INTRODUCTION The Scope of the Chapter This chapter discusses environmental regulation and closely-related public policies associated with mineral development in the United States. This chapter outlines the nature, extent, and amelioration of secondary effects of mineral development. It sketches the policy foundations of regulation; discusses the implementation of environmental law; describes land use conflicts and land management regimes; and surveys the costs and benefits of environmental regulation. Since regulations are subject to frequent change, the chapter emphasizes basic factual and conceptual material, rather than specific regulations. The goal is to familiarize the reader with the general nature of environmental impacts and mitigation which arise in the minerals industry, and with the issues surrounding the regulation debate. The chapter is organized as a series of sub- chapters. The first of these is a discussion of the conceptual foundations of regulatory policy. The second section summarizes the principal federal environmental statutes, and the implementation of such regulation. Following that, the third section summarizes the current state of knowledge regarding the types of environmental impacts associated with mineral development. This discussion, organized in a format similar to that used in environmental impact statements, can be thought of as a guide to reading and understanding such statements. Next, the fourth section surveys studies of the costs and benefits of environmental regulation. 'These empirical studies are evaluated in terms of the framework developed in the first section of the chapter. In the fifth section, the discussion turns to federal, state, and local approaches to land use control and siting, and the economic analysis of such conflicts. Included are discussions of the two principal forms of public lands mineral entry, the 1872 location patent system and the 1920 leasing approach. CONCEPTUAL FOUNDATIONS OF REGULATORY POLICY David A. Gulley The Role of Regulation in a Market Economy What is Regulation?: Regulation is the intervention of government in the activities of the private market. In a market society, the private sector is presumed to be the most appropriate economic agent. Given this presumption, regulation generally begins with a demonstration of persistent problems under laissez-faire in a given context. Environmental and related regulation occurs because the public believes the free market does not properly value environ- mental quality. In this section, concepts are advanced to aid the reader in understanding the government's role in this respect.

The Pittsburgh Safety and Health Technology Center of the Mine Safety and Health Administration (MSHA) has developed the Mine Emergency Responsiveness Development (MERD) program to improve the reaction and re¬sponse of mine personnel in mine emergency situations. The MERD program simulates problems that may occur in underground mine fires and explosions or surface mine accidents. Since its inception in 1982, the MERD program has been presented to MSHA, industry, labor and state government personnel. This versatile program is easily adapted to suit various training requirements. In 1992, a Mine Simulation Laboratory was built at the Natinal Mine Health and Safety Academy, Beckley, WV, to improve training for mine emergencies and prevention and fighting of mine fires. This facility is capability of simulating a coal mine and metal-non-metal mine for training purposes. It has been included in the MERD program to provide realistic and practical training for mine rescue teams and MERD partici¬pants in advanced mine emergency operations. The objectives of the MERD program are to improve the organizational and management skills of the participants in a rescue and recovery operation and provide a better understanding of the importance that various roles have on the overall organization and the importance of their interaction. The MERD program is not intended to provide the participants with all of the abilities and knowledge required to respond effectively to a mine emergency. Rather, it is intended to give the participant an opportunity to experience the emotions, frustrations and successes of a mine emergency without having to actually be involved in one. The participants are expected to return to their regular jobs with a greater appreciation of the environment in which emergency operations take place. Experience in mine emergencies is extremely limited in the industry today. The participants are encouraged to use the knowledge gained during a MERD program to develop or enhance a mine emergency plan suitable to their needs.

HISTORICAL BACKGROUND The American Concrete Institute defines shotcrete as "mortar or concrete conveyed through a hose and pneumatically projected at high velocity onto a surface." This definition thus includes what is traditionally known as gunite, which is a pneumatically applied mortar. In mining practice, the term shotcrete is restricted to pneumatically applied concrete, and this differentiation will be used in this chapter. In 1914, following the invention of the mortar gun in 1907, then chief engineer of the US Bureau of Mines (USBM) George Rice developed the gunite process for underground test work at the USBM facility at Bruceton, PA. After World War I, gunite was used extensively in American mines and was also utilized for underground civil works such as the San Jacinto tunnel in California. The greatest development was in Europe where, as early as 1911, gunite was successfully used as an overlay for deteriorated tunnel linings. In 1951, the Swiss firm Aliva developed a pneumatic gun capable of handling coarse aggregate, thus making possible the first use of shotcrete at the Maggia hydropower development. Initially, shotcrete was used to reduce manpower requirements for forming and placing conventional concrete. However, by 1954 Sonderegger was reporting that the structural advantages of shotcrete were derived from its flexibility and from the fact that it could be applied almost immediately after the opening had been made. The incorporation of wire mesh into the shotcrete led to the new Austrian tunnel method or NATM. The use of shotcrete in American mines has been implemented more recently. This delay seems to be due to previously unsuccessful experiences with gunite as a structural material and to the US reliance on wood or steel supports in main-line haulageways. The long