THE Pyrometer Committee was. formed Sept. 20, 1918, at the suggestion of Dr. H. M. Howe, Chairman of the Engineering Division of the Research Council, for the purpose of developing a pyrometric method suitable for open-hearth steel practice so that the effects of temperature in the various stages of the processes of steel making might be correlated quantitatively with the other factors influencing the production of sound .steel. Water laws important to the mining industry are those which govern or affect the right to use water, to dispose of water after using it in mining or milling, and to discharge waste material into watercourses. They include statutes and court decisions having general applicability, as well as others that pertain specifically to mining. THE INDUSTRY'S CONTRIBUTION TO WESTERN WATER LAW Despite sharp differences of opinion, the water law the Spaniards brought to the Southwest appears to have included some form of appropriation of water. The Mormons, who settled in Utah in the mid-nineteenth century, also developed a system of appro-priative water titles. But by far the most profound impact on western water law was made by the gold-seekers who flocked to the Sierra Nevada foothills of California after the discovery of gold in 1848. Much of the gold was extracted from the ground by hydraulic or placer mining, and so the miners' rights to the use of water became fundamentally important. Since there was no organized government in the foothills and no laws other than those made by the miners, they helped themselves to the land, the gold, and the water needed to work their claims.1 They established and enforced regulations governing the acquirement and holding of mining claims and their rights to the water they needed.' In 1879 Justice Field, former Chief Justice of the California Supreme Court, spoke for the U. S. Supreme Court in saying that the miners were "emphatically the law-makers, as respects mining, upon the public lands in the State."" Rules of the California mining camps were based on two essential principles: 1) priority in discovering claims and appropriating water by diverting it from streams and putting it to use, and 2) diligence in working claims and applying water in mining. The customs so developed, which were copied in mining areas of other states and territories, were enacted into law in one western jurisdiction after another. They form the basis of what is called the arid-region doctrine of prior appropriation of water, which received the attention of Congress in legislation recognizing and protecting appropriations of water for mining, agriculture, and other purposes on the public domain.' In several western states a great number of water cases decided in the early years involved relative rights to the use of water for mining purposes or for milling connected with mining." The miner's inch, the customary unit for measuring water in the mining camps, is still used in various western communities, although its relation to the cubic foot per second varies from one area to another. Undoubtedly, the miners of a century ago made the major contribution to the appropriation doctrine as it is now recognized and applied throughout the West. What inspired the California gold-seekers to develop these principles? Thoughtful writers have pointed out that their regulations and customs were strikingly characteristic of much earlier mining enterprises in the Old World.D It is said that the right of free mining and free use of flowing water therefor —so similar to the California conditions and practices—-was a part of the customs of Germanic miners in the Middle Ages, that it spread from middle Europe to other countries and colonies, and that the doctrine of prior appropriation was widespread in the important mining regions of the world. Certainly the Forty-niners came to California from many countries. It does not tax the imagination to consider that they may have brought with them some knowledge of the old Germanic customs and applied this knowledge in their new environment. RIGHTS TO USE OF WATER IN GENERAL In the West, rights to the use of water of watercourses fall into two categories—appropriative and riparian. The doctrine of prior appropriation is recognized in each of the 17 western states. The riparian doctrine is recognized concurrently with the appropriation doctrine in some of these states but has been abrogated in the others. The riparian doctrine prevails generally throughout the East, although there is now considerable interest in developing something else. Generally speaking, the appropriation doctrine has been highly developed in the West, whereas the principles of riparian doctrine have been comprehensively established in only a few states throughout the country. The subject of water rights is a big one. Space permits no more than a brief discussion of aspects that bear upon the title of this article. RIGHTS OF PRIOR APPROPRIATION Fundamental to the doctrine of prior appropriation is the principle first in time, first in right. Although in some states there are statutory exceptions. the original and still generally prevailing rule is that the first one who initiates a right to divert and use water of a stream, and who completes his undertaking with reasonable diligence, acquires thereby the first right of appropriation of the specific quantity of water involved. Each succeeding right in point of time is junior to all earlier rights but senior to all later ones. The practical effect of this priority system is that when the water supply is not enough for all, the earliest rights must be fully satisfied before any water may be taken by those later in time. Acquirement of Appropriative Rights: Each of the 17 western states has a statute under which water may be appropriated pursuant to a prescribed procedure. Generally, the first step to be taken by the intending appropriator is to file application in the office of the State Engineer for a permit to make the appropriation. Between 6 and 8 million cars are shredded annually in the U.S. This shredded material is magnetically separated leaving a mixture of nonmetallics and nonferrous metals which can be further separated into its metallic and nonmetallic constituents. The metallic portion is a mixture of metalr; and alloys containing predominately zinc, and some aluminum, copper, and residual iron. Hydrometallurgical strategies are proposed for recovering the aluminum, copper, and zinc. The thermodynamic and kinetic behavior of the most promising alternatives to separation are discussed.

The co-operation of the members of the Institute is earnestly sought by the Committee on Nominations, recently appointed by the Board of Directors, in its work of formulating a ticket for officers and places falling vacant in the Board of Directors in February, 1916. The Committee must present the official ticket of nominations to the Board of Directors at its October meeting. Members are, therefore, urged to send promptly their nominations for officers and Directors in order that the Committee may have an opportunity to give them full consideration. R. F. McELVENNY.- Mr. Oldright has just given me a letter to read to you, which I think it may be of interest. It is headed, "Silver Meeting Dinner". The letter is as follows: "To Members of the A. I. M. & M E.: The annual business meeting and election of officers will take place at the University Club, Wednesday, May 28th, 1930 at 7 p.m., at the Silver Meeting Dinner. The Nominating. Committee for next year's officers have proposed the following names: Chairman, Robert Wallace; Vice-Chairman, G. W. Crane; secretary, C. T. Van Winkle, Other nominations can be made at the meeting. Utah being the leading silver producer of the United States, constructive suggestions regarding the silver situation will be made at this meeting which are new and of general interest to the members. Who is particularly interested in that subject? The type of boilers is practically a standard practice now. I do not know of anybody that is using the tandem system now. No one is building a plant with a tandem system in it.

