The limiting activity coefficient of zinc in a "binary " solvent has been described for several dilute ternary solutions by combining literature data from recent interaction studies in the terminal regions with thermodynamic data for the central regions. Results are discussed in terms of the Alcock and Richardson random solution model. The observed behavior agrees semiquantitatively with predictions using the model. RECENT efforts in the thermodynamics of dilute ternary liquid metallic solutions have been mainly concerned with the interactions between two dilute solutes, that is, the terminal region at an apex of the composition diagram.'-' A more general case is that of the behavior of a dilute solute over the full range of a ternary system, or, more specifically, the limiting activity of solute i as projected to the k-j binary side of the i-j-k composition triangle. An implication of this is that the interaction between i and j at the k apex should connect in some way to the interaction between i and k at the j apex. A model to characterize various types of expected behavior has been discussed by Alcock and Richardson.9,10 Such behavior can range from a simple linear relation for In yi over the 1-k binary to more complex curved relations which depend on various assumptions regarding the heat of solution in the j-k binary system and the presence or absence of clustering with solute i. Quantitative data to assess these concepts have been limited primarily to the cases of nonmetallic interstitial solutes in ferrous solutions. Alcock, Richardson, and various coworkers9-13 have discussed the behavior of oxygen, sulfur, silicon, or hydrogen in dilute solution over the range of iron + metal systems; however, the only data considered by them for substitutional nonferrous metallic solutions were the results of Elliott and Chipman concerning the activity of cadmium in the Pb + Sn, Pb + Bi, and Pb + Sb systems.9 These data were limited and did not cover the terminal regions in detail. An opportunity to extend the Alcock and Richardson considerations to the dilute solution of zinc in various "binary" solvents has been afforded by combining results of several of the recent investigations of ter-minal-region interactions with previous data from the literature for the same more concentrated solutions. RESULTS AND DISCUSSION The results of the analysis are shown in Figs. 1 to 5 where the log activity coefficient, (In yZn)xzn--o, is plotted vs the composition of the "binary" solvent. In these plots the end points are the values for In yzn in the appropriate binary solution with Bi, Pb, Sn, Cd, or In at the indicated temperature—usually 550°C (823°K). For the terminal regions the slopes were drawn using the first-order interaction parameters taken from various studies reported in the literature. The data points shown in the central regions were obtained by the short extrapolation to infinite dilution of the logarithm of the activity coefficient calculated from thermodynamic studies reported in the literature for the same systems. The sources of the data are indicated on each figure. Second-order effects were not considered. Reasonably smooth curves can be drawn to connect the central region with the terminal regions for the Zn-Pb + Bi system, Fig. 1, the Zn-Pb + Zn system, Fig. 1, and the Zn-Bi + Cd and Zn-Bi + Sn systems, Fig. 2. As shown in Fig. 2, where central region data are available from two independent investigations, the agreement is quite good. Generally speaking, there is nothing very difficult about taking good microgrztphs of photogenic thin sections or grains with a petrographic microscope-camera setup. However, sometimes it is desired to show some detail that cannot be illustrated satisfactorily by the usual micrographs taken with parallel polarized light, with crossed nicols, or even with two micrographs. A simple procedure giving good results has been used at Battelle Memorial Institute for subjects falling into this classification, and it is believed to be of interest, especially to research people who must sell a point to executives through the medium of well-illustrated reports. The following problem illustrates a typical application: It is desired to photograph a thin section of an iron ore to illustrate the character and association of the iron oxides and the individual quartz