos evidenciaram que a adição de cromo é um método eficiente quando se deseja aumentar a resistência de um material. Observou-se que os valores de dureza e microdureza para o aço com a adição de cromo apresentaram-se maiores em relação ao aço padrão, como consequência das microestruturas obtidas, principalmente após têmpera e revenimento. A adição de 0,2% em massa de cromo no aço carbono influiu na melhora das propriedades mecânicas do aço tornando-o mais interessante na fabricação de peças para a indústria metal-mecânica.

Rock excavation in both surface and underground mining is largely accomplished using the drill and blast technique. At the perimeter of such excavations, cautious blasting procedures are often employed to minimize unwanted damage to the remaining rock. Of the several different techniques available, the use of explosive charges with a diameter smaller than the holes in which they are introduced (so-called decoupled charges) is the most common. In spite of the long and widespread use of the technique, a technically sound basis for relating the borehole wall pressure to the explosion pressure is still lacking. A large wedge failure had occurred in the study area which was under construction. Therefore, in order to analyze the potential instability for this rock slope, the authors conducted numerical analysis with DEM and then the behaviour of rock mass was analysed after appropriate reinforce-ments were applied. The geochemical properties of Kaiata Mudstone and Brunner Coal Measures are evaluated in order to determine their suitability for placement at the proposed Cypress and existing Stockton mines. Correct scheduling of this waste material is needed in order to prevent sulfide oxidation and the generation of acid rock drainage. The Kaiata Mudstone has both acid generating and acid neutralizing properties. Results from this study and previous research from Kingett Mitchell Ltd (2003), indicate that within the Kaiata Mudstone sulphur content decreases with distance away from the Brunner Coal Measure/Kaiata Mudstone contact, while calcium carbonate content increases; sulphur values range from 0.33 to 4.23 wt %; and the acid neutralizing capacity ranges from 0 to 10.4 wt %. The Brunner Coal Measures have a low capacity to neutralize acid and sulphur content is variable ranging from 0.25 to 3.5 wt %. Appropriate control measures are therefore needed for the Brunner Coal Measures and any Kaiata Mudstone within close proximity to its contact. Tests have been undertaken to develop a rapid field or laboratory procedure to define the potentially acid-forming from the non-acid-forming Kaiata material. Results indicate that paste pH, Net Acid Generation (NAG) and Carbonate Bomb tests are suitable. Results from the Carbonate Bomb Test show a strong relationship with the Acid Neutralizing Capacity (ANC) and the Net Acid Production Potential (NAPP), indicating that this method may efficiently determine non-acid forming material in the field within fifteen minutes. Ongoing research includes kinetic column and shake extraction tests. These tests will quantify what trace elements could be leached from the waste rock and provide information on the usefulness of alkaline producing products such as Bauxsol, Limestone and Cement Kiln Dust.

MY remarks are addressed to the question whether a program of international mineral control can effectively serve as a means of maintaining world peace in the kind of world envisaged by the Atlantic Charter. They do not touch the quite different questions whether such control could be appropriately used for postwar punishment of Germany and Japan, or for other purposes. I assume also that the question relates, not to the transition period immediately following the war, but to the more normal years which we hope will succeed this. Finally, they deal primarily with metals and metallic minerals rather than with. oil or coal or other minerals, although they may be applicable also to these other nonmetallic materials.

The Bureau of Mines Minerals Information organization collects worldwide data on virtually every commercially important non fuel mineral commodity. These data form the base for tracking and assessing the health of the minerals sector of the U.S. economy. This data collection activity was instituted by the 47th Congress in an appropriations act of August 7, 1882 (22 Stat. 829), to place the collection of mineral statistics on an annual basis. The most recent authority for the Bureau of Mines Minerals Information activity is the National Materials and Minerals Policy, Research and Development Act of 1980 (Public Law 96-479, 96th Congress), which strengthens protection for proprietary data provided to the U.S. Department of the Interior by persons or firms engaged in any phase of mineral or mineral-material production or consumption.