experience with the apparently more substantial rigid supports led mine operators to be reluctant to accept the new and seemingly unrealistic lighter shotcrete support. APPLICATION REQUIREMENTS Shotcrete is a relatively new material for use in underground support systems. Consequently, experienced miners are not always available who are capable of applying the material effectively. Shotcrete, particularly in the small cross sections typical of mine shafts or haulageways, is applied in cramped quarters under less than ideal conditions. Adequate lighting should be made available. The surface should be clean and free of running or dripping water. It may be necessary to collect flowing water in plastic pipes or water collection devices. Any dry cement dust from previous shotcrete applications should be washed from the surface in order to assure a good bond. The US Bureau of Reclamation (USBR) while shooting test panels at the Cunningham tunnel in 1974, found that experienced shotcrete operators were able to obtain up to three times greater compressive strengths than were obtained by unskilled operators using the same equipment and shotcrete mix. ENVIRONMENTAL AND SAFETY REQUIREMENTS Since sodium and potassium hydroxide, as well as other moderately toxic compounds, are often contained in shotcrete (particularly where accelerators are used), safety precautions must be taken to prevent skin and respiratory irritation. Nozzlemen and helpers are required to wear gloves, protective clothing, and ventilation hoods with a filtered air supply. Respirators approved by USBM, equipped with chemical filters that will not pass the caustic mists, may be permitted in lieu of hoods if goggles or safety glasses are worn. Protective ointments are available to reduce skin irritation. All air and shotcrete feed hoses should be equipped with safety-type couplings and secured with safety chains at each coupling to prevent whipping in the event of a hose or coupling failure. Some environmental effects can take place down-stream from the development face being supported. The accelerator compounds, as well as the portland cement used in the shotcrete, will be found in the rebound material which falls to the invert of the heading. Since these compounds may be leached from the rebound material and carried by the drainage system, it may be necessary to install neutralizing or other water treatment facilities. Investigations may find that the final reaction with other compounds being leached from the mining operations may result in a more or less environmentally acceptable end product. USES OF SHOTCRETE General Uses Shotcrete, as a combination of cement, aggregate, and accelerator, is utilized for underground openings such as shafts, adits, haulageways, and service chambers for the following general purposes : (1) primary sup¬port; (2) final lining; (3) protective covering for excavated surfaces that are altered when exposed to air (the protective covering may be of a temporary or final nature); (4) protective covering for steel or wooden supports, rockbolts and rockbolt plates, heads, nuts, and other mats, including wire fabric, used to prevent rock-falls; and (5) as a lagging material in place of timber, steel, or concrete between steel or wooden supports. These applications can be grouped into three general use categories: shotcrete used as a rock sealant, shotcrete used as a safety measure, and shotcrete used as a structural support. Use as a Rock Sealant Thin applications of shotcrete can reduce or prevent slaking of shales or other rocks that are altered when exposed to the wetting and drying cycles created by mine ventilation circuits. While shotcrete may be effective in preventing such rock alteration, at the present time it is not as economical or efficient as other commercial sealants. However, if the sealant property can be incorporated into the structural support capability, the added contribution is usually helpful. Skam deposits considered as porphyry copper deposits have been classified into three basic prospecting models: (I) the skam deposit associated with a mineralized intrusive (Pima-Mission), (2) the deposit associated with a barren igneous stock (Ertsberg), and (3) mineralized rock that seems to have no clear association with apluton (Phoenix). Pima-Mission, Christmas, and many other copper-bearing skarns developed in carbonate sequences near mineralized intrusives form an important part of the deposit. Historically, copper derived from the mineralized intrusion accounts for less than half of the metal produced by most porphyry mines, as most mineralization occurs in the intruded rocks. Skam mineralization is an important part of wall-rock metal deposition, because carbonate sequences are preferentially replaced by sulfide and skarn minerals. Exploration for skam mineralization is an important phase of porphyry copper exploration. Impure carbonate beds can become better host rocks for skam deposits than pure carbonates, and these in particular should be included in porphyry-exploration programs if the impure strata are cut by the stock. Skam deposits can also form near stocks that are barren of sulfide. In this model, the two best ore guides are strata favorable for mineralization (usually impure carbonate beds) and the intrusive contact. Faults can also act as important ore controls. Some skarn deposits form that have no clear genetic connection with a stock, although intrusive rocks are known in the district. In such cases, the best ore guides are strata and district-wide faulting. Dikes and sills are also common and mineralization can locally prefer their contacts even though the igneous rocks are barren. Skam minerals are influenced by the chemical composition of the carbonate. Forsterite, brucite, tremolite, and talc are common in skams developed in dolomitic beds. Skams derived from calcic beds often contain wollastonite, calcite, stilbite, or idocrase. Diopside, however, is a common accompaniment of copper sulfide in skam regardless of the original composition of the carbonates. Tremolite and possibly other amphiboles and chlorite can occur significantly in the zinc-lead portion of skams. Gamets occur in magnetite, copper, and zinc-lead zones of skams, but are not as diagnostic as diopside for the copper zone or tremolite for the zinc-lead zone. A general desciption of skam-deposit mineralogy can be used to construct prospecting models of porphyry copper skams. An abstract of such a description follows.

