FROM time to time, one of the authors has had occasion to investigate the graphitizing reaction and has published the results mainly as discussion1 of the work of other investigators. In view, therefore, of the diversity of both observations and interpretation, it seemed well to attempt a revision of the entire subject in the Research Laboratory of the National Malleable Castings Co. The work consisted of a careful study of a single, impure, iron-carbon alloy. The material, which may be considered typical low-carbon white cast iron of the malleable industry, was an air-furnace iron of the following composition: carbon 2.30 per cent., silicon 1.20 per cent., manganese 0.29 per cent., phosphorus 0.156 per cent., sulfur 0.048 per cent. The freezing range extended from 1213° to 1132° C., the latter figure agreeing with Gontermann's data .2 We have attempted to define the equilibrium diagram of this alloy, in the stable condition as related to the metastable diagram, from a temperature somewhat below the eutectic freezing point to a temperature below Ar1 and for a graphitic-carbon content from practically nothing to the original total carbon of the specimen (see Fig. 6). More especially we desired to locate the line in the stable diagram corresponding to the Acm line of the metastable system, which is designated by analogy, the Atm line (tm from temper carbon) ; also to determine the location of Aim with respect to Acm toward their lower extremities at Ar1 in order to determine whether or not graphitization is completed by the separation of an iron-carbon eutectoid analagous to pearlite in the iron-cementite system. This would involve further a comparison of the locations of the stable and metastable A1 points.

The advance made in recent times in this branch of metallurgy is indicated by the attention the subject is receiving from important American copper-producing companies. Reference to the files of publications devoted to the mining industry discloses that some 20 American companies are actively investigating the amenability of their ore, or other material, to leaching methods, and that plants of varying capacities up to 10,000 tons per day arc under construction or are projected. Several leaching works are in commercial operation. It has been frequently pointed out that no method of leaching is universally applicable, for the reason that each ore differs in some particular from apparently similar ore found elsewhere, and also because local conditions are rarely the same even where the ore closely approximates in character that being worked at some other point. For this reason the older companies are approaching the matter in a conservative manner, experimentally determining for themselves the salient features in each instance. In considering a leaching proposition three factors at once fix the attention: (1) disengaging the metal from mineralized forms in which it is found in nature; (2) recovering the metal in a commercial state after it has been dissolved; (3) the apparatus best adapted to carrying out the several operations. Bringing the Metal into Solution This feature.has been found to present no serious difficulties. Numerous solvents for copper are known, and it has been repeatedly demonstrated on a commercial scale that from 80 to 90 per cent. of the metal contained in an ore can be rapidly brought into solution. It is interesting to note, however, that all of the companies above referred to have selected sulphuric acid as the basis for a lixiviant. In 1964, mining education in the United States will celebrate a 100th anniversary-that of the founding of our first school of mines at Columbia University. Prior to that, curricula leading to degrees in mining and metallurgical engineering were offered in 1853 by the Polytechnic College of Pennsylvania in Philadelphia. But the New World's earliest achievements in mining and metallurgical education were those of the Spanish in what is now Mexico. American metallurgy probably goes back to Father Jose de Acosta, who in 1590 described the metallurgy of silver and mercury in the New World.' The Spanish priest and metallurgist Don Alvaro Alonso Barba Toscano (1569-1662), in his hook The Art of Metals, published in 1640, stated a need for a school of mining and metallurgical education in the New World. (The latest translation of this book was made by R. E. Douglas and E. P. Mathewson and published by J. Wiley & Sons, New York, in 1923.)

