In Mr. Weed's interesting paper, frequent reference is made to the Cananea copper-deposits, which are said to have been so vigorously exploited that they produced 14,000,000 Ib. of copper in 1901. The ore-bodies which yielded this large quantity of metal are described as a product of contact-metamorphism, and in Mr. Weed's genetic classification of such deposits, they receive a place under the sub-heading, "Deposits impregnating and replacing beds of contact-zone."* They are considered by Mr. Weed to represent a special type under this head, and are further classified as: " l. Chalcopyrite deposits: (a) Pyrrhotite ores; (6) Magnetite ores, Cananea type." In condensing much information into a comparatively small space, the presentation of a subject may be so abbreviated as to detract from its clearness. The situation at La Cananea, considering its importance from an economic as well as scientific standpoint, may he worthy of more detailed description. As Mr. Weed rightly remarks, " structural differences are so important, and have SO marked a bearing, not alone on the theory of their genesis, hut also on the working of the deposits and a determination of their value as mines, that they merit a full discussion."† It is my present purpose: (1) to show that it is doubtful whether the copper of La Cananea is mined, except to a limited

WIENER and Bergerl reported the existence of the nitrides Fe3NiN and Fe3PtNwith a cubic L1'2 structure. The present note shows that a similar nitride Fe3PdN can be observed and that the composition range between the iron nitride Fe4N and the nitrides Fe3NiN, Fe3PdN, and Fe3PtN is occupied by single-phase cubic nitrides with structures intermediate between L1' and L1'2. The materials used in this investigation were electrolytic iron of 99.9 pct purity, carbonyl nickel of 99.7 pct purity, sponge platinum of 99.95 pct purity, and palladium sheet of 99.8 pct. purity. Binary alloys of the transition metals were induction-melted in a crucible of fused alumina, powdered, and screened to a particle size of - 200 mesh. The powders were nitrided at 600°C in a gas mixture of ammonia and hydrogen, and the crystal structure was determined with the aid of a Wilson powder camera. The results are compiled in Table I together with information from the paper of Wiener and Berger.1 The compound at the nominal composition Fe3PdN has a diffraction pattern with prominent reflections of a face-centered cubic lattice (h2 + k2+l2 = 3, 4, 8, 11, 12, 16) and weaker superstructure lines (h2 + k2 + 12 = 1, 2, 5, 6, 9, 10, 13, 14). With decreasing palladium content the superstructure lines become weaker and approach the intensity of those of Fe4N. No analysis was made of the intensities, but it can be assumed that the structure is that found by Wiener and Bergerl in Fe3NiN and Fe3PtN, namely L1'2 (perovskite structure) with both palladium and the interstitial nitrogen fully ordered. The dependence of the lattice constant upon the solute atom (Ni, Pd, Pt) content can be explained tolerably well by simple lattice expansion due to subsequent work confirms this suggestion, it will be of significance to order-disorder theory. Production engineering has continued its rapid progress during the past year. Many engineering efficiencies long practiced in other industries are being rapidly accepted by the oil industry, and every branch of development and production work is undergoing study that is reducing the time and hazard in the drilling of wells even for greater depths, is securing better service from equipment, and is obtaining greater ultimate recovery from the reservoirs. Deviation of Drill Holes Deviation of drill holes probably has attracted greater and wider study than any other subject. Until about one year ago it had been given little attention. Some California operators knew the common magnitude of deviation, but Mid-Continent operators hesitated to believe that holes could be drilled so crooked. The great emphasis and publicity given to the seriousness of the problem resulted in the design of many instruments to record the deviation by chart or photograph. Instruments which would give the direction as well as deviation were not generally favored because of the grave fears of the legal complications which might result if the bottom of a producing well should prove to be on a neighboring lease. With all the instruments available for determining deviation, the use of etching on a glass bottle by hydrofluoric acid