BACKGROUND Diesel exhaust is an animal carcinogen, although evidence of the carcinogenicity in humans is "limited". (World Health Org. , 1989) Of the eight cohort studies in the 19808, five found an increased risk for lung cancer among workers who may have been exposed to diesel exhaust (RR from 1.3-1.5, SMR from 101-132). (Howe, et al., 1983) Only two studies accounted for smoking indirectly. Of the ten case-control studies in the 1980's, eight reported increased risk of lung cancer among those populations purportedly exposed to diesel exhaust. (Benhamou, et al. , 1988) All but one of these adjusted for smoking and other occupational exposures. The odds ratios ranged from 1.2 to 2.1. In two of these studies, miners experienced a two to three fold risk. (Benhamou, et al., 1988) Bladder cancer has also been linked to diesel exhaust in cohort and case-control studies. Excesses of approximately 50% were observed among truck drivers in studies by NCI. (Hoar, et al., 1985) In the National Bladder Cancer Study, risks for truck drivers rose with duration of employment. A study by NIOSH in Ohio also found an excess of bladder cancer among truck drivers, particularly among those with 20 or more years of employment. (Steenland, et al, 1987) Despite the large number of studies in which the relation between diesel exhaust exposure and lung cancer has been examined, exposure to diesel exhaust has been quantitatively estimated only in the studies of railroad workers and truck drivers. (Woskie, et al., 1988) The excess lung cancer risk experienced by workers in these two occupational groups was modest, ranging from 40 to 90% for those with long-term employment. However, diesel exhaust exposure among railroad workers and truck drivers is lower than that seen among miners. Several markers of diesel exhaust have been utilized in these studies. Diesel exhaust is a complex mixture of particulates, vapors and gases. One group of these gases, the nitrogen oxides, react with polynuclear aromatic hydrocarbons, forming mutagenic and possible carcinogenic nitrated derivatives. (World Health Organization, 1989) For this reason, and because it is easy to measure and analyze, NO, was frequently used as a marker of diesel exhaust exposure. As part of the Garshick (Garshick, et al., 1988) study of railroad workers, Woskie measured NO, exposures of 477 railroad workers. On October 27, 1972, ground was broken for the first section of the Second Avenue Subway, a two track underground rail system that was to extend from the south end of Manhattan at Broad Street, north to the Harlem River at 126th Street, a distance of eight miles. This ground breaking was the culmination of 67 years of planning for an east side subway in Manhattan. Following the successful opening of New York City's first subway on October 1904 there was a mass planning for additional subways throughout the City. In 1905 approval was requested of the Board of Estimate for a First Avenue route and Third Avenue route. The Third Avenue route was approved but when action was not taken to start construction, the approval in accordance with the conditions under which it was given was withdrawn. Further reports and plans for an east side subway, usually to be constructed on Third Avenue, were issued in 1920, in 1922, in 1924, etc. Those of us who had worked on the Sixth and Eighth Avenue subways in the thirites and early forties left to join the armed services of World War II in the expectation that we would return and start work on designing and constructing that east side subway. The reason that much of the thrust in those years was to construct on Third Avenue was that there was a Third Avenue "EL" and business interests of the City were in favor of its demolition. This demolition was accomplished in 1955 so one of the incentives to construct on Third Avenue was removed; but an east side subway was always part of the master plan of the City.

Mooranbah North is a new greenfield project in Australia's Bowen Basin that is projected to produce 4 mtpa of hard coking coal from a single longwall. Located in Central Queensland in Australia's northeast, this is one of Australia's main coal producing regions. From the outset, Mooranbah North's approach to equipment selection has differed markedly from that usually taken in the mining industry, and the conveyor industry in particular. Until recently, no performance requirements have been placed on conveyor equipment suppliers. This arose from a practice of purchasing components in an ad-hoc manner from a variety of sources, and the mine then configuring the system. More recently, single source supply has been adopted as a means of obtaining some performance guarantee, usually expressed in terms of system availability. Unfortunately, the term "availability" has a multitude of definitions, particularly in the underground coal sector. A conveyor availability of 98% is a common goal but this rarely means the conveyor must operate 165 hours/week, 52 weeks/year. There are mines that have one maintenance shift for each production shift and claim availability of 100%. What is meant is that no down time is logged to the conveyor during the hours that it is wanted. This "generous" definition of availability would not be tolerated in many industries and nor should it. Unfortunately, a true definition of availability, such as is applied to steam turbines in the power generation industry, is not particularly helpful. Five day/ week operations would immediately face a 28% penalty against 7 day rosters, and there would be no sensible manner in which weekend maintenance could be incorporated into the availability formula. The approach adopted by Mooranbah North was to specify a period of "Failure Free Operation," which would be followed by a maintenance period. This