crystals. A magnification of 75 dia. is acceptable. A micrograph of the field in question (Fig. Ia) was taken with parallel polarized light. Due precaution was taken to provide critical illumination, correct exposure, a sharp focus, a good darkroom technique, and other essential conditions. It illustrates correctly the iron oxides, but it fails to show the individual quartz crystals. A micrograph of the identical field (Fig. Ib) was taken under the same precise conditions, but with crossed nicols. It gives a better idea of the character of the individual quartz crystals but is likely to be misinterpreted unless accompanied by a lengthy descriptive note. This micrograph suggests that the centrally located, large black area is composed entirely of iron oxides. That this' is an incorrect interpretation is evident by reexamining the micrograph of Fig. Ia. The correct interpretation is that the dark area contains quartz crystals oriented with their optical directions parallel to, or nearly parallel to, the vibration directions of the polarizer and analyzer of the microscope. Thus, the executive, or anyone who had not done the work personally, would get no more than a fair interpretation, even if two micrographs were included; and in the interests of both brevity and clarity, one micrograph usually is more desirable. Exactly how many quartz crystals occur in this region cannot be told from the two micrographs, and a printing of the two negatives in register would likewise not show the detail desired. Thus, it is evident that some subjects cannot be satisfactorily illustrated by the usual procedures. In photographing Fig. Ic the light was subdued and, during the entire exposure of 75 sec., the analyzer nicol was rotated uniformly in its mounting from a crossed position to 45° uncrossed position to introduce the desired amount of contrast in the various individual quartz crystals. A SYMPOSIUM on current. conditions in Mexico, particularly in the oil and mining industries, was a most successful feature of the May meeting of the New York Section of the A.I.M.E. Heath Steele, vice-president of The American Metal Co.. Ltd., with an intimate knowledge of Mexico gave the principal address, and asked that his analysis of the present situation he regarded neither as an endorsement of Mexico's policy nor as the criticism of a disgruntled operator. To explain the .attitude of the great mass of the Mexican people towards recent developments, he first described briefly the political, social, and religious beliefs and customs of tile Mexican Indian. In spite of their contact with foreigners these beliefs and customs have remained unchanged throughout many generations. The old communal spirit and the idea of common ownership of the land still persist especially in the rural districts and villages; the old custom of a council for local self-government is reflected in the present-day labor committee. THE instrument for the rapid determination of carbon in steel, described in this paper, was developed originally to facilitate the opera-tion of the pilot-sized open-hearth furnace in the Jones & Laughlin Research and Development Laboratory. In this small furnace, with its shallow bath, the drop in carbon is accelerated, and a rapid, reliable test for carbon content is indispensable. This problem becomes rather acute when it is desired to finish heats at a carbon content higher than can be estimated with any degree of accuracy by the fracture test. Several independent methods for determining carbon were investigated, therefore, and it was found that a relatively simple magnetic device could be made to give reproducible results. A laboratory instrument was designed and set up for the use of the furnace operators. It was tested exhaustively in the laboratory and was used with considerable success for following the carbon content in the furnace bath. As soon as suffi-cient data had been compiled to indicate that the instrument might have a wider application, a more rugged model was constructed and placed in the mill to be tested on commercial heats. Finally, about a year ago, instruments were furnished to the plant open-hearth shops, and these have been in use since that time. As a matter of convenience, the instrument has been named the "Carbanalyzer," and will be referred to by this designation in the following pages. ?