is still the most common method employed. The beneficial result of this earnest effort to drill straighter holes is proved by a comparison of deviation of wells completed recently with those completed over a year ago. The time of this change is arbitrarily taken as Jan. 1, 1929, as at that time the operators were aware of the deviation which usually occurred, and most of them were making some effort to reduce it. The term "survival" in the title means the preservation of a society in which men are free from the political and economic restraints that characterize totalitarian systems, be they communist, socialist or facist. It means the ability to withstand the enemy's offensives in the fields of propaganda, commercial competition and, if necessary, war. The temptation to substitute "victory" for "survival" is great but a realistic appraisal of the creeping socialism and demagoguery that pervade our time indicates that we may have to be content with survival in status quo. "Mineral strength" means assurance that adequate supplies will be available to meet all the contingencies of cold and hot wars. The overall mineral position of the U. S. viewed in the light of these premises is far from secure. It is true that we are the leading producing and consuming nation of the world, but the Soviet Union is gaining and the Sino-Soviet Bloc confronts us with a sobering potential. The emergence of the Common Market in Europe as an economic and political unit places a third independent entity into the competition. Our total mineral output continues on an up- ward trend but the reverse is true in certain strategic commodities. Moreover, consumption is moving ahead faster than production so that there is increasing dependence on imports which has significant adverse geopolitical connotations. There is widespread belief that our resources can at least maintain present levels of self-sufficiency during this critical period in world history, but social dreamers, the labor monopoly, and trade and taxation policies have discouraged aggressive activity in exploration and development, and access to essential foreign sources is threatened by a variety of circumstances. Our stockpiles, belatedly built up to achieve minimum protection against shortages in time of war, are under. political attack and threatened with partial destruction on the basis of what are at best uncertain assumptions regarding the new: look of global warfare.

The large increase in the wages of mine workers makes it imperative that all factors tending to limit production per miner be eliminated, if possible. The trolley and storage-battery locomotive, mining machine, hoisting engine, mining system, etc., have increased the possible output per man. But this output is still limited by the capacity of the hoisting engine and cable and by the size of the mine car. The superiority of skip hoisting in metal mining is shown by its almost universal adoption. By varying the size of skip and the rope speed, any desired tonnage can be secured and, since frequently only one kind of material is handled and breakage is unimportant, the loading of the skips can be easily and cheaply effected from bins into which the cars are dumped. The cars may then be designed to fit the conditions in the mine instead of being a compromise between hoisting and mining conditions, very likely suiting neither. In coal mines, the usual practice has been to hoist the car to the surface, either on platform or self-dumping cages. Of late years the number of skip-hoisting plants in coal mines has been rapidly increasing, but there is more or less inertia to overcome in establishing so radical a change in practice; also the earlier skip operations were not uniformly successful. As a result, it became evident that metal-mining practice would require radical modification before skip hoisting could be successfully used in coal mining. Objections to Skip Hoisting Breakage Except where coal is used for coking, or for other purposes whcre breakage is unimportant, breakage of the coal is vitally important all the way from the face to the railroad car. The average selling price is seriously reduced when the percentage of screenings is increased. Following metal-mining practice exactly, the coal would be dumped into a deep pocket, cut off into a skip load by a measuring hopper or other means, dumped into a deep, narrow skip, and dropped into a bin at the top, all of which would contribute to excessive breakage.

