In the year 1948, more than ever before, the coal industry established itself on the threshold of a new and exciting future expansion. While production did not equal the wartime and peacetime peaks of 1944 and 1947, it was, in review, a good coal year. During the latter part of the year a combination of mild weather, record stock piling, and general business slackening reduced coal demand to the extent that marginal mines suspended operations, while mines remaining active found it necessary to renew their attention to producing better products at lower operating costs.

This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World," (Information Circular 80 1 7, 196 1. ) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then bronze, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. THE Aldrich Mining Co. holds under lease from the Illinois Central R. R. Co. about 14,000 acres, in the East half of Township 12, Range 12 `V., in Marion county, Alabama, and owns other lands, of which about 1,000 acres adjoin this leased tract, making a total area of about 15,000 acres, all of which is underlain by the coal-seam upon which the company is operating. This seam is nearly horizontal ; and a ravine, diagonally crossing the tract, exposes the outcrop on either side for about 2 miles. The territory has been so divided that nearly the whole of it can be worked out by two collieries. The mines at Brilliant were opened in the Fall of 1898, and shipments began in the following spring. The original plan was to furnish steam-coal for locomotives to the Illinois Central R. R. Co.; and upon this expectation the investment of capital was made. The field was entirely new; and the softness of the coal at the outcrop induced the belief that it could be very cheaply mined. A contract for the delivery of a large quantity of coal to the railroad was accordingly executed. But with the advance of the entries to increasing distances from the outcrop, the coal proved so hard that it could no longer be drilled with a breast-auger; and the expense of mining became so great that the contract for cheap steam-coal had to be cancelled. It became evident that the work must be done with machinery and explosives, if it could be profitably done at all. On the other hand, the excellent quality of this coal opened, at the same time, a possible market not specially contemplated at the outset-namely, that of a first-rate coal for domestic and general uses. C. W. MERRILL*-Mr. Hughes' paper not only is very well presented but is most timely in that it covers a subject of vital interest to the United States. Tin is one of the strategic metals which has not been found here in appreciable quantities. The total United States tin output since the first recorded production over 100 years ago would not supply current consumption for a fortnight. On the consumption side, tin is extremely important in national defense because of its use in tin plate which, in the form of tin cans, makes it possible to feed properly the armies that the United States recruits from its civilian population in emergencies. Moreover, the internal combustion engines so important in powering tanks, planes, and other war machines, require large quantities of tin alloys for bearings and for soldering. These considerations, along with the fact that Malaya, historically, has been the leading source of tin to the United States, make the kind of information that Mr. Hughes has presented so ably, a matter of vital interest.

Both the San Andreas fault complex and the Murray fracture zone are apparently found to be contemporaneous with the Laramide mineralization period. Their compounding effects certainly have disturbed the Texas lineament belt and its components with serious lateral offsets and most probably have been instrumental in allowing intrusives to be emplaced as well as mineralization to accompany these intrusions at some of the fracture intersections. While the main fracture centers can be almost accepted as being structurally linked together, the Texas lineament trend definitely predominates, exerting a prevailing direction to graben (Silver Bell) and to elongated depressions (Bisbee). That this lineament belt also influenced the concomitant mineralization seems a logical inference. The orebodies are generally found at intersections near the most centrally-located intrusive with a distance varying from contiguity to one or two miles. The Southeast Arizona copper province owes its existence primarily to a particularly favorable structural setting of broad semi-continental scope. Thus, various regional structural elements are to be considered as possibly direct or remote cause for the widespread mineralization, although the one or the ones really responsible may never be singled out. There arc three basic regional elements: (1) The north-northwest-trending anticlinorium that diagonally crosses Arizona is quite obvious because many mountain ranges follow this direction. This anti- clinorium, which merges northward into the Wasatch-Jerome Belt, marks a broad zone of weakness where tension seems to prevail. Mineralized trends such as Jerome-San Manuel-Bisbee may give some weight to the economic value of this structural element. (2) Northeast-trending fractures, parallel to the Colorado Mineral Belt (Landwehr, 1967), appear troincident with mineralization as evidenced by the Questa-Grants-Morenci and the Lordsburg- Tyrone-Santa Rita alignments. This structural direction is accepted as one of the most economically significant in the Southwestern United States. (3) The Texas Lineament.

