Today's coal market offers many unique buying and selling opportunities. By reviewing past and present marketing practices, new contracting philosophies can be developed with cooperation between the buyer and seller that can lead to a more stable market. This paper presents an analysis of the past and present coal markets and techniques that are currently being used in contracting that are intended to develop a more stable market place in the future.

Mr. President, and Members of the Rocky Mountain Coal-Mining Institute-Gentlemen : I appreciate the distinction of addressing this representative body of men upon a subject that lies so close to the heart of each one of us, and which is one of the principal objects of our gathering here today, in this beautiful city-so beautiful, with its grand and glorious mountains looking down upon us, that its charm makes us almost forget the men we left toiling "underneath the ground." But that object-the safeguarding of our coal-miners, who spend the greater part of their lives delving in the bowels of the earth-is the cause of our gathering from the "rock-ribbed" States of Utah, Wyoming, New Mexico, and Colorado. And, as I look about me, my eye lights on the face of many an old-time friend- on some with whom I have walked for more than thirty years; so, whatever the merit of this little talk of mine, it cannot be said that it was made by a "tenderfoot." You must not for a moment think that I shall attempt the impossible task of completely covering so comprehensive a subject as '(Accidents in Coal Mines,' and take much more time than has been allotted me, or would be advisable for me to consume. So I shall confine myself, as briefly as possible, to some of the most common causes of accidents, and the possible means by which these disasters may be diminished. For a great many years the cause of mine accidents and their prevention have been the subject of grave thought and investigation by both national and state governments. As early as 1835 Great Britain appointed a royal commission of talented men, possessing special knowledge in the conduct of coal- mining, also eminent authorities in science and its application, to search into these matters. Coal mining as an occupation, is hazardous under the most, ideal conditions. Confronted with this inescapable fact, every possible emphasis is placed by the Phelps Dodge Corporation, at the Dawson mines upon the employment of every means available for safeguarding its employes from the dangers attending their vocation. Accidents have a human aspect and a direct bearing upon the well-being of the workmen themselves. They cause a loss of wages, suffering and often privation of the employe and those dependent upon him. In case of death, his children are often forced into the wage earning class without preparation to fight the battles of life, with the result that the efficiency of the next generation is lowered. Dr. Jones, formerly of the war industries board, is responsible for the following statement. "Accident prevention as it is now conducted is principally a matter of education and not merely one of protection against physical hazards as frequently believed. In fact, the last ten years experience in accident prevention has demonstrated conclusively two things: 1. That three-fourths of all deaths and serious injuries in industry can be prevented. 2. In the industries doing the most efficient work, two-thirds have been accomplished thru organization and education as against one-third accomplished by means of mechanical safeguards or equipment. Experience in the past decade has conclusively proven that the work of accident prevention is not a "one man job" that satisfactory results can be secured only thru the highest measure of co-operation between the employer and employe, and this by means of organization. The employer must be vitally interested in the work if he expects to educate his men to share the responsibility with him. The men must be given a part to perform in it, if their interest is to be aroused and maintained. It is only thru organization that this is possible. In this connection it is interesting to note the results obtained by the Old Dominion Co. of Globe, Ariz., in reducing accidents after the organization of their safety department. The O. D. Co. are pioneers in the adoption of the workmens safety committees and and the results obtained by this, company after their safety work was well organized are truly wonderful. For the years 1913 to 1916, inclusive, at which time the safety work was not well organized, there were a total of 18 fatal accidents, the years 1917 to 1920, inclusive, was a period of intensive safety work, during which time there were only three fatal accidents, none having occured during 1919.