Research by the National Institute for Occupational Safety and Health (NIOSH) has pursued quartz analysis for the specialized ?lter assemblies of a new worker-wearable personal dust monitor (PDM). The PDM is a real-time instrument utilizing a tapered element oscillating microbalance (TEOM®). Standard ?berglass TEOM ?lters cannot accommodate the desired P-7 infrared analytical method used by the Mine Safety and Health Administration (MSHA). Novel ?lter materials were tested with the objective of demonstrating this type of analysis. Low temperature ashing and spectrometric examination were employed, revealing that nylon ?ber candidate ?lters left minimal residual ash and produced no signi?cant spectral interference. Avoiding titanium dioxide in all ?lter materials proved to be a key requirement. Fine quartz particulates were collected on prototype ?lters in a Marple chamber, either open-faced or through PDMs during test runs. The ?lters were then subjected to MSHA P-7 analysis and the spectrometrically based analytical results for quartz mass were compared to reference measurements. Also, PDM instrumental mass readings were compared to ?lter gravimetric measurements. Results suggest that the P-7 method is adaptable to variations in ?lter materials and that quartz dust analysis by the P-7 method when utilizing the new ashable PDM ?lters can have accuracy and precision within 10% and 4%, respectively. This is within the declared 13% accuracy and 7–10% precision of the P-7 method itself. Instrument mass readings had modest positive bias but met NIOSH accuracy criteria. Continued work with specialized PDM ?lters is merited, as they are a new type of TEOM sample amenable to ashing analysis of particulates.

THE object of this paper is to, describe the several necessary characteristics of the zinc-retorting charge and to show how by certain improved methods; the large excess of coal, over that theoretically required, can be reduced, thereby effecting an increase in the smelting capacity of a retort plant as well as other economies. In the Southwestern zinc works a charge of roasted zinc ore with a side mixture of carbonates and silicates, analyzing on the average 50 per cent. Zn, is mixed with 55 or more per cent. of its weight of a mixture of coal and coke analyzing 60 to 70 per cent. fixed carbon. . The ore is of varying fineness and the coal and coke are usually crushed in a semi-moist condition through a 3/8 -in. screen. With ores of a slaggy nature, this coal proportion is increased, sometimes to as much as 100 per cent. of, the weight of the ore. With carbonate ores, or where anthracite screenings with higher carbon content are cheap enough, the percentage of reducing agent is cut to 45 per cent. or even somewhat lower. The average charge per retort for a monthly run of a plant on ore, as distinguished from retorts on blue-powder, ladle-skimmings and other between-products, runs from 60 to 66 lb., with a mean of 63 lb. for the Southwest with standard retorts of 8 ½ -in. inside diameter and 50 in. long inside, using roasted sulphide ores. Conditions will change these figures, but 40 lb. of ore per cubic foot of retort space is, I believe, an average in the better-operated plants. Since the rise in. the price of spelter, the tendency has been to overcharge. To remove the slag that is formed when retorts are overcharged, extra men are put on to "gum-chisel" the retorts to prevent "set" furnaces and "butchered, retorts." Taking the above conditions as premises, we find that from four to six times the amount of coal necessary for the reduction is used, as is evidenced by the fact that the residues analyze as high as 35 per cent, fixed carbon. There are good reasons why this excess of fixed carbon must be used and perhaps these can be best explained by a description of the metallurgical requisites of a zinc charge. "INTRODUCTION The Camp Bird mine was investigated by Bureau of Mines engineers 3/ September 22 and 24, 1942, and April 29 and 30, 1944. In a subsequent report and supplement, it was recommended that core drilling be done below the 14th. level to determine if commercial ore existed at greater depths, and particularly if ore existed in the vein or adjacent thereto where it passes into the sedimentary formations estimated to underlie the volcanics approximately 400 feet below the 14th level.Seven diamond-drill holes aggregating 3,956 feet were drilled. Four of these holes were under the Hematite ore body and three were under the Big Discovery ore body. Two holes under, the Hematite ore body wore directed at angles but little steeper than the angle of dip of the vein and penetrated the sedimentaries beneath the volcanics close to the vein. Enough low-grade ore was found at the base of the Telluride conglomerate to indicate the presence of a large body of low-grade zinc sulfide ore. Two holes were directed to crosscut the vein at a depth of approximately 125 feet below the 14th level. No commercial ore was cut, but the vein showed the average width and same general characteristics as at the 14th level. One hole under the Big Discovery ore body was directed to crosscut the vein and test the base of the Telluride conglomerate in the footwall block. No commercial ore was found in either the vein or the sedimentary horizon. One hole was directed to test the base of the Telluride conglomerate in close proximity to the vein in the hanging-wall block. This hole was lost approximately 100 feet short of its objective, and a third hole was drilled to accomplish this same thing. The third hole was stopped approximately 50 feet short of its objective when failure of equipment caused a recess of the"