In this paper, oxidation potentials measured in the presence of various concentrations of cyanide, ferro-cyanide, and ferricyanide and ethyl xanthate at various values of pH are related to flotation response. Eh-pH diagrams are presented to show that the formation of surface ferric ferrocyanide is probably responsible for depression when cyanide is added. The influence of cyanide on the depression of pyrite with xanthates as collector has been the subject of a number of investigations,'-6 and several theories on the mechanism of depression have evolved from these studies. Wark and Cox7 and Gaudin8 have suggested that the depressing effect is due to a competition of cyanide ion with xanthate ion for the surface. Cook and his colleagues9-11 have explained this phenomenon in terms of competition between hydrocyanic acid and xanthic acid. Sutherland 12 has shown that although both of these theories accurately describe the relation between pH value and cyanide addition at constant collector addition, they fail to describe the relation between pH value and the amount of collector required to cause flotation. Taggart 13 suggested that depression in these systems is due to the formation of a reaction product between ferric ion at the pyrite surface and ferrocyanide ion derived from solution. Majumdar4,6 has attempted to prove this hypothesis by measuring the contact angles of pyrite in the presence of 25 mg per liter ethyl xanthate and different concentrations of potassium ferrocyanide and ferricyanide. In all cases the contact angles were quite high up to pH 10. These results indicate that pyrite should not be depressed by either potassium ferrocyanide or ferricyanide. In view of these facts, Majumdar has assumed that the compound Fe(CN)2 forms at the surface. Gründer and Bornl4 have stated that depression may be due to the formation of the compound K2Fe(II)Fe(CN)6 at the pyrite-solution interface. This compound is thought to be an interaction product between the K2Fe(CN)6-2 ion from solution and the Fe++ ion at the pyrite surface and, accordingly, K4Fe(CN)6 should depress pyrite at least as effectively as KCN. This was proven experimentally, but there was no simple relation between the depression of pyrite and the concentration of either KCN or K4Fe(CN)6 in solution. In view of the many mechanisms that have been proposed for pyrite depression by cyanide, it is apparent that a clear understanding of the phenomena occurring in these systems is lacking. One reason for this may be the fact that the species responsible for pyrite flotation in the presence of xanthate is not the xan-thate ion but rather dixanthogen.15 Since the oxidation of xanthate to dixanthogen is dependent on the oxidation potential of the solution, it would seem that knowledge of these potentials would be a requisite to understanding the pyrite-xanthate-cyanide system. It is the object of this paper to measure both the oxidation potential and pH of the pyrite systems in the presence of various concentrations of cyanide, ferrocyanide, and ferricyanide and xanthate and to relate these values to flotation response. EXPERIMENTAL MATERIALS AND 'TECHNIQUES In the experiments discussed here, pure potassium ethyl xanthate was used as collector, and reagent grade potassium cyanide, potassium ferrocyanide, and potassium ferricyanide were used as depressants. Reagent grade HC1 and KOH were added for pH adjustment. Conductivity water, made by passing distilled water through an ion exchange column, was used in all experimental work. Two natural samples of pyrite were used in the investigation. Sample preparation for flotation included dry grinding with a mortar and pestle and sizing the product to 100 x 200 mesh. Prior to flotation, a 0.75-gm sample of pyrite was added to a solution containing a known amount of depressant at the desired pH value, and the system was conditioned for 4 min. Following this, a known amount of collector was added and the system was conditioned for another 4 min. A simple means of predicting the flowing well pressure history in a natural gas reservoir has been developed. The differential equation for unsteady radial flow of gases through porous media was solved by numerical methods using electronic punch card machines. The results obtained from these calculations are presented in a generalized form which is believed to be most convenient for engineering use. These results are compared with those presented in a paper by Bruce, et al4. An effective radius of drainage has been defined which permits the equation of steady state gas flow to be used easily to predict well pressures in gas reservoir depletion. An equivalent effective radius of drainage is defined for liquid flow systems and a comparison is made of the gas solution to the liquid solutions. INTRODUCTION This paper presents a numerical method for describing the transient flow of gases radially through a porous medium from which the production rate is specified. The results obtained from these calculations are presented in a generalized form which is believed to be the most convenient for engineering use. The principal application of these calculations should be to flow in natural gas reservoirs, in the interpretation of pressure drawdown tests, in the estimation of reserves, and in calculation of injection pressures required in gas injection and cycling operations. The evaluation of natural gas wells is based upon back-pressure tests in which measurements of production rate and flowing well pressure are made for periods of one, two, or more days. The flow is assumed to have stabilized at this time, and the observed values of pressure and production rate are used with standardized formulae to determine the well's allowable production rate. Furthermore, the results obtained from such a test of short time duration are extrapolated in such a manner to allow a prediction of what the well pressure will be at some future time for a specified (but possibly untested) flow rate. The manner of conducting such back-pressure tests suggests several questions as follows: 1. 