By American tradition, if not by rational decision, publicly owned natural resources have been transferred to private industry for processing. The process of transfer requires specific determination of the price which the patentee, buyer, or lessee must pay to the government in exchange for the right to develop a resource, and selection of the patentee, buyer, or lessee from among several possible contestants. Pricing of natural resources owned by the government presents a set of problems quite different from ordinary commodity pricing. Natural resources in situ are not homogeneous commodities. Within any class of natural resources, specific leasable parcels will differ in value by reason of location and accessibility, as well as quality and quantity. Thus, there is no "going price;" every lease within a specific resource class will have a different value. To complicate further the pricing and buyer selection problems, competition may not be reliable. Natural-resource markets are characterized by oligopsony conditions. In a significant number of cases, as will be shown later, there has been only one bidder for a given lease, and in most lease sales the number of bidders is equal to or less than three. As a further complication, there is great uncertainty regarding the value of specific resources, even among the best-informed buyers, as well as within the leasing agency. In some instances, particularly with regard to oil and gas resources, there may be uncertainty about the presence of resources, as well as the quantity and quality of any resources contained in the tract offered for lease. In other cases, such as oil shale and some deep ocean minerals where new technologies are involved, the presence of the resource is clearly established. There may be a relatively high degree of knowledge about the quantity and quality of the resource, but there is great uncertainty concerning the cost of production. These problems in total make it difficult for the leasing agency to appraise accurately the resource to be leased, as well as for the potential bidder to calculate a bid price that will yield him a normal profit. The pricing goal of the federal government as the seller or lessee may be to capture the economic rent; that is, the price of a resource might equal its discounted present value. A required price substantially above this amount would either generate no bids, or, in the long run, would bankrupt the buyer. A price below this amount is a disguised subsidy to the lessee. A subsidy to mineral lessees, as to any other economic interest group, as a minimum should be justified by a clear showing of net external benefits from the economic activity. In the case of timber sales by the U.S. Forest Service, the Forest Service Handbook asserts that "the aim in national forest stumpage appraisal is to determine market value,"8 and "market value" is equated to "fair market value." FOLLOWING the receipt of questionnaires from many parts of the world, the Aviation Committee is completing a review of the use of aviation in mining and petroleum operations. The summary of this study should be available at the 1937 Annual Meeting in New York City, at which time several papers will be presented on specific application of aerial geologizing. From the reports received, there is little question that this air branch of mining is here to stay. Of course, the transportation of personnel arid material continues to merit attention but it is in the division of aerial geologizing that flying is finding its widest, most technical application.

THE year 1936 has seen rehabilitation of many plants which had been closed or severely curtailed. The Steptoe smelter of the Nevada Consolidated Copper Co. has been transformed by a rearrangement of the flow of material and utilization of mechanical handling to a maximum. The Phelps Dodge Corp. reports the construction of newer and better reverberatories at the Copper Queen smelter, and of particular interest, a single high-pressure waste-heat boiler placed directly over the uptake. There has also been a complete reconstruction of the smelter at the Laurel Hill plant of the Nichols Copper Co.

DURING the year, the' Institute has made the most remarkable growth in its history. Our actual increase in membership was 1816 and therefore was 80 per cent. larger than any previous year. Even without expectation of any abnormal growth, we should pass in the year 1921 the 10;000 mark. The causes of this increased growth are not far to seek.. They lie in the widening vision of the Institute's work, not only in its relation to' the profession but as an avenue of service to the nation as a whole. The Institute is today in the first rank of influence among public institutions in the country. During this year we have, for the first time in many years, had a ?deficit of some $3000 in our finances. The sum is not important, but it- does indicate the tendency of the times, and that is the high cost of living:' The increase in our expenses lay, to the largest degree, on the publishing side of the Institute's work. If we compare the year 1918, as a fairly repre¬sentative year, with that of 1920, we find that the costs of issuing the' Institute's publications, after deducting the income received from these publications, shows a .net increase of about $33,000. for the year. This has been to some degree due to the enlarged membership but to a large degree due to the cost of the paper and printing.