In a recent survey of the literature, the author has found evidence incompatible with prevalent views regarding the technical cohesive strength and yield strength of metals. Some of the evidence regarding the technical cohesive strength was presented in a previous paper,21 and views were presented that are believed to be in better accord with the evidence. In that paper, it was shown that the technical cohesion limit (contrary to prevalent views) varies with the combination of principal stresses,t and that the influence of plastic deformation on the technical cohesive strength is not in accordance with prevalent views. In this paper, consideration will be given to both the technical cohesion limit and the yield stress as affected by the combination of principal stresses. Evidence will be presented that the variations of the yield stress and the technical cohesion limit with the combination of principal stresses are not in accordance with prevalent views. Consideration will also be given to ductility and work-hardening capacity, which depend on the initial difference between the technical cohesion limit and the yield stress. By the "technical cohesion limit" is meant the mean stress at actual or poten- tial* fracture. An example of a rechnlcal cohesion limit is the "true" breaking stress of a tension-test specimen, the breaking load divided by the sectional area at fracture. The cohesion limit thus obtained for a ductile metal, however, has been greatly altered by the plastic deformation. It is important to consider the cohesion limit of the metal prior to this deformation, and the variation of the cohesive strength with plastic deformation. The relation between the cohesion limit and the corresponding flow stresst determines the ductility of a metal and the energy that it will absorb before fracture. In this paper, as in the previous paper,21 tensile stresses will be viewed as positive and compressive stresses as negative. The algebraically greatest principal stress will be designated S1, the least principal stress will be designated S3, and the intermediate principal stress will be designated Sz In the previous paper, attention was confined to stress combinations with two of the principal stresses equal (with the intermediate principal stress S2 equal eithel to S3 or 31). In this paper, consideration will also be given to the effect of stress combinations with all three principal stresses unequal. "Lately, the development work in closed circuit grinding has mainly been focused on mills and on different types of instrumentation, mathematical models and automation in spite of the fact that the poor efficiency of the classifier is well known. It has also been proven by several investigations that by improving the sharpness of classifier separation, remarkable technical and economical advantages can be achieved. Some attempts to improve the performance of the most common classifier, hydrocyclone, have been made, among them injection of wash water above the spigot cyclone and retreatment of either or both of the products of the primary classifier. No method has been successful enough to achieve general adoption in the industry. The purpose of this paper is to introduce some industrial results achieved by two-stage classification where the coarse product of the turbulent-flow classifier, hydrocyclone, is cleaned in a laminar-flow cone classifier.The main target of the adoption of the two-stage classification circuit it naturally to improve the sharpness of size separation. This again leads to the following advantages in the grinding process:- lower circulating load and increased capacity- lower energy consumptionnarrower size distribution in the fine product- less overgrinding and less slimes- reduced specific surface areaThese improvements, no doubt, reflect on the subsequent concentrating process in the following aspects:the rate of flotation is improved, less reagents and energy is neededthe recovery and grade of valuable minerals in concentrates is improved- savings in dewatering can be expected- less fines in tailings improve the conditions for water recirculation."

