"IntroductionAt TransAlta Utilities Corporation's Highvale Mine, located west of Edmonton, Alberta (Fig. I and 2), dragline stripping has proved to be a practical and economical method of overburden removal and future plans have been based upon the continued use of draglines (Fig. 3) as the major stripping equipment (Williams, 1979, Nikols et al., 1986). However, long range planning has shown that the capacity of draglines alone will be exceeded in the early 1990s as mining progresses into deeper overburden cover (Tapics, 1983). Strip ratios will increase from I.3 bank m!/ t of coal in 1985to 4.5 bank m3 / t in 1995. During this period the depth of overburden will increase substantially and the areas to be mined will be characterized by weak soils including glacially displaced overburden. This increased overburden depth in relatively weak soils will make it impractical to _continue side casting by draglines without prestripping in advance. In 1983, a major investigation was initiated to determine what additional overburden removal equipment was appropriate to the Highvale operations, and recognizing the long delivery times of this major equipment. when it would be required. This paper describes studies and tests which were undertaken in 1983 and 1984 to select prestripping methods and equipment for the future operation of the mine.Previous planning studies have shown that with the current burn schedule and with the economies of progressing from low cover to high cover, as has been practiced in the past, overburden volumes will exceed the capacity of the existing draglines in the early 1990s (Fig. 4). These previous studies had placed reliance on (I tandem dragline operation for future overburden removal requirements up to a depth of 45 m throughout the Highvale Mine. New drilling together with the associated geotechnical studies and some detailed planning on the practicality of using tandem draglines, created concerns about their universal application. Even without considering geotechnical conditions there was a depth limitation to tandem dragJines and substantial prestripping would be required to achieve the ultimate depths."

Sindesar Khurd Mine is situated in Rajasthan, India, and operated by Hindustan Zinc Ltd, under Vedanta Group. The base metal mine is high in reserves of Lead, Zinc and silver and has been producing since 2007 with initial production of 0.3 mtpa. Recently the mine has gained prominence as a base metal underground mine in introduction of latest mining techniques and achieving high production at lowest costs. The promising Lead-Zinc reserves of Sindesar Khurd Mine (SKM) and high-tech exploration adopted by Hindustan Zinc Ltd (HZL), (Vedanta Group), raising the reserves and resources from a meager 9 Mt (1997) to 81 Mt (2012), has prompted HZL management to ramp up the mine production from 0.3 mtpa (2006-07) to 2 mtpa by 2013-14 with ambitious plans to reach 3.5mtpa subsequently (presently largest underground metal mine in India). The complete trackless system underground mine, recently equipped with latest leaky feeder communication system (unique in India), utilize modern drilling, mucking and hauling equipment aided with various utility/service vehicles. Excavation optimization and quality recovery maximization from the open and post filled stoping methods, continual expert analysis and feedback from International consultants like AMC (Australia) and SRK (UK), and involvement of renowned bodies in management excellence, have lead the mine towards highest productivity and lowest mine operating cost, earning the mine a prominent place in the global base metal industry. The paper deals with how the various challenges in mine planning and designing, mine development, operator skill, equipment introduction and maintenance, expertise availability, provide training and exposure to officials, prompt and effective communication/service, control of ground vibrations, maintain ventilation standards etc are faced in attaining high operational excellence and thus attain a record mine output/man shift (OMS) of 14 ton/man shift with targets to reach 20 ton/man /shift. Scientific designing using 2D/3D numerical mine-modeling techniques, faster stope sequencing with introduction of paste filling ( first time in India),latest leaky feeder communication system, control ground vibration to stringent standards using electronic delay system, faster raising techniques using raise borers to enhance development and ventilation, cavity scanners to monitor large stope voids, fast shaft sinking at 100 m/month(Chinese expertise) and maintaining adequate ventilation with close software monitoring are some of the highlights discussed in the paper towards achieving the targets.

During the last three years prospecting has been active in southeastern Manitoba and a number of interesting gold, nickel and copper deposits have been discovered within an area 90 miles north of the international boundary, and extending about 40 miles westerly from between mileage 60 and 110 on the Manitoba-Ontario boundary. As known at present, two-thirds of this area of 2,000 square miles is underlain by pre Cambrian granite and granite gneiss and is not likely to contain mineral deposits of economic importance. The remaining one-third is underlain by metamorphosed sediments and lavas (greenstones), penetrated by the granite and granite gneiss and, at various localities, cut by bosses, sills, or dykes of gabbro, diorite, granodiorite, and other types of intrusives. The nickel, copper, and gold mineralization accompanied or followed the intrusion of these different rock types. The gold deposits are limited in distribution, so far as known, to the northern part of this prospecting area and occur along Manigotagan and Wanipigow rivers. These deposits have recently been described in some detail, (3) and therefore only the copper and copper-nickel deposits of the southern part of this area, along Oiseau and Maskwa rivers, will be described in this paper.

