"REVIEW OF ISA's DRAFT EXPLOITATION REGULATIONS – HAVE KEY STAKEHOLDERS' CONCERNS BEEN ADDRESSED ADEQUATELY?In early August 2017, the ISA published a revised draft of the exploitation regulations. My presentation will focus on the extent to which key State and Contractor issues raised in formal submissions in November 2016 have been addressed in the revised draft and any additional key issues in the revised draft which are likely to cause significant concern for Contractors.ABSTRACTFollowing the ISA's call for submissions in response to draft zero of the exploitation regulations in July 2016, 43 responses from stakeholders were received by the ISA in November 2016. My presentation will start by briefly looking at how the ISA has continued to engage with stakeholders following the publication of draft zero of the exploitation regulations, including at payment regime workshops in London (November 2016) and Singapore (April 2017) and at the environmental workshop held in Berlin in March 2017. It will also touch on the publication in February 2017 of what was in effect a very preliminary draft of the environmental regulations before moving on to consider in detail the extent to which key State and Contractor issues have been addressed in the ISA revised draft exploitation regulations which were published in August 2017. My review of the formal submissions will include, amongst other things, commentary on:(i) the level of Stakeholder response (State Parties to UNCLOS, Sponsoring States, Privately owned Contractors, State Owned Contractors and NGOs);(ii) the quality of the submissions (particularly by States and Contractors); (iii) the key concerns raised by State and Contractor stakeholders and how those issues have been addressed in the revised draft exploitation regulations; and(iv) how all stakeholders need to further engage with the ISA to ensure that the exploitation code adequately addresses the legitimate and reasonable concerns of each Stakeholder group (e.g. Contractors, Sponsoring States, Developing States and NGOs)."

"Two types of metallic deposits have been found in the deep Arctic Ocean: Hydrothermal Fe, Cu, and Zn sulfide deposits form along Gakkel Ridge in the Eurasia Basin and associated ridges between Greenland and Europe; and iron and manganese oxide crusts (Fe-Mn crusts) and nodules, precipitated from seawater onto rock surfaces in the Amerasia Basin, contain many rare metals of economic interest. Fe-Mn crusts and nodules collected in the Amerasia Basin during 2008, 2009, and 2012 cruises on the USCGC icebreaker Healy are characterized by unique mineral and chemical compositions, very high Fe/Mn ratios, fast growth rates, and other unique characteristics compared to those formed elsewhere in the global ocean. These characteristics reflect temporal and spatial variations in geological, oceanographic, and climatic conditions in the Arctic Ocean and surrounding continents over the past ~15 Myr.RESULTS AND CONCLUSIONSDiscrimination diagrams show that the crusts and nodules found in the Amerasia Basin north of Alaska are hydrogenetic. However, the mineralogy is not typical for hydrogenetic Fe-Mn crusts and nodules, which usually include only amorphous Fe oxyhydroxide and ?-MnO2 (vernadite). The Arctic samples also include the Mn oxides birnessite and 10Å manganates (todorokite, buserite, asbolane), and the Fe minerals also include goethite, lepidocrocite, feroxyhyte, and ferrihydrite. This mineralogy reflects formation under lower oxygen conditions than typical for samples formed elsewhere.The Amerasia Basin crusts have a unique chemical composition compared with crusts from other areas of the global ocean. The key difference is the high Fe contents relative to Mn contents, which determines the types of trace metals hosted by the Fe-Mn oxide phases, and their concentrations. The high Fe/Mn ratios reflect the expansive continental shelves (>50% of the Arctic Ocean) and upper slopes that support redox cycling and release of Fe and other metals to bottom waters, and to the large fluvial input from North America and Siberia. Brine formation on the shelves and currents promote the distribution of the metals throughout the Amerasia Basin, including the deep basins."