The Formative Years Douglas Winston Fuerstenau was born December 6, 1928 in Hazel, SD to Edwin Arnold and Hazel Pauline (Karterud) Fuerstenau. His father, of German extraction, was a farmer and, later, a cabinet maker, while his mother, of Norwegian lineage, was a school teacher. His parents are still alive today at ages 91 and 88, respectively. Two younger brothers, Richard and Maurice and a sister, Jean, completed the family. The family first lived near Watertown and later in Lemmon and Mobridge, SD. The 1930's were a difficult period for any family in South Dakota. A decade-long drought made this a part of the dust bowl, which together with a serious infestation of grasshoppers (the locust plague described in The Bible), and the world-wide depression, made living difficult for all. In spite of these privations, Doug has many happy memories of his childhood which can be attributed to the resilience of youth and a strong family structure. He has fond memories of summers spent with his cousins on family farms where the children were introduced to farm chores at an early age. When he was old enough, he worked in a grocery store after school. At the age of 14 he spent the summer hearding 2,000 sheep near Lemmon, SD as his contribution to the war effort in that labor-short period. He remembers well the dust storms of the 1930ts, the destruction at his grandmother's farm by tornado, pulling weeds on the farm, threshing grain with a monstrous steam-driven machine and such pleasant childhood activi- ties as fishing for bullheads, hunting for rabbits, searching for arrowheads in newly plowed fields, and ice skating in the winter. Early in life his parents instilled in him a strong work ethic, a love of learning and the need for a good education. In 1943, the family moved to Rapid City, SD. With a population of 13,000, it was

INTRODUCTION The Idarado mine lies high in the San Juan Moun¬tains on the divide between the Uncompahgre and San Miguel Rivers and consists of a consolidation of a number of old and prominent mining properties through which course some famous and very produc¬tive veins. Among the better known are the Smuggler, Tomboy, Montana-Argentine, Black Bear, Liberty Bell, Virginius, Flat, Barstow, and Japan, as well as many others. Most of these veins have been extensively mined over the past century and in the last three decades the Montana-Argentine and Black Bear veins have been the backbone of the Idarado mine; therefore, the descrip¬tion of the veins is limited to them. Access to the mine is through either the Treasury tunnel, whose portal is below Red Mountain Pass on US Highway 550 at an elevation of 3244 m (10,643 ft), or the Mill Level tunnel entrance 3.2 km (2 miles) east of Telluride, CO, at an elevation of 2761 m (9060 ft). The Treasury tunnel intersects the Black Bear vein 2643 m (8670 ft) from the portal and the Mill Level tunnel intersects the Argentine vein 2179 m (7150 ft) from the portal. Mining is by shrinkage stoping from slusher sublevels. The size of the scope blocks varies somewhat, but the standard size is 67 to 76 m (220 to 250 ft) long and 61 to 76 m (200 to 250 ft) high. The mine ranks either first or second in Colorado in yearly production of gold, silver, copper, lead, and zinc. It is 9.6 km (6 miles) from the Red Mountain plant to the Pandora plant, via interconnecting drifts and raises. There are engineering offices at both plants as a matter of convenience. The Red Mountain plant in¬cludes the company general offices, warehouse, carpen¬ter and machine shops, and mine change room. The Pandora plant consists of the mill and assay office, ma¬chine shops, and mine change room. The flotation mill has a capacity of 1632 t/d (1800 stpd), making a bul¬lion product and separate concentrates of lead, copper, and zinc. HISTORY OF THE MINE The Montana-Argentine vein was first extensively worked by the Tomboy Gold Mines Co., Ltd., a British concern. This company mined the stoped areas above the Ophir level between 1910 and the late 1920s and most of the stoped areas above the 2100 level between 1900 and the late 1920s. Gold was the principal ore metal mined. The area between the Revenue and Ophir levels was mined chiefly by the Revenue Mines Co. between 1900 and 1910. The ore was worked from the Revenue tun¬nel, which portals in Canyon Creek. Gold and silver were the chief metals recovered. The stopes between the 1700 and Revenue levels, as well as some higher stopes, were mined by Telluride Mines Inc. during the 1940s. The Mill Level tunnel was driven by that company from 1945 to 1948. Lead and zinc then became economically more important than the precious metals. In 1953, Idarado purchased Telluride Mines, which merged with the parent company in 1956. The Black Bear vein was first extensively worked by the Black Bear Mining Co. in the 1900s and by the Colorado Superior Mining Co. from about 1914 until snowslides at the mine camp [altitude 3750 m (12,300 ft)] terminated the company's operations in 1924. Leasers operated at intervals until 1934. The Treasury tunnel, formerly the Hammond tunnel, had been started before 1900 and reached the 1646-m (5400-ft) mark early in the 1900s, at which time activity lagged until the late 1930s. In the early 1940s, Idarado extended the Treasury tunnel from its heading at 1646 m (5400 ft) to the Black Bear vein and established a raise connec¬tion with the 600 level, the lowest level in the old mine. Since completion of initial work in the mid-1940s, systematic development of the mine, both in the driv¬ing of new headings and the utilization of older open¬ings, has resulted in the present extensive network of workings. GEOLOGY Introduction The oldest rocks of the area are the Precambrian metamorphic rocks, the Uncompahgre formation which are massive quartzites, some phyllites and slates, and dolomitic or limestone beds. West-dipping Paleozoic and Mesozoic strata lie on the Uncompahgre formation. These units are separated by a major angular uncomformity from overlying, essentially horizontal, Tertiary formations that include the basal Telluride conglomerate and several thousand feet of overlying volcanic rock. Intrusive rocks, mostly Tertiary in age, are common in the area, and are in the form of dikes, stocks, and sills. Dikes are very closely associated with some of the ore veins (Mayer). Description of Veins The Black Bear and Argentine veins range from 0.6 to 7.6 m (2 to 25 ft) in width, but in most places are 1.5 to 2 m (5 to 7 ft) wide. They vary in character from a well-defined tabular structure between sharp "frozen" walls, or gouge seams, to an irregular zone of quartz and quartz-sulfide stringers. Many gouge seams within the veins make the veins blocky and loose. Common gangue minerals in the veins include quartz, pyrite, rhodonite, chlorite, sericite, clay