The greatest of all gifts is the power to estimate things at their true worth. LaRockefoucauld INTRODUCTION The primary reason for performing a feasibility study on a proposed mining venture is to investigate all phases of the proposal in as much detail as necessary to justify either dropping the project or continuing expenditures through the next stage. The economic evaluation component of the feasibility study, therefore, must ultimately be based on information which provides an answer to the question, "What is it going to cost?" Unfortunately engineers preparing feasibility studies never have all the engineering or economic information they would like or need. Consequently, the economic portion of the analysis can only be performed if estimates of the various costs associated with the project are made. Project cost estimates, in turn, require estimates of all the physical factors affecting cost components, including anticipated performance of plant and equipment as well as all pertinent geologic, mineralogic, and metallurgical variables. Before useful cost estimating procedures can be applied considerable data must be collected, compiled, and organized. Preparatory work typically includes organization of cost data available for estimating purposes, development of techniques for updating historical costs, and establishing methods of forecasting prices and costs over the duration of the project. Cost estimates for mining and mineral processing projects involve so many features and variables that it is absolutely essential to have some means by which the vast amount of detail can be organized. It is very important to identify, in as much detail as possible, all the cost data available (historical and developed) to the estimator. These costs, after being properly identified in detail, should be com- piled, stored, updated regularly, and made readily available for use in developing new cost estimates Accessing files of current cost information requires a standardized numerical system of classifying cost data. When uniform definitions and procedures are used, every project record contributes to the common store of estimating data.

AT A MEETING of the Shareholders of the Russo-Asiatic Cons. Ltd., in London, Oct. 23, 1922, LESLIE URQUHART, chairman of the com- pany made the following statement:* I come now to our recent negotiations with the Soviet Government and to the agreement which has resulted from them. You will remember that the conference at The Hague broke up without having achieved anything very definite. It was not, however, a failure. It elicited from M. Litvinoff an offer which will, I think, come to be regarded as a milestone in the progress of Russia from a ruinous and unpracticable Communism towards a modified form of capitalism. The offer made by M. Litvinoff at The Hague amounted in effect to this: that in return for political recognition on our part the Soviet Government would first acknowl-edge its liability for Russia's national foreign debts, and, secondly, would give the original foreign owners of property in Russia effective compensation. A very great advance that. It showed-and there have been many other signs to confirm it-how real and persistent has been the internal evolution of Russia during the past year from Marxism to the economics of the Western world. I will not now detain you with the reasons why M. Litvinoff's highly promising and significant offer came to nothing. The fact that it had been made and the further fact that The Hague Conference had separated indefinitely were the important things. The first fact seemed to indicate that the Soviet rulers, after all, proved to be people with whom one could do business. The second fact rather emphatically showed that the way to do business with them was not by unwieldy poly-glot conferences of ministers, officials and experts representing a few dozen different governments and a few dozen different sets of national interests. That method had been tried at Genoa. It was tried again at The Hague. Each time it failed, and having failed it left the road clear for a simpler and more direct approach.

A current study of the growth kinetics of k (hcp) plates in a Cu-Si (fcc)' has generated a requirement for data 02 the chemical interdiffusion coefficient in a (termed D,) as a function of temperature at the composition of the a/a + k pJase boundary. Rhines and Mehl 2 have determined D, as a function of composition at lower silicon contents by making Matano analyses of concentration-penetration curves. However, the accelerating increase in B, which they demonstrated as the phase boundary composition is approached at constant temperature and the rapidly diminishing accuracy of this analysis as the limiting compositions of a diffusion couple are approached (the silicon-rich component of their couples contained appreciably less silicon than is permitted by the solubility limit) indicate that the required information cannot be safely obtained by extrapolation of their data. Although the quite different method employed in this study is not exact, it will be shown that the approximations made are not serious ones, particularly from the viewpoint of the prgcipal application anticipated for these data. D, was determined from the migration kinetics of the a :k boundaries formed in sandwich-type diffusion couples produced by welding a block of high-purity copper to opposite sides of a cube (* in. on edge) of homogenized high-purity Cu-5.82 wt pct Si alloy. The alloy is pure k in the temperature range employed. The surfaces of the couple components which were normal to the diffusion direction were machined accurately flat and parallel, lightly polished, and carefully cleaned. Welding was then accomplished by means of the vacuum-encapsulated pressure jig technique previously employed.3 Welding was always conducted at the intended diffusion temperature; thus the welding anneal also served as the first diffusion anneal. Subsequent diffusion anneals were performed in evacuated Vycor capsules. Following the welding anneal, one of the surfaces parallel to the diffusion direction was machined, ground, and polished flat; additional material was removed from this surface after each diffusion anneal in order to avoid any effects of composition changes. After etching,4 the average distance between a : k boundaries was measured by means of a traveling microscope with an accuracy (per measurement) of better than 1 p. Satisfactory results were obtained at four temperatures in the range 775° to 655°C; attempts to obtain data at two lower temperatures were unsuccessful, evidently as the result of the interference of surface contamination during the welding process.