A. C. RICHARDSON*—First of all, [ think that the paper represents a lot more work, study, and correlation than has been indicated by the brief talk by Mr. Price. I like the way he started out and described the areas from which the samples were obtained, the locations of the washing plants, the available tonnages, and other background information with which to evaluate the data he submitted later on. Then I like the way in which he described the various types of washing plants, the tonnages handled and the difficulties of the washing problems; showing the amount of material that lies close to the specific gravity at which the washing separation is made. Later he gave figures from washing plant operations showing recoveries and cleaning efficiencies. He then discussed his own plant at Pueblo. It is the same old plant, I think, that I worked around a good many years ago. It is unusual to find a plant treating nearly 5000 tons of coal a day on tables. But this table plant is, I believe, more efficient than is indicated by the figures that Mr. Price gave. To determine the efficiency of a cleaning operation or to compare it with another it is necessary to consider the quantity and character of the material close to the specific gravity at which the separation is made. It is not fair, I believe, to penalize the table operation by something like 4 pct of out-of-place-material as he has done here. The variety and difficulty of the coals that he has to wash, the continuous shift and change in their composition make a very difficult cleaning problem and the table performance is excellent. I believe that the information in this paper will be of interest and value to anyone operating or planning to build a coal cleaning plant in this or other areas; particularly where the cleaning of fine coal is a problem. The data may be used for comparative purposes in determining the relative efficiencies of other cleaning plant separations. E. D. HAIGLER*—What is a Baum jig? J. D. PRICE (authors' reply)—A Baum-type jig is one in which the pulsations of the water is secured by means of a pulsating air current applied on top of the water. I imagine you are all familiar with the old plunger-type jig which is in effect a U tube in which a plunger on one side of the U, moving up and down, causes a corresponding pulsation on the far side of the jig. In the Baum jig, the pulsating air current is applied on the surface of the water on one side of the U tube of the jig and gives a corresponding pulsation on the other. It is also commonly known as a pneumatic jig. The control of the rise and fall of the water in the jig body proper is under much better control than it is in any of the other type jigs. Mr. Richardson could enlarge on that feature, for I know that he has had considerable experience with these jigs. A. C. RICHARDSON—You have asked how to control a Baum-type jig. The pulsations in a Baum jig can be modified and regulated to a marked degree by the amount of water admitted to the jig and by the adjustments of the valve which regulates the manner in which air is admitted. The number of pulsations per minute is controlled by the number of cycles of the air valve. Thirty to forty cycles per minute is a good speed for large jigs treating coarse sizes of cod. With an air valve it is possible to modify the time-velocity curve of the pulsating water to some extent which in turn determines the action in a jig bed. Within limits the following parts of the air valve cycle may be regulated: (1) the rate and period of air admission, (2) the period of air expansion, (3) the rate and period of air exhaust, and (4) the period of air compression. The rate and period of air admission determines the acceleration of the water at the beginning of the pulsion stroke and the amplitude of the stroke. The period of air expansion, after inlet port is closed, is one in which the water has reached the desired velocity, positive acceleration reduced, and the bed held in a mobile condition. The rate and period of the air exhaust can be adjusted to modify the degree of suction and so modify the manner in which the particles in the bed stratify. The compression period, alter the exhaust port closes and before the intake port opens may be used to advantage in retarding the downward velocity of water during the suction stroke. An ideal jig stroke is one in which during the up stroke the bed is lifted slowly in a mass and opens up like an accordian with the bottom layers dropping away first. With the bed open and mobile the particles adjust themselves according to their hindered settling rates. During the down stroke, while the bed is still open the particles of high specific gravity are accelerated toward the bottom layers. It is possible to approach this stroke with all types of jigs but it is less difficult to approximate it with a Baum jig.