HAVING had occasion while in Europe during the past summer to visit some of the foreign mints and assay offices connected with the same, I thought a brief description of the general process of coining employed, and such items connected with assaying as were new, might prove interesting to the Institute. The principal foreign mints are: the Royal Mint, London; and the mints in Paris, Brussels, Utrecht, Berlin, Vienna, Copenhagen, St. Petersburg, Stockholm, Madrid, Milan, Rome, and Constantinople. My time only permitted my visiting a few of the principal and largest given in the list, and for a description of the remainder I am indebted to the kindness of Mr. James M. Napier, who in company with the deputy master, and chemist of the Royal Mint, made a complete inspection of all the European Mints in 1870.

THE following paragraphs, constituting the concluding portion of the Annual Report of the Council for 1903, have been withheld from publication until now, in order to make them as accurate and complete as possible. They will be published in Volume XXXV. of the Transactions in their proper place at the end of the said Annual Report. Franklin Ballou was born in Pittsburg, Pa., May 29, 1845. He was the son of an old resident, Arthur Ballou, a manufacturer and wholesale dealer in vinegar. In early youth Franklin attended the Western University of Pittsburg, but left school at the age of 16 to become book-keeper for his father, upon whose retirement from business, in 1868, he associated himself with Walter C. Childs, of Pittsburg, in the manufac¬ture of furnace-grates and asbestos-cement for blast-furnaces. This firm was known as W. C. Childs & Co., and did a success¬ful business for several years. In 1869 Mr. Ballou married Miss May S. Wilson, daughter of Judge Wilson, of Lewistown, Pa. In 1876 he spent several months traveling in the West and studying the mining industry, which greatly interested him. In consequence of this journey, he wound up his business in Pittsburg and removed in 1877 to Georgetown, Colo., where for several years he conducted a sampling-works, and built up an extensive business as an agent for the sale of ores, besides engaging to some extent in mining enterprises. , It is said that he controlled at one time about one-eighth of the output of the Leadville mines. In the early 80's, he became Vice-President and General Manager of the Bimetallic Smelter at Leadville, of which Mr. David H. Moflat was the principal owner. This was practically the first successful demonstration of pyritic smelting in Colorado. Upon the sale of the works in 1897 to the American Smelting and Refining Co., Mr. Ballou retired

HE Tonopah Extension property consisted originally of three claims, with an area of 38 acres. In 1902 a shaft, now known as No. 1, was started near the eastern end of the property, close to the Tonopah Mining Co.'s boundary line, in the. andesite cap rock' which covers the ore-bearing formations in the western end of the Tonopah district. A short distance below the 60-ft. level, the orebodies pinched out, although the veins continued. This shaft has not been used since 1916. Before 1910, the production was small, coming mostly from small shoots of high-grade shipping ore. In that : year, the, company started its 30-stamp mill and cyanide plant; the mill was later enlarged to 50 stamps, with a corresponding increase in the cyanide-plant capacity, which brought the capacity of the mill up to 350 .tons per day. The total production of the mine to Oct. 1, 1920, is 871,177 tons of ore, from which was recovered 15,267,216 oz. of silver and 156,241 oz. of gold.' This makes an average recovery per ton of 17.5 oz. silver and 0.179 oz. gold. The average price received for silver since' the beginning of operations is 65.87 c. per oz., and the average value recovered from the ore-'is $15.25. The area of the property has been gradually increased by purchases and consolidations of adjoining ground until it is now 647 acres. A new shaft, known as No. 2, was started in 1912, 1600 ft. west .of No. 1, and in the following year a crosscut on the 750-ft. level of this shaft resulted in the discovery of the. Murray Vein system, from which the greatest prosperity of the mine has come. This vein, with its related veins,

William Kent, New York City: I regret that I have not had the time since the Cincinnati meeting to make as complete a study of Mr. Salom's paper as I wished. I regard it as one of the most important papers that have been presented on this subject, and worthy of complete study. I started out, on the limited time I had, on a system of study which I would recommend to any one else who has leisure to complete the investigation. I took the original report presented at the Cincinnati meeting, and selected from it' such tests as had the analyses reported along with the physical tests, giving the amounts of carbon, phosphorus, manganese, etc., taking only those in which all these elements are given.