The effects of impurities on the electrical properties of silicon are discussed in a companion paper by Messrs. Scaff, Theuerer, and Schumacher.' It was shown that an ingot of silicon which contained boron and phosphorus in certain concentrations consisted partly of p-silicon and partly of n-silicon2 and that the common boundary between these regions was the source of a photo-voltage. These features were ascribed to the segregation of boron and phosphorus during solidification of the ingot. Because of different rates of segregation the first portion of the ingot to freeze contained a molar excess of boron over phosphorus and hence was p-silicon. The last-solidified region contained a molar excess of phosphorus and was n-silicon. This paper is concerned with the microscopic examination of such ingots. The microstructures are rather unusual in certain respects and their study has helped to show how the segregation of minor elements modifies the electrical properties of silicon. The microstructures of ingots prepared from two lots of silicon, designated 1 and 2, will be described. These lots were obtained from the Electro Metallurgical Co. Both contain 99.8+ pct silicon, but they differ in impurity analysis. For each lot will be shown the microstruc-ture of a slowly cooled ingot, for which the time of solidification is 6 min., and that of a rapidly cooled ingot, for which the time of solidification is 2 min. The ingots were prepared from 45 g charges of silicon. When an alloy freezes a cored structure is generally produced because of insufficient diffusion to remove concentration differences established during freezing. As a result of coring the first portion of a crystal to freeze is usually poorer in solute than equilibrium requires, while the last material to solidify is richer. In a columnar grain, growth is principally unidirectional and coring can produce a concentration gradient along the entire grain. By carrying the picture of the coring process from a single grain to an entire ingot in which columnar grains are aligned more or less radially, one can easily see that a composition gradient could be established between the outside and center of the ingot. This, to a considerable extent, occurs during the solidification of a slowly cooled ingot of silicon. Slowly Cooled Ingot In slowly cooled ingots of both lots of silicon, columnar grains which are approximately radial in direction and longest at the top of the ingot enclose a region in which the shapes and align- ment of the grains are considerably less regular. The central region is last to solidify and contains cavities and inclusions. The sketch of Fig 1 illustrates some of these features, as well as others which will be described below. If a polished section of an ingot is etched in a mixture of 2 parts of 20 pct HF and 98 parts of HNO3 the p-n barrier becomes visible. The overall shape of the barrier in a slowly-cooled ingot is roughly oval, as may be seen in Fig 1. The proportion of n-silicon, that is, the region enclosed by the barrier, is considerably greater in ingots of lot 1 than in those of lot 2. A sample about 34 x 1/8 X 1/8 in. was cut from a slowly cooled ingot of lot 1 with its long direction extending from the top of the ingot to the porous region. Thus its upper half was psilicon, its lower half n-silicon. A longitudinal face was polished and etched in the acid mixture. The areas of interest are identified in Fig 2. A band of parallel markings extends across the sample in the columnar region. These striae are roughly parallel to the upper surface of the ingot and cross grain boundaries with only slight deviations. They are quite distinct in the n-silicon,

The diffusion coefficient for hydrogen in the ß titanium alloy containing 13 pct V, 11 pct CY, and 3 pct A1 was measured over the temperature range 20° to 500°C. Results fit the expression: D= 1.58 x lgs exp-------==-----) cm2,sec THE diffusion coefficient for hydrogen in the metastable ß-phase titanium alloy containing 13 pct V, 11 pct Cr, and 3 pct A1 was measured as part of an investigation of the effects of hydrogen on the mechanical properties of titanium alloys. Several theories on the mechanisms of hydrogen embrittle-ment include diffusion of hydrogen at ambient temperature as an important step in the embrittling process.'