minerals, epidote, calcite, adularia, rhodocrosite, fluorite, and specularite. Quartz constitutes 60 to 70% of the veins and varies widely in character, ranging in color from clear through white, gray, and green, to amethyst. Chlorite, sericite, the clay minerals, and fine-grained quartz are common alteration products of the vein walls and of wall rock fragments in the veins. Introduction The Sierra Nevada Foothill Gold Belt in California extends from Mariposa north for more than 420 km (200 miles). It includes the Grass Valley and Alleghany districts in the zone of Northern Mines and the famous Mother Lode to the south. The gold belt has produced more than 3.1 kt (100 million oz) of gold since its discovery in 1848. This remarkable production, at the present gold price, would be valued at more than $40 billion. The Law of Gambler's Ruin supposes that averages are based on systematic rather than random variations. It emphasizes the vast differences between finite and infinite probability. By applying this Law to this figure, it can be seen that the belt has produced an average of 15.5 t (500,000 oz) of gold per running mile. Many geologists believe, with some justification, that less than half the gold in this belt has been mined. Sixty per cent of the past production has come from lode deposits, the balance from Tertiary and Recent placer gravels. This paper will concern itself with the developing lode mines along the Sierra Nevada Foothill Gold Belt. As a further and final note regarding placer mining along this belt, Mark Twain suggested that placer miners, having lost their senses, had contributed liberally to the population of California's insane asylums. After a 40-year lull with little or no gold production, the lode mines of this famous belt are showing signs of renewed activity. Two open pit mines, the Sonora (Jamestown) and Carson Hill, are now in operation at substantial scales. Two others, the Goldenbell (Pine Tree-Josephine) and the Royal-Mountain King, are being readied for production on equally impressive scales. All are in the southern part of the Mother Lode. Exploration farther north, at Sutter Creek, Drytown, and Georgetown, is showing encouraging results in developing deeper lode deposits. This new activity has been sponsored to a large extent by junior Canadian mining and exploration companies. Most of the established American mining companies have looked the other way, not participating in this important development. One major reason for domestic disinterest in this opportunity is there is little chance for heap leachable open pit ore in this belt, excluding Carson Hill. And heap leaching has become fashionable with American mining companies today. Also, this great old gold belt must have been worked out, for why else is there so little activity here - Catch 22 logic. Another reason is that if a new deposit of size and grade similar to the mines in the past was found, high costs would preclude a profitable operation. And, finally, California environmentalists would not permit mining, even if a rich deposit were found. These may all be pefectly valid reasons not to explore for gold along this belt. But a look at the history of gold mining in California may suggest that the future for exploration and development of the gold resources in the Sierra Nevada Foothills can be greater than the past. It was during the Depression of the 1930s that this gold belt saw its maximum activity, with more than 3000 mines in operation. Some were father and son operations producing only a few tons of ore a day. Other mines employed hundreds of miners to hoist more than 900 t/d (1000 stpd). Some ores were of marginal grade. INTRODUCTION Historical mining activities in the Robinson Mining District, in the Egan Range of east-central Nevada (White Pine County), resulted in five open pits (Veteran, Tripp, Liberty, Ruth, and Kimbley Pits), several large mine-waste dumps, and numerous underground workings developed for copper, zinc, gold, lead-silver, and manganese (Figure 1). Groundwater percolating downward through the copper sulfide ores produced a blanket-like supergene zone enriched in copper, which has been one of the primary objectives of mining since the early part of this century. To obtain permits for future operation, an EIS was conducted that evaluated future pit- lake chemistry, groundwater quantity and quality issues, transport of water and solutes subjacent to a proposed tailings impoundment, and the potential for waste dump acidification. AREA HYDROGEOLOGY The mine area is on a ridgeline draining to the Steptoe Valley to the east and to the White River Valley to the West. Precipitation in the Robinson Mining District ranges from a low of 15 cm (6 in.) per year in the valley to more than 50 cm (20 in.) per year in the surrounding mountains. Evapotranspiration exceeds precipitation, leading to a net loss of water from the basin as either surface flow or underflow to the north at Currie, Nevada (Eakin et al. 1967). The White River Valley, which lies to the south and west of the mine area, includes approximately 4,200 km2 (1,620 mi2) of the upper part of the Colorado River Basin. This valley is 112 km (70 mi) long, 32-48 km (20-30 mi) wide, and like Steptoe Valley, evaporation and transpiration exceed precipitation (Maxey and Eakin 1949). The local groundwater flow system in the Robinson Mining District and the proposed mine area is dominated by two main components: (1) a groundwater mound or high between the Ruth Pit and Murry Springs, and (2) a shallow groundwater flow divide that follows the ridge crest south of Ruth, which contains the Veteran and Tripp pits. Besides the alluvium, the main hydrostratigraphic units controlling groundwater flow are limestones, shales, and sandstones, along with the intrusive quartz monzonite stocks. INTRODUCTION Although the mining method described in this chapter is locally designated "modified Mitchell," there are so many features which are characteristic of square sets that the designation "modified square set" would describe the method equally well. The method was developed as a result of local operating experience with various mining methods, observing operations in mines in the southwest where Mitchell stoping had been thoroughly developed, and an exhaustive study of min¬ing