A 9-meter-long drift was constructed in the unsaturated-fractured tuff at Yucca Mountain to evaluate the potential for water seeping into an underground opening. Forty seepage tests were performed by releasing a finite volume of water at a constant rate into short test intervals located in boreholes positioned above the drift. The seepage threshold flux, defined as the liquid-release flux at and below which water will not drip into the opening, was determined for 10 test intervals. The seepage data, observations, and model results indicate that a seepage threshold exists because a capillary barrier diverts water around the opening.

This is the seventh annual tabulation of royalty information. It is also the first year in which some data have been deleted to make room for new data. The concept of royalties evolved from a time when the government owned all of the land, including mines, to the situation where free miners won the right to claim minerals but paid a portion of their production to the royal treasury. Today, a mineral royalty is a payment to the owner of the mineral rights for the privilege of producing the mineral commodity. However, some people incorrectly believe that the selling price and the royalty are the same thing. The contract between the owner (lessor) and the mining company (lessee) is the mineral lease. Some clauses that are common to mineral leases include: identification of property, granting clause, reservations, definitions, royalty rate, taxes and title, indemnity, termination, inspection, assignability, successors, and reclamation. There often are variations in royalty rates for a given commodity that reflect differences in location, quality, market conditions or public versus private ownership. History In the time of ancient Rome, the government owned the mining properties by virtue of conquest. It would lease the mines to favored citizens who would pay rent to the State. Various conditions of sovereign ownership of both land and mineral rights continued in Europe until the Renaissance. As the laws evolved for land ownership by private citizens, the concept that minerals belonged to the State (King, Crown, sovereign) continued until about the 15th century. Free miners challenged the notion of sovereign ownership and won the right to discover and claim minerals. But a portion of their production had to be paid to the sovereign - a royalty. So, the original concept of a mineral royalty was a tax on production that was due to the Crown or Church. The term mineral royalty, as it is known today, is a payment to the owner of the mineral rights (formerly the royal owner) for the privilege of mining and producing the mineral commodity. The owner of the mineral rights, the lessor, and the mine operator, the lessee, enter into an agreement to mine the property. The agreement is the lease. While this concept is common, there are some who do not understand that the royalty is a portion of production paid to the owner as agreed on in the lease document. This author has seen reports where the selling price of a commodity has been quoted as the royalty. ("They get 70 cents a ton royalty at their pit and the guy down the road only has a 65 cent royalty.") These reports have been authored by people not familiar with the mining industry. Lease clauses In addition to the amount to be paid the lessor, there are several other items to be addressed in the lease agreement. The following list may not be all inclusive, but briefly describes most of the common clauses any good mining lease should contain. Identification: This opening clause names the owner (lessor) and the operator (lessee), the address of each, and gives the legal description of the property. Granting clause: This part of the lease gives the time period or duration of the agreement and information about renewal periods. It also has language about the exclusive right of the lessee to mine the property. Reservations: If the owner wants to exclude any portion of the property or set some specific conditions about the operation, there needs to be a clause that describes these reservations. Definitions: This section should address some of the technical terms that the lessor may find confusing - short tons versus cubic yards, dollars versus percentage of average selling price, any escalator indices such as consumer price index or producer price index, and material mined versus material sold. Royalty: This section spells out what the royalty rate will be, how often it will be paid, if there is an annual minimum, the pay dates, and how the records will be kept. This section also describes the conditions under which the lessee is exempt from the annual minimum - natural disasters, strikes, governmental actions, or other causes referred to as force