-5 In hydrogen-contaminated a-ß titanium alloys, it has been postulated that the rate-controlling step may be the rate at which hydrogen diffuses from the ß phase to stress- or strain-nucleated brittle hydride platelets at the a-ß interface.' However, embrittlement of the all-ß alloy investigated in this work may proceed by a different mechanism, since this alloy can be embrittled without the formation of detectable hydride platelets.6 Troiano has suggested that in this case the mechanism of delayed failure or embrittlement is similar to that proposed for high-strength steel, i.e., repeated crack initiation caused by a decrease in bonding energy as hydrogen diffuses to points of high tri-axial stress at the root of a notch. In both types of alloy the rate of embrittlement is believed to be controlled by diffusion of hydrogen in the ß phase. Accurate hydrogen-diffusion data in the vicinity of room temperature should therefore be of some assistance in understanding the mechanisms of embrittlement in these two classes of titanium alloys. Diffusion of hydrogen in pure titanium has been studied by Wasilewski and Kehl7 at temperatures above 500°C. Their measurements on diffusion in the ß phase were extended below the ß-a transformation temperature (882°C) to approximately 600°C. This was possible because of the 8 stabilizing effect of hydrogen. No results at lower temperatures have been published and there are no data in the literature on hydrogen diffusion in the ß -phase alloy used in this program. Hydrogen diffusion in metals is generally investigated by measuring the rate of transport of hydrogen past a solid-gas interface, i.e., by absorption, permeation, or degassing-rate measurements. These methods produce accurate diffusion data when bulk diffusion is the rate-determining step in the over-all process. However, at the lower temperatures of interest in hydrogen-embrittlement studies or under conditions where surface films are present, the measured rates may be surface-controlled and the calculated diffusion coefficients will be in error. Surface effects were eliminated in the present work by using a modification of the common welded-couple technique m which two bars with uniform but different compositions are joined before the diffusion anneal." The same type of step change in the initial concentration vs distance curve was produced by electrolytically hydrogenating thin-strip specimens which had been electrically insulated over half of their length. Concentration vs distance curves were determined, after appropriate diffusion-annealing treatments, by vacuum-extraction analyses of transverse samples sheared from the strips. Diffusion coefficients were calculated by the methods of Grube.M This technique was feasible because of the large concentrations of hydrogen which can be charged into p -phase alloys without the formation of hydrides15'16 and because of the extremely low degassing rates observed when hydrogenated titanium alloys are heated in air. Committee it supports pioneering research on the development of a coal-burning gas turbine and through the Mining Development Committee it promotes research on a new type of continuous mining machine that operates without using explosives. Other organizations have contributed major publications on fundamental and applied coal research in the last two decades, including the Minerals Industries Experiment Station of Pennsylvania State College, the Illinois Geological Survey and University of Illinois, the University of West Virginia, the University of Michigan, the University of Alabama, the University of North Dakota, the Massachusetts Institute of Technology, the Koppers Company, the U. S. Bureau of Mines, and, in recent years, the Institute of Gas Technology. Engineering development work, which is included in the overall estimate of $20,000,000, is conducted largely by manufacturers of equipment, and this portion of the estimate is difficult to gage. It represents a large proportion of the estimate and probably is too small rather than too large. For example, the development of mobile coal-loading machines and continuous mining machines, outstanding in recent mining research, undoubtedly involved a high cost. Coal Mining From an economic point of view, the greatest research development in the coal industry obviously has been the growing degree of mechanization in mining. The percentage of underground-mined bituminous-coal output mechanically loaded has risen from 3 pct in 1926 to 67 pct in 1949. Coal operators and equipment , manufacturers have united in designing machinery. Loading machines of large capacity and astonishing flexibility are in common use. Shaking conveyors transport coal from producing faces to transfer points from which it may be carried long distances underground and on the surface; and in many mines rubber-tired shuttle cars carry the coal from the loader to the

