Risk and dispute resolution are linked. Dispute resolution techniques are brought to bear on a dispute - which is an outcome of a risk being wholly or partially realised. There has been an increasing awareness by business of risk as a component of doing business. There is an accompanying awareness of the need to manage risk - including legal risk. Many companies have undertaken a systematic review of their potential risks and endeavoured to put in place systems to help to avoid or manage risks. A legal risk management program will not prevent disputes arising. However, such a program should prescribe how that dispute will be managed. The management of the dispute will involve consideration of the dispute resolution procedure to be adopted. The most appropriate processes will take into account the practical, personal and commercial considerations surrounding the dispute and be as efficient, cost-effective and user friendly as achievable in the circumstances for the benefit of all the parties. Carrying on business in South East Asia, whether as an explorer or a mining operator, brings additional considerations to bear in legal risk management and the dispute resolution process. A significantly different perspective is required due to the varying nature of the legal systems in many South East Asian jurisdictions. These jurisdictions often have relative uncertainty as to the law. This impacts on the dispute resolution processes and also raises further timing and cost issues. The authors contend that this is all the more reason to endeavour, as practically as possible, to adopt a legal risk management and dispute resolution profile which will provide business with the greatest prospects of maintaining control of the dispute resolution process. This presents a greater chance of a successful outcome to the dispute. In these times of increasing pressures on profitability because of low mineral prices, all costs of a minerals business are being reviewed. In such times, a significant legal dispute may have even greater potential to adversely impact on the companies concerned, together with the careers of the people involved. In this paper possible approaches to managing disputes and a case study a legal dispute in which Freehill Hollingdale and Page were involved are discussed. The dispute concerned an international mining company developing a gold mine in Indonesia and one of its contractors in Indonesia. Described is how that dispute was resolved. This achieved a very satisfactory result for the client - all things considered. Given the æadditionalÆ problems associated with ascertainment and enforcement of ærightsÆ in South East Asia, the longer the parties can retain control over their dispute the better off they will be. For this reason, the authors set out in this paper the main additional dispute resolution tools available - that are appropriate for use throughout South East Asia.

The object of this talk is to bring before members the importance of the prospector and the' State Battery system to the wealth and prosperity of the mining industry in particular and the State of Western Australia in general, and to touch on the more important features.Customs plants of any sort are usually subject to a good deal of critioism, usually on the large profits made at the expense of the customer, etc., and this often clouds the real value of the work being done.Prospectors, on the whole, are a good class of men; they work under conditions and difficulties which would deter those less spirited. Food, water and mining supplies are often difficult to obtain and frequently have to be transported great distances. Their mining tools are usually of the most primitive type, yet during last year over 109,000 tons of prospectors' ore were handled by the State Battery system for 73,250 fine oz. valued in Australian currency at over £587,000, the value being 57/- per long ton at par.This production brings the State Battery system into fourth position amongst the producers of the State, the yield being exceeded by the Lake View and Star, Wiluna and the Great Boulder.In passing I might mention that these notes were written at the end of the year 1940, and the above figures were for the previous period. The figures for last year, 1940, were not quite so good, being 101,000 tons for approximately 60,000 fine oz., valued in Australian currency at £572,000.In spite of this drop the State Battery system maintained its position as fourth in order of gold output for the State.The extractions, as a whole, throughout the system, were 92·54%, made up of 68·86% by amalgamation and 23·68% by cyanidation. These figures, for a group of 20 plants treating widely different classes of ore, must be considered satisfactory. The total production since inception is over £11,000,000 in Australian currency.State Batteries are usually more or less of a standard design. Ore is reduced to about 2i in. maximum size before being sent to the bins. Challenge automatic feeeders control the feed to each mill unit, amalgamated copper plates collect the free gold. One of the most significant technical and practical challenges facing the tunnel construction team on the Legacy Way road tunnel project in Brisbane, Australia was how to erect the prestressed precast concrete slabs to form the smoke duct in the tunnel boring machine (TBM) tunnels.An essential part of the tunnel ventilation system, the smoke duct extends the full length of the 4.6 km-long twin two-lane tunnels. The vast majority of the tunnels (approximately 4.3 km) were constructed using two 12.4 m diameter double-shield TBMs. The refurbished Herrenknecht machines broke several world records on the way to completing the tunnel excavation works in just over nine months. With the excavation complete the focus turned to solving the complex civil tunnel fit-out challenges. A key component of the civil fit-out of the tunnels was constructing the smoke duct in the TBM tunnels, which was designed as a precast solution.The slabs, which each measure 8.62 m long × 2.0 m wide × 200 mm thick and weigh close to 9?t, need to be erected above cast in situ corbels whilst other tunnel finishing works continue. The space-proofing clearance offered by the design to the support corbels below and the precast segmental lining above was in the order of only 100 mm.This paper tells the story of how the Transcity Joint Venture (JV) tunnel fit-out team comprising some of Europe and Australia’s leading tunnel construction specialists drew upon the global strengths of the existing JV member companies and the global reach of leading TBM manufacturer Herrenknecht to develop an innovative system in solving this challenging problem. Most epithermal Au-Ag deposits in the Hauraki Goldfield are hosted in late Miocene andesites. Broken Hills is an exception, being one of the few economic deposits hosted in rhyolite. Investigation of Broken Hills provides the opportunity to collate structural data that may be compared with that collected from andesite-hosted deposits in order to evaluate the importance of rock type on vein development. The rhyolite host rock at Broken Hills is strongly flow-banded, but this anisotropy does not appear to affect the orientation of mineralised structures. There is a range of structures at Broken Hills: veins, faults, fractures, and large breccia pipes. Veins generally strike north-south, with localised changes in strike and thickness. Slip vectors determined from striations indicate near pure dipslip on the main lode, indicating an extensional tectonic setting. The orientations of vein deflections are parallel to slip vectors. This correlation is common in modern extensional fault arrays where fault growth and linkage produces subvertical deflections in fault orientation (eg TVZ). There are three main types of breccias: 1. Primary breccias related to rhyolite emplacement. 2. Jigsaw type secondary breccias that are that developed during the life of the hydrothermal system. 3. Breccia pipes. Broken Hills was a dynamic epithermal mineralising system.