majeure. Taxes and title: The lease needs to identify who is responsible for the property taxes, severance taxes (if applicable), and other taxes that relate to the mining activity - taxes on equipment, improvements, or stockpiles. This is a good place in the lease for the owner to certify his ownership of the property and its mineral rights and also certify that no other leases are in effect. The lessees may want language that allows them to pay mortgages or other debts on the property to keep their lease in effect. Indemnity: This portion of the lease identifies that the lessee assumes the risks for lessee's mining operation. Lessor should expect indemnification by the lessee through standard insur¬ance policies - workers compensation, liability and property damage. Termination: Both the lessor and lessee want language that will allow them to terminate the lease. How does SME-AIME cope with profound changes in technology, markets - and most importantly - in employment patterns facing its membership today? This is the question that prompted the Society's Board of Directors to appoint a Long-Range Planning Commission (LRPC) (see ME, Feb. 1984, pp. 118 and 128). This is also the question addressed most particularly by the LRPC's Scope Committee. The Committee started its deliberations by asking such basic questions as "Who are we?" and "What is our business?" The Scope Committee then reviewed the findings and recommendations of other more specialized committees to develop and integrate their concepts of the Society's business for the next 10 years. The policy-making suggestions of the LRPC were reviewed and acted upon by the Board of Directors at its open meeting in Los Angeles on Feb. 26, 1984. At the Oct. 23-26, 1984 SME Fall Meeting in Denver, the Board will again review LRPC recommendations. In answer to the question "Who are we?" the Scope Committee proposed description, which was accepted by vote of the board of directors: . . A technical and professional organization that consists of individual members, namely those mining engineers, metallurgists, geologists, earth scientists, economists, managers, educators, and other professionals concerned with all facets of exploration, production, distribution, and using of mineral commodities. "These mineral commodities include all metals; industrial minerals, including construction materials and fertilizers; coal, oil shales, tar sands, and other mined fuels. Among the earth's mineral resources, only wellpumped oil and gas lie outside the Society's specific purview. "Traditionally, SME members work in the fields of engineering, technology, exploration and discovery, development, construction, mining, quarrying, beneficiation and processing, handling and transport, equipment manufacturing, sales and marketing, data processing, safety, land reclamation, environmental protection, taxation, administration, and management of these elements. "Members practice their professions in industry, in universities and research institutions, and in government. They may be operators, manufacturers, sales persons, contractors, consultants, analysts, researchers, educators, advisors, regulators, or members of supporting staffs. "The members of the Society are leaders in dedication to their crafts, in innovation, and in the pursuit of excellence. Among their numbers they count the most distinguished of engineers, applied scientists, and managers. "The Society is based in the United States, is active on a worldwide basis, and is open to nationals of any country. Certain qualifications must be met for attaining and maintaining membership." Purpose of the Society As to the question "What is our business?" the Scope Committee restated our purpose in light of current practice and the constitution of AIME and the bylaws of AIME and SME. Water-swellable layered silicates, namely, the smectite clays can remove suspended materials (called herein as debris) and metal ions from aqueous streams. The present study shows that the flocculating and metal extracting abilities of smectite clay-based flocculants can be enhanced when these clays are used in conjunction with a specific anionic polymer. Such performance enhancement is attributed to the following: i) the clay-dispersing ability of the polymeric additive, that would translate into an increase in the clay-surface area available for the attachment of the debris particles onto the clay particles; ii) the possibility of dispersant-to-coagulant transition of the polymer during the later instants of the treatment process, as a result of reduction in solvency of the wastewater for the polymer due to the release of cationic species from the clay-based flocculant solids; iii) metal-complexing ability and adsorption properties of the polymer.