NORRIS, Wilkes-Barre, Pa.-For many years the power requirements of breakers designed in the Anthracite. Region have been based on calculations made from indicator diagrams taken during operation, with various sections of machinery idle; these, while giving reasonably accurate figures, gave no intimation of the peak loads which have been shown so clearly in the paper. The high-speed flywheel for breaker rolls is new and shows a remarkable saving in peak power required, besides eliminating the stalling of the rolls from overload. The figures given are so far in advance of anything previously published that they will undoubtedly be used as a basis for future breaker design. It is to be hoped that the authors will continue this investigation and extend their paper by a description of the motors found best suited for this work. WILLIAM KENT, Montclair, N. J.-I notice on p. 187 reference is made to one of the difficulties being the starting torque, and it is proposed to use roller or ball bearings in order to decrease the high starting torque. I suggest that. before the roller or ball bearings are put in, an investigation be made as to the amount of the starting torque, as shown by wattmeter measurements and as to what the starting torque ought to be, theoretically, according to the energy formula; that is, how much starting torque is required to accelerate the rotating mass in a given number of seconds up to full speed. Having secured this information it may be found the amount to be saved by roller bearings is not very great. If it appears that roller bearings will not greatly decrease the starting torque, the next thing to be done is to have a special design of motor in which there is a field that can be made very strong at the start, by the use of extra poles or other means, and the next thing that may be done is to increase the speed from 10,000 r.p.m. to 25,000, which can be done with wire-wound flywheels, especially if the wires are made of vanadium steel.

This paper was prepared as a supplement to the general review by Dr. N. G. W. Cook. His analysis of the problem in terms of the strain energy involved in making the excavation is excellent. It will contribute much towards a clearer understanding of rock behavior and control. Several of the practical applications described herein can be directly related to Dr. Cook's theories and conclusions, and are based on the very same principles. CONTROLLED BLASTING IN ROCK EXCAVATION Generally speaking, the natural rock is a relatively strong and competent structural material, if we conserve its inherent good properties and perhaps reinforce its weak spots. The difficulty often lies in blasting out the tunnel or chamber without damaging the walls and roof we wish to have remain afterwards. Much progress has been made in the last five years in better understanding the controlled excavation of rock. The specialized techniques known as smooth wall blasting and presplit blasting have now developed from the status of curiosities of rock excavation to the point where these techniques are specified in contracts drawn up for such rock excavation projects as tunnels, underground pourer houses, etc. These techniques have been well described and discussed in previous publications; there is no need to reiterate here. It might be well to point out that recent research has demonstrated the effect that inherent rock stress may have on presplitting in certain directions. Material can be presplit most readily parallel to the direction of maximum compressive stress, and this may not always be in the direction desired. Inherent rock stress measurements by stress relief over coring, etc., may have important value in deciding how to best presplit proposed excavations. In addition, recent work at the Colorado School of Mines has demonstrated the feasibility of con-

IT IS well known that one of the cornerstones of economic theory is the so-called law of supply and demand, which, really, is a group of economic laws, one of which may be succinctly stated : A rise in price tends, sooner or later, to increase supply. It is the fear that, in the case of petroleum, a limited natural resource, a point will soon be reached when supply will not respond adequately to price advances, which in recent years has prompted a movement for oil conservation. This movement has lately taken concrete shape in the appointment of a Federal Oil Conservation Board by the President. An important aspect of the law of supply and demand is that the supply of any commodity is not an entity per se, but is a factor of price. Supply, without the specification of price, has no exact meaning; and in practice supply cannot be divorced from considerations of price. Mathematically, supply may be expressed by the formula SP, which means that supply varies with price, just as the value of 10 raised to the x power varies with x. In its technical usage, supply is the quantity of a commodity that is bought currently on the market at a given price. In the case of a natural resource, however, this quantity will eventually depend not alone on price but on the physical volume of the reserve that exists and. that, in consequence, can respond to the stimulus of price. If this reserve is fixed in size, we must sooner or later reach a point where supply can no longer respond to price in the usual degree and a permanent shortage. will develop which no advance in price can correct, except in so far as higher prices may curtail demand or improve the efficiency of utilization.

