The ability to identify hazards during a workplace examination is a critical skill for mineworkers to have in order to maintain a safe workplace. While research suggests that being able to successfully recognize hazards requires a complex set of competencies, it is unclear which competencies are most critical to adequately perform a workplace examination. This paper presents a hazard recognition competencies framework as an explanation of the competencies that affect mineworker hazard recognition. To better understand how the industry is selecting and preparing workplace examiners, researchers fromthe National Institute for Occupational Safety and Health (NIOSH) interviewed nine health and safety (H&S) professionals at surface stone, sand, and gravel mine sites throughout the USA. A primary purpose of these interviews was to verify the competencies included in the hazard recognition competencies framework and to understand why these competencies are critical. Finally, the results of this study are presented within the context of current NIOSH research findings related to hazard recognition.

"INTRODUCTION On February 1, 1962, after five years of exploration and research, Jones & Laughlin Steel Corporation announced that they would develop the Adams Mine. Plant construction began immediately and in December of 1964 the first shipment of pellets arrived at J & L's blast furnaces in Pittsburgh. J & L continued to operate the property through its wholly owned subsidiary, Jones & Laughlin Mining Company, Ltd., until August of 1971 when it was sold to Dominion Foundries and Steel, Limited of Hamilton. Dofasco engaged Cliffs of Canada, a subsidiary of Cleveland Cliffs Iron Company, to manage the operation of the property.SUMMARY:The Adams Mine is a one million tons per year iron ore pellet operation located in the Boston Township Iron Range, approximately seven miles southeast of Kirkland Lake, Ontario. The property includes 5,300 acres in which eight areas suitable for open pit mining have been outlined. It was estimated that the reserves in these out lined areas are sufficient to produce 30 million tons of high grade iron ore pellets.The ore 'consists of fine grained magnetite with alternating layers of chert and is mined by conventional open pit methods. This extremely hard and abrasive ore averages about 20 percent magnetic iron, and has a ratio of concentration of 3. 9 /1. Presently, mining operations are confined to two pits with a third one being developed for operations to begin in 1973.The run-of-mine ore is crushed and ground and then concentrated by magnetic separation and flotation to a concentrate grade of 68 percent magnetic iron. The concentrate is agglomerated by a grate-kiln pelletizing process and shipped by rail to Dofasco's blast furnaces in Hamilton and to Jones & Laughlin's furnaces in Pittsburgh."

Mineral output and trade in the Central American countries were directly or indirectly affected by the sometimes violent civil unrest and recessionary economic developments that have pervaded the region for several years. Central American countries found their foreign exchange export earnings and traditional market areas shrinking while essential import costs were rising. Restricted spending measures were adopted by governments and private industries. Domestic investment funds for mineral development and exploration projects were among the first casualties of these austere budgetary measures, especially since weak demand and depressed mineral prices diminished the probability of a favorable cost-benefit ratio. The lack of physical security and political stability also discouraged private foreign investment. The United States Congress enacted the Caribbean Basin Economic Recovery Act of 1983 (19 U.S.C. 2702), more popularly known as the Caribbean Basin Initiative (CBI). This legislation was designed to stimulate economic recovery and promote economic development by increasing private investment and trade in the Caribbean Basin countries. The act provided for the elimination of U.S. duties on most trade items imported directly from eligible Caribbean countries, provided at least 35% of the product value originated in the region. The financial assistance components of the CBI were to be supportive of the basin's private sector as well as assist general economic stabilization programs.