Many techniques that are used to characterize and monitor microbial populations associated with sulfide mineral bioleaching require the cultivation of the organisms on solid or liquid media. Chemolithotrophic species, such as Acidithiobacillus ferrooxidans and Leptospirillum ferrooxidans, or thermophilic chemolithotrophs, such as Acidianus brierleyi and Sulfolobus solfataricus can grow quite slowly, requiring weeks to complete efforts to identify and quantify these microbes associated with bioleach samples. Real-time PCR (polymerase chain reaction) assays in which DNA targets are amplified in the presence of fluorescent oligonucleotide primers, allowing the monitoring and quantification of the amplification reactions as they progress, provide a means of rapidly detecting the presence of microbial species of interest, and their relative abundance in a sample. This presentation will describe the design and use of such assays to monitor acidophilic microbes in the environment and in bioleaching operations. These assays provide results within 2-3 hours, and can detect less than 100 individual microbial cells.

What decision making tools and methods are available to a project owner when there is no clear differentiator between construction alternatives? A team led by a joint venture of Parsons Brinckerhoff and PGH Wong Engineering (PB/Wong) has been providing preliminary engineering services to the San Francisco Municipal Transportation Agency (SFMTA). The SFMTA and PB/Wong team developed several alternative construction methods for the tunnels and stations of the San Francisco Central Subway Project, none of which could be judged clearly better than another using traditional approaches and metrics. The team employed a risk assessment and analysis frame-works as a means of comparative analysis, drawing upon the knowledge of industry experts in the geotechnical, tunneling and construction fields to assist in the effort. This paper presents the approach and results of a cost and schedule risk analysis for two such analyses designed to answer two different questions regarding the advisability of different construction approaches. These assessments paved the way for key decision making in the preliminary engineering phase of the project and formed the foundation for continuing risk management efforts on the project. The focus of this paper is primarily the first two stages of risk management?identification and assessment?and some of the organizational dynamic issues that arise in such efforts.

A number of important international events took place in 2001 in the development and evolution of mineral valuation standards internationally. In Canada, the CIMVal Committee released a draft discussion paper for public and industry comment on principles to guide the development of the planned Canadian mineral property valuation standard. The International Accounting Standards Board (IASB) received comments on its Extractive Industries Issues Paper. IASB will decide whether the financial statements of public mining and petroleum companies will be allowed to provide the value of mineral and petroleum assets on a current value basis instead of an historic cost basis. The author led the Extractive Industries Task Force of the International Valuation Standards Committee (IVSC) in developing its submission to IASB. IVSC intends to develop an extractive industries valuation section for its International Valuation Standards, which could support the planned IASB standard. In Australia, AusIMM has carried out an in-depth review of its highly regarded VALMIN Code. The AusIMM's MICA subdivision organized the VALMIN ‘01 Conference in Sydney, Australia, with a range of international and current issues papers published in the VALMIN ‘01 book. Considerable support for the IVSC initiative was evident at this conference. The results of the review of the extractive industries submissions to the IASB are expected to be released in early 2002. The CMMI Congress in Cairns, Australia in May 2002 is likely to prove to be an important forum for continued discussion of the development and implementation of international standards and qualifications for mineral valuation. The outcomes and implications of these events are discussed.

INTRODUCTION King County, Washington operates a regions wastewater treatment system that provides treatment to 18 cities and 16 sewer districts in the greater Seattle metropolitan area. The system serves 1.4 million people and currently includes two regional treatment plants. In 1999, a long-range planning study identified the need for a third regional treatment plant, now known as Brightwater. Prior to this project, the county has almost exclusively used the traditional design-bid-build delivery process for its capital projects. However, with the adoption of the RWSP, the county began to study the potential application of innovative project delivery methods. This paper looks at the project delivery methods used for the Brightwater project, based on the specific needs of this large, complex, and multi-faceted project. THE KING COUNTY WASTEWATER TREATMENT SYSTEM In 1958, voters approved the formation of a regional agency called the Municipality of Metropolitan Seattle, or Metro, to build and operate a regional wastewater collection and treatment system. Prior to the formation of Metro, there were no regional wastewater treatment facilities and pollution of Lake Washington and Puget Sound from untreated sewage was a concern for many residents. In 1994, King County merged with Metro. The county’s 1,087 square kilometer (420 square miles) wastewater service area covers most of urban King County and extends into portions of two neighboring counties. The system includes two regional treatment plants, a local plant, 61 pump and regulator stations, and 571 kilometers (355 miles) of conveyance pipeline which convey wastewater from local districts to the treatment plants. As with other areas, the greater Seattle/King County region has seen rapid population growth. The RWSP estimates that the current system would soon reach capacity, and called for the construction of a new third regional treatment plant, called Brightwater, to be operational by 2010.

As one of the largest private utilities globally, E.ON currently operates hard coal fired power stations in with a total installed capacity of some 20.000 MW: These thermal power plants consume domestic coals but are increasingly dependent on imported seaborne traded coal (in 2009 approx. 17 million t). Knowing that the company’s reputation and credibility depends in part on how E.ON lives up to the responsibilities along the entire energy value chain, E.ON takes a collaborative approach with the various suppliers. Hence, E.ON’s responsible policy also applies to the procurement of coal; the utility launched in 2009 a comprehensive Corporate Responsibility program with special focus on supply-chain audits. One of the first coal audits focussed on the Cerrejón coal mine in North Eastern Colombia. The authors will share the key learning’s and experience from the Colombian audit jointly conducted with an independent auditor and E.ON experts from the Corporate CR and E.ON Energy Trading.