Recent experimental evidence has shown that it is often incorrect to neglect the reactions occurring at an interface with respect to the diffusion reactions. By introducing reaction-rate constants and k for the transfer of components 1 and 2 between the a and b phases, a phenomenological description has been devised for the coupled processes of diffusion and in-terfacial reaction. An illustrative example has been analyzed with the aid of a suitable computer program. The results indicate that for kab values on the order of 10'1 cm per sec and Ð values of about 10¯10 sq cm per sec, the interfacial reactions are significant during the first 10 2 to l0 6 sec of a diffusion experiment. Among the observable effects of the interfacial reactions in this case appear to be the burying Kirkendall markers and an anomaly in the initial shifting of these markers. THE study of diffusion between two phases is especially important because of its direct connection to phase transformations. For example, the transformation of austenite to ferrite involves diffusion in the a and ý phases and also an interfacial reaction (trans formation) at the a/? interface. If ferrite and aus-tenite are the two members in a diffusion couple, the same two reactions occur during the diffusion process. The numerical values obtained for the diffusion coefficients and interfacial-reaction constants from diffusion experiments can then be employed to predict phase-transformation behavior. Refinement of the calculations of phase transformation is also suggested by the present method for treating two-phase diffusion. In the recent paper by Nolfi et al.' only the solute com ponent is considered in the interfacial reaction accompanying a phase transformation. The present analysis demonstrates that both components must be considered. It is generally recognized that reactions of some kind must occur at the interface in a two-phase diffusion couple, but usually it is assumed that the interface reaction occurs so rapidly that its effect on the overall process is unobservable because the slower diffusion process determines the kinetics of the process. However, Seith and Heumann 2 pointed out that effects of the interfacial reaction should always occur in the early stages of diffusion, and recently Eifert et al. 3 have shown that interfacial reactions influence the composition and motion of the interface in a/ß Al-Cu diffusion couples during the entire course of prolonged, high-temperature treatments. A general procedure for handling the combined processes of interfacial reaction and diffusion in a binary, two-phase system is to introduce kinetic coefficients for the interface reactions and to develop the system of equations governing the interlinked processes of diffusion and interface reaction. The resulting equations, although not amenable to solution in closed form, can be usefully manipulated by a digital computer. Since the days of Newcomen and Watt, when men first sought to turn the energy of fuels to useful purposes, coal-generated steam has supplied most of the power needed for both stationary and mobile applications. The low efficiency and large water requirements of the nineteenth century steam-power plant caused many engineers to turn their thoughts toward more direct means of converting heat into power. As far back as 1791, John Barber secured an English patent on a combination' which he might well have called a "gas turbine." He proposed to generate producer gas from coal or charcoal, to burn it under pressure in air obtained from a reciprocating compressor, and to drive a turbine wheel with the resultant hot combustion products. With the optimism characteristic of the inventor, he hoped that the turbine would not only operate his compressor but also perform useful work. There is no record that Barber ever built his machine, but if he had done so he would have learned that useful power can result from such a combination only when both turbine and compressor are highly efficient and when the temperature of the gas entering the turbine is not far below 1000°F. Hot-air prime movers continued to attract attention, and both Stirling in England and Ericsson in America2 built reciprocating engines that operated with some success upon coal-heated air. The internal-combustion engine, burning liquid fuels, supplanted the hot-air type, and, for the first time, challenged the supremacy of both the steam cycle and its familiar fuel, coal. Liquid Fuels Compete with Coal As the increasing use of the automobile multiplied the demand for gasoline, the supply of residual fuel increased rapidly, and heavy oil declined in price to the point where it became competitive with coal. First in the marine field and later in stationary plants in areas adjacent to refineries, oil began to be widely used. Oil's greater convenience and higher heating value per pound of weight or per cubic foot of bunker space have caused it to take over much of the marine field. The introduction of the highly efficient diesel engine, capable of burning a fuel that is cheaper than gasoline, again threatened the position of coal, for the operating costs of the diesel became directly competitive with those of coal-burning equipment. In isolated power plants and smaller marine installations, the diesel provided the medium by which oil again successfully invaded fields formerly dominated by coal. The diesel engine, provided with an electrical transmission, found an excellent application in railroad service. Many direct processes have been proposed for the treatment of oxidized ores of copper by reducing the copper oxide to the metallic state, and by separating it from its impurities by a subsequent fusion. The radical objection common to all the methods which have come to my notice, except those in which sulphur plays the prominent part, is that the very deoxidizing agent which effects the reduction of the copper oxide, inevitably reduces at the same time a very considerable part, if not the whole, of the iron which almost invariably accompanies copper in its ores. The result is that, when the ore is subsequently