"The smelter is described by area; feed preparation, continuous furnace line, gas handling and auxiliary systems, blister refining, Hazelett casting of thin anodes, and scrap remelting. Early smelter campaign data is presented and compared to design. Some modifications to the basic design of the furnaces and gas trains are indicated, with their respective impacts on improving smelter performance.Plant compactness, the use of jumbo tanks, and a highly automated electrode handling system are featured in the refinery description, with brief coverage of the liberator and slimes leaching sections. Early experience in refining thin regular Hazelett anodes, and submersible pump recovery of raw slimes are relayed, together with automatic stripping from titanium blanks.Refinery tonnages and operating parameters are given showing the relatively trouble-free attainment of refinery design performance.IntroductionPrevious papers and articles ( 1), (2) ,(3 ) have described the metallurgical facilities serving the copper-zinc-silver Kidd Creek orebody located near Timmins, Ontario. For convenience a brief review of their mid-1983 operating status is presented.The concentrator, originally designed for 9,000 short tons, was commissioned in late 1966. It can now comfortably process over 13,000 metric tonnes per day largely as a result of the addition of a fourth circuit in 1978."

This paper is concerned with an analysis of a number of failures of large-size, hypervelocity light gas gun chambers and barrels. A brief description of the light gas gun principle and of the various types of guns is first given. The failures and the investigations carried out are then described in detail, with the failures divided into two groups. The first group comprises those failures caused by certain conditions to which the guns may be submitted, and includes, for example, severe local heating of the bore surface causing hardening and cracking of the steel. These conditions were accidental and steps were taken to prevent them. The remaining failures were due to faults in the material or in the heat-treatment, manufacturing or assembling procedures. Specific problems, such as hydrogen embrittlement, and the use of high strength gun barrels above their ductile-brittle transition temperature by preheating prior to firing, are briefly considered. """Unassayable gold and platinum group metals"" have come into vogue in the 70sand 80s in certain jurisdictions as a means of perpetrating fraud. Usual arguments are that a particular ore is not amenable to ""conventional fire assaying"". Explanations for unassayable gold usually revolve around: evaporation of micron-size gold; vaporization of organic gold complexes; volatization of gold halides; alloying of gold with PGM's which prevents fusion or alloying which prevents collection .This paper reviews several of the myths and truths of gold and PGM assaying with the knowledge that not a single mine operatesin thefree world producing gold from unassayable ore.INTRODUCTIONAccurate analyses of exploration data and estimation of ore reserves are two of the most important functions of professional geologists and engineers in mine development. The problems encountered become particularly acute when dealing with precious metal values where very low grade deposits (in the range of 0.0 I Troy oz per ton or - 0.2 ppm (g/t) by weight) sometimes are economic or constitute ""ore"". To emphasize this ""scarcity effect"", a gold assay of 0.4 g/t (0.01 T oz/st) would result from the presence of a single 420 J.tm (35 mesh) gold flake (which weighs I milligram) in a 5 kilogram siliceous sample.The current high gold price and the prospects of high profit margins awaiting exploitation of even very low grade gold deposits, has spawned a sizeable group of incompetent or fraudulent gold assayers. These ""assayers"" will often report significant precious metal values where no such values occur. Failures of legitimate assay labs to confirm these ""significant"" assays are often attributed, by the charlatan, to their capability of detecting ""unassayable gold"" while the check assayer cannot. Geologists and engineers lacking detailed knowledge of sampling and assaying techniques are often hard-pressed to convince a gold-fever aroused company executive or investor-client to abandon a property on which attention-grabbling values have been reported, often by more than one laboratory. Professionals engaged in such evaluations must acquire an understanding of contemporary precious metal sampling and assaying techniques . Only then can they determine whether misrepresentation of values have been perpetrated"

As a bubble travels through the pulp region of a flotation cell, it will collect the most hydrophobic particles of an intermediate particle size range, this being the primary source of true flotation selectivity. Despite its role on bubble-particle attachment, however, particle hydrophobicity is still missing a mathematical definition that can be used for plant simulation. In this paper, particle hydrophobicity is defined in terms of the induction time necessary for attachment and then linked to the mass of collector adsorbed per particle. This allows particle hydrophobicity to be written as a function of density of collector adsorption as well as particle size and mineralogy. The model is calibrated from the experimental measurement of the flotation rate constant. Liberation data from an industrial flotation rougher is used for model validation. It is demonstrated that the model can describe a broad experimental dataset by means of a minimal number of parameters. Main industrial application is in simulating the effect of the chemical environment upon plant metallurgical performance.