DR. BANOWSKY: Thank you very much. That was the shortest introduction that I have had lately, and I didn't have time to get my coat on. But I appreciated it, and I'm delighted to be here with an industry with which 1 feel strong affinity. At the University of Oklahoma we have an energy history. We are a little more currently involved in oil and gas, and those of you who know the history of our state would be aware we have an early coal development back really before the turn of the century in the southeast part of our state what we call Little Dixie. How many of you have spent anytime in Oklahoma or are from the state of Oklahoma? I'm not going to ask how many are from OSU or the University of Colorado. We did send you a football coach here from Oklahoma, and 1 see you have exchanged him. Several of you were only interested in the lobby in asking about our football team this year. 1 would like to go somewhere where we can talk about something besides football. I'm just trying to build a University that our football team can be proud of. We're going to be strong again. 1 can assure you. We've got the best football team money can buy. It's not quite as bad as the college president who called the coach in and said, "Coach we're in trouble, you're losing games and the alumni is very unhappy." "What can we do?" the president asked. The coach said, "Well the football team is flunking the admissions test. We can't get them in with the standard achievement and SAT tests." The president said, "What can we do?" The coach said, "Well the coaching staff has substituted for the American College Test the simple fill in the blank questionnaire." The president said, "Let's use it. We have got to get the team in." The first question was, Old MacDonald had a (-). And a couple of the big tackles were taking it and one of them said, "Hey, what did Old MacDonald have?" His friend said, "Stupid, Old MacDonald had a farm." "Well how do you spell farm?" He said, "Stupid, e i e i 0." Now the gentleman who met me at the registration line from Lakewood, Colorado, was asking me about one of our great big tackles; and he is doing well. We call him Doctor Death; he is also a wrestler and that gentleman said, "1 don't know how bright he is." 1 said, "He is bright enough for our academic tutoring that he is going to get through all right." So I'm delighted to see you and be here with my very dear friend, Carl Terzian. Carl and 1 were in Los Angeles together for 10 or 12 years when I was president of Pepperdine University. He and I are exactly the same age. Born in 1935 and 1 a month or two later in 1936. Fewer children were born in that period than in any other period of time in this century. For those of you who remember anything about that period, you will know why no one was having babies during that period. But Carl called and said, "Bill do you know where Vail, Colorado is?" Well when you live in Oklahoma, you learn where Colorado is in a hurry. 1 not only know this beautiful area, but have made too much of an investment here at a place called Beaver Creek. The real estate is cheap over there. 1 play regularly in the Gerald Ford Invitational Golf Tournament here. Hope you will visit Beaver Creek. It's just 10- 12 miles to the west. The sight of the 1976 winter olympics until the people of Colorado voted them out. And now Vail Associates and I are good Oklahoma families. Bass family, Harry Bass of course, many of you know this story, who is chairman of the Board of Vail Associates, is making quite an investment in that year-round resort area. I am not an orator and have never said a word in public during my thirty years' experience in the coal mines of Colorado; but, being requested to speak by our worthy chairman, and as I am deeply interested in the future welfare of this organization, 1 will make an effort to say a few words in behalf of the Rocky Mountain Coal-Mining Institute, which we are about to organize. As 1 understand it, it is the object and intent of this organization not merely to assemble occasionally for the purpose of discussing various problems in coal-mining, and thus to obtain the best possible results in economic operations, but its especial duty will be to devise ways and means whereby accidents in coal mines will be minimized. Figuratively speaking. we are about to plant a tree in the State House of Colorado, and desire its roots and branches to extend over Wyoming on the north, New Mexico on the south. and Utah on the west. So we expect this tree to bear fruit over a vast area. We must remember that the planting of a tree, even in good soil, is useless unless we cultivate, prune, and nurture its development. If we will not do so, the tree will not bear the desired fruit. So, in order to make the Rocky Mountain Institute a success, we must not only start it off in good shape, but we must keep on adding to its strength in various ways, so that it will become a known factor and a recognized power over this broad territory. In other coal-mining states and countries of the world much has been accomplished through similar organizations to reduce loss of life among men engaged in the production of coal, and there is no reason why our institute in the West should not be equally useful and attain the same results. There are many ways by which this organization can be made beneficial to the men engaged, in various capacities, in handling the "dusky diamond." I will endeavor to confine my brief remarks to the necessity of a crusade of an educational nature among three classes of men that are directly and indirectly connected with coal mines. First-We need to educate ouselves. It is amazing how few of our number, holding positions of trust, and having charge of men in and around coal mines, are conversant with our brief mining laws and cognizant of our duties in enforcing them. Going down the line to our company men and miners, I think 1 can safely say that not over 5 per cent of them are in any way familiar with the statutes that have been enacted for their especial benefit and protection. This condition, 1 think, can be, and ought to be, remedied, and. if thoroughly done, the effect in reducing loss of life will soon become apparent. Now, to reach the officers or men in charge I consider an easy matter, which could be accomplished in this manner: Have our general managers or owners of coal properties issue a circular, compelling every superintendent pit boss, fire boss, or other officer having charge of men, to send them a copy of the mining law in their own handwriting every six months. But to come to the masses engaged in coal-mining. to get these men of various nationalities educated in the mining law, will be a difficult task indeed; but I think I have an original scheme that is practical, and which, if put in operation, would work wonders in educating our company men and miners. This plan is as follows: Have every school in every coal-mining district devote one-half hour on Friday afternoon after school hours to the familiarizing of all male pupils between the ages of twelve and sixteen years with the contents of our laws governing coal mines. At the end of each term of school, award small prizes- say, $5, $3, and $2- to those that are best posted, the principal of the school to be the sole adjudicator. Now, someone may say that this is causing extra work to our teachers, with no compensation. In this respect, I will vouch that 95 percent of our teachers will do this work gratis, providing we can show them the benefit of the system. If we go a step farther, and put an incentive before our teachers, probably it would be a good scheme to award a prize-say, $20 or more-for the best set of practical amendments to our mining laws complied by any school and its teachers, judges of the amendment to be members of this Institute and appointed by the President. There is no denying the fact that we need to be educated, and that we should adopt some system that will encourage a knowledge of practical and scientific mining amoung our present forces and the rising generation.
