All branches of production engineering showed steady and definite progress during 1941. Most of it has been of the slower and more conservative type rather than the sensational. To a large degree the changes have been influenced by the expanding war economy, and this tendency will probably be even more marked during the coming year. The stress of the times is placing more emphasis on the principles of engineering and conservation, with the object of obtaining the greatest possible recovery with a minimum waste or expenditure of equipment. Also available material supplies are often being turned to new uses.

STATISTICAL methods are becoming increasingly important for inter-preting routine reports, or for analyzing special test data in industrial plants, such as steel plants. They have already become practically a necessity to the plant metallurgist. A paper by Chancellor,1 written in 1933, gives many examples of the benefits the plant metallurgist can derive from the use of these methods. The present paper discusses applications of importance to many others who must analyze reports in the steel plant, as well as other examples of interest to metallurgists. Statistical Methods Logically Suited to Plant Problems.-Statistical methods are not new as a branch of mathematics. Until comparatively recently, however, practical applications were confined mainly to actuarial science, biology, and economics; fields in which an observed result is obviously influenced (and often determined) by a complicated set of vari-ables more or less constantly tending to affect it. As pointed out by Daeves, 2 a decade or more ago, problems in industry are basically similar to those in these other fields in that a given result is at least partly due to that chance combination of causes happening to be present at the time. When trying to do the same thing repeatedly, constant results are never attained; they vary about the desired result with more or less well defined mathematical regularity. Such a condition arises out of the great number of factors tending to affect the final result. If statistical methods are so valuable to the biologist or economist, why then should they not also be of great value to plant managers and engineers, and to all who must interpret reports from various sources in the industrial plant? Within the last few years, industry has become conscious of this situation, and the use of these methods has been rapidly expanding in such plants. ?

In low temperature phase diagrams, liquidus curves below about 1500°C are relatively easily established, e.g., by thermal analysis or separation of coexisting solid and liquid phases, followed by chemical analysis. Experimental difficulties increase considerably at higher temperatures and in systems involving more reactive metals. Although there are now thermocouples available for use from 1600" to 2400°c, as summarized by Caldwell,' the need for frequent calibration, aging, and contamination problems, and unavailability of suitable protection tubes has sharply limited their use at higher temperatures. Many of the high melt- ing metals are found to react with refractory oxides. TO avoid such problems, a frequently used procedure is the diffusion and saturation method, as described by Spedding et a1.' for the system La-C. This technique involves the annealing of one metal or a suitable alloy in a crucible of the other element at a temperature above the melting point, followed by chemical analysis of the center of the melt, after equilibrium is established. Further, if an alloy system is to be investigated employing the electron microbeam probe, and calibration charts have been established, it may be possible to measure the alloy concentration at the center of a cored as-cast structure, and to conclude from this points on the liquidus curve in a manner similar to the one to be described. It is known that in phases with a broad homogeneity range the rapidly cooled, cored, as-cast structure of an alloy presents concentrations having different lattice constants; this spread of lattice constant values contributes to the broadened lines of a powder pattern for the as-cast condition. The region of the crystal which is first to solidify will then correspond to the edge of the lines if the change of the lattice parameters with concentration is monotonous. Howe, New York, N. Y. :-I think we can hardly rate the importance of the entry of the Bureau of Standards into our field. There is no body in the world that is better fitted to undertake this work than that Bureau, and it is work which really calls for the aid of some national organization. The skill and care with which this work has been done speaks for itself. It is very striking that within a very few months the distinguished English investigator, Professor Carpenter, of whom I spoke before, thought that he had disproved the existence of beta iron by proving that the A2 retardation which Professor Burgess has now demonstrated did not occur. Dr. Burgess's demonstration of the existence of. this retardation makes the existence of beta iron very probable, in my opinion. Osmond used to call beta iron " decipuum." You knew of its existence as you know of the existence of certain planets, only by the perturbation which it caused. Certain phenomena could not be explained, except by assuming the existence of a third allotropic form, beta iron. The evidence that you got was always evasive and susceptible of other explanations, except that which we have to-day, which it seems to me is not capable of other explanation. Professor Carpenter proceeded in the same way that Dr. Burgess has, by taking the heating and cooling curves of exceedingly pure iron, and thought that he had shown that there was no thermal change, no absorption or evolution of heat at the supposed A2 point, and hence that the A2 point did not exist. This he did by a piece of reasoning which I think seems to most of us rather surprising. That is to say, if of ten witnesses, three have seen a thing and seven have not, the evidence of the seven who have not is set aside, and that of the three who have seen stands. In Dr. Carpenter's own experiments under certain conditions he found the A2 change, the heat evolution., under certain others he did not. That is like the three witnesses who saw and the seven who did not see. You can arrange your test so that this change will not become visible or so that it is masked. But though an existent change can be masked a non-existent one cannot be shown. So that the reasoning seemed to me wholly fallacious.