Land disturbed by alluvial gold mining should be restored to a capability or productivity as good as that which existed prior to disturbance.   Effective rehabilitation requires detailed planning prior to mining and must also be closely integrated with the mining operations.   The main constituents of a rehabilitation plan: description of existing site conditions, choice of final land use, establishment of final landform, water management and erosion control, soil reconstruction, revegetation and management of rehabilitated land are briefly described.

In this paper a laboratory investigation into the effect of confining stress, water content and gas desorption on coal permeability is presented. Of major significance is the effect of coal permeability on outburst occurrence and methane production, which is influenced by changes in stress. Test results indicated that the shrinkage of the coal matrix associated with desorption is greater than the coal matrix compressibility which will cause a reduction in the effective stress, hence increasing coal permeability.

Tonnage and grade are the principal reported components of mineral resource estimates but tonnage is a derivative of two more fundamental estimates; volume and bulk density. Typically, most of the effort in a resource estimation study is directed towards grade and volume, yet poor application of bulk density data to resource models can result in significant biases. The impact on tonnage estimates is easily recognised but poor density estimates may also introduce subtle biases into the grade estimates. Methods for measuring bulk density have been discussed previously. This paper focuses on the manipulation of bulk density data and the extension of bulk density from essentially point measurements to block estimates within resource models. Bulk density is a continuous, geologically controlled, spatial variable and should be treated as such. Issues such as combining data from multiple sources, sample support and the interdependence of bulk density and grade estimates must be resolved. The statistical and geostatistical techniques used for grade estimation are, under the right circumstances, equally applicable to bulk density. The importance of bulk density needs to be recognised. With robust raw data and correct estimation procedures, better estimates of bulk density can be obtained and both local and global tonnage and grade estimates can be improved.

A geologic, petrographic and geochemical study has been performed on the pyroclastic flow deposits in the coastal area of East Zhejiang Province, Southeast China. This study leads to classification of the pyroclastic flow deposits into three associations: the extrusive type, the surge type and the ash flow type welded tuff associations. Through detailed investigation and comparison of the characteristics of these lithologic associations, with emphasis on the welded tuffs, a comprehensive model has been proposed to demonstrate the petrogenesis of the pyroclastic flow deposits.

The Ernest Henry mine is a transverse sublevel cave (SLC), which is relatively unique due to the 45 degree inclination of the orebody. To economically recover ore, each sublevel is horizontally offset from the previous level by around 25 m, depending on the orebody geometry. Mine development, slotting and initial production within this zone occurs in a high stress abutment that increases in magnitude at depth. These areas are seismically active and close to the hanging wall where cave propagation is yet to initiate. High stress conditions and the close proximity to the cave seismogenic zone results in challenging geotechnical conditions in the step out zone of each level and requires management of hazards including stress driven rockfalls, rock bursts and pillar failure.This paper outlines how these hazards were forecast using numerical modelling and geotechnical monitoring. Risk management techniques included dynamic ground support design, development of a new mine layout and extraction sequence as well as delayed re-entry into seismically active areas. Ongoing monitoring, instrumentation measurements and field observations were used to track the effectiveness of the controls.Future production levels are forecast to experience increasing stress and seismicity, which will increase demand on excavations and installed ground support. On a worldwide basis trackbound transportation is on the decline. As mining operations progress from open cast operations to underground operations, most utilise mechanised equipment. However, in South Africa hard rock mines, only a small percentage (¦10 per cent) of the production can be generated by mechanised methods and therefore trackbound mining methods will remain the dominant means to transport ore. In the Australian context there may be occasions where the nature of the orebody would dictate the use of rail transportation with the ore being transported from drawpoints by means of locomotives and hoppers. This paper focuses on horizontal rail haulage systems from the stope loading boxes to the shaft station area and will be largely based on South African experience. It is intended that this document will provide a practical guideline for mine designers and planners during the design process. The paper looks at trackbound transport systems and evaluates such items as construction and management of an underground rail haulage system. Current transportation systems for personnel, material and rock transportation are evaluated, gaps in technology highlighted, and recommendations made.