methods literature. Since 1941, modified Mitchell stopes have con¬tributed over 50% of the total stope production and were largely responsible for supporting production dur¬ing the war years and period of declining manpower and increasing costs. GEOLOGY The community of Gilman is situated on Battle Mountain at an elevation of 2743 m (9000 ft) in the Battle Mountain mining district, about 45 km (28 miles) by highway north of Leadville, CO. The sur¬rounding area, including the Mount of the Holy Cross and Eagle River Canyon, is noted for its beauty and recreational facilities, both summer and winter. Massive sulfide ore bodies of the limestone replace¬ment type occur as chimneys and mantas or as blankets in strata dipping 0.19 rad (11°) northeasterly. A chimney is shaped like an inverted cone with shale, quartzite, and porphyry caprocks forming its base. This relatively impervious capping apparently blocked rising ore constituents which formed the chimneys and mantas. At the apex or lower extremity of the chimneys, the ore follows small fractures and bedding planes in under¬lying quartzite. Dimensions of chimneys vary, ranging up to 61 m (200 ft) vertically and 76 m (250 ft) horizontally near capping. The manta or blanket ore bodies vary in vertical cross section from one hundred to several thousand feet. One such manta was developed from its outcrop to its chimney source approximately 610 m (2000 ft) downdip. Another manta of substantial cross section and length did not follow shale but extended updip with limestone capping from its source at a lower horizon. All chimneys, however, make up to the shale¬quartzite-porphyry capping. Chimney ore minerals are mainly pyrite and chalco¬pyrite with accessory copper and silver minerals, surrounded by, and in places overlain with, marmatite, pyrite, and galena. Manganosiderite extends into the ore. It may or may not be impregnated with sufficient marmatite and galena to be of commercial grade. Ore may be massive, coarsely crystalline, or sandy, some¬times rubbly. Generally speaking, chimney ore masses are incompetent and of variable grade. Caprock is heavy and caves readily. Manta ore minerals are mostly marmatite, pyrite, and galena associated with manganosiderite. Structural characteristics of the ore are similar to those found in chimneys and where the manta contact shale capping the ground is unusually heavy. However, the large manta with limestone capping mentioned previously consisted of a hard strong ore mass in fairly strong host rock. Commercial ore contacts are fairly regular in this manta but in others the ore waste contacts along the walls are irregular with shaly limestone pendants extend¬ing downward into the ore at capping. Dolomite sand is also quite frequently encountered along wall contacts and less frequently overhead. MINING METHODS Practically all stoping in the Gilman ore bodies has been carried on with timber and fill methods and the features which have been briefly described have dictated the choice. Although at the present time modified Mitchell and underhand square-set stopes account for the total production, considerable production has been obtained from alternate horizontal cut-and-fill stopes with Mitchell truss stopes in the pillars. This method was highly satisfactory in the hard manta ore body mentioned earlier and where ore excavations 11 m (35 ft) wide and 23 m (75 ft) long required no auxiliary timber support. "Public engagement is increasingly important in ensuring the success of projects related to energy development, particularly with regard to issues of environmental protection, public health, and socio-economic impacts. This is due to concurrent trends in public behavior, including a rise in public interest in these projects that is not matched by a rise in science literacy, and increasing organization and participation of the public through social media, citizen science, and grassroots initiatives. In recent years, several high-profile incidents have demonstrated that when public concern is ignored or met with a passive response from industry, it can rapidly grow into organized opposition that negatively impacts or wholly derails a project. Engaging, listening to, and educating stakeholders during early planning and development phases are therefore essential to earning credibility and trust. Moreover, maintaining two-way lines of communication throughout the lifespan of a project demonstrates social responsibility and facilitates cooperation, acceptance, and even support from communities and others. Positive experiences with specific projects at a local, community level can influence the larger public opinion of an entire industry sector. This paper presents cases studies of public engagement related to shale gas development (including hydraulic fracturing and pipeline construction), mountaintop removal mining, and management of mixed-use watersheds near surface mining operations. The experiences highlighted in these case studies are used to draw best practices of public engagement for sustainable energy development.Introduction Within the scientific research community, the importance of public engagement has gained increasing recognition. In a 2007 article in Nature, medical researcher, Patrick Taylor, stated that public engagement has both “gone viral” and “gone global” and has the ability to make real impacts to research (Taylor 2007). Nancy Baron, the science outreach director for COMPASS, an organization providing communications training for scientists, provides further evidence for the increasing focus on engagement, including shifting attitudes observed during her own experience as a communications coach and documented in surveys, the recent inclusion of communication and engagement activities in academic tenure review, and the surge of workshops, materials, and other resources available on the subject (Baron 2016). In addition to COMPASS, a number of organizations and institutes have been developed to train scientists for communication and engagement with the public, perhaps most notably the Alan Alda Center for Communicating Science at Stony Brook University, and academic fellowship programs, such as the Leopold Leadership Program at Stanford University and the Wilburforce Fellowship Program, have been established for the same purpose."