Discussion of the paper of Woolsey McA. Johnson, presented at the Butte meeting, August, 1913, and printed in Bulletin No. 79, July, 1913, pp. 1137 to 1145. F. L. GRAMMER, Leesburg, Va. (communication to the Secretary *):-Mr. Johnson's paper must interest by suggestion those connected with the " burning " of lime, the production of cement, and the smelting of iron. All iron men know how quickly the impalpable purple ore of wet origin reduces compared to finely ground red hematites of approximately identical composition obtained from Lake lump ores. Most housekeepers appreciate that the several forms of carbon-charcoal, coke, and anthracite, not to include graphite and diamond -have different temperatures of ignition. The temperature usually rises with the density and hardness. Some of the scientific bureaus of the government might appropriately conduct some tests along lines suggested by Mr. Johnson's article. We are unable to say whether the topic lies within the spheres of activity of the Bureau of Mines, the Bureau of Soils (Agricultural Department), the Geological Survey, or the Bureau of Standards. The calcining qualities of limestone is a topic too wide for individual effort and is of wide enough interest to merit government or State activity. It is of interest, as aforesaid, to burners of lime, cement manufacturers, and smelters. The chemical composition of a limestone does not tell all the story -if over 1-in. size lumps. The limestones of Annville and Myerstown, Pa., break at a tap; those on the Hudson above Poughkeepsie .act like "nigger heads." The manager of lime kilns near Lake Champlain told me his fuel consumption was high compared to that at other points. Yet the Hudson and Annville stones were both of greatest purity, being rivaled by only the marble at Rutland, Vt., or some stones near Martinsburg, W. Va. A local kiln operator says the conglomerate or pudding limestones of Loudoun county, Va., act very differently in the kiln from the more normal limestone deposits nearby. The tilted and twisted bedding in the anthracite region tells the story of hard coal origin. We might therefore expect that the limestones of greater geological age or depth or metamorphism