"Three main types of base metal sulphide mineralization are present in the Timmins area:(1) -Massive and stringer-type copper-zinc deposits occurring mainly in pyroclastic rocks, as typified by the mines of Kam-Kotia, Jameland and Canadian Jamieson, or within or close to possible breccia pipes as shown by the Genex and Kidd Creek mines. With the exception of the Kidd Creek mine, all of these orebodies occur northwest of Timmins (Kamiskotia area) and appear to lie within or close to a major center of volcanic activity characterized by a thick accumulation of felsic pyroclastic rocks and subordinate epizonal intrusions. The margins of the rhyolitic pile are interfingered with mafic volcanics; overlying sedi-ments mark the termination of a vol-canic cycle. The copper-zinc deposits in the Kamiskotia area are confined to a particular stratigraphic unit. Ore-bearing solutions were probably derived from the intrusive complex of the volcanic pile.(2) -Porphyry copper deposit of the Mcintyre mine. The deposit occurs in a quarz porphyry intrusion related to the volcanism in the area (Hurst, 1936). Mineralization was probably introduced at the time of intrusion, and subsequently redistributed within the porphyry during deformation. (3) -Massive and disseminated nickel mineralization, associated with serpentinized alpine-type ultramafic intrusions, as shown by the Alexo, McWatters, Hart, Inco and Texmont deposits. The nickel mineralization occurs at or near contacts of the serpentinites with felsic or mafic volcanics, or sulphide-bearing iron formations. The nickel deposits south of Timmins are confined to a particular stratigraphic unit along the margins of domical-shaped structures which appear to outline former volcanic centers. Sulphurization as pro-posed by Naldrett (1966) appears to be a workable hypothesis for the formation of some of the deposits."

"This paper provides an understanding of interpreting and evaluating airborne time domain electromagnetic (TEM) surveys as applied to massive sulfide exploration. Variations in the conductive morphologies of massive sulfide ore systems are discussed, followed by forward modelling exercises examining the derived TEM response to these morphologies and discussion of the subtleties of data interpretation. Deposit morphology in the orientation at formation and the variations occurring due to later deformation are considered. Images of corresponding resistivity–depth models are provided. The combined modelling results provide a low-cost method for initial interpretation and screening of TEM anomalies. RÉSUMÉ Cet article nous permet de mieux comprendre l’interprétation et l’évaluation des levés élec-tromagnétiques aéroportés en domaine temporel (TDEM, de l’anglais time-domain electromagnetic) appliqués à l’exploration du sulfure massif. Y sont débattues les variations au niveau des morphologies conductrices des systèmes de minéralisation du sulfure massif, suivies d’exercices de modélisation prospective qui examinent la réponse dérivée des TDEM à ces morphologies et d’une discussion sur les subtilités de l’interprétation des données. L’étude envisage la morphologie de l’orientation originelle non déformée des gisements ainsi que les variations résultant d’une déformation ultérieure. Des images des modèles correspondants de résistivité-profondeur sont fournies. Les résultats combinés relatifs à la modélisation proposent une méthode peu onéreuse d’interprétation et de contrôle initiaux des anomalies dans les TDEM.INTRODUCTION Electromagnetic geophysical surveys are an indispensable foundation of many mineral exploration programs and can account for as much as half of the predrilling exploration costs. Quantitative mass interpretation of the survey results remains difficult due to the infinite variation of deposit morphologies, their complex physical properties, and the presence of barren conductive materials that can mimic or mask the response of targeted ore. Many modern geophysical investigations that focus on time domain electromagnetic (TEM) data interpretations are devoted to problems with inversion and modelling and their algorithms. Although a few of these investigations have resulted in commercial software products, these require highly qualified and experienced users and usually include geometric assumptions. Furthermore, without the input of known physical properties and geometric constraints, the inversion results are highly ambiguous. A number of case studies document the geophysical responses to known targets in well-defined and diverse geo-electrical environments, providing a high degree of correlation between field obser-vation and the results of the modelling used in this style of investigation (Hone, 1980; Schneider & Emerson, 1980; Tyne, Idnurm, & Malone, 1981; Bishop & Lewis, 1992; Hopgood & Hungerford, 1994; Meju, 2002; Yang & Oldenburg, 2016). The uniqueness of the target/environment parameters and their specific features limits the use logy is poorly understood. The responses are therefore that are devoid of complicating environmental factors (e.g., highly conductive overburden and hostrocks or nonuniform target conductivity) as a first approach to the interpretation process of such case studies as the main reference for interpreting TEM survey responses in areas where the underlying geomodelled from generalized and typical geological models"