This paper describes operational environmental threshold levels for exploitation of mineral resources in the deep sea. Such criteria are needed to be able to monitor and control deep sea mining with respect to the stringent environmental requirements that are needed. It is recommended to use existing environmental threshold levels for comparable activities where such are existing. Fields of application are mainly but not exclusively seabed mining operation activities under the governance of the International Seabed Authority (ISA). The threshold levels and limits mentioned in this paper are proposed recommendations based on other activities than seabed mining but are a proven and accepted approach in other maritime industry activities. An example of such other activities with proven and accepted environmental threshold levels are Oil & Gas exploitation activities in the sea. Background The first exploitation of mineral resources is coming closer. At the moment regulations for exploitation for mineral resources in the Area are being developed by the International Seabed Authority (ISA). The ISA regulations will contain the framework related to environmental monitoring of exploitation. However, the regulations will not contain operational environmental threshold levels for the Contractor.

Nautilus Minerals (Nautilus) is following the lead of the petroleum industry as it strives to tap vast offshore resources. Planning is well underway for the Solwara 1 Project in the Bismarck Sea, Papua New Guinea (PNG) to recover high-grade seafloor massive sulphide deposits in 1600 m water depth. The deposit contains an average copper grade >10 times higher than a typical land-based porphyry copper mine. The high grades combined with a relatively small amount of overburden ensure the Solwara 1 Project will have a significantly smaller physical footprint than its land-based counterparts. Offshore minerals production also has the advantage of minimal social disturbance. Nautilus is dedicated to setting a high environmental and social responsibility standard. Nautilus recognises the importance of transparent and inclusive stakeholder engagement and has taken a proactive approach to involve as many key stakeholders as possible. One of the first steps in the permitting process in PNG is the preparation of the Environmental Inception Report, which describes the project, its envisaged impacts and the proposed studies for the Environmental Impact Assessment (EIA). Local (PNG-based) and international environmental scientists, anthropologists, NGOs and other experts were involved in the definition of studies conducted for the Solwara 1 EIA and a team of world-leading experts was involved with carrying out the studies, culminating in the preparation of the Environmental Impact Statement (EIS). To ensure transparency, collaborating researchers are free to publish their findings. Following its submission, the EIS was made available for public review and public hearings were held at several locations. The EIS has also undergone a rigorous independent review by PNG government-engaged consultants. Outside the permitting process, Nautilus works alongside government officials to carry out ongoing community consultations. Information dissemination and feedback acquisition has also occurred through the Nautilus website and attendance at a number of international conferences, workshops, and meetings. This paper will outline the leading edge approach Nautilus has taken in completing the environmental impact statement for the world?s first deep seafloor copper-gold mine. In addition, this paper will review the permitting process and the government and stakeholder engagement undertaken as part of Nautilus? desire to ?do it right? in this exciting new industry.

The chemical composition of the nodules varies with the type of manganese minerals and the size and characteristics of their nucleus, but those who have an economic interest have the following composition: Mn 29%, Fe 6% Si 5%, Al 3%, Ni 1.4%, Cu 1.3%, Co 0.25%, Na 1.5%, Ca 1.5%, Mg 0.5%, K 0.5%, Ti 0.2 0.2% and Ba 0.2% (Morgan, 2000; ISA, 2002). The Pacific Rim is an area of abundant occurrence of polymetallic nodules (Glasby et al., 1980; Morgan, 2000). According to these authors, the Pacific sea floor of the Clarion-Clipperton Zone (CCZ) is one of the most interesting areas in regard to the genesis of polymetallic nodules. Their abundance in the ocean floor is very variable, as there are places where they cover more than 70% of the ocean floor. The nodules can be found at any depth, but the highest concentrations are between 4000 and 6000m (Morgan et al., 1993). In studies conducted in the EEZ of the Mexican Pacific are those made within the project "Research on the origin, process and distribution of minerals in the Pacific ocean floor in the Exclusive Economic Zone of Mexico". Within this project Rosales (1989) conducted studies on the origin, process and distribution of polymetallic nodules, finding that a number of processes give origin to nodules, being diagenesis one of the main mechanisms of elements that contribute to the nodules. Besides hydrothermal processes that are carried near the East Pacific Rise at 21° N, inputs are contributing to the nodules metallic elements and sediments, especially in regions close to the dorsal, as a greater influence hydrogenetic processes occurs westward (Rosales and Carranza, 1990). In 1993, after cruise MIMAR II, Carranza and Rosales refer that metals such as Cu, Co, Ni, Sn, Fe, Mg, Pb, Zn and Ba may have a relationship with the East Pacific hydrothermal activity and sea currents carry these metals in solution to the Clarion-Clipperton fracture area, where there are hydrogenic metals sources (Al, Fe and Mn). As result of chemical analysis of Mn, Cu, Ni and Co, polymetallic nodules observed in part of the EEZ of Mexico are possible of potential economic interest (Rosales and Carranza, 1990, 2001; Carranza and Rosales, 2003).