'What is the definition of stabilized flow and what factors determine the length of time required for the flow to become stabilized? 2. How may the recorded values of pressure and rate be utilized? 3. As the well is produced and the reservoir pressure falls, how will the flowing well pressure change? Can this flowing well pressure be predicted from the back-pressure test? 4. Are the results obtainable from the test influenced by a particular procedure used in obtaining the results? 5. Is it possible to estimate the gross reservoir permeability from back-pressure data? It is not within the scope of this paper to provide solutions Or even to discuss adequately all the above questions. However. in considering such matters, the

High purity ZrC14 (25 to 200 ppm of metallic impurities) can be readily prepared in simple apparatus by thermal decomposition of alkali chlorozirconate fused salts at 500° to 600°C and at atmospheric pressure. Suggested phase diagrams for the systems NaCI-ZrC14 and KCI-ZrCI, are presented. ALKALI chlorozirconate compositions — anhydrous fused mixtures of ZrCl4, NaC1, and KC1— are manufactured commercially and are used by the magnesium industry to introduce zirconium into magnesium alloys. Zirconium refines the grain size and improves the physical properties of many important magnesium alloys. In the course of working with chlorozirconate compositions of high ZrCl4 content, it was noticed that these salts decomposed progressively itwaswith increasing temperature to yield considerable amounts of a ZrCl4 sublimate of high purity together with a solid chlorozirconate residue. AN investigation has been made of the multiplying factors for some of the more common alloying and deoxidizing elements for use in calculating hardenability of steel according to Grossmann's method.1 The factors for manganese, silicon, and aluminum that were reported in an earlier communication2 have been confirmed by microscopic determination of the half-martensite structure rather than on the basis of an empirically determined hardness corresponding to a half-martensite structure. Measurement of ideal critical diameter by microscopic examination was found to he necessary for other alloying elements, and multiplying factors for nickel, chromium, molybdenum, zirconium, vanadium, titanium, and boron have been determined. The nature and order of magnitude of the multiplying factors reflect the effect of the alloying elements on the structural character of the steel. Except for nickel and vanadium, the multiplying factors agree fairly well with previously published results. Good correlation between actual and calculated ideal critical diameters has been found in developing the multiplying factors and in checking the results against fairly simple steels. However, some discrepancies have suggested the need for a more thorough study of low-carbon and complex steels. TESTING PROCEDURE The investigation was conducted principally on steels made at the Union Carbide and Carbon Research Laboratories, Inc., in high-frequency induction furnaces using Armco iron and standard alloying materials. However, a few open-hearth steels were used in establishing the effect of nickel, and the hardenability factor for boron was based primarily on open-hearth steels. All bars were normalized prior to the machining of Jominy hardenability specimens. The Jominy test was carried out under conditions standard for the test.3 Austenitizing temperatures judged to-be-appropriate for the composi¬tions of the steels were used., Chemical analysis was determined on a sample taken adjacent to the Jominy specimen. Residual amounts of phosphorus, sulphur, nickel, chromium, molybdenum, and copper were determined on only one heat of each group made with the same materials during the same period. "Acid-soluble" aluminum and zirconium rather than total amounts were determined, as it is considered probable that the acid-soluble amount is more representative of the effective alloy. As tin was present to the extent of only 0.002 per cent, its effect was neglected. The conventional role of exploration, development and grade control is examined in this paper within the context of the many and varied types of gold occurrences which are found at the Dome Mine. The account endeavours to trace the development of the total ore evaluation process, from diamond drilling through the exploration and drifting stage, to the stope development and planning phase of the operation, with an emphasis on sampling techniques and assaying procedure. The concept of ore reserve calculations is developed and the practice of grade control is described. In summary, the role of the geological, the engineering and the mining department is presented in relation to the contribution each has to make in the evaluation and exploitation of ore from one of the world's classic Archean gold deposits.