The Millennium deposit, located in northern Saskatchewan between the McArthur River mine and the Key Lake mill, has considerable potential for becoming an operating mine. Located in the Athabasca Basin, Millennium is blessed with both the riches and the challenges that this basin offers. The potential for ground water inflows during shaft sinking, and the unconventional challenges associated with underground uranium mining, render the successful development of a new mine in this area especially rewarding. The preliminary design and engineering of the Millennium Project has tapped into the experience of other operations in the area, and has utilized new applications of geophysics technology to enhance the understanding of the local geological structure. This discussion will focus on the innovations, and the challenges specific to uranium mining, for a deposit that is poised to be one of the next mines to supplement Saskatchewan's uranium resources.

"The Murray Brook precious metal (Au, Ag) gossan deposit is one of nine supergene mineral deposits that have developed over polymetallic massive sulfide deposits in the Bathurst Camp of New Brunswick. Reserves consist of 1.9 Mt of gossan containing 1.53 g/t Au and 65.9 g/t Ag. The supergene zone at Murray Brook consists of six distinct units: a) altered massive sulfide, b) pyrite-quartz sand, c) massive sulfide gossan, d) disseminated sulfide gossan, e) ferruginized wallrock, and f) leached bedrock. The massive sulfide gossan constitutes the main body of economic mineralization and consists of goethite, primary quartz, secondary amorphous silica, K-Fe-Pb-As- Sb-Ag hydrated sulfate and oxide minerals (beudantite, plumbojarosite, jarosite, bindheimite, scorodite), trace cinnabar, and cassiterite of primary origin. The order of stability of sulfide minerals during oxidation was pyrite _ arsenopyrite _ galena _ Bi-Sb sulfosalts _ chalcopyrite _ tetrahedrite group _ sphalerite.Two mass balance techniques (isovolumetric and conservative element) indicate elemental depletion in gossan relative to primary ore in the order: S>Cd=Zn>Cu=Mn>Na=Ca>Fe=Al=V> Mg= K=Se=Hg>Pb>Ti>Ag>Mo=P>Ba; and enrichment in the order Au>As>Sb>Si>Bi. Tin, as cassiterite, is conservative.Mineralogic and paleomagnetic data suggest that the gossan deposit formed under a warm temperate climate throughout the Pliocene. The rate of oxidation and the compositional nature of the ore was significantly influenced by: a) the position of the primary sulfide zone in a downward moving hydrological system, b) primary sulfide composition and zonation that promoted the development of a strong electrochemical oxidation system, and c) pronounced intercalation of carbonate and sphalerite mineralization in sulfide zones, which promoted rapid development of secondary porosity, permeability and downward flow of oxygenated groundwater.During progressive oxidation and physico-chemical erosion of the gossan zone, Au was transported downward in groundwaters, probably as a Auo colloid complex, to be concentrated in the lower horizons of the gossan profile. The precipitation of Au was greatly increased in the pyrite/arsenopyrite zones. Gold concentration was multi-cyclic with continual dissolution and nucleation of the metal until final concentration in the void structures of the gossan. Leaching experiments and microprobe analyses indicate that Au is present in the gossan as submicron composite sols of Au-Ag-silica."

"What is Due Diligence?Within the mining industry the term “due diligence” is used to describe a detailed data review, generally in connection with the purchase or sale of a mineral property, the approval of a large capital expenditure, or the borrowing of a large sum of money.The term originates in the requirement of the board of directors of a corporation to “act honestly and in good faith ... and exercise the care, diligence, and skill that a reasonably prudent person would exercise in comparable circumstances” (OBCA, 1994). Furthermore, the law assumes that a corporation (or its board) will have exercised due diligence in the acquisition of an asset and, therefore, knowingly (in the absence of fraud or deceit) will have taken on the liabilities and obligations associated with the asset (Nelson, 1994). This is the familiar “Buyer Beware”.Directors are liable for their decisions except “if the director relies in good faith upon financial statements of the corporation represented … by an officer of the corporation or in a written report of the auditor, or a report of a lawyer, accountant, engineer, appraiser, or other person whose profession lends credibility to a statement made by any such person.” (OBCA, 1994).Hence the importance of reports prepared by professionals. They provide confirmation that the directors have exercised due diligence in the performance of their duties. For this reason these reports are referred to as due diligence studies"