A mining company has entered into contractual commitments to supply certain quantities of its product to clients in each time period. Failure to fulfil its obligations would damage its reputation as a reliable supplier. The planned production would normally be sufficient unless major problems such as highwall failures, roof falls, natural disaster, or strikes that interrupt production or delays in obtaining environmental permits, occur. To overcome these difficulties, the company may be able to obtain more of the commodity: from its strategic stockpile (if there is sufficient there); by buying it on the spot market; or for some commodities such as gold and uranium, by leasing it. Two sources of uncertainty, the spot price of the commodity and the occurrence of serious incidents that interrupt production, are considered. For simplicity it is assumed that the commodity price follows a geometric Brownian motion, that productions incidents have a binomial distribution, that they are independent from one time period to another and that they do not affect prices. A branching tree structure is used to model the joint evolution of prices and production incidents. The aim of this research project was to evaluate the companyÆs options for fulfilling its contractual commitments. When evaluating these options, multi-stage stochastic programming with recourse was used to solve this problem because in addition to providing the dollar value of the project, it gives decision-makers the æroadmapÆ to reach the optimal value. That is, how much material should be bought/sold on the spot market, how much to add to/subtract from the stockpile, how much to lease and in the worst case what the shortfall would be, for each time period as a function of the current spot price and breakdown status. A case-study over a five-year period is used to illustrate the proposed procedure. In this study the production would be sufficient to cover the companyÆs contractual commitments unless production incidents occur. Focus is on evaluating the impact of the quantity initially in the stockpile on the value of the project when the commodity market is tight, that is, when only small quantities can be bought on the spot market or by leasing.

The roasting of sulphide ores and concentrates is often the first step in the production of metals or chemicals. In many processes, the production of sulphuric acid is viewed as a by-product, whereas in some plants production is an important economic factor. Regardless of the purpose, a pyrite roasting plant consists of mainly three plant sections: roasting, gas cleaning and sulphuric acid. With the addition of air, the pyrite concentrates are transformed into solid oxides and gaseous sulphur dioxide at temperatures of 600?1000°C. After cleaning and cooling, the sulphur dioxide in the roasting gas is further processed to sulphuric acid. Two types of reactors are used depending on the application: stationary or circulating fluid bed. For over 60 years, Outotec has progressively been developing the principle of fluidized bed technology in several different reactor types for a multitude of process applications. The versatility of the fluidized bed reactor system has manifested itself in the treatment of minerals, including solid fuels, and for metallurgical processes both in the ferrous and non-ferrous fields. Process applications have included roasting, calcining, combustion and charring of coals, as well as off-gas treatment. This paper provides a summary of the pyrite roasting technology currently used along with a simple cost comparison of pyrite roasting and sulphur burning processes.

The conditions under which vanadium is rendered insoluble by silica in the alkali-roast process have been investigated starting with both slag and reagent-grade materials. The inert phase is a glass formed slowlyfrom soluble NaV03 produced at lower temperatures. It contains approximately 30 per cent V in a partly reduced state; iron is not a principal component. Some of the vanadium in the inert phase is slowly returned to a soluble form by heating in an oxidizing atmosphere below the temperature at which the glass is formed (750°C). As the reaction leading to the required, soluble form of vanadium is also slow between 600 and 750° optimization and control of the temperature profile and atmosphere in the furnace, and the residence time of the solids, are necessary to ensure high vanadium extraction during subsequent leaching.