The subject of the flow of homogeneous fluids—gases alone or gas-free liquids—through porous media may be considered at the present time to be fairly well completed. That is, analytical, graphical, numerical, or experimental methods are now available for obtaining detailed descriptions of the behavior of such homogeneous fluid systems of any reasonable geometry. Thus, satisfactory empirical techniques are now well established for the determination of the permeability of porous media for homogeneous fluids, the numerical magnitude of this permeability uniquely and completely describing a porous medium as a carrier of a homogeneous fluid. Considering this constant as known, the treatment of a wide variety of specific problems involving either the flow of gases or liquids has been carried through to satisfactory conclusions. Beginning with the simple case of strictly radial two-dimensional flow of a liquid or gas into a well under steady-state conditions, generalizations have been developed to apply for systems where the flow is not strictly radial, due either to a lack of uniformity in the reservoir pressures at points distant from the well or deviations from circularity of the external boundary whereby the fluid is being supplied, and finally, to the lack of complete penetration of the well into the producing strata. Satisfactory descriptions are now available for cases where gravity is acting as the driving agent inducing the flow of liquid into the well, either alone or as a supplement to the effect of pressure. The effect of acid treatment on limestone wells has been given a reasonable interpretation on the basis of the fundamental theory of the flow of homogeneous fluids through sands, as have the important features of the problem of water-coning. The increase in 1937 was clue to an increase of some 20 million gallons from Singu, 51/2 million gallons from Attack, 11/4 million gallons from Thayetmyo, and 1 mi1lien gallons from Digboi, accompanied by decrcases of 91/2 million gallons from Yenan-gyaung and 2 million gallons from Yenangyat,. The amount of gasoline produced from natural gas during the year was 10,616,313 gal. in Burma and 456,780 gal. in the Punjab. Yenangyaung Field.—The Yenangyaung field maintained its reputation of being one of the most wonderful oil fields in the world. The total production during 1937 was less than in the previous year but the resources of the field as a whole are sufficient to ensure an adequate supply of oil for many years. At the end of 1037 there were 2910 wells producing in the field. Besides a large number of ells drilled to shallow sands, this total includes 180 hand-dug wells, whose continued existenice is one of the interesting features of the field. During the year the deep drilling activities of 1936 in the southern part of the field died down, owing to the disappointing results obtained. On the eastern flank the limit of present economic extension of the oil sands was approximately demareated. Satisfactory results continue to be obtained from gas drives in the leased blocks; gas is also injected for repressuring and storage. Casing policies continue to be carefully designed to protect the oil sands against the danger of flooding by water and, in general, production methods throughout the field are characterized by a realization of the importance of the conservation of oil and gas and the prevention of waste, whether simple or underground. The roof truss as a means of secondary or supplemental mine roof support has enjoyed increasing acceptance in recent years, particularly in bituminous coal mines. In those entries where long life is required or doubtful performance from other forms of support seems likely, trusses in many cases have provided the necessary protection for continuing operations. Although relatively expensive and time-consuming in their installation, trusses, particularly with the new resin point anchor system, appear to be justifying their higher premium. It seems inevitable that techniques and equipment for installing them within the cycle will soon be developed. The actual mechanism by which trusses contribute to the stability of a roof is, as yet, poorly understood, and it may be that more than a single mechanism is involved. There are, however, a number of useful observations which can be made concerning the structural behavior of the truss itself, based solely on the mechanics of rigid and deformable bodies. The purpose of this article is to present some of these observations, particularly relating to friction in the system. A few speculations concerning the roof must, of course, be made. From a knowledge of the structural behavior, some insight into the truss-roof interaction may be gained. The concept of the truss is quite simple. As shown in [Fig. 1], it consists of two inclined chords (usually at 45') anchored in holes drilled in the roof over the ribs. A horizontal chord is formed connecting the exposed ends of the inclined chords, either with a third piece or by bending extensions of the inclined chords until they meet in the