Specifically, the paper will cover the role of counsel in the investigative process and how best to design and conduct internal investigations to minimize the development of problematic material and disclosure of information. The paper will also address the extent of privileges that may be relied upon to protect materials and information from disclosure. These include the attorney-client privilege, the self-critical analysis privilege, and the attorney work product privilege. These privileges are qualified and understanding the limits of their coverage is essential to minimizing liability.

In the early 1990’s the British Columbia (Canada) mineral industry frequently discussed the need to participate in, and compromise with, public environmental interests in order to ascertain long-term stability. However, as the decade progressed the mineral industry withdrew from almost all meaningful public participation. As government protected areas policy in the past year has illuminated, there is a continued need for long-term land access stability. This paper historically analyses the public engagement policies of the British Columbian mineral industry while it participated in long-term consensus-based multi-stakeholder land-use planning processes. From this analysis the paper recommends that the mineral industry reengage the public and institute a new working relationship with environmental advocacy groups so as to ensure British Columbia becomes the most sustainable mineral producing jurisdiction in the world.

Carbonate-hosted massive sulfide (60%) ores of the western Cordillera compose a distinct class of deposits although they vary widely in detail and perhaps genesis. They have been important sources of lead, zinc, copper, silver, gold, and more rarely, molybdenum, tin, and tungsten in complex mineral assemblages usually dominated by pyrite. They occur as concordant stratiform bodies, as discordant mantos, and as chimneys crossing tens of meters of section; many are associated with faults and breccia bodies. Environments of formation of carbonate hosts range from craton basin to shelf with ages from Proterozoic to Cretaceous; in many instances, dating has shown mineralization to be significantly younger than hosts. Temperatures of formation determined for many deposits are high (200°-400°) and many districts are centers of igneous activity manifested by dikes, sills, and stocks. However, direct cause and effect relationships have been difficult to establish. Many important problems attend the renewed interest and study of these deposits and include questions of metal-sulfur sources, metallization processes and histories, geological controls at all scales, and relationships to broader patterns of metallogeny.

Pyrite, a mineral associated with uranium ore, is closely related to uranium leaching. In this study, Ozone micro-nano bubbles (OMNBs), as an environmentally friendly advanced oxidation technology, were used for the first time to oxidize pyrite under experimental conditions to improve the leaching rate of uranium. A laboratory-scale agitation leaching experiment of pyrite was carried out with a pH of 1.0–3.0, gas flow of 1–3 L/min, ozone generation rate of 0.55–2.22 mg/s, and pyrite concentration of 0.1–5.0 g/L for 1 h. By adding three different co-oxidant: Mn(II), Mn(IV), and Fe(III), it was found that only Mn(IV) increased the oxidation rate of pyrite by 21.7%. The results of the scanning electron microscope (SEM) and X-ray photoelectron spectroscopy (XPS) show that the formation of Fe(III)-O film on the surface of the ore suppresses the oxidation rate of pyrite to a certain extent. Pyrite can be rapidly oxidized up to 57.6% by OMNBs, which is beneficial to uranium leaching. This method is expected to be used for in situ acid leaching of uranium with OMNBs injected into the ground.