Many fields, where the reservoir is composed of sandy layers, show great complexity because of the lack of continuity which results from a particular type of seditnentation. This complexity may be a factor of prime importance in studying reservoir drainage, especially in the displacement of oil by water or gas. This paper describes work done to study this heterogeneity and its influence in the exploitation of the fields of the lower Devonian sandy shale in the Fort Polignac Basin in Algeria. Two lines of research were followed. 1. On the border of the hasin, a detailed sedimentological study established rules for the distribution of the sandy zones, which furnished hypotheses necessary for devising a geologic model of the reservoir. A certain number of sandy zones were recognized and characterized by their sedimentation. 2. In the interior of the basin, production logs deterrnined the productivity profile. Study of these point data led to a description of the distribution of oil and gas phases in the reservoir so that the continuity of different zones between the wells could be deduced. These techniques were applied to the study of the lower Devonian sandy shale reservoir of Zarzaitine. The sedimentological study guiding the correlation work, with the aid of the conventional static data (logs and cores), led to the establishment of a useful geologic model of the reservoir. Production logs, thanks to the contribution of dynamic elements, permitted corrobora-tion of the model. In particular, the logs confirmed separation, as proposed by the sedimenfological study, of two comparable sandy groups by revealing the continuity of a thin impermeable layer, invisible on conventional logs. INTRODUCTION The heterogeneity of sandstone reservoirs considerably influences the distribution of fluids, as well as their displacement in the reservoir. Rational development of a field and maximum recovery of hydrocarbons are closely tied to an exact and precise knowledge of the intern architecture. We will try to show how it is possible I refine the knowledge of the reservoir by seeking qui different and varied sources of information. Productic geology, the group of techniques which leads to idei concerning reservoir architecture and its geometric descris tion, furnishes the framework of this undertaking. Of these techniques. those used so far are qui varied. Descriptive as well as quantitative, the technique partake as much of classical geology as of reservo science. They include (1) geologic studies of the enti basin, especially a stratigraphic and sedimentologic study of the reservoir member at its outcrop, detail1 observations of cores taken from wells and, finall oriented cores; (2) interpretation of geophysical dat (3) interpretation of electric logs, nuclear and sonic lo and dipmeters: (4) petrophysical study of the reserve on samples taken from wells; (5) reservoir dynamics (stu of the production history and, in particular, interpretati of production logs); and (6) analysis of the fluids a thermodynamic studies. This incomplete list could also include (1) study the migration of the fluids, (2) geochemistry (chemi characterization of the oils), (3) regional hydrodynamii and (4) injection and detection of tracers. If most of these techniques are classic, attention i nevertheless be called to applying two of the techniql in conjunction: the study of the reservoir member its outcrop and the study of dynamic distribution fluid phases in the reservoir through use of product logs, used in the study of the sandy shale reservoirs the lower Devonian of the Fort Polignac Basin, Alge in particular, their application to the study of the 2 zaitine field where they have led to a new and satisfact model of the reservoir will be described. THE district of Catorce, San Luis Potosi, ranks among the first half-dozen silver-producing camps f Mexico. Mining has been more or less continuous there for 150 years. The large producing mines, Mapum, Mazapil, Palomas, Musquiz, Minas Virjas, now for the most part idle or abandoned, are grouped around the head of two valleys: one, which drains to the west, falls 2000 ft. (609.6 m.) in 4 1/2 mi. (7.2 km.) between the main Catorce and the western foot of the range and is characterized by steep canon walls; the other, east of the main town of Catorce from which it is separated by a high divide, heads in a number of steep tributaries above the basin in which lies the town of Potrero and flows nearly north for 10 mi. (16 km.) to the northern base of the range; below Potrero, it has for the most part gently sloping valley walls and a broad valley floor. The Sierra Catorce is the highest range of the region, the summits reaching altitudes of over 11,000 ft. With the exception of a few cliffs of the erosion escarpment of the lower limestone and the canon walls below the main town of Catorce, which is the highest town in Mexico, the gently rounded slopes are characteristic of a maturely eroded mountain range composed of folded sedimentary rocks. As is usual in desert regions, the heavy-bedded limestones are the most resistant to erosive forces. Folded into anticlines, they form the mountain ranges; and the intermontane valleys and basins, originally carved out of less resistant shales, clays, marls and sandstones, are covered by debris forming a mantle with surface gradually rising upwards toward the hills. In time, the debris buries, in deposits formed from their own ruins, all but the highest summits of the original mountains; some f this region has already nearly reached this stage. Most of the debris is firmly cemented by calcium carbonate (caliche). Solution f the limestone by meteoric waters afforded the supply of lime carbonate, which has been redeposited upon evaporation of the waters as a cement binding the boulders, pebbles, and finer detritus.