fused, a very great quantity of the already reduced iron separates from the slag along with the copper, alloying with it, and necessitating costly subsequent operations for its separation. Thus, at Perm, in the Urals," the product of the fusion of ferrnginous copper oxides is a mixture of one hundred and fifty-tive parts of highly cupriferous pig iron with two hundred and fire parts of very impure and ferruginous black copper, containing Pome 10 per cent. of' carbon and iron, though free from sulphur, and of course very difficult to refine. If, in order to avoid this reduction of iron to the metallic state, the reducing action be made feebler, it inevitably results that a considerable part of the copper as well escapes deoxidation; and, consequently, the slags are so rich that it becomes necessary to treat them subsequently in order to recover the copper which they contain. Thus,. in treating native copper, at Lake Superior, where the reducing action is purposely made feeble in order to prevent the deoxidation of the iron, the slags from the first fusion of the ore carry so much copper as to render it imperative to treat them again, which is done in a cupola. And yet, in spite of so far weakening the reducing action as to cause a notable slagging of the copper, a very considerable reduction of iron actually takes place. These are the two dangers which threaten the smelter of oxidized copper ores. If he wishes to avoid slagging his copper, he must have so strong a deoxidizing action as to reduce a great deal of his

The object of the present investigation was to discover a physical basis for rank differentiation of coals, particularly the coals of the Illinois basin. Vitrainl was selected as the most appropriate coal material to use in the investigation, because of its homogeneity and ease of acquisition and handling. Previous Investigations.—Hoffman and Jenker2 have shown that their index of reflection is a characteristic of coal rank and that the Leitz slit microphotometer may be used in determining the different intensities of reflection. Zhemchuzhnikov3 measured the luster of several Russian coals with a color analyzer and found that the degree of luster was indicative of rank. Luster-volatile matter curves based on data from Sucan and Donetz coals were satisfactorily used for determining the rank or volatile content of other coals after the luster strength was determined. In 1934 Fisher4 reported refractive indices of 1.76 for bituminous vitrain and 1.87 for semibituminous vitrain. Investigation of Angle of Polarization.—Early in the present investigation several determinations of the refractive indices of the vitrains were made by immersing the minus 150 plus 200-mesh powder in oils. It was found that all the samples fell within the range 1.6 to 1.8. However, difficulty was encountered in securing oils in this high index range that were closely enough spaced to separate some of the coals. The writers made a number of determinations of the angle of maximum polarization from the polished surfaces of the vitrains and derived their refractive indices by the procedure described in the following paragraphs. Johannsen5 states the fundamental concepts underlying this procedure as follows: In general, in an isotropic medium light vibrates in all directions at right angles to the direction of propagation, and when it meets with another isotropic medium at an angle, part of the light is reflected and part refracted. A standard set of coal mining laws for the entire United States is hardly practicsble, yet the numerous variations in the state laws for almost every item seems entirely unnecessary. The same useless variations appear in almost every comparable section with no apparent reason except that no attempt has ever been made to codify them, and as they were developed over a long period of time by innumerable individuals and legislatures, the present situation is the logical outcome of lack of cooperation between states. The ventilation of a mine is affected indirectly by many provisions not listed specifically under this heading, so that it would be necessary to tabulate the major portion of all the laws to secure a complete comparable digest; therefore only a few of the more important have been set down here. This point is well illustrated in the section providing for clearance between car and rib, which is intended as a safety measure against personal injury, but is very important from the standpoint of ventilation because of choked airways in mines on two-entry system. Confusing Phraseology Misinterpretation and confusion may be expected from the phraseology alone; one state provides that the scale of the mine map shall be "not more than 100 ft. to 1 in.;'' another state demands "not less than 100 ft. to 1 in." Both probably mean the same thing and seek to prevent the operator from furnishing a map on which the workings will appear SO small that the detail is illegible. Legislation is certainly indefinite that specifies structures must be fireproof when "near" a mine opening, and just what is a "dusty" or "gaseous" mine is open to argument in most of the states. The variation in spacing crosscuts and break-throughs and the limited number of men on a split seem entirely unnecessary, as the distance is not reduced in gaseous fields, excepting in Arkansas and Tennessee, which states produce a comparatively small amount of coal, and the number of men differs 100 per cent. and more for no apparent reason.