The Brothers hydrothermal system is host to two very contrasting vent fields and to date, is the only known example of this kind for any submarine arc volcano in the world. Firstly, there is the NW caldera field. It is perched on the caldera walls and is up to 1,200 years old, and represents a more ?mature? system dominated by water/rock interactions, though there is also evidence for magmatic contributions to the hydrothermal fluids. It is host to relatively high temperature (~300°C), focused venting of metal-rich fluids. Large Cu- and Zn-rich sulfide chimneys occur at this site, with high concentrations (up to 90 ppm) Au apparent in some chimneys. Vent fluids of the NW caldera site show sub-seafloor phase separation is occurring at this site. Silica concentrations in these vent fluids are consistent with the vent fluid temperatures. Secondly, there is the cone vent field that is much younger, and which sits atop the summits of a main cone (the Upper cone) and an adjacent satellite cone (the Lower cone) that occur inside the caldera, near the southern caldera walls. This field is dominated by S-rich vents with vent fluids more diffuse, lower in temperature (<120°C), very gassy and acidic (to pH 1.9), and relatively metal-poor. Fluids of the cone site have Mg and SO4 concentrations higher than seawater values, indicating these ions have been added to the hydrothermal fluid and are not being depleted via normal water/rock interactions. Variability occurs between the two cone vent fields, with the diffuse discharge observed at the Upper cone volumetrically small and chemically different from the Lower cone. For example, from the vent fluid Mn, Li, Rb, and Cs concentrations, it is apparent that the Lower cone has experienced a lower degree of water/rock interaction (i.e., more reaction) than the Upper cone. Vent fluid pH is higher for Lower cone, consistent with more reaction and neutralization of acidic gases. Fe/Mn is lower at the Lower cone due to decreased Fe solubility at the higher pH. The lowest pH sample (1.9) is from the Upper cone that has 39.4 mmol/kg of SO4, consistent with input of magmatic SO2 and disproportionation to sulfuric acid and S or H2S. Thus, the Upper cone site could be interpreted to have a shorter reaction path and residence time between the point of magmatic degassing and the seafloor venting than the Lower cone site. Isotopic compositions of the NW caldera and cone vent fluids show evidence for magmatic water with negative dD and d180 values, while 3He/4He values show the Brothers hydrothermal system has shifted towards more magmatic conditions over the past several years with both sites affected by magmatic events. Similarly, vent fluid sulfide d34S values and those for sulfide minerals from NE caldera chimneys also indicate disproportionation reactions involving magmatic SO2. Minerals such as chalcopyrite, bornite, chalcocite, covelllite and euhedral grains of hematite occurring in high temperature chimneys from the NW caldera site are consistent with a more oxidizing, magmatic fluid, while bulk sulfide geochemistry data show evidence for a higher temperature suite of elements (e,g., Mo, Co, Se) associated with Cu-rich chimneys. Gold mineralization occurs in these high temperature chimneys and is associated with the most recent deposition of high concentrations of Cu, where d34S values are most negative. Geophysical evidence suggests that the top of a magma chamber occurs ~2.5 km below the caldera floor, beneath the cone site in the SSE quadrant of the volcano. Very low velocities of <1 km-2 are seen in the seismic data between the magma and the seafloor, and are indicative of gas release. Harmonic tremor data provide evidence for a 500 m pipe-like ?conduit? located above the magma chamber (and below the cone), linking it with the overlying hydrothermal system, providing a mechanism for magma-derived metals to enter the hydrothermal system under the cone site. The NW caldera and cone sites are considered to represent stages along a continuum between magmatic-hydrothermal and water/rock-dominated end-members.