"In the 1990’s metal prices were trending in a long term decline and the usual cost cutting exercises were adopted. Cuts to research and development made innovation difficult and the outlook was grim. But necessity is a strong motivator, and these conditions spurred the Mine-to-Mill movement which optimised across organisational “silos” and utilising new technology tools, innovative software and increased computing power. Many applications of Mine-to-Mill exploited the fact that comminution is usually the site processing bottleneck, and that blasting is more efficient at breaking rock than grinding. This approach sought to: • Understand and characterise rock breakage from mining to the mill • Develop models and simulators for blast design, fragmentation, crusher and mill circuits • Develop tools to measure in real time the particle size distribution of rocks on conveyors and Run of Mine (ROM) muckpiles • Ensure effective communication across the silos between geologists, blast design engineers, mining engineers and metallurgists These methods and the technology tools available in the 1990s were widely adopted at numerous sites around the world with significant benefits. SAG mill throughput increases of 10-20% were common. This was the advance the industry desperately needed. It was low capital cost; it was obvious. It was here to stay. Except, in too many cases, it didn’t. In the minerals price boom of the 2000’s Mine-to-Mill was no longer necessary to “survive”, even though it was still good business. Some operations, including some of the early success stories, slipped back to old habits of optimising within organisation silos instead of across them. Fortunately, other operators still embraced Mine-to-Mill and developed new techniques. Mine to Mill was still successful, but it not as widely adopted as we had expected it to be.Now the boom has ended and operations are again under cost pressure. Since these are the same circumstances that created Mine-to-Mill, it seems time to achieve the wider adoption. Since the 1990s many new or advanced technology tools are available for Mine-to-Mill projects: blast-hole sensors, new explosives formulations, new blasting techniques and modelling, ore tracking devices, improved image analysis to determine size, texture and colour of coarse ore, grade sensors, whole-stream simulation tools, even more powerful computing hardware and data analysis software. If we could achieve so much in the 1990’s, how much more can we achieve today when we have the same imperative, the same potential and a larger number of high technology tools?"

Asset availability has been a longstanding objective in mining and mineral processing plants around the world. Enormous resources in both dollars and manpower are invested in improvement efforts to achieve higher asset availability. One dimension of asset availability is the time equipment is out of service for large scale planned maintenance activity: grinding mills, kilns, furnaces, mobile equipment, shovels and draglines are all regularly taken out of service for extended repairs and service. The speed, cost and quality of these planned outages provide an opportunity to increase asset availability. Equipment shutdowns are projects that are executed in a compressed time period. This paper will describe how the overall time and cost of equipment shutdowns were significantly reduced at Cliffs Natural Resources Michigan Operations (CNRMO) through the introduction of the Critical Chain Project Management techniques.

In its 2001 diesel particulate matter (DPM) rule for metal and nonmetal underground mines, MSHA established an interim concentration limit of 400 micrograms of total carbon (TC) per cubic meter of air (400TCµg/m3), and a final concentration limit of 160TCµg/m3, to be phased in over five years. Following a court challenge to the 2001 rule, MSHA, industry and organized labor reached a partial settlement of the litigation under which the agency agreed to issue a proposal to amend the 2001 rule by, among other things, changing the surrogate from TC to elemental carbon (EC), applying MSHA's traditional hierarchy of controls, and revising requirements for one-year special extensions for complying with the final DPM exposure limit. MSHA issued a final rule in 2005 converting the interim concentration limit from 400TCµg/m3 to 308 micrograms of EC per cubic meter of air (308ECµg/m3) based on a miner?s personal exposure. Pending further rulemaking, MSHA retained the final concentration limit of 160TCµg/m3. In May 2006, MSHA issued a final rule that clarified that the final limit of 160TCµg/m3 would be based on a miner?s personal exposure rather than as a concentration limit. The 2006 rule also phased in the final DPM limit in three steps over two years, beginning in May 2006 at 308ECµg/m3, followed eight months later in January 2007 with a limit of 350TCµg/m3, and finally reaching 160TCµg/m3 in May 2008. Also in the 2006 rule, MSHA committed to converting the 160TCµg/m3 limit to an EC limit in future rulemaking. This paper reviews the DPM exposure limits in the context of the MSHA rulemakings and discusses the DPM engineering controls that were utilized by mine operators to attain compliance with each progressively lower limit.

The Wyoming bentonite industry continued its run of stable, if not strong, growth in its complex markets. Growth at the macroscale was fueled by a strong domestic economy, the weakening of the U.S. dollar in the global market and strong worldwide global demand. Challenges to the benchmark of the industry were rapid and saw ongoing increases in raw material costs(pallets, bags and additives), higher energy costs and higher overall transportation costs for all modes of movement. Exports continued to be assisted by dollar depreciation (5 percent to 10 percent) from January 2004to January 2005. This depreciation followed the significant weakening of 2003. And it was most favorable during the pullback in fuel and shipping rates in the second half of the year.