Perlite, as a volcanic glass, has been recognized since the Third Century, B.C. (Langford, 1978). The precise details of discovery often become lost in antiquity, and the variations among the stories pertaining to the more recent discovery of perlite as a material of commerce are no exception. Credit in the United States is given to a dentist who, while experimenting with tooth enamels about 1941, discovered that perlite-the rock-intumesced when subjected to heat. At about the same time it is reported that the chief geologist of Silver and Barytes Ores Mining Co. attempted to put out a picnic bonfire on the shores of Milos Island, Greece by throwing beach sand on it. The ensuing pyrotechnic display immediately conjured up in that man's mind the possibility of a new use for the volcanic rock that constituted most of the island. Very little was done with this discovery either here or abroad until after World War II. Today the name perlite is applied to both the hydrated volcanic glass, generally of rhyolitic composition, and to the lightweight aggregate that is produced from the expansion of the glass after it has been crushed and sized. Petrologically, it is defined as a glassy rhyolite that has a pearly luster and concentric, onionskin parting. Occurrences of perlite are restricted to several Tertiary to Quaternary age rhyolitic belts that trend in a generally north-south direction around the world. Commercially suitable deposits generally occur as domes of several hundred feet in height, although glassy zones in welded ash-flow tuffs and others associated with dikes and sills also have been reported. Mining is by ripping and blasting from open pits. Because of weight considerations, perlite usually is shipped to the local market area for subsequent expanding. In the United States, New Mexico leads in production with Arizona, California, Nevada, Idaho, and Colorado following in approximately that order. The principal use for expanded perlite is as a lightweight insulating aggregate in cryogenics, in plaster, concrete, and in loose fill insulation. Expanded perlite is also used in horticultural applications, and after subsequent milling and classification, as a filter aid. The United States is the world's largest producer and consumer of perlite. Table 1 shows the world production of perlite and Table 2 shows the perlite mined, processed, expanded, and sold or used by producers in the United States. Geology Composition and Morphology Any discussion of perlite must take into consideration its dual nomenclature, for it is known by the same name as both the naturally occurring rock and, after processing and expansion, as the lightweight aggregate of commercial significance. In its naturally occurring form, perlite is a rhyolitic glass that contains from 2 to 5% combined water. While perlite also can occur as andesitic or dacitic glass, these latter types are of negligible commercial significance. Table 3 lists the chemical composition of a few typical perlites (Anderson, et al., 1956; Langford, 1979). What sets perlite of commercial significance apart from other volcanic glasses is the fact that under the proper conditions of preparation-crushing and sizing-it will, when rapidly introduced into a flame of sufficient temperature, expand or "pop." All of the elements of composition contribute to the expansibility of the rock. The role of the combined water, however, is the most significant because it is believed not only to produce a fluxing effect in the softening of the highly siliceous glass prior to expansion, but it is also responsible for the explosive force of expansion through volatilization during heating. Anatolia Minerals Development Limited (AMDL) is constructing the Çöpler Gold Project in eastern Turkey and commenced mining in the fourth quarter of 2009 with gold production scheduled to begin in the fourth quarter of 2010. The project is a 15,500 tonnes/day oxide heap leach with three-stage crushing, agglomeration, carbon adsorption and electrowinning for final metal recovery. Leach solution copper levels are expected to be relatively low during the first two years of production but will increase in later years due to higher copper content in the mined and processed ore. Over the mine life approximately 40 million tones of ore will be placed on the leach pad, which will contain about 35,000 tonnes of copper. Metallurgical testing indicates copper extraction will vary by ore type and, if controls are not implemented, may lead to copper levels exceeding 1,000 mg/L in pregnant solution. High copper levels in leach solution have the deleterious effect of increasing cyanide consumption and potentially overwhelming the ability of the carbon circuit to effectively adsorb the principal economic metals, which in this case are gold and silver. Using data obtained from laboratory leach column testwork, the heap leach facility was modeled using METSIM process simulation software to estimate the build-up of copper in leach solution over the mine life. Laboratory testwork was also performed to evaluate process conditions for treating a portion of pregnant leach solution via sulfide addition to precipitate saleable copper as copper sulfide (Cu2S).