This paper outlines the principles of friction hoisting and the components involved, and gives a description of a specific mine hoist. Friction hoisting is compared with conventional drum hoisting, and the depth of shaft at which friction hoists become more economical than drum hoists, with respect to power consumption, is determined. Introduction T HE purpose of this paper is to outline the principles of friction hoisting, to describe the components and to show the advantages of multi-rope friction hoisting. Some calculations are made to show that the power requirements and the initial costs of friction hoists are less than those of conventional drum hoists, once a certain depth of shaft has been reached. The use of multi-rope friction hoists is gradually superseding the employment of the conventional drum hoist in many parts of the world. It results in heavier payloads from deeper levels, an increase in shaft safe-ty and a more compact installation for protection against adverse weather conditions. It was observed that where drums and friction sheaves exceeded 30 feet in diameter, a number of mechanical disadvantages were being experienced;

The Mary River iron ore deposits were discovered in the 1960?s. The high quality of the deposits was immediately evident, and drilling programs were successful in defining a resource adequate for supporting a feasibility study. Through a combination of ownership, market and political forces, the deposits were not developed. Having missed the window of opportunity, the project remained dormant for over three decades. Baffinland Iron Mines Corporation, with its 100% ownership of the Mary River deposits, began trading publicly in 2004. Modern exploration and metallurgical test work began in 2004 and has continued in 2005 and 2006, resulting in total expenditures during this period of almost C$60 million. In May 2006, an engineering team lead by Aker Kvaerner E&C, a division of Aker Kvaerner Canada Inc., completed a scoping study based on the first of five identified deposits. Highlights of that study include direct shipping of high quality lump ore to Europe over a 34 year mine life at a production rate of 10 million tonnes per annum, based on an indicated resource of 309 million tonnes at 66.1% Fe and an inferred resource of 28 million tonnes at 65.9% Fe. Capital costs were estimated at C$1.5 billion. Using iron ore prices approximately 36% below that of the 2006 market, a pre-tax internal rate of return of 15% was estimated assuming equity financing. Payback on initial capital was 5.9 years. The pre-tax life-of-mine cash flow was estimated to be C$6.3 billion. As a result of this study, Baffinland initiated a Definitive Feasibility Study, under the management of Aker Kvaerner, which is scheduled for completion in December 2007. This paper touches on the geology of the deposits, the current resource and the outlook for expansion. Project permitting, construction planning, logistical challenges and ocean shipping considerations are discussed, providing a current perspective on the project scale, scope and timeline for commercial production. In addition, an overview of the Company?s bulk sampling program will be provided.

"Blast fumes are one of the major sources for NOx in underground mines. In 2016, the Occupational Exposure Limits for NOx in Germany were reduced by 90%. The task is to keep re-entry times after blasting at the present level and thereby ensure an economic operation of the mine. Measurements show that using ventilation solely is not sufficient. A new approach to reduce NOx from blast fumes is described. Laboratory experiments were performed and a reduction of NOx was observed. Measurements were conducted at an explosive factory’s testing facility and in an underground mine at blasting operations. INTRODUCTION Whether for production of ore or for drift development, the processes in an underground mine are always the same: 1) fracturing the rock, 2) loading the pile, 3) support the resulting cavity. The fracturing of the rock can be done mechanically, by cutting, for example by using continuous miners or tunnel boring machines, or by drilling and blasting. Drilling and blasting is more flexible than mechanical driving, as it can be used independently of the rock strength. Furthermore, this driving method allows a more flexible reaction to changes in geological and/or operational conditions. Thus, underground mining and blasting are almost inextricably linked with each other, and regardless of the size and level of technology of the mine, blasting is hardly avoidable. Depending on the mining method chosen and the existing framework conditions, such as the mechanical properties of the rock or the availability of machinery, blasting is an integral part of daily operations. Even in mines where blasting is not part of regular operations, it cannot be completely avoided. The blast fumes generated by the explosions are, in addition to diesel engine emissions, one of the two main sources of emissions of nitrous gases underground. Up to now, state of the art for dealing with blast fumes is ventilation. The fumes are diluted with fresh air and ventilated out of the mine. This treatment of blast fumes is more than sufficient with the former German Occupational Exposure Limits (OEL). The adaption of the OEL in Germany to the recommendations of the Committee on Occupational Exposure Limits (SCOEL), a committee of the European Commission, leads to big challenges for the mining industry in reducing the concentrations of these gases at the workplaces underground. On its meeting on May 2nd and 3rd 2016, the Committee on Hazardous Substances (Ausschuss für Gefahrstoffe, AGS), an advisory body of the German Federal Ministry of Labour and Social Affairs (BMAS), advised the BMAS to copy the OEL, as recommended by the SCOEL, to the Technical Rules for Hazardous Substances (TRGS 900). BMAS followed this advice, consequently the new OEL where published on November 4th 2016 and became part of the TRGS 900. Table 1 shows the former and new OEL for Germany. These new OEL became law after publishing, but two exceptions were made: For tunneling operations, they became law on October 31st 2017, for mining operations they will become law on October 31st 2021 (BAuA, 2004, 2016, 2017)."

This paper deals with the large iron ore concentrating plant owned by the Iron Ore Company of Canada. The plant is part of the Carol Project, which is being developed in the Wabush area of western Labrador. The mining and milling operations were officially opened in July of this year. The handling of fine material has always been considered a serious operational problem. The crushing, grinding and sizing of 50,000 tons of iron ore per day, in a dry state, could present sizeable problems in maintenance and orderliness. The operation, as a whole, embraces many recent developments in the iron ore industry. Mining operations include the latest techniques of jet piercing and blasting. Primary crushing involves a single crusher, which handles the complete production. Grinding of the ore includes the latest concepts of dry autogenous grinding in air-swept mills. The actual concentration of the ore is per-formed, in the wet state, by the use of spiral concentrators, with provision for possible flotation or magnetic separation, if required. The upgraded concentrates are either stored or pelletized, prior to shipment by rail to Seven Islands.

Historical Sketch Occurrences of native copper have been known along the Arctic coast of Canada, especially in the vicinity of the. Coppermine river, since the early part of the eighteenth century (See map, Figure 2, insert). In 1769, Samuel Hearne, a clerk of the Hudson's Bay Company at Fort Churchill, was sent to explore the 'copper mines' from which natives had been reported to secure copper for tools, fishing spears, etc. After two successful attempts, he reached the Coppermine river in 1771, accompanied by Indian guides. This hazardous trip was indeed a remarkable feat when one considers the vast distance covered, a great deal of which was barren lands. At Bloody falls, (See Figure 1) on the Coppermine river, Hearne's Indians swooped down on a party of sleeping Esquimaux, who gathered there each summer to fish, and murdered the entire band encamped on that side of the river. Hence the name of the falls. Hearne's knowledge of minerals was undoubtedly limited. He reported having seen the copper mines from which the natives were securing the copper, but he failed to prove the economic possibilities of the copper occurrences or to give an accurate description of any deposit. Sir John Franklin visited the area in 1821. He and other members of his expedition, namely, Richardson, Back, Kendall, and Hood, reported native-copper float to occur in the vicinity of the Coppermine river and Bathurst inlet.

"3.1. INTRODUCTIONThis chapter discusses briefly the common law concepts of fiduciary relationship, constructive trust, and breach of confidence. Following a discussion of confidentiality agreements, the last section of the chapter compares and comments on two common law cases, the LAC Case and the Metalore Case. Civil law readers should not ignore this chapter or § 3.5. the comparison as, to a large extent, the concepts and comments are universal, even though the procedures for applying them may vary.1It should be appreciated that, regardless of the legal system, if the Court sees that a wrong has been done, it will attempt to right that wrong, either by awarding monetary damages against the wrong-doer to compensate the injured party or by attempting to make the injured party whole again by such means as negating an agreement (as in the Metalore Case) or returning property to a wronged party (as in the LAC Case). The methodology for accomplishing either of these results will vary with the jurisdiction, and the two are not mutually exclusive.These two Ontario cases have been chosen, not because they are the only ones available – they certainly are not – but because both are relatively well known within the minerals industry and they deal with problems that may face any explorationist (although it is to be hoped that the facts of the Metalore Case do not represent “normal” behaviour). Each judgment offers useful guidelines, as well as insight into a judge’s approach to problems, the type of information he expects to receive, how his mind works, and, particularly in the Court of Appeal judgment in the Metalore Case, how he might reason through and “justify” his decisions.3.2.