(communication to the Secretary*):—On close examination I think it will be found that the evidence by which Mr. Corson claims to have shown the inaccuracy of a statement I made a few years ago, is far from convincing. This statement is: "Hot work as such has no influence upon the structure of the metal. Indirectly, however, by retarding crystallization until a lower temperature is reached, it may influence its structure most decidedly ; but the same results could be accomplished by heat treatment alone, i.e., by re-heating the unworked metal to the temperature from which the worked piece was allowed to cool undisturbedly." The Melallographist, vol. ii., p. 267 (under the head of "Changes of Structure Brought About by Work"). Of the two pieces of steel tested by Mr. Corson, one was worked and finished at a a cherry-red" and the other reheated to a cherry-red, and the assumption was made that in both cases the temperature was about 715' C., although no pyrometric device was used to record it. IN this survey of the progressive development of education for the mineral industries throughout the United States, the review of the history of each school has usually been completed wherever it is first mentioned, but the history of the schools in the cities of the eastern seaboard was not carried beyond 1870. It is necessary now to cover what happened during the period of approximately the last quarter of the nineteenth century in several of the schools in the east. PHILADELPHIA Of Philadelphia, it has been related in chapter 4 that the Polytechnic College of Pennsylvania began offering a curriculum leading to the B.S. in mining in 1853; that the school did not prosper, and finally closed about 1890. The establishment of a Department of Mining, Arts, and Manufactures at the University of Pennsylvania in 1855-56 was also mentioned, but its history was not carried beyond 1860. In 1859 J. Peter Lesley was appointed professor of mining in the University of Pennsylvania. The son of a cabinetmaker, born in Philadelphia Sept. 17, 1819, he had taken his A.B. degree at the University of Pennsylvania in 1838 and then secured a position on the Geological Survey of Pennsylvania under H. D. Rogers. When the Survey was discontinued, in 1841, he went to Princeton to study theology, was ordained a Presbyterian minister and followed that career until 1853, when the Pennsylvania Geological Survey was again started and he rejoined its staff. He published "A Manual of Coal and its Topography" in 1856, and studied at the École des Mines, Paris, in 1850-57. He published an 800-page "Iron Manufactures Guide" the year that he was appointed to the staff at the University of Pennsylvania. Two great discoveries of this century have diminished the dangers of fiery coal-mines,—the sifety-lamp, conceived in 1815 by Sir Humphrey Davy and successively improved by many engineers, such as Clanny, Marsaut, Mueseler, Fumat, etc., and safety-explosives, the appearance of which is comparatively recent, hut which, thanks to the persevering labors of several technical commissions (especially the French commission on explosives), and of the manufacturers and experimental users of these powders, appear likely to play, in the protection of the miner, a part as important as that of the safetylamp itself. Brit while it is true that by the use of a safety-lamp of approved form, and the exclusive employment, with all prescribed precautions, of these new explosives, complete security should be assured, even in highly fiery atmospheres, experience has shown that the imprudence of workmen, or the bad condition of a lamp, may nullify these protective means, so that it ought to be the constant care of the engineers of fiery mines to dilute the fire-damp by good ventilation so far as to maintain always and in all parts of a mine a proportion of this gas below the lower limit of explosiveness belonging to a mixture of air and methane. Good ventilation still remains the best preventive of explosions from fire-damp, and since, even with a rational and well-controlled mine-ventilation, the volumes of air traversing galleries and rooms are liable to vary within wide limits by reason of open doors, falls of rock, or other accidental causes, it follows that but a few thousandths of fire-damp should be left in the normal atmosphere of the mine-workings, so that a considerable

As developed up to the end of the Great War, an airplane was essentially a mechanism of wood and fabric, joined and held together by metal fittings and fastening. The engine and accessories, wire for wheel spokes and other tension members, and the occasional use of metal for inter-plane struts and the shafts of surface controls required some metal, but essentially it was a wood and fabric structure. Attempts had been made to use metal for other purposes, such as struts in the drag-trussing of wing panels and for short interplane struts, and Junkers had produced an airplane of iron in 1915. By 1917 he was using steel tubes and duralumin sheets, securing noteworthy advantages aerodynamically and from the standpoint of weight and upkeep. He was a pioneer along lines in which progress is still being made. Principles of Airplane Construction The loaded weight of airplanes ranges from 500 lb. for the light plane of which we heard so much a short time ago, to about 40,000 Ib. The great majority of planes range from 2000 to 10,000 Ib. Of this weight from 15 to 30 per cent. is for the dividend-earning load. This percentage is so low that every per cent. saved on the rest of the weight increases the pay load from 3 to 6 per cent,. The economic value