Water is the main medium for removing impurities from iron ore during wet processing to achieve a higher quality product. However, there is a substantial increase in freshwater consumption due to an increase in demand from the following two factors: in the past 55 years the world population has doubled from 3 to 7.5 billion and crude steel production has increased five times from approximately 350 to 1662 Mt/a (IISI, 2008). Furthermore, social development in developing countries exacerbates water consumption making freshwater an increasingly valuable resource with an average distribution of 70 per cent for agriculture, 20 per cent for industry and only ten per cent for domestic consumption (Hourtolle, 2005; OECD, 2009). Rapidly changing regulations over the access and preservation of water across the world indicates the growing importance of this issue, so the mining industry must adapt to this continual change and must be committed to increasing the efficiency of water usage.Tailings dams receive most of the water used by the process plant. In arid regions where evaporation is high and availability of water low or non-existent, technical solutions other than the conventional tailings dam, such as thickened and/or filtered tailings, exist to optimise the recovery of water and reduce the need for external water consumption. However, these solutions present additional challenges, such as energy consumption and transportation from the process plant to the ultimate storage area.This paper considers a range of alternatives covering thickening and filtering, transportation and storage, water return, closure and rehabilitation. Mining projects in the future will be more affected by the rising cost in water and tighter regulations in accessing water and energy. Good tailings management can contribute significantly to reducing the dependence on these two key commodities (water and electricity), improving the resilience of iron ore projects especially in arid regions and areas with high competition for water.CITATION:Vuillier, C and A Roshdieh, A, 2017. "Electricity as a means of transmitting power was introduced in coal mines of the United States about 1891 for both haulage and coal cutting, only a few years after electrical haulage was first installed on street cars. At first, the hazards of electrical ignition ere not appreciated and the general use of open lights and black blasting powder made the possibility of electrical ignition of fire damp seem small by comparison.5 The possibility of igniting coal dust directly by electric sparks or arcs had not been considered.In the nine years prior to 1900, the progress of introducing electricity underground was slow, except that it was used for lighting shaft bottoms. Electricity had to contend with the more general use of compressed air for coal-cutting machines and, in mainline haulage, with the use of mule-teams and endless and tail-rope systems. During this period, great improvements were made in electrical apparatus, in surface installations as well as in mines. By 1900, therefore, the technique of applying electricity in mines had so far developed that it rapidly drove out the use of compressed air in coal mines because of the comparative ease of its installation and the marked economic advantages of its use over that of compressed air in practically all kinds of mining machines except percussion. rock drills.At this time, however, little thought was given to the hazard of indiscriminate use of electricity causing explosions and fires, and the possibility of electricity causing direct ignition of coal dust had not been considered. On December6, 1907, however, the Monongah, West Va. mine explosion occurred. This was the greatest mine disaster this country has over had, 361 men being killed. Although: there was much diversity of opinion, as to the origin of the explosion, many well-informed engineers concluded that the cause was ignition of coal dust do to wreckage of a runaway trip in a rope haulage entrance slope. This slope also served as a ventilating and it extended from the level of the coal bed to the surface. The runaway trip tore down electric cables and stirred up a cloud of dust when it was wrecked at the bottom of the slope. The dust was probably ignited by the electric arcing that occurred when the wires were knocked down. (Another but less probable source of ignition was the open flames of miners lamps.) From the foot of the slops the explosion appeared to have travelled into the mine, spreading as it went. If this ignition of coal dust was the origin of the explosion, it occurred on pure intake air entering directly from the surface."

U.S. Bureau of Mines personnel examined mines, prospects, and mineralized areas to determine the mineral resources and potential of the Moses and Dennison Peak RARE II areas in Tulare County, California. These areas, along the west slope of the Sierra Nevada, are underlain by grarnitic rocks of the Sierra Nevada batholith and contain numerous metasedimentary roof pendants. Silver, copper, and zinc occur in contact-metasomatic deposits within the metasedimentary rocks. In the Moses area, the Powell Mine (fig. 1) contains an estimated 90,000 tons (82,000 t) of subeconomic silver, zinc, and copper resources. The King Solomon Prospect has 3,000 tons (2,700 t) of silicified phyllite containing zinc. On the Helen-Joyce Prospect, 44,000 tons (40,000 t) of gossan occur above a poorly exposed silver-zinc rich zone. Potential exists for additional mineral resources and occurrences at each of these properties.

There are tens of thousands of inactive mine features in 274 mining districts in New Mexico (including coal, uranium, metals, and industrial minerals districts). However, many of these mines have not been inventoried or prioritized for reclamation. Many of these mines have existing mine wastes, generated during mineral production, which could have potential for critical minerals, especially since the actual mineral production was generally for precious and base metals and not critical minerals. The purpose of this project is to characterize and estimate the critical mineral endowment of mine wastes and “beta-test” USGS sampling procedures. This project is important to the state of New Mexico because critical mineral resources must be identified before land exchanges, withdrawals or other land use decisions are made by government officials. Future mining of mine wastes that potentially contain critical minerals will directly benefit the economy of New Mexico. Possible re-mining of mine wastes could clean up these sites and pay for reclamation. Furthermore, this project will include training of younger, professional geologists and students in economic and reclamation geology by the PIs.