In the 1990?s, Técnicas Reunidas developed the Modified ZINCEX® Process to recover zinc from ores and secondary materials. The heart of this process was the use of solvent extraction to produce purified zinc electrolyte instead of traditional zinc dust cementation. This development was commercialized by Reunion Mining and Anglo American for primary ore at the Skorpion mine in Namibia with the first SHG zinc produced in May 2003. Horsehead Corporation through Horsehead Metal Products, Inc., its wholly owned subsidiary, is presently commercializing the MZP for the treatment of Waelz oxide. This paper will review open source information about the lessons learned and process modifications that have occurred at Skorpion over the past decade. It will also provide an update on Horsehead?s facility being constructed in Rutherford County, North Carolina.

Seven legendary figures of American mining will be enshrined in the National Mining Hall of Fame in ceremonies on Saturday, Sept. 7 at the Little America Hotel in Salt Lake City, UT. The 15th annual induction banquet will begin with a reception at 6 pm, followed at 7 pm by the dinner and the program. Of the seven inductees, one is living. He is Alexander Murray (Bud) Wilson, 80, of Los Altos, CA. Wilson led Utah Construction (later Utah International) to become one of the world’s most diversified and successful mining companies in the 1960s and 1970s. It was acquired by General Electric in 1976.

The Pebble Cu-Au-Mo deposit in southwest Alaska is one of the world's largest porphyry deposits. The western part of the deposit was discovered by Cominco America in 1987, who sold the project to Northern Dynasty Minerals Ltd., in 2001. Northern Dynasty discovered the high-grade eastern part of the deposit in 2004 and went into a 50:50 partnership with Anglo American PLC in 2007, forming the Pebble Limited Partnership (Lang et al., 2008). The Pebble Limited Partnership has continued to delineate the deposit through diamond drilling with the most recent resource estimate released in February 2010 (Pebble Limited Partnership, 2010). The Pebble deposit mineral resources comprise 5.94 billion tonnes of measured and indicated resources grading 0.78% Cu EQ, containing 55 billion pounds of copper, 67 million ounces of gold and 3.3 billion pounds of molybdenum. Also delineated are 4.84 billion tonnes of inferred mineral resources grading 0.53% Cu EQ, containing 25.6 billion pounds of copper, 40.4 million ounces of gold and 2.3 billion pounds of molybdenum (Pebble Limited Partnership, 2010). Resources are calculated using a 0.3% Cu EQ cutoff. GEOLOGY AND MINERALIZATION Deposit Geology The Pebble deposit is located in the Kahiltna terrane, between terminal strands of the north-east-striking Lake Clarke strike-slip fault. This fault represents an accretionary boundary and separates the Kahiltna terrane to the north-west from the Peninsular terrane to the south-east (Lang et al., 2008). The Pebble deposit represents a large magmatic-hydrothermal system centered on a group of 90 million year old porphyritic hornblende granodiorite intrusions. An east-west cross section through the southern part of the deposit (Figure 1A) shows the typical relationships between the various rock units which host sulfide mineralization. Sub-parallel ~96 million year old granodiorite and diorite sills were intruded into siltstones of the Jura-Cretaceous Kahiltna flysch. In the west, these sills were cut by a ~96 million year old alkalic intrusive complex composed of porphyritic monzonites and monzodiorites and related intrusion breccias (Bouley et al, 1995). The mineralized 90 million year old hornblende granodiorite intrusions cut all rock types and comprise four small stocks in the western part of the deposit and a larger pluton in the eastern part of the deposit. Recent deep drilling indicates that these intrusions coalesce at depth. The strongest porphyry-style mineralization is centered on the eastern granodiorite pluton and extends into the surrounding rock units (Figure 1A). The western half of the deposit crops out at surface, whereas the eastern side is un-conformably overlain by a cover sequence of Late Cretaceous to Eocene sedimentary and volcanic strata. The deposit was tilted 20º to the east during the Eocene.