Submarine hydrothermal vents and associated mineralization on the Tonga arc have been identified in the summit calderas of two shallow-water volcanoes. The highest temperature vents (up to 270°C) occur at water depths between 430 and 540 meters below sea level (mbsl) near the summit of one volcano at 24°S (volcano 19). Clusters of large barite, anhydrite, and sulfide chimneys on the summit cone are vigorously discharging clear hydrothermal fluids with temperatures on the seawater boiling curve. There is abundant evidence of phase separation and associated gold and base metal precipitates. Pyrite, marcasite, wurtzite-sphalerite, tennantite, and chalcopyrite line the interiors of the highest temperature vents. Acid-sulfate alteration of basalts and basaltic andesites is evidenced by intense silicification and the presence of abundant alunite. One volcano at 21°S (volcano 1) has a chain of explosion craters on the flank of a neovolcanic scoria cone and associated massive pyrite, barite and native sulfur deposits at a water depth of 210 mbsl. Intergrowths of pyrite and enargite are associated with intensely argillic altered basaltic andesites. The reported alteration and Au-enriched mineralization styles of these vent fields are similar to other shallow water hydrothermal systems at island arc volcanoes and contribute to the diversity of seafloor hydrothermal activity in the western Pacific region.

KIGAM (Korea Institute of Geoscience and Mineral Resources) has been doing various kinds of research works in marine minerals and energy resources exploration and utilization since early 1990s in Korea. In the presentation, the authors will introduce the recent research and development activities mainly focusing on the rare earth metals of the Pacific deep seabed Mn-nodules and gas hydrates which occur from Korean deep waters. KIGAM has been participating in the polymetallic manganese nodule exploration, mining and metal-extraction project, which is modulated by KIOST (Korea Institute of Ocean Sciences and Technology, formerly KORDI). Now KIGAM puts more focus on extracting precious and rare earth metals from the Mn-nodule as well as underlying sediments. The rare earth elements (REE) from seabed mineral deposits also draw attention to those countries including Korea which are lack in natural resources. KIGAM is doing several kinds of leaching experiments using various kinds of reagents under the different experimental parameters. Extraction of rare earth metals from deep sea nodule using H2SO4 and HCl solution showed good leaching effect. As the gas hydrates are to be evaluated as a new future energy resource globally, Korean government has initiated national R/D program covering fundamental exploration survey for resources assessment in Korean deep waters and production technology development. Nautilus Minerals is the world leader in exploration and development of deep ocean seafloor massive sulphide (SMS) resources. The company is currently focused on generating its resource pipeline in the Western Pacific and its first development project for recovery of high-grade copper, gold and silver mineralisation from its Solwara 1 site in the Bismarck Sea, Papua New Guinea. The Solwara 1 site is located at a water depth of 1,600 ? 1,800 meters. Over 150 SMS seafloor surface samples have been collected from chimney structures during dives made by remote operated vehicles (ROVs). In order to obtain an understanding of the sub-surface mineralisation, Nautilus carried out 4 drilling programs between 2006 and 2010 which allowed the calculation of a Canadian NI43-101 compliant resource estimate. The initial 2006 campaign was based on conventional offshore surface driven drill equipment. In conjunction with the subsea remote technology industry, Nautilus subsequently developed an ROV operated seafloor drill system with improved drill core recovery and efficiency. This technology was developed further with a 2010 - 2011 drill program to increase the available geological knowledge at Solwara 1 and adjacent prospects. his paper will provide an overview of Nautilus? SMS drilling requirements and recap the evolution of drilling technology and operations undertaken at Solwara 1 from 2006 to 2011. The paper will also discuss the potential of further developments in drilling techniques and equipment to increase or improve drilling depth, efficiency and data quality.