middle. A distinction can be made between active and passive chords of a truss depending upon the manner of installation. If the inclined chords are fully grouted and the horizontal chord is merely attached to them, it may reasonably be assumed that no significant forces exist in the truss until the roof begins to work. Such would be a completely passive system. On the other hand, if the inclined chords are anchored only at their upper extremities and the horizontal chord is formed in such a way that all three chords can be pretensioned to a significant portion of their tensile strengths then the truss may be regarded as fully active. Combinations of active and passive chords are also possible. * The discussion here is confined to the fully active truss such as the Birmingham steel rod system or the Galis wire rope truss. SOME time ago during a study of impact properties of tempered martensite,1 it was postulated that the consistently good ductility of tempered martensite might be caused by its relatively small and peculiarly shaped ferrite grains. The fer-rite grains of tempered martensite have approximately the same size and shape as the martensite "needles." Thus they form an interlocking mass of needle-shaped grains quite different from equiaxed or lamellar ferrite grain structures. When the common mechanical test methods are applied to steel, variations are often observed in the ductility of specimens that have closely similar hardness and tensile strength values. The ductility so measured appears to be structure dependent. When steel from the same heat has been heat treated to produce different structures with the same hardness, the elongation and reduction of area values from the tensile test and the transition temperature determined by the notched-bar impact test vary according to whether pearlite, tempered martensite, or other structural constituents were produced by the heat treatment. It has been widely recognized that tempered martensite gives a consistently good performance, when tempered to the same hardness as many other structures with which it has been compared. In recent years the isothermal transformation of austenite to specific structural products and the quantitative evaluation of the character of these products with respect to their nature and response to deformation has received considerable attention. The objective of the present study was to pursue somewhat further the dependence of ductility upon structure; specifically, it was desired to ascertain whether ferrite grain structure, including both shape and size of the grains, can account for the consistently good performance of tempered martensite in the notched-bar impact test. It was thought that a simple experiment would indicate whether the ferrite grain structure plays any part in the good ductility exhibited by tempered martensite in contrast to other steel structures with different types of ferrite grains. By determining the impact transition temperature, it was proposed to compare spheroidites having similar carbide particle size and spacing but obtained in such a manner that their ferrite grain structures would be very different. Spheroidite obtained by tempering martensite, with its small, needle-shaped grains, was to be compared with spheroidite from pearlite. If the latter is produced by sub-critical annealing, the ferrite grains correspond to the pearlite colonies. Thus, if the pearlite was not too coarse, the ferrite grains of spheroidite from pearlite are equiaxed in contrast to the needle-shaped grains of spheroidite from martensite. It was thought that the ferrite grain structure of spheroidite from martensite might depend to some extent upon the grain size of the prior austenite. The austenite grain boundaries limit the maximum attainable size of the martensite needles and thus of the ferrite grains in the derived spheroidite. In order to evaluate any possible influence of prior austehite grain size, spheroidites were to be prepared from martensites that had been formed from fine-grain austenite and also from coarsened austenite. As the carbide particle size and distribution were to be essentially alike in the various spheroidites, the difference would be in the ferrite grain size and shape. Thus any marked difference in transition temperature could be attributable to the character of the ferrite grain structure. There are certain considerations in assuming that these spheroidites would be equivalent in all respects except ferrite grain structure, and an attempt was made to take them into account. One of the considerations was the choice of the carbon content of the steel. An approximately eutectoid steel was selected for two reasons. First, the pearlitic structure would contain no proeutectoid ferrite which might complicate the picture by producing a non-uniform ferrite grain structure in the resulting spheroidite. Then, too, the high-carbon content would inhibit ferrite grain growth during the sub-critical treatment. Another factor to be taken into account was the choice of an alloying element to assure a martensitic