AT the seventeenth National Metal Congress, held at Chicago, Oct. 1-3, the Iron and Steel Division and Institute of Metals Division participated with the American Society for Metals, American Welding Society, and the Wire Association in one of the most successful meetings ever held. The total attendance at the technical sessions and the scope of and interest shown in the exhibits at the Exposition were greater than at any of the "Metal Weeks" since the depression began. The Iron and Steel Division held two all-day symposia and one general session. The latter, at the International Amphitheatre, Wednesday afternoon, was the only one poorly attended. This was attributable, at least partly, to the location of the meeting roan.

The performance of the most common type of low-intensity dry magnetic separator is analyzed on the basis of fundamental physical principles. Expressions are developed for estimating the optimal choice of design and operating parameters for beneficiation of magnetite ores. By proper choice of these parameters either a high-grade concentrate or a low-grade tailing can be produced from an incompletely liberated feed.

The existence of local room-temperature plastic flow in germanium, which has been a subject of controversy for nearly two decades, has recently received renewed attention, albeit no more agreement than hitherto. Phenomenologically one major facet of the problem has been reduced to the question whether or not indentation can be effected in germanium without the introduction of cracks. That plastic flow can be induced at room temperature by fracture appears to have been rather convincingly demonstrated recently by Suzuki and Kamada and by Noble and Henisch.1 The literature contains both direct and incidental references to Vickers and Knoop indentations showing no cracks, within resolution of optical microscopy. Recently, however, following a controversy on the subject,2,3 johnson4 made a study of indentations produced by spherical indenters and concluded that these are accompanied by cracking. The role of calcium, phosphate, and fluoride species in determining the zeta potential of apatite in aqueous solutions was investigated in this study. The zeta potential of apatite was determined by streaming potential measurements over a wide range of concentrations of potassium nitrate, calcium nitrate, potassium dihydrogen phosphate, and potassium fluoride solutions at various pH values. While the addition of phosphate made the apatite surface more negative at all pH values, calcium caused a significant increase of the zeta potential only when the zeta potential was negative. Fluoride addition had only a minor effect on the zeta potential, but both negative and positive values were increased.

The death of Louis Janin, which took place Mar. 6, 1914, at Santa Barbara, terminated the earthly career of almost the last survivor, and one of the most illustrious members, of that group of American mining engineers and metallurgists who, in the last quarter of the nineteenth century, directed the development of the mineral resources of the Pacific slope. This paper analyzes the effects of geology and mining methods on surface subsidence factor, angle of draw and angle of critical deformation based on the results of 40 longwall subsidence profiles in the Northern Appalachian coalfield. Several equations were derived to show the relationships between those parameters. Furthermore, the equations were transferred and plotted in the form of several monographs for convenience of applications.

A CERTAIN amount of interest has been indicated recently in the resistance to oxidation at high temperatures of iron-aluminum alloys (rich in iron). Hautman1 published a paper in. which some interesting results are given. According to his paper, only alloys containing at least 8 per cent aluminum indicate a marked improvement in their resistance to oxidation. At about this aluminum content, however, alloys become brittle, which considerably reduces their commercial value. About two years ago the author, performed a series of experiments, the results of which are presented here. A series of iron-aluminum-carbon alloys was prepared by melting electrolytic iron, aluminum and high-carbon iron alloy in an induction vacuum furnace.2 The list of these alloys is given in Table 1. Selective flocculation studies carried out with iron ore tailings generated at Kudremukh iron ore plant indicate that a concentrate containing 63% iron can be obtained from the tailings containing 34% iron with around 60% recovery. This opens up the possibility of recovering most of the iron lost in the tailings generated at 2 kt/h (2200 stph) while processing 22 Mt (24 million st) ore per year. This would mean that the productivity could increase by around 50%. In these studies, it has been established that caustic degraded tapioca starch is a most effective agent for selective flocculation. While potato starch after caustic degradation can also be used, neither the parent starch nor the amylopectin compound is as effective.

The stabilities of finely divided mineral suspensions were determined as functions of pH and concentrations of polyethylene oxide, sodium ligninsulfonate, sodium dodecybulfate, and sodium oleate. In addition, the electrokinetic potentials of the minerals were determined under identical pH and additive concentration conditions. Flocculation or dispersion of the suspensions is discussed in terms of both the amount and manner of adsorption at the appropriate solid-liquid interface as it is influenced by additive concentration and pH.

Returning the original soil material to the surface of smoothed mine spoils is a practical means of restoring agricultural productivity. Research has established that high-sodium spoils in North Dakota: (1) must be covered with about 70 cm of soil material to achieve maximum production; (2) top-soil must be segregated and spread separately from subsoil; (3) potential production depends on the quality of the soil material returned; and (4) erosion and upward salt movement must be controlled for sustained production. Erosion is best controlled by reducing final grades as much as possible during the smoothing process followed by prompt establishment of vegetation.

This paper generalizes the results of the recent theoretical and experimental investigations on the air-pulsated jigs in Japan. The pulsating mechanism is analyzed as a special vibratory system, and the jigging mechanism as a mass system subjected to the law of hindered settling. The results of investigations on the following items are reviewed: dynamics of the pulsating mechanism; pulsation in a practical TACUB jig development of a new type of air valve; uniform pulsation in a large Baum jig; motion and mobility of bed particles; separating speed in hindered conditions; and standard deviation in practical jigs.