Not infrequently, in the case of the failure of a metal structure, such as a bridge, tank, airplane, gun carriage, etc., a doubt arises whether the failure was due, among other causes, to the effect of an overburden or of an explosive maliciously or accidentally exploded in contact with it. As few means of discriminating between the effects of these causes have been known and these means were of a rough qualitative character, it was surprising to find in the record of an inquiry into the failure of a structure, the statement that, by observations on the Neumann bands in the structure, it was possible to determine the speed of breakage in the metal and to distinguish between a fracture caused by an explosion and one caused by an ordinary mechanical strain. Such a criterion, if well proved, was of value to the explosives experts of the Bureau of Minea, the Ordnance Department of the United States Army and the Bureau of Ordnance of the United States Navy, but search showed no record of it in the literature nor did any of the metallurgists and metallographers consulted know of any data on which such a criterion could be based having been assembled and critically studied. However, it was universally held that there was promise in the idea and that there exkted unique facilities at the Bureau of Mines Experiment Station at Pittsburgh for the preparation, under definitely known conditions, of material for study by metallographers, and that material of value might also be obtained from the proving grounds of the Army and Navy. Therefore, with the approval of the Director of the Bureau of Minea and the Chiefs of Ordnance of the War and Navy Departments, the Chairman of the Division of Engineering of the National Research Council, on April 12, 1919, appointed a Committee on the Investigation of Neumann Bands, which has since been engaged in this study and which, after some slight change in its personnel, consists now of the following: Dr. William Campbell, Advisory Metallurgist, Bureau of Ordnance, Navy Department. P. B. Foley, Metallurgist, Bureau of Mines. S. P. Howell, Explosives Engineer, Bureau of Mines. Comdr. 0. M. Hustvedt, U. S. N., Bureau of Ordnance, Navy Department. Dr. Charles E. UNDERCLAY squeeze is the plastic flowing of underclay below coal pillars into mined-out entries and rooms. Squeezes may be caused either by wet mine conditions where the moisture is taken up by the clay—making it more plastic—or by the presence of certain clay minerals, such as mont-morillonite, which are plastic when there is enough natural moisture. Under either condition, sufficient stress will cause the underclay to flow. Squeezes may fill an entry or room within several hours, or it may be several months before movement stops. Squeeze areas commonly cover hundreds or thousands of square yards. The Coal Div. of the Illinois State Geological Survey has collected samples of underclays from various mines and from cores drilled by coal companies in the state. From these samples natural moisture content, particle size and particle size distribution, and clay mineralogy are determined. Data from samples collected from the underclay below Herrin (No. 6) coal in the Lumaghi Coal Co. mine near Collinsville, Ill., are used in this report to clarify points in the discussion. Data from samples taken from other mines lead to the same conclusions. A generalized geological section for the area is given in Table I. The underclay below coal No. 6 ranges from a few inches to 3 or 4 ft thick. The upper 6 to 18 in. are noncalcareous; the lower part becomes more calcareous with depth. Limestone nodules become larger with depth, almost grading into the limestone below. In areas where the clay is nearly absent the limestone may thicken to take its place; thus they may complement each other in thickness. There are two types of squeeze areas in a mine. In one type up to 3 or 4 ft of underclay lie in what appears to be a depression in the limestone underneath. This is suggested by a rim surrounding the squeeze area where the underclay is thin and the limestone lies within a few inches of the coal. In the second type the underclay of the squeeze area is surrounded by underclay of similar thicknesses which does not squeeze. Test Methods: Natural moisture content, particle size and particle size distribution, and clay mineralogy were determined by the following methods: Natural moisture is the moisture content a clay contains in its natural environment, expressed in percentage of the weight of ovendried clay (110°C or 230°F). To obtain the natural moisture content, given in Table 11, the clay samples were sealed in containers as soon as the samples were taken in the mines. Particle size and particle size distribution were determined by the pipette method,' and