INFACON conjures up many things for many people. For the fortunate few who have been actively involved with this event since its inception, it brings back memories of far places, stimulating debates and above all, the people who have over the years contributed to the outstanding success of the Congress and who have added to the wealth of knowledge on all aspects of ferroalloys. The International Ferroalloy Congress (INFACON) has been held every three years since 1974. INFACON X will be held in Cape Town in February 2004. Simple arithmetic shows that next year?s Congress should in fact be INFACON XI. Thus, one Congress was skipped. INFACON 74, as the name implies, was held in 1974, in Johannesburg, South Africa. The event was sponsored by the Ferro Alloy Producers? Association of South Africa (FAPA), the National Institute for Metallurgy (NIM - Mintek as it is known today) and the South African Institute of Mining and Metallurgy (SAIMM). You will see some of the same sponsors involved in INFACON X. Dr. Robbie Robinson, renowned academic and past president of the SAIMM, was the Chairman of the Organising Committee. The editor was Dr. Helen Glen. Anyone fortunate enough to possess a copy of the proceedings of this first Congress will agree that from a literary and technical perspective, it is still the benchmark for subsequent events. A unique feature of INFACON 74 was the use of rapporteurs (my first duty) to ensure that the discussions following the presentations were recorded (in direct speech) as accurately as possible. This involved time-consuming correspondence (can you imagine life before e-mail?) to all parts of the world between the author and the person posing the question, with the rapporteurs acting as go-betweens. It is understandable that the much-awaited proceedings only saw the light in 1975. The names recorded in the proceedings as the members of all six committees read like the who?s-who of the South African ferroalloy industry at the time: Dr. Peter Jochens, Mr. Harvey Reid, Mr. Piet Streicher, Prof David Howat, Mr. Sigurd Selmer-Olsen - to name but a few. The Congress was held in the new, very fashionable and upmarket Carlton Hotel in the CBD. In the Foreword of the proceedings, Dr. Robinson provides an insight into the event. Three hundred and thirty six delegates from twenty two countries attended the Congress, which was opened by the Honourable P.G.J. Koornhof, Minister of Mines. Again, the opening address makes fascinating reading. During the Congress an ad hoc committee was convened as the first International Committee on the Organisation of Ferroalloys Congresses, with representation from the main ferroalloy associations of the world. The following decisions were recorded: ? The Congress would be continued at three-yearly intervals under the name of INFACON ? Every third Congress would be held in South Africa ? NIM (Mintek) would provide the permanent secretariat. Six technical sessions were held, each preceded by a plenary address with a closing address by the session chairman. In all, thirty technical papers were presented. Prior to the closing address, a panel discussion on factors affecting the future of the ferrochromium industry provided stimulating debate in the form of a question-and-answer session. The hosting country for the next INFACON would be announced. Eventually, word got round that the next INFACON would be held in Japan. However, due to unforeseen circumstances, the event was cancelled ? thus no INFACON 77. INFACON 80 was subsequently held in Lausanne, Switzerland from 12th to 16th October 1980. The event was organised by IFPEO, Institut des Producteurs de Ferro-Alliages d?Europe Occidentale. The Congress was officially opened by the President of IPFEO, Mr. R. Björklund, who was also President of the Organising Committee. The technical sessions were held in the Palais de Beaulieu. The Congress was well attended by 400 participants from 28 countries as well as 100 accompanying ladies. A total of four plenary addresses and 18 technical papers were presented. As with the first event, an international panel discussion (questions and answers) preceded the closing address. In his closing address, Dr. Louw Alberts, Chairman of the International Committee on Ferroalloys and President of NIM, presented an insight into the factors affecting growth in the industry and where growth was likely to take place. Twelve exhibitors had stands at the Congress. Attendees could choose from four post-event tours to Belguim/France (SADACEM/Compagnie Universelle d?Acetylene et d?Electro-Metallurgie), France (CUAEM), Finland (Outokumpu Oy) and Norway (Elkem Fiskaa plant).