Although so common and well known a metal, tin is really a less abundant element than many of those less familiar and usually ranked with the scarce or rare elements, such as cerium, yttrium, lithium, beryllium, titanium, zirconium and vanadium. The color of tin is white, with a slightly bluish tinge. When it is compared with nickel, the latter metal is brown. When placed alongside of tin, chromium is definitely blue. Tin is whiter than silver or zinc. Exceedingly thin films of tin show various shades of brown by transmitted light. The metal has a brilliant luster, and when mirror-polished, has high light reflectivity. The luster depends to a large extent upon the pouring temperature at which the metal is cast. If the temperature be too high, iridescent colors may show on the surface. These are the result of oxide film formation. If the pouring temperature be too low, the surface is dull. Small amounts of foreign metals, such as lead, arsenic, antimony and iron, decrease the luster of tin and impart a yellowish tinge to the metal. The structure is decidedly crystalline. The cast metal is a mass of crystals. When a bar of tin is bent, it emits a characteristic creaking sound. This is called the "cry" of tin, resulting from the grinding of the crystals one against the other during the bending of the metal. Tin metal may lose its crystalline structure by cold working, but grain growth occurs rapidly under the influence of heat. Metal which has been cast at a low temperature may become amorphous as the result of mechanical work. If such material be heated to temperatures well below the melting point, say at 110° C. for a half hour or for a few minutes at 150" C. recrystallization occurs. If the surface of tinned plate, tin foil, or tin meta1 in cast form be etched with hydrochloric acid containing a little free chlorine, attack occurs at the intererystalline faces. The surface shows patterns resembling the frost flowers on window panes in winter. The etched appearance is called moire metallique. Fine dendritic surface crystals of tin may be obtained by casting the metal on a surface of polished steel. THE search for oil has required, and without a doubt supplies, a tremendous amount of information on the structure, composition, physical properties, and history of sedimentary rocks. The earliest and most complete source of knowledge is the sample or core of the rock itself, the uses of which are well known. The purpose of this paper is primarily to discuss a new method for obtaining these cores, and to illustrate its use in connection with electrical logs. Most cores have been obtained through a special adaptation of rotary drilling, and the results have been remarkably good, considering the mechanical problems involved. Unfortunately, because of the time and expense, this method cannot be used for the entire length of the drill hole. Even though ingenious contrivances have been evolved in order to reduce the time spent in round trips, such as wire-line coring equipment, mechanical coring still remains too expensive to be carried out con-tinuously. In practice, therefore, one is finally compelled to estimate the probable depths of the more interesting horizons and, allowing a wide margin of safety, to core through those sections only. It is true also that interesting results have been obtained by examining the cuttings brought to the surface by the mud circulated in the well during the process of drilling. Be that as it may, the inescapable fact remains that key horizons may be passed inadvertently, for one reason or another, while the drilling operations are being performed. The only continuous record of the formations encountered is that furnished by electrical surveys. Obviously, it would be desirable to make the electrical survey first and to take the samples from the wall of the hole according to the indications on the electrical log. In this way, it would be possible to core only the exact sections desired, eliminating the otherwise inevitable estimates as to the point at which to start coring, and thereby reducing to a minimum this expensive operation. At the same time this method would provide a maximum' of useful samples.

In the seven years that have elapsed since the AIME World Symposium on Mining and Metallurgy of Lead and Zinc, there have been a number of significant milling innovations and trends implemented in lead-zinc flowsheets to either improve grade and recovery or to control escalating mill costs. First, mill controls and instrumentation, which only had a foot in the door in 1970, have become increasingly common. In Australia, research into automatic crushing control has been implemented by Mount Isa Mines, and in virtually any large lead-zinc mill worldwide, an assortment of on-stream x-ray analyzers, grinding circuit controls, level detection devices, and reagent metering methods can be found. The increased circuit control offered to mill operators by this new technology points to more efficient flowsheets, as well as to a greater dependence upon computer-controlled operation.

Raymond, New York City: In connection with the subject of multiple tuyeres, my attention has been drawn to the practicability of gaining, without the multiplication of tuyeres, the advantages which that measure is intended to secure ; and learning that this had been attempted in the invention of the Gaines radial-discharge or fan-shaped tuyere, I wrote to Messrs. Gustafson Brothers, of Sequachee, Tenn., who manufacture that tugere, for information concerning the invention itself and its performance in practice. To their courtesy I am indebted for most of the facts given below. I present these statements without expressing any personal opinion on the subject (having no personal knowledge of it), for the purpose of bringing this device to the notice of members, and calling forth both criticism and testimony concerning it. Admitting that definite advantages are to be secured by the multiplication of tuyeres, we must still confess that this change involves considerable expense in the increased number of blastpipes, tuyeres, coolers, connections, and pipes for water-circulation. There is, moreover, a serious question involved in the weakening of the furnace-wall by extra perforations. This consideration applies with special force to furnaces already built without reference to such an increase of tuyere-openings. Ledebur, in his Handbuch der Eisenhüttenkunde, says on this point (I translate from the edition of 1893, page 365): "A limit to increase in the number of tuyeres is given, in any case, by the circumstance that the perforation of the wall weakens it; in other words, that there must be left between the tuyeres a mass of masonry sufficient to carry the parts above. In most cases an appropriate number may be secured by giving to the furnace as many openings as there are meters in its circumference at the tuyerelevel. For instance, for a hearth-diameter of 2.5 meters, i.e., a circumference of 7.7 meters, seven or eight openings might be made, of which, however, one would