The resources and reserves calculation of marine diamond deposits should be based on a systematic sampling grid. The distribution of the sample grade results tends to be very skew and has a large variance. A bias is easily introduced due to the fact that the grade distribution of the samples is very different from the grades of the area of influence. The temptation is always there to extrapolate the highest grade samples simply to their area of influence. If this is done, the higher grade areas will be systematically overestimated, while the lower grade areas will be underestimated. Such a bias should surely be avoided by weighing the sample grades in such a way with their neighbours, so that the estimated grades have a similar distribution as the grades of the blocks. The grade distribution of small mining blocks tend to be lognormal-like. If the coefficient of variation is known, i.e. the standard deviation divided by the mean, then the grade distribution of the small mining blocks is relatively well-defined. The distribution of the diamonds within the deposits can be simulated, based on the histogram of the sample results and on the semivariogram. The diamonds tend to cluster in trapsites. From the semivariogram and the histogram, the average size and spacing between trapsites, and the grade distribution within the trapsites, can be calculated using the model of the General Family of Discrete Distributions. Using such a simulated deposit, the grade distribution for different block sizes can be obtained. The grade distributions become more lognormal-like with increasing block sizes, as the trapsite effect is reduced.

Diamond production from the reworked beach and river channel gravels along the west coasts of South Africa and Namibia is well known throughout the world, not only for the exceptional quality of the diamonds, but also for the sheer scope of the operations. To date an estimated 140 million carats have been produced from the resource worth some US$40 billion in today&apos;s money terms. It is therefore not surprising that it didn&apos;t take long before the attention turned towards the possible extension of this valuable diamond resource on similar submerged beaches in the adjacent territorial waters of South Africa and Namibia. This has proved to be a very successful move as the marine production in Namibia today constitutes 48% of that country&apos;s total diamond production. Although small scale recovery of diamonds from the sea commenced in the 1950&apos;s, the first large scale production came from the operations of the Texan entrepreneur, Sam Collins, in the 1960&apos;s. The De Beers Group, which took over Sam Collin&apos;s operations in 1969 had all the concession areas, as well as the financial and human resources to tackle the new mining frontier in the correct way by years of data gathering (ie diamond reserves and seafloor terrain studies) before commencing with large scale mining operations in the 1980&apos;s. Those who are familiar with the beach mining operations along the South African and Namibian west coasts will have appreciation for the daunting task of surgically removing the payable portion of diamond deposits from the non-payable material on the one hand, and the complex uneven fractured and gullied bed-rock floor of the deposits on the other hand. Not to mention the additional complexities of large boulders and hard calcretised diamond gravel layers (conglomerate) which are sometimes associated with the deposits. It was a natural development that the sea diamond mining operations were approached with the known information of the land operations, attempting to duplicate land mining operations in the sea, but taking cognisance of the variations of the terrain in the different areas. For instance, we encounter the following variations, and combinations, off the Namibian Coast. ? Close inshore - holocene sand cover often masks large areas of potentially diamondiferous gravels. ? Hydrogenetic Fe-Mn crusts play an important role in marine mineral-deposit research because of their widespread occurrence and high concentrations of valuable and rare metals. Most Fe-Mn crust deposits occur on the tens of thousands of seamounts found in the global ocean as well as on ridges and plateaus. Because of these circumstances, it is essential to clarify a number of outstanding issues with regard to Fe-Mn crust history and development, including controls on metal sources and concentrations. The first-order characteristics of Fe-Mn crusts as potential ore deposits include concentrations of metals (grade) and the thickness of crusts (tonnage), which vary depending on Fe-Mn crust structure and texture. Data on the structure, composition, age, and deposit characteristics will help define which factors are key for the creation of mineral accumulation and which combination of factors leads to the formation of potentially economic concentrations of metals. In this paper, we address the structure and characteristics of Fe-Mn crust stratigraphic sections collected from Central and Western Pacific seamounts. We describe the changes in mineralogical and chemical compositions of crust layers of different ages, the occurrence and regional distribution of these layers that correlate regionally, and reconstruct the paleoceanographic conditions that influenced crust growth.

From December 2004 through March of 2005 an extensive geophysical program was conducted to delineate polymetallic sulfide deposits in the Bismark Sea for a major mining concern. Deeply towed sidescan sonar, interferometric swath bathymetry, subbottom profiling, magnetic gradiometry, electrical resistivity, induced polarization. self-potential, gravimetry, water temperature/conductivity and towed video were among the methodologies tested against known occurrences of polymetallic sulfides in 1500 m -- 2200 m water depths. Known active and currently inactive sulfide areas were characterized using the various remote sensing techniques followed by survey with these same tools in other areas where they successfully discovered new prospects. Dredge sampling was used to ground truth both previously known sulfide areas and newly found deposits.