The need for ground support research in underground excavation has been well identified in recent years by many studies in the subject area (1, 2, 3, 4, 5). A typical conclusion from these reports (1, 2) is that the drill-and-blast (D & B) mining or the mechanical tunnel boring machine (TBM) methods are expected to be continued in use for the needs of tunneling in the immediate future. The Organization for Economic Co-operation and Development (OECD) sponsored in June, 1970 advisory conferences on Hardrock and Soft Ground Tunneling (3,4). These two reports were based on the combined response received from approximately six hundred inquiries from 17 nations in the summer of 1969 and which concerned all aspects of present-day inadequacies of, and the needed improvements in the technology of tunneling. Some specific problem areas in ground support and tunnel linings were: 1) the ability to successfully predict rock loads that must be carried by the support system; and 2) inadequate methods for determining the load-carrying capacity of the various support systems. Therefore, the problem area is clearly defined by these two objectives: 1) To find means of predicting rock loads; and 2) To develop methodology for determining safe, efficient, and economical ground support design practices. Noting these research needs from a great number of sources, the United States Bureau of Mines, Spokane Mining Research Center (SMRC), acting as agent for the Advanced Research Projects Agency (ARPA), undertook contract research effort in these problem areas. Work by Jacobs Associates has studied a methodology for specification of temporary artificial support based on the dependent sequence of mining operations and prediction of various rock conditions in the pre-excavation stage. INTRODUCTION The rock mechanics study of the shortwall mining system at Beth-Elkhorn corporation's Hendrix No. 22 Mine is being conducted under contract with the U.S. Bureau of Mines. The objective of the study is to obtain data on surface subsidence over a portion of the mined area, strata subsidence in the mined area, and underground stress changes and displacements in and near natural support elements of the mining system. This study is currently in progress, and only a portion of the results are being presented at this time. The Hendrix No. 22 Mine is located in the moderately rough mountainous terrain of Letcher County in eastern Kentucky. The nearest mine workings to the shortwall area are approximately 1,900 feet distant. The depth of cover over the mined shortwall area varies from 770 feet at Panel 1 to 170 feet at Panel 5 (Figure 1). The strata in the shortwall area is summarized in the three core logs shown in Figure 2. Hole no. 2 is located in approximately the center of the mined shortwall area (Panel 3, Line C, Figure 1). The coal seam in the shortwall area is approximately 4 feet thick and horizontal, although one major ‘roll’ intersects all panels.

Since geologic anomalies are one of the governing factors of instability of underground openings, it is extremely important to know in advance the locations and extent of these anomalies such as faults and weak zones. At an underground coal mine in the Black Warrior Basin, core drilling was conducted to find a fault in an area where they were planning to locate longwall panels and possibly a shaft. Core logging did not provide sufficient information to delineate the exact location, strike, and dip of the fault. However, a high resolution reflection seismic study successfully solved this problem. This experience proved the seismic exploration technique could be used for premining coal exploration by reducing drilling costs and providing more accurate and detailed information about geologic anomalies.

Introduction Many solids processes that look feasible on paper or even in pilot studies become disasters in full scale. Changes in solids flow characteristics from pilot scale to full scale be- cause of larger solids contact pressures, thermal shocks, or unforeseen temperature excursions often cause full-scale solids flow problems not encountered in the laboratory or pilot studies. Fortunately, proper applications of solids flow principals and solids flow properties measurement at full scale conditions can anticipate the problems and thus provide an accurate basis for full-scale design or existing plant modifications. Solids flow properties The basic solids flow property definitions are given in Table 1 (Johanson, 1966, 1976, 1978, 1985). In this section, the author will discuss each property and its potential for creating full-scale pilot plants. Unconfined yield strength The unconfined yield strength of a bulk solid determines the tendency for cohesive hangups of the solids in the process and is effected by the time at rest, chemical reactions, temperature, liquid content, solids size consist, and phase changes of solids or fluids involved in the process. One of the common mistakes is to consider the solids condition only at the beginning and the end of the process. For example, consider the direct reduction of iron ore. The feed solids are free-flowing, hard lump ore or pellets. The end result is a hard, free-flowing reduced sponge iron lump or pellet. One might conclude that the process involves free-flowing lumps. This conclusion may seem reasonable based on laboratory studies oreven pilot plant studies where solids contact pressures are very low. Unfortunately, during the reduction reactions at high temperatures, the rock or pellets soften and, with solids contact pressures associated with the full-scale plant, may fuse together, thus providing a possible solids hangup in the moving bed reactor not evident in the low pressure pilot scale. Fig. 1 shows some typical unconfined yield strength measurements for pellets as a function of solids contact pressure at various times at rest. Note at low consolidation pressures, generally associated with laboratory or pilot plant studies, the pellets show no strength unless held at rest for an extended time. This will produce a very free-flowing condition in pilot plants that will not exist in the full size reactor.