The proposed Second Avenue Subway is a new two-track subway line running from 125th Street and Park Avenue at the north, east along 125th Street to Second Avenue and south along Second Avenue to the Financial District in lower Manhattan, NY with 16 new stations and 13.6 km (8.5 miles) of track. The project has been broken into four construction phases. The initial Phase 1 operating segment includes three new stations (96th, 86th and 72nd Street stations) with a connection to the existing Broadway line at the 63rd Street Station at Lexington Avenue. Rehabilitation of the 63rd Street Station is also included in the scope of Phase 1. Subsequent phases extend service north and west to 125th Street (Phase 2), south to Houston Street (Phase 3) and finally to Hanover Square (Phase 4). The DMJM Harris/Arup Joint Venture (DHAJV) prepared the Contract Documents MTA for Phase 1. Parsons Brinckerhoff is providing the MTA with construction inspection services for Contract C-26002. In April 2007, NYCT awarded first Phase 1 for $337 million to S3 Tunnel Constructors, a tri-venture comprised of Skanska USA Civil, Schiavone and Shea. Contract C26002 is for the construction of the tunnel boring ma-chine (TBM) launch box and the mining of the TBM tunnels from 92nd Street to 63rd Street. The major part of the contract is to construct a shaft, commonly referred to as the launch box, from East 92nd Street to East 95th Street having dimensions of 244-m- (800-ft-) long by 18.9-m- (62-ft-) wide and a depth of 19.8 m (65 ft), including more than 91,000 m3 (119,000 cu yd) of soil and rock contained within its walls. The launch box will ultimately become the southern half of the 96th Street Station. The focus here is geological conditions at the launch box and existing structures along the launch box. These geologic conditions and existing structures had a major influence on the selection and design of the support of excavation system (SOE), the SOE bracing system, construction staging, the ground movements, dewatering and other challenges of constructing the launch box (Fig. 1).

PotashCorp?s Aurora phosphate mine, in Beaufort County, NC, operates four low pressure boilers and four high pressure boilers to meet its process steam requirements. Maintaining these boilers is critical to meeting production demands. Processing phosphate ore into phosphoric acid requires large amounts of sulfuric acid and steam. Ore is mined from the phosphate deposit with large bucket excavators after 9 to 30 m (30 to 100 ft) of overburden is removed. The phosphate ore is mixed with water to make a slurry that is pumped to the mill. Elemental sulfur is burned in the presence of air to make sulfuric acid. This process is highly exothermic and boilers produce steam while cooling the process. The phosphate ore is reacted with sulfuric acid and the resulting products are refined into different grades of phosphoric acid for fertilizers, feed stock and food additives. Plant operators at the mine were challenged with boiler feed water that was high in silica and other contaminants. As a result, boiler operations were experiencing difficult, labor-intensive operations and equipment deterioration. This resulted in higher operating costs and diminished processing performance. The facility was operating an aged boiler feedwater pretreatment system that included warm lime softening followed by pressure filtration and a cation/anion/mixed bed demineralizer system. The demineralizer required frequent regeneration and chemical usage was high and costs were difficult to predict. Depressurized well water (DPW water), used for plant utility water and boiler makeup, is very high in silica, in the range of 60-70 ppm. Silica can form scale at pressures below 600 psig. Above 600 psig, silica starts to volatize, carrying over with steam to potentially form deposits on downstream equipment and processes. Mine officials decided to upgrade the boiler feedwater pretreatment system to a state-of-the-art reverse osmosis (RO) membrane system. This new system, which started up in March 2009, has improved operating performance and reduced water consumption and overall operating expenditures.

A common problem recently encountered with the increase in the rate of input feed at Enrichment Plant 2 of the Sarcheshmeh Copper Complex is the loss of value to the tails, translating to lower recoveries. The feasibility of the direct transfer of part of the high-grade concentrate from rougher stages to an appropriate position along the circuit was studied, and two positions were proposed for direct transfer of the concentrate. One position was the feed flow into cleaner cells, and the other was the feed flow into the recleaner cell. The results indicated that transferring the concentrate from the first unit of the rougher stage to the feed flow into the cleaner cells was feasible, with no limitations, while the second position required the installation of a set of hydrocyclones. It was found that the transfer of concentrate to the proposed positions not only addressed the problem of limited cell capacity, resulting in debottlenecking of the circuit, but also improved metallurgical separation efficiency up to 1.4%.

Large surface mining projects in sparsely populated regions of the West have the potential to create disruptions in an area's social and economic character with potential effects on man that can far outweigh the physical and ecological effects on man's environment. The data and analyses involved in addressing the socioeconomic issues are additional to those traditionally associated with surface coal mining, such as those concerning land reclamation and water quality. Appropriate socioeconomic studies in conjunction with mine-planning can identify the potential problem areas in order that project measures can be taken to maximize the beneficial impacts and minimize the adverse effects of surface coal mining. The information required to conduct such socioeconomic analyses, available data sources, and the applicable analyses are described. Overall impacts of some proposed Western surface mines are summarized and potential mitigating steps discussed.

Background The resources of the Gippsland Basin include not only the coal and oil for which it is well known, but also the tourism resource and the quality of life which it offers its residents and visitors. To manage this group of resources requires an understanding and ability to predict the consequences of possible developments. The water of the streams and estuaries as a key component as it is both a resource and the means for transporting wastes from one area to another. To aid in the resource planning process there is a need for models of the estuarine hydraulic processes. This paper describes an appropriate modelling technique. Resource use conflicts may arise from developments in the catchment upstream of the estuarine reach. For example the diversion of water for domestic and industrial use will change the velocity and salinity structure of the downstream estuary. In turn these changes will affect sediment distribution and deposition patterns and may impose stress on the biological communities and ultimately on the fisheries resources and water quality. The manager of an estuarine system may have expertise in ecology, hydraulics or another of the specialist disciplines involved, but commonly will not. The manager will identify needs for resource and development and the broad options required to satisfy them. The manager will use these studies as the basis for his/her selection of the option for execution. Thus a model for'use by the manager of an estuarine system must have the following properties: (i) The model must be sufficiently accurate to throw up all the likely options. (ii) The model must be capable of being run by the manager, interactively, to answer `what if' questions. This requirement implies a simple code andhardware limited to a personal computer or possibly a desk top work station. (iii) The model must be robust so that unrealistic input oes not generate apparently useful output, and no output is generated for cases where the model is not designed to give results. (iv) The model must be capable of being used as part of a modelling system comprising models of all the geographic and demographic components

The production and dispersion of metal nanoclusters onto inorganic supports and amorphous carbon rest on well consolidated technologies belonging to the realm of industrial catalysis and of basic catalysis research (1). In spite of the existence of a variety of specific synthetic strategies, their very rationale relies on three main approaches i. e.: A: precursors of both the metal nanoparticles and of the relevant supports (or the support itself) are intimately mixed (even let to react) at ambient conditions and then thermo-reduced according to very controlled protocols (2); B: precursors of metal nanoclusters are let to be adsorbed onto suitable supports from the gas or liquid phase and subsequently thermally decomposed (3); C: metastable size-controlled metal nanoclusters are previously generated in a liquid medium and subsequently transferred onto pre-formed support particles (4). The production and dispersion of metal nanoclusters onto organic soluble supports is also a rather well documented academic praxis (5, 6, 7, 8) able to provide e.g. size-controlled Au0 nanoclusters of 4.4±1.7 nm (5). Our group started in 1997 developing (9) an innovative approach to the synthesis of metal nanoclusters dispersed inside insoluble, albeit accessible (see below) mechanically robust gel-type resins (10), which procedure was tested so far on palladium metal. Metal ions are previously dispersed upon ion-exchange inside of the polymer framework, followed by chemical reduction and by the aggregation of born metal atoms into nanoclusters, the size of which is templated (11, 12) by the three-dimensional intercommunicating meshes that build up the overall polymer framework (Figure 1).