During the lifetime of an open pit mining project, each stage from exploration activities to exploitation and mine closure produces disturbances on the mining region. Mined land reclamation plans establish constructive solutions to rehabilitate the disturbed areas. Open pit mining as an effective method for exploitation of a wide range of orebodies especially for massive reserves of shallow metallic substances has exhaustive and harmful environmental effects on the mining project region. Nowadays, closure and reclamation stage in a mining project is emphatically enforced by the relevant environmental protection regulations in many countries. It is therefore obvious that closure and reclamation costs of an open pit mining project, as costs of other stages of project, must be estimated to enter the planning and design processes in open pit mining. Post-mining land use is the most important factor to recognise closure and reclamation costs. Thus, using a model to define optimal land use in planning phase of an open pit mining project is necessary in this regard. In this project a model was developed to define optimal land use regarding different sections of open pit mines such as pit(s), waste dump(s), tailing pond(s), roads, areas for onsite facilities and free land zones which are not mined. TOPSIS and PROMETHE techniques were applied to create the developed model. Lumber production was recognised as the optimal post-mining land use for the pit area of the case study in this project.

Reasons are given for the seemingly excessive public concern with taxation of the mineral industry. Optimality of mineral extraction is a concept that requires careful definition in terms of one or more objectives. Once defined, the impact of taxation upon optimal mineral extraction may be studied; findings from earlier work on this topic are presented for two basically different cases. In conclusion it is observed that the pursuit of optimality requires the availability of highly skilled engineers; in the event of a large-scale mineral development it is this resource that is probably scarcest of all.

There are many technologies available today in terms of fire and life safety in road tunnels. So many in fact that it is becoming more and more difficult for clients and contractors alike to determine what they want and what they need. From a clientÆs perspective, fire and life safety is about protection to its infrastructure and to the public at large. Conversely, the contractor is looking to meet its æfit for purposeÆ or ædeem to complyÆ requirements in the most economic and practicable way. Practices regarding fire and life safety in road tunnels have undergone a degree of transformation during the last decade or more throughout the world. This transformation has largely been driven by a series of catastrophic accidents such as the major fires in Europe including the Mont Blanc Tunnel, Tauern Tunnel, Saint-Gothard Tunnel, and now most recently in the CityLink Tunnels in Melbourne. International guidelines produced by organisations such as the Permanent International Association of Road Congresses (PIARC), the European Union, the International Tunnelling Association (ITA) and the US National Fire Protection Authority (NFPA) now provide clients, owners and designers with the tools required to define and specify the required fire and life safety systems in road tunnels. The majority of these tools are based on risk assessment and risk management. Recent road tunnel projects within Australia, however, have not referred solely to such guidelines. Clients have opted to prescribe different or additional fire and life safety requirements within the projectÆs technical specification documentation (project requirements), leaving designers and contractors with little room to implement alternatives or substitutions. Further, these project requirements are largely dictated by practice established on previous road tunnel projects within Australia. This paper looks at the current international guidelines and practices and undertakes a comparison with the EastLink tunnels in Melbourne and other road tunnels within Australia and makes assessment on whether Australian methods are the most appropriate for clients and contractors alike. Focus is directed to the key elements of fire and life safety such as:traffic envelope, barrier arrangements and emergency walkway provisions;deluge systems;drainage systems;fire rating requirements;tunnel ventilation systems;cross passage provisions;fire safety assessment;critical intelligence systems including help phones, CCTV, incident detection, tunnel signage, etc; andexternal tunnel control systems.

"An EXTENDED ABSTRACT is available for download. A full-length paper was not prepared for this presentation. Over the last decade (2005–2014), a total of 439 significant deposits of gold and base metals were found in the world. Twenty (or 4.6 per cent) of these deposits were in the Pacific/South-East Asia (Pacific/SE Asia) region. In terms of contained metal, the region accounted for 1.6 per cent of gold and 13.8 per cent of copper found in the world. With regard to nickel and zinc/lead, the region’s contributions were insignificant.Over the same period, the Pacific/SE Asia region accounted for 6.6 per cent and 12.6 per cent of all gold and copper exploration expenditures in the world respectively. After adjusting for by-product credits, unreported discoveries and likely growth in resource, the unit discovery cost for the region was US$199/oz (compared to a world average of US$50/oz). For comparison, the unit discovery costs for the previous decade were US$55/oz and US$25/oz respectively. The region’s unit discovery cost for copper was US$0.036/lb (versus a world average of US$0.040). For comparison, the unit discovery costs for the previous decade were US$0.026/lb and US$0.008/lb Cu respectively.The region’s mediocre discovery performance doesn’t reflect its distribution of known mineralisation. Some countries within the region have a very good endowment per square kilometre.It is noted that the intensity of exploration (and resulting success) would be boosted if governments provided a more mining- and investment-friendly business environment and generated better precompetitive geological data sets (to identify new exploration targets and boost the country’s perceived mineral prospectivity). A multivariable regression analysis of a decade of data from the Fraser Institute’s mining company surveys found that a ten point increase in the Policy Perception Index or a 0.1 point increase in the Mineral Potential Index could boost (in the short term) exploration expenditures by 1.9 per cent and 2.7 per cent respectively. Enhancing the understanding of gravity flow in caving operations is a key factor in the design, operation and success of caving methods. Consequently, much research has been performed to increase knowledge about gravity flow. Many valuable theories have been gained from different research approaches, which include physical modelling, numerical modelling and a limited number of full-scale tests. Recent advances in technology have allowed Codelco Chile to carry out trials using Smart Markers technology. This technology was used in Esmeralda mine’s Block-2 at El Teniente mine from August 2012 to January 2015. This paper aims to determine the characteristics of the extraction zone and obtain the data that will allow greater understanding of gravity flow for design and draw control purposes.The collected data from recovered markers were analysed using a linear interpolation of both the initial position of the markers and drawbell accumulated drawn tonnage. For each drawpoint in the trial, the regularity or irregularity of flow was analysed based on the recovered markers and the drawn tonnage. Correspondingly, the relationship between flow characteristics and observed fragmentation in drawpoints was analysed. The gravity flow of the Smart Markers revealed that current drawpoint spacing provides the interaction conditions of adjacent flow zones. However, it is possible to increase the drawpoint spacing while allowing caved rock to be extracted from the major and minor apexes.The results of this research also verified that full-scale test data are the predominant factor in the production level design and production control at El Teniente mine.CITATION:Garcés, D, Viera, E, Castro, R and Meléndez, M, 2016. BHP New Zealand Steel produces iron from titaniferous ironsand by a direct reduction process comprising multihearth furnaces/rotary kilns/electric iron melters. The electric iron melter is a six-in-line rectangular submerged-arc furnace which takes the partially reduced ironsand (80 per cent metallisation) from the rotary kiln and completes the reduction process to produce iron of nominally three per cent carbon. As the melter operates at around 1500¦C and under very hostile conditions, it is near-impossible to obtain any basic operating parameters such as the velocity and temperature distribution in the slag and in the molten iron. As a first attempt to understand the operating conditions inside the melter, a scaled room-temperature model using wax and water to represent the slag and iron, was constructed. This paper will report on some of the preliminary model results on the temperature distribution.

The Clyde Power Project, and its Clutha Valley Development forerunner, has taken widespread investigations for various hydroelectric purposes both along the valley floors upstream from Alexandra and on the higher schist terrain. As part of this work the nature and extent of many of the alluvial deposits have been resolved and the ages established with varying precision. Gold values have been approximately appraised in some areas as an element of environmental assessment.

Cement production in Australia approximates 6.5 million tonnes per year. Cement clinker is sourced from 15 plants which operate 28 kilns. Cement grinding is conducted at 14 of the clinker plants plus 7 grinding plants. Average annual capacity per kiln or plant is lower than in many overseas countries, but kilns introduced since 1970's have been of larger size more in keeping with size trends overseas, although still smaller than the large units overseas. Substantial economies in capital and labour costs can be achieved in large production units, particularly with dry process kilns using precalcination techniques in which part of the fuel is introduced in the static preheater section ahead of the kiln while the balance is added to the kiln in a conventional manner. Precalcination techniques have been introduced to the Australian cement industry but as cement transport costs form a major part of supplying diverse market areas, the size of kilns is likely to remain less than maximum owing to balance with distribution costs. The cement industry uses significant amounts of thermal and electrical energy which can be minimised by proper selection of equipment and technology. Labour costs are also significant and can be contained by automation and computer control of the process.