the data were plotted as cumulative curves, Fig. 1, on semi-logarithmic paper. Particle size was plotted on the logarithmic scale and percentage on the arithmetic scale. The quartiles (diameters that correspond to frequencies of 25 and 75 pct) and medians (diameters that correspond to the frequency of 50 pct) of the samples were determined from these curves. The clay minerals were identified from the data obtained by differential thermal' and X-ray powder" techniques. The differential thermal analyses were made on the whole samples, whereas the X-ray analyses were made on fractions of less than 2p. Data and Discussion Moisture Content: After the sealed jars had stood for 24 hr, those that contained squeeze samples had perspired, so that droplets of water had accumulated on the insides of the jars. Table II shows the moisture in the clay after it had perspired for 24 hr. (This perspiring was not noted in samples from nonsqueeze areas.) After perspiration one of the squeeze samples still had a higher moisture content than the samples that did not squeeze. The general control on the isoelectric point ([i]ep) of the natural magnetite that is effected by colloidal and adsorbed silicate species can be reversed by various acid/alkali washing procedures. Added aqueous silicate and aluminium ions lower and raise the [i]ep to values consistent with hydrous silica and alumina coatings respectively.

In the case of The Eureka Consolidated Mining Company v. The Richmond Mining Company of Nevada, recently tried at San Francisco, California, the real defendant was the Richmond Consolidated Mining Company, of London; but this being a foreign corporation, holds its mining property in Nevada through the Nevada corporation of similar name, in which the London Company owns all the stock, except the few shares necessary to " qualify" the American directors. The trial would naturally have taken place in the Circuit Court at Carson City, Nevada, and before a jury. But by stipulation of the parties, the case was tried in San Francisco, before Hon. Stephen J. Field, Justice of the Supreme Court of the United States, Hon. Lorenzo Sawyer, United States Circuit Judge of the Ninth Circuit, and Hon. E. W. Hillyer, United States District Judge, for the District of Nevada. The hearing began July 23d, 1877. The witnesses occupied two weeks, and the argument of counsel three days. Very eminent lawyers were engaged on both sides; for the plaintiff, Messrs. Solomon Heydenfeldt, R. S. Mesick, John Garber, and H. J. Thornton; for the defendant, Messrs. S. M. Wilson, Thomas Wren, and J. J. Williams. The court held the case under advisement until August 22d, when Mr. Justice Field delivered its unanimous opinion in favor of the plaintiff. The action was a complaint in ejectment, and an appeal was taken to the United States Supreme Court. The questions at issue between the Eureka and the Richmond Company in this suit, comprised several points in the construction of the mining law of the United States, and its relation to the customs and regulations of the mining districts, which possess an importance and an applicability far beyond the limits of the case in which they arose. Many of the parts of motor cars, aircraft, etc., that require strong light construction, hence must be made of high-quality steel, are stressed to the maximum limit only in a very small volume. In parts subject to bending stress a line or even a point may take the maximum stress. A series of endurance tests under repeated bending in progress in the U. S. Bureau of Mines laboratories, like similar tests by other investigators, has shown the great difference in life of sister bars of the same stecl, handled in the same way and tested at the same nominal stress. It is known that a surface notch or scratch greatly increases the local stress over the nominal calculated stress; internal notches, such as those formed by inclusions or sonims, probably have a similar effect. From the tetss made by the Bureau of Mines, the cleanliness of the steel at the dangerous section, or point of maximum stress, seems to be one of the most important factors in determining the life of the piece. The more localized the stress, the more does chance, rather than the average properties, dctermine the life of the steel. The usual test, a tension test of a bar taken longitudinally, is not sensitive to the local drop in strength (or tendency to increase the true local stress over the nominal) because of inclusions, which probably have a more injurious effect in hard heat-treated steels, such as must be used when great strength is sought, than in softer steels. Users of steel who make transverse tests find surprisingly low ductility on transverse bars of dirty steel, though the longitudinal tests may be good.