Extraction of minerals can be achieved by a variety of technologies; one of them is ion exchange. There are several ion exchange configurations and mechanical set-ups available, but only one technology will provide more process performance and flexibility compared to the other. The multiple column Continuous Countercurrent Ion Exchange (CCIX) technology provides the highest form of process flexibility with also the highest mineral recovery feasible through ion exchange. In comparison with a fixed bed system, the PuriTech CCIX system offers the benefits of continuous counter-current contact mode. This way the resin capacity is fully exploited leading to reduction in resin inventory and, at the same time, in chemicals and water consumption, and product dilution. For any set of operating conditions the mass transfer zone has a characteristic length (MTZL). The MTZL can be expressed in duration, column length, or volume, but is the measure of the quantity of resin in the system that is doing "work" at any given moment in the process. The objective of continuous ion exchange processing is to eliminate all resin volume from the process equipment that is not within a mass transfer zone. In most commercial ion exchange processes for the recovery of metals, CCIX engineering can eliminate as much as 20 - 80 % of the ion exchange resin inventory. Consumptions of water and chemicals are typically brought down around 40% or more. For each type of resin the selectivity/affinity towards a particular metal depends on the basic process conditions such as pH, concentrations of other competing metals in solution. By changing the pH in the ion exchange process phase, the selectivity of the resin can be changed. By doing this, a split elution, or extraction of metals separately can be achieved and the effect of other competing metals (cross-contamination) can be reduced. For example the DOW resin XUS43578 is commonly used for the recovery of copper or nickel/cobalt separation.

Stimulated by 4 years of continuous economic growth without inflation, demand for energy in the United States reached an alltime high in 1964. Total value of production of goods and services (gross national product--GNP) for the year was $629 billion, an increase of 6.8 percent from 1963. Allowing for price changes based on 1958 dollars, the gain in real terms was 5 percent. In 1964 the Federal Reserve Board Index of Industrial Production stood at 132, a rise of 6.2 percent. With the impetus provided by personal income and corporate tax reductions during the year, aggregate wages, profits, and consumption reached record levels. Even the persistent balance of payments problem improved. Against this background the national consumption of commercial energy increased 4.2 percent. Energy needs continued to be met largely from domestic resources with imports, mainly crude petroleum and refined petroleum products, accounting for but 7 percent of the total. Mineral energy resources, namely gas, coal, and petroleum, contributed 96 percent of the input of energy into the economy during the year. The remaining 4 percent came from hydropower and nuclear power.

I. INTRODUCTION West Virginia has a long history of coal production.1 The state at one time led the nation in total coal production, while at the same time coal from West Virginia constituted one quarter of total U.S. coal production.2 In more recent years, however, West Virginia’s level of coal production has been reduced in comparison to that of other states due to the high relative cost of producing coal in the state.3 Another blow to the producers of coal in West Virginia is the action known as Bragg v. Robertson.4 In 1998 various individual plaintiffs, as well as a conservation group known as the West Virginia Highlands Conservancy, filed a civil action under a provision of the Surface Mining Control and Reclamation Act of 1977, Pub. L. No. 95-87, §522, 91 Stat. 445 (codified at 30 U.S.C. §§1201-1328) ("SMCRA" or the "Act") that allows declaratory and injunctive relief against state and federal officials for non-compliance with the Act.5 The plaintiffs generally claimed that the Director of the West Virginia Department of Environmental Protection ("WVDEP") had exhibited a pattern of violating mandatory non-discretionary duties under SMCRA and the West Virginia state regulatory program.6 These non-discretionary duties involved many areas of regulation, including water quality standards, disturbance of wetlands, hydrologic reclamation plans, Approximate Original Contour ("AOC") requirements and AOC variances, post-mining land uses, contemporaneous reclamation, and as explained later, the "buffer zone rule."7 In addition to these claims against WVDEP, the plaintiffs also alleged that certain individual members of the Army Corps of Engineers (the "Corps") had failed to carry out statutory duties under the Clean Water Act (the "CWA") and the National Environmental Policy Act ("NEPA").8 Generally, the complaint stated that the Corps did not have statutory authority under the CWA to regulate valley fills created for the purpose of the disposal of waste material, i.e., the overburden associated with mountain top mining.9 Alternatively, the plaintiffs claimed that even if the Corps could regulate valley fills, the Corps violated NEPA by issuing nationwide permits without required analysis. Finally, the plaintiffs asserted that the issuance of a nationwide permit for surface mining valley fills is unlawful.10