of every pound that can be saved in designing or constructing a plane is sufficiently great to warrant spending money on refined methods of structural analysis, materials of superior strength properties for a given weight, methods of manufacture which may make possible the use of refinements in structural design, and the like, to an extent unknown heretofore. The weight of the airplane, without fuel, oil and crew, and pay load, ranges from 50 to 65 per cent. of the total weight loaded for planes suitable for commercial use. It is doubtful if the structural weight will ever be brought down to as low as 40 per cent. for commercial planes. It seems to me that uniformity of mining law in North America must of necessity start with uniformity in each country. I understand that the Provinces of Canada have the right to make their own individual laws and conditions, to prescribe the terms under which the prospector or the applicant for mineral titles may secure the same. That is not true of the states in the United States. In this country, the Federal Mining Law was made applicable to the public domain, which, at the time of the adoption of this Act in 1872, was chiefly west of the Missouri River; it is impossible to locate a mining claim in most of our eastern states. It is true, however, that there are certain holdover rights, mostly obsolete, arising from the fact that at the time of the formation of the Confederation of States, the land that belonged to each state became the property of the Federal Government. I am not quite correc-t in that, it was sometime after the adoption of our Constitution, I think it was 1778, but those rights were largely, by agreement, surrendered to the Federal Government; but it is a fact that the great acquisitions of territory in the West, with the single exception of Texas, were of domain that came into the possession of the Federal Government and our Federal Mining Law applies to that territory. No state has the right to (by legislative enactment) enlarge upon the rights given by the Federal Mining Law, governing the acquisition of mining claims in its territory, within its boundaries. Each state, however, may, and some of them do, limit somewhat the rights given to the prospector. For instance, the Federal Mining Law provides that a claim may be taken, staked upon the public domain, of 600 ft. in width and 1500 ft. in length. Some of the states, like South Dakota and Colorado, have at times said "that is an excessive amount of land for a single mining claim; we will therefore limit it to 300 ft. or 200 ft. in width." There is, therefore, not any direct and immediate need for uniformity of mining laws in the United States, such as there might possibly be if it were considered at all desirable upon the whole in Canada. The initiation of mining rights under the Federal Mining Act is the act of discovery of valuable mineral in place, referring now to the lode mining claims, but the same is true of the placer claim. A methodology was developed wherein the increase in compressive strength, mineralogical changes, and pore water composition were studied simultaneously as a function of moisturized spent shale curing time. From these results the relationship between the nature of cementation process and the composition of pore water was established. Heavy metals were entrapped in the cementing constituents and the pore water became mainly a solution of alkaline sulfates. The specific data are applicable only to the material studied. But the methodology and general conclusions are useful for evaluating the environmental factors in spent shale disposal and expected leachates composition.

The decision of the Supreme Court -of the United States not to review the findings of the lower courts closes an interesting chapter in the mining litigation that has arisen as a result of the extralateral feature of the mining law. The time seems opportune to record some of the important geological features, and also some of the legal features, of the controversy, in the hope that these will be permanently accessible to members of the mining profession. After many rumors of litigation, the Utah Consolidated Mining Co. sued its neighbor for the ore that had been, it was alleged, wrongfully extracted from its so-called Yampa limestone lode. This ore lay beneath Utah-Apex surface and was claimed by virtue of the extralatera1 rights conferred on the Utah Consolidated Co. through the ownership of certain specific mining claims, one of the principal claims being the Yampa. Previous to bringing suit, the Utah Consolidated Co. had strengthened its position by purchasing the Old Yampa mine and by making an agreement with the Utah Metal & Tunnel Co., which gave it clearer title to the outcrop of the Highland Boy limestone. Access to the workings of the Utah-Apex Co. was secured and reciprocal privileges gave Utah-Apex representatives the right to enter the properties of the Utah Consolidated Co. This resulted in the Utah-Apex immediately bringing countersuit for ore alleged to have been wrongfully extracted from under its surface in the Leadville country, see Fig. 4. Six cases came up for consideration: five related to the original suit and the countersuit, and one related to the Dana extralateral claims of the Utah-Apex Co. Well-known attorneys, geologists, and mining engineers were engaged by both sides, and thousands of feet of development work were done to prove or disprove ideas that would sustain the contentions of the opposing sides. Models of wood, wire, and glass were constructed to present clearly to the court the actual physical relations.