structure throughout on quenching the impact specimens. Nickel was chosen, because it is a common alloying element and resides in the ferrite both upon its formation from austenite and throughout tempering. The formation of alloy carbides, or even a large solubility of the alloying element in cementite, would have complicated the interpretation by changing the composition of the ferrite .during spheroid-ization. The possibility of temper brittleness was minimized insofar as possible by using a tempering temperature as high as consistent with the 1 pct of nickel in the steel, namely, 1150°F. While it certainly is not claimed that no difference other than ferrite grain structure could exist between the spheroidites, nevertheless, reasonable precaution has been exercised within the limits of steel metallurgy. SILVER the whitest of all metals, has been used for thousands of years. Students of antiquity agree that silver, gold, copper, and their alloys were the first metals discovered by man and they have all played an important part throughout the advance of civilization. Native silver has been found in different parts of the world in varying form and size, such as clusters of fine wires in rock cavities, thin sheets along cleavage planes in veins of rocks, and pieces of irregular shape that vary in size from extremely small particles to masses weighing many pounds. Nearly pure silver is found in, the native state but the native metal is more likely to contain copper or gold. Some of the natural alloys closely approximate the compositions of synthetic alloys that are used in the arts at the present time. As these native silver alloys usually are malleable and ductile, it is evident that prehistoric man was provided by nature with metals that he could work, with the crude tools at his command, into simple ornaments or other articles. The relative scarcity of silver combined with its resistance to attack under ordinary atmospheric conditions have been important factors in determining the purposes for which man has used it. Its scarcity and indestructible character have made its possession particularly desirable, and from the earliest times its principal use has been as a measure of wealth and a medium of exchange. The comparatively high value of silver in relation to other commodities makes it possible to transport a large amount of wealth in small bulk, and silver has traveled back and forth over all parts of the world. There are many solution mining operations that use solar ponds as a mineral recovery step. Other locations in the world are now under investigation to recover minerals by solution mining but require the cheap energy of solar ponds to make the recovery viable. This paper shows a step-by-step material balance system that can be used in both simple and complex solar ponds. Use of this system will help the engineer determine if solar ponding efficiency can be improved or if solar ponding will work at all with a given set of conditions. Even the most complicated solar pond can be reduced to six flow streams. These are (1) feed, (2) exit, (3) leakage, (4) entrainment, (5) salts, and (6) evaporation. The equations developed in this paper will allow the solar pond engineer to easily evaluate the effect of each of the flow streams on the mineral production of a pond or pond complex.

THE Federal income tax law permits as a deduction in determining net income "in the case of mines, . . . a reasonable allowance for depletion and for depreciation of improvements, according to the, peculiar conditions in each case, based upon cost, including cost of development not otherwise deducted: Provided, that in the case of such properties acquired prior to Mar. 1, 1913, the fair market value of the property (or the taxpayer's interest therein) on that date shall be taken in lieu of cost up to that date." The law provides for a reasonable allowance but the regulations provide for a definite method of computation that possesses more the virtue of simplicity than that of reasonableness. Article 210 of Regulations 45. reads: "When the cost or value as of Mar. 1, 1913, or within 30 days after the date of discovery of the property shall have been determined, and the number of mineral units in the property as of the date of acquisition or valuation shall have been estimated, the division of the former amount by the latter figure will give the unit value for purposes of depletion, and the depletion allowance for the taxable year may be computed by multiplying such unit value by the number of units of mineral extracted during the year." This is simple, but is it reasonable? The intent of the law is clearly that the cost of the ore in the ground shall be considered as part of the cost of the same ore when removed and sold. The regulations fail to carry out that intent, because of the unwarranted assumption that all the ore in the mine cost the same amount per ton. This is what gives the Treasury Department's method its simplicity, but at the same time robs it of its reasonableness because the assumption is contrary to fact.