Control of radiation hazards in mines is only one of many goals of the Bureau of Mines. Radiation research is only a small part of the Bureau's mine health and safety research program. In this paper I will describe the mission and programs of the entire Bureau of Mines, with emphasis on the mine health and safety program of which our radiation research is a part. The radiation program and its results will be described in detail by other speakers during this symposium. The Bureau of Mines was established in 1910 and is one of a number of agencies within the Department of Interior. Our mission is given by the Organic Act of the Bureau of Mines, last revised in 1913, which still accurately describes our work today. The amended Organic Act (Public Law 62-386) gives the Bureau authority "... to conduct inquiries and scientific and technologic investigations concerning mining, and the preparation, treatment, and utilization of mineral substances with a view to improving health conditions, and increasing safety, efficiency, economic development, and conserving resources through the prevention of waste in the mining, quarrying, metallurgical, and other mineral industries; to inquire into the economic conditions affecting these industries..." Since 1913 at least 52 public laws bearing on Bureau responsibilities have come into force. However, our basic role is still unchanged, i.e. improving health conditions, and increasing safety and efficiency in the mineral industries. The two principal activities of the Bureau are Minerals Information and Analysis and Minerals Research. The Minerals Information and Analysis programs provide the data base and the analytical capability to support the development of effective national mineral policies. Data on the availability, production, and utilization of minerals are collected, interpreted, and analyzed for some 100 commodities. Resources of the most important commodities are evaluated to support policymaking that influences utilization of the Nation's existing and potential mineral supplies. The President's budget for the Mineral Information and Analysis programs in fiscal year 1982 is $34 million. The largest activity of the Bureau is Minerals Research, which is divided into three major programs: Mineral Resources Technology, Minerals Environmental Technology, and Minerals Health and Safety Technology. The principal goal of the Mineral Resources Technology program is to help provide technology to maintain an adequate supply of minerals for the United States. The budget requested by the President for this program in fiscal year 1982 is $41 million. The goal of the Minerals Environmental Technology Program is to create mining and mineral processing operations that are more compatible with the environment. The budget for this program in fiscal year 1982 is $12 million. The largest program of the Bureau is Minerals Health and Safety Technology, which has the goal of providing the technology to protect the health and safety of mine workers. The budget for health and safety research for fiscal year 1982 is $55 million. Our radiation research is part of the health and safety research program. The Bureau of Mines has done research to improve health and safety conditions in mines since it was established in 1910. The research expanded greatly following the passage of the Federal Coal Mine Health and Safety Act of 1969 (Public Law 91-173) and the Federal Mine Safety and Health Amendments Act of 1977 (Public Law 95-164). These acts provided for increased health and safety regulatory activities, but they also significantly increased the funding available for mine health and safety research by the Bureau of Mines. Funding for the Bureau's health and safety research grew from $12 million in 1970 to $60 million in 1981. The funding in 1982 will be somewhat lower than that for 1981. However, the health and safety program funding is still approximately 40 percent of the total budget of the Bureau of Mines. Of the health and safety budget, 22 percent is spent on research to control health hazards in mines, including radiation hazards, which has a budget in 1982 of approximately $1.1 million. Other mine health hazards which the Bureau is doing research to control include respirable mine dusts which cause black lung and silicosis; excessive noise; toxic gases from explosives and diesel emissions; and excessive heat in deep hot mines. The other 78 percent of the budget is spent on safety research to prevent death and injury to miners from such causes as roof falls, fires, explosions, and accidents involving mining equipment. Over the past decade the majority of the Bureau's health and safety research has been done through outside contracts with private industry and universities. Our policy has been to do some research inhouse to maintain the expertise of Bureau personnel. Contractors are used to do research for which the Bureau does not have the necessary personnel available. The percentage of the program being done by contract has been gradually declining for the past few years, and in 1982 the program will be divided evenly between inhouse and contract research. The inhouse research of the Bureau is done at the 10 research centers located throughout the country. Our radiation research is done at three research centers, Denver, Spokane and Pittsburgh, and by contractors whose work is monitored by project officers at these centers. There are three Federal agencies involved in mine health and safety. These are the Bureau of Mines, the Mine Safety and Health Administration (MSHA), and the National Institute for Occupational Safety and

The most important event affecting the United States coal industry in 1993 was the strike by the United Mine Workers of America (UMWA). This was a series of selective strikes, beginning with a strike against four Peabody Holding affiliates on Feb. 2, following unsuccessful contract negotiations between the UMWA and the Bituminous Coal Operators' Association (BCOA). Although that strike ended on March 3, the failure to reach a new contract agreement led to walkouts at several Midwestern mines on May 10. During the summer, the strike expanded to include mines of 13 companies in seven states including Ohio, Pennsylvania, Illinois, Indiana, Kentucky, Virginia and West Virginia. About 17,000 miners were idled during the strike. As the prospects for a settlement diminished, the Secretary of Labor appointed a federal mediator. The mediation resulted in a five-year contract. In addition to increases in wages and pensions, it was agreed that 60% of new job openings would be filled by laid off and active UMWA miners. In return, companies won the right to establish more flexible work rules and scheduling of miners. While some health care benefits were expanded, the agreement established a new health care system that was designed to reduce costs. Preliminary Energy Information Administration (EIA) data indicate that US coal production fell by 5% in 1993, to 859 Mt (947 million st) (Table 1). The strike was one of the primary causes of the decline in production. Another significant cause was a 27% decline in coal exports. Also, a very small displacement of domestic coal production resulted from a rise in coal imports.

Summitville is an old mining district located south of Wolf Creek Pass in the southern San Juan Mountains of Colorado at an elevation higher than 3500 m (11,500 ft). The Summitville mine site is about 40 km (25 miles) southwest of Del Norte. The current mine, developed by Galactic Resources Ltd. and its subsidiaries in the mid-1980s, is on the north facing side of South Mountain. The area is drained by Cropsy Creek to the east and Wightman Fork to the north, both tributaries to the Alamosa River. Mining in the Summitville area began in 1870 when James Wightman discovered placer gold on what is now known as Wightman Fork of the Alamosa River. The first vein-type deposits were located in 1873 on South Mountain near the current Summitville Mine. Mining began in the district in 1875 and continued sporadically through 1942. Major mining episodes occurred from 1875 to 1894 and from 1926 to 1942. Total gold production from the mining district through 1949 totaled 7.5 t (240,000 oz). An additional 7.7 t (249,000 oz) were produced during Galactic's tenure. Natural degradation of the outcropping sulfide-rich veins in the area and the early mining activity, including development of the Reynolds, Dexter and Iowa drainage tunnels in the late 1890s, have polluted the streams draining the area with heavy metals and acidic water. Names of the various tributaries to Wightman Fork, such as Iron, Alum and Bitter Creek, testify to this natural pollution. This degradation has reduced, or killed, aquatic life in several area creeks, including Wightman Fork, for many years before recent mining activity.