Four types of slope failures in waste dumps are recognized debris flow, foundation failure, edge slump, and blowout. The first three types, although at times causing considerable damage to property and interfering with mine operations, are not usually dangerous to personnel because of their slow rate of movement. The fourth type, the blowout, is the most dangerous because of its explosive mode of failure and lack of forewarning. The December 1969 failure at Verona dump is presented as an example of a blowout. Data from piezometer holes indicate that the blowout was due to perched leach solutions near the face of the dump. The level of water in this zone is very closely related to the rate of leach water application on the dump. A detailed analysis of core samples indicates that the impounded water was perched on a zonal accumulation of jarosite which is associated with a buried dump surface. Drain holes proved successful in controlling perched leach solutions in the critical zone near the face of the dump. Monitoring of the water level in the perched zone is considered essential in preventing blowouts. The use of drain and piezometer holes has allowed an increase in the rate of water application on the dump while preventing additional failure.

THEM is acute need for a method that will measure the size distribution of finely divided materials, particularly when the particle sizes are smaller than the openings of the finest screen cloth regularly available for testing. Several methods and types of apparatus are in common use, but none are entirely satisfactory for all purposes. The commonest methods are microscopic grain counts, elutriation by liquids or air, and sedimentation. Valuable results have been secured by air elutriating devices, typified by the Haultain Infra-Sizer and the Pearson Air Analyzer. These are especially useful in obtaining sized fractions that can be examined and analyzed separately. They are particularly advantageous because the sizes of the samples produced are adequate for a considerable amount of subsequent manipulation and testing. The sedimentation methods, such as the Wagner and Klein turbidimeters, and the sedimentation balance, do not deliver sized fractions, but they do provide a means for reasonably rapid comparative determinations of fineness and surface area, which are important in many industries. The sedimentation balance consists essentially of a balance pan suspended in a liquid that contains falling particles. These are weighed as they settle onto the pan, and the time rate of settling is determined. The size distribution is computed from the settling rate. The balance appears to be inherently more accurate than any of the other methods, and it has served a useful purpose in the study of numerous problems, but there have been limitations which have restricted its scope of application. Because of the essential simplicity of the method, it was felt that intensive investigation might lead to modifications that would make it a valuable tool for the operators in industries that require precise information regarding the results secured from grinding equipment. A large number of size-distribution determinations below 200 mesh were required in connection with a particular research problem in fine grinding. The sedimentation balance was used in this investigation, and a technique was gradually developed that ultimately gave good results. A serious difficulty appeared early in the work. It was discovered that less material always settled on the sedimentation pan and more on the bottom of the containing jar than could be accounted for by calculation, and also that the material that settled to the bottom of the jar outside the edges of the pan was considerably finer than that on the pan. This segregation was so great that the distribution obtained for the finer sizes was obviously very much in error; material ground to about the degree of comminution of cement might have only 60 per cent of the calculated weight actually settling on the pan, and the error increased with the fine-

Mechanical properties of columbium have been studied over the temperature range of -196 to 1093oC. The decreased strengthening influence of cold-work at temperatures below ambient has been interpreted in terms of the Peierls-Nabarro effect. Maxima in the rate of strain hardening observed during tensile testing in the range 250-600°C. have been correlated with interstitial impurities to indicate the temperature ranges at which carbon, oxygen, and nitrogen, respectively, are responsible for strain aging. THE growing need for structural materials for use above the useful service temperatures of the iron-, nickel-, or cobalt-base alloys has caused the refractory metals to be considered as potential engineering materials. These metals, which include columbium, tantalum, molybdenum, and tungsten, are called refractory because the lowest melting point among them,that of columbium, is about 1000°C higher than the average melting temperatures of conventional high-temperature alloys. They are all body-centered cubic transition metals and, as such, their mechanical properties have basic characteristics which distinguish them from the face-centered cubic metals. For example, all show a much steeper rise in strength with decreasing temperature below room temperature than do the face-centered cubic metals, and their mechanical properties are strongly influenced by interstitially dissolved impurities. In order that these new metals may be used efficiently, it is necessary that their characteristics of behavior be fully known. In this paper, the mechanical properties of columbium will be examined over a wide range of temperatures. In particular, the influences of cold-work and individual species of interstitial impurity atoms on mechanical properties will be described, and basic mechanisms which may control the observed characteristics will be explored. EXPERIMENTAL The material used in this investigation was Union Carbide Metals Co. columbium roundels consolidated to four 4-in. diam ingots, three by consumable-electrode arc melting and one ingot by electron beam melting. Impurity contents of the ingots and methods of ingot conversion and treatment are summarized in Table I. The only metallic impurity occurring in any significant quantity was tantalum at about 0.1 pct. Iron, silicon, titanium, and zirconium were each less than 0.015 pct; boron was 1 ppm or less. This should have no appreciable influence on properties. The electron beam melted material, being the purest, will be used as the basis for comparison in the discussions to follow. Tensile tests were conducted from-196 to 1093oC, on both cold-worked and fully recrystallized arc-melted and electron-beam melted columbium using standard 1/4-in. diam, 1-in. long gage length test specimens. A strain-rate of 0.005 in. per in. per min was employed until the 0.2 pct yield strength was achieved and then the strain-rate was increased to 0.05 in. per in. per min for the balance of the test. Samples were protected in an inert atmosphere at tests above 300°C. The tensile properties obtained on the electron-beam melted columbium, E, in both the cold-swaged and recrystallized conditions are given in Fig. 1. The yield strength data of Dyson, et al.,' obtained on recrystallized electron beam melted columbium and the tensile strength data reported by Tottle2 on powder metallurgy columbium are included in Fig. 1. The material used by Tottle had been purified by vacuum sintering. There is excellent agreement between Dyson's data and those obtained in the present investigation. The tensile strengths obtained by Tottle were slightly greater than those obtained in this investigation on electron-beam melted columbium but varied with temperature in a similar manner. Tottle's data showed a maximum in tensile strength near 500°C, as did our data on electron-beam melted material, and also showed a small maximum at 300°C. The significance of these maxima will become evident later in the discussion. The tensile properties of cold-swaged and recrys-tallized arc melted columbium are plotted in Fig. 2. It was found that the properties of the recrystallized arc-melted columbium from all three heats showed very close agreement except at temperatures between about 500" and 800°C. A reason for this range of disagreement will be suggested in the discussion. The generally good agreement, however, attests to the ability of cold-working and subsequent recrystal-lization to erase the effects of the three different primary breakdown procedures and to produce nearly equivalent structures in the samples derived from the three different heats. wesse13 reported tensile data on columbium having interstitial impurity contents between those of the