In September 2005 Williamson & Associates, Inc. delivered the BMS2 remotely operated seafloor coring system to the Japan Oil, Gas & Minerals National Corporation (JOGMEC). During acceptance trials aboard the JOGMEC research vessel R/V Hakurei Maru No. 2 the BMS2 successfully recovered 7.44 m of rock core in 3377 m water at a site near the crest of a seamount about 500 nm SE of Japan. Hydrogenous ferromanganese oxide crust, basaltic lava, sandstone and volcanic sediments were sampled with near 100% core recovery. The BMS uses rotary rod coring tools to collect samples to a maximum depth of 30 m in water depths up to 6000 m. Depending on bottom type to be sampled, the BMS tool magazine can be loaded with various drilling tools including core barrels with different bit types, drill rod and bore hole casing. The drill has 9 video cameras, a suite of sensors and 60 hydraulic functions powering thrusters, telescoping legs, seawater pumps and all of the standard drilling controls. The BMS provides deep water investigations with the functionality of conventional diamond bit rod drilling currently the mainstay of exploration programs in land mining.

"An environmental impact assessment (EIA) of a deep sea mining project typically describes the environmental baseline, impacts of the project to the environmental values, and proposed management techniques. Comprehensive EIAs also consider the impact of the mining project on existing industries, including deep sea fishing. However, few projects to date have included other industries in the EIA process in more than a cursory manner, due to the confidentiality of the process, conflicting priorities, and bureaucratic limitation. Deepsea Mining will soon become a reality with Nautilus Minerals getting their equipment ready to mine SMS at Solwara 1 off the coast of Papua New Guinea. The vertical transport system (VTS) adopted by Nautilus consists of a riser hanging ‘freely’ from the mining production vessel with a lifting pump unit suspended at its lower end. A compliant jumper connects the pump to the seabed crawler without restraining its movements. In this free-hanging VTS arrangement, the vessel can be re-positioned to follow the crawler should it want to extend the mining area and start stretching the jumper. A recently proposed alternative to this is a free-standing VTS whereby the riser is grounded on the seabed with a base and maintained in an upright position by distributed buoyancy modules or a buoyancy tank at the top. A compliant jumper connects the seabed crawler to the riser base, and another connects the riser top to the vessel. In this free-standing arrangement, the entire VTS can be lifted clear of the seabed for relocation to a new mining area. This paper will describe the important features of the two options and discuss the advantages and disadvantages in respect of riser dynamic behavior, water depth, weather and mining windows, pump maintenance, installation and retrieval, continency measures, etc. The two systems will also be appraised separately for mining SMS and SMnN deposits.

The southern shoreline of Monterey Bay, extending from Moss Landing to the Monterey Peninsula, consists of sandy beaches backed by an extensive Flandrian and pre-Flandrian dune complex. This length of shoreline, proximal to areas of urban expansion, is currently being considered for development. For this reason, it is extremely important to understand the variability of beach and dune position along this stretch of coast through time. Previous studies of southern Monterey Bay have documented relatively high erosion rates of 2-8 ft/yr due to a net deficit in the sand budget. Although the sediment transport system in this region is not well understood, estimates for the sediment deficit in southern Monterey Bay range from 200,000 to 1,500,000 yd3/yr. A possible cause of the erosional regime in the southern bay is the removal of sediment by coastal sand mining operations. Based on agency reports and mining permit applications, approximate volumes of sand removed by mining range from 300,000 to 450,000 yd3/yr. These volumes are significant when compared with estimated values for the sediment budget deficit. The sand of southern Monterey Bay, a valuable commercial resource because of its hardness, roundness, amber color and range of usable grain sizes, has been removed from the surf zone, beaches and dunes of Marina and Sand City by four companies since 1906. Information regarding the cross-shore location of sand removal and the exact amounts of sand removal through time is proprietary and poorly documented. However, records documenting the time at which each company commenced and terminated mining do exist. This information suggests that the greatest amount of sand was removed between 1950 and 1968 when three mining companies were operating concurrently.