THE professional career of Thomas Septimus Austin, who died at El Paso, Tex., August 23, 1906, was contemporaneous with the growth of the silver-lead smelting-industry of the Far West, to which his talents and zeal contributed in no small degree. Born at Stratford, Conn., December 7, 1853, he was the seventh son in a family of thirteen. His parents were well-to-do; and he received a thorough preliminary training at the Hopkins Grammar School, New Haven, Conn., passing thence to the Columbia School of Mines, in New York, where he was graduated in 1876. His first professional work was that of analytical chemist with a Cuban sugar company. In this position he spent a year, and, whatever else of benefit he may have acquired during that year in Cuba, he gained a facility of speech in the Spanish language which was of inestimable value in his subsequent work in Mexico and the southwestern United States. In 1877, he went to the Rocky Mountains, and, under the firm name of Murphy & Austin, opened an assay-office in Leadville, Colo., which was just then coming into public notice as a rich silver-lead camp. The next year, however, he entered the service of the Germania Smelting & Refining Co. at Salt Lake City, Utah, where he remained until 1882, first as assayer and chemist, and later as Assistant Superintendent. The Germanic bears the honorable distinction of being one of the first of the large " custom " lead-smelters erected in the West. Its founders may be called the pioneers of the modern lead-smelting practice, and the Germania served, to a large extent, as a model for the many plants that sprang into existence during the next few years in Utah, southern Idaho, Colorado and other lead-producing districts. On August 4, 1844, J. C. Fremont made the first record found of coal in Wyoming. On the North Fork of the Platte River, beyond Medicine Butte, in Carbon County, he noted: "in the precipitous bluffs were displayed a succession of strata containing fossil, vegetable remains, and several beds of coal. In some of the beds, the coal did not appear to be perfectly mineralized; and in some of the seams, it was compact and remarkably lustrous." A little later he noted, "longitude 111°, latitude 4 1/2°-Muddy R.--coal."1 In 1848, Clayton reported coal on Sulphur Creek near the site of old Bear River City, in Uinta County.2 Maj. Osborne Cross in his journal, on July 1, 1849, records seeing coal on Deer Creek and in one of the hills near Crooked Muddy Creek, in Converse County; on July 7, he records that the country from Deer Creek to the Sweetwater River abounds in coal, probably in Natrona and Carbon Counties.3 A letter from Asst. Quartermaster Van Vliet to General Jessup dated July 25, 1850, asked an appropriation for building shops at Fort Laramie for making repairs for the emigrants, and mentions "coal and timber," but undoubtedly meant charcoal, as no other mention of stone coal is made in the records of the fort.4 Stansbury, in 1852, placed on his map of this section the words: "Great Coal Basin," extending from the west bank of Bear River, near the present Evanston, to Point of Rocks in Sweetwater County. In 1859, a military coal reservation was established near here, but the coal was never worked to any great extent, although probably some was hauled to Fort Bridger for smithing purposes. When the fort was abandoned this reservation returned to the public lands .2 In the same year (1859), Hayden traced the lignite formation uninterruptedly from the upper Missouri Valley to a point on the North Platte River, about 80 miles northwest of Fort Laramie.5 On August 25, 1865,

During the first half of the year 1935, the oil industry in California was on a fairly profitable basis, owing mainly to the operation of the Petroleum Marketing Agency. Coincident with the discontinuance of enforced curtailment, California production surged upward from an average of about 500,000 bbl. per day (over the first five-month period) to approximately 625,000 bbl. per day (over the last seven-month period). On Dec. 9 the state production had reached a peak of over 700,000 bbl., a figure that had not been approximated since the early days of voluntary curtailment (Fig. 1). A price cut was instituted during the last half of August, but had no deterring effect on operators that were determined to take advantage of the breakdown of curtailment and produce to capacity. New reserve figures, compiled from actual potentials, available after cessation of curtailment, revealed the startling fact that California reserves were rapidly declining. This situation, coupled with the desire among operators to obtain a more equitable price for their dwindling reserves, caused a restoration in November of a portion of the August price slash. A further rise in price was effected in early December, and crude quotations at the end of the year closely approximated those in effect during the first right months. At the close of the year, the industry felt confident that the production situation was under control. In all fields where competition is keen because of close spacing, production is gradually declining. In the Los Angeles Basin especially there is no likelihood of a large amount of overproduction, unless a new pool is discovered or deeper drilling reveals a prolific source of crude. As long as the fields that are operated by a few companies, such as Kettleman Hills, North Belridge, Ventura Avenue, West Coyote, Dominguez, and some others, can be controlled, it is believed that the overproduction problem in California will be solved.

I fear most of the Institute members are already weary of the perennial controversy about the apex law. I feel that way about it myself now, though I have been guilty of considerable contribution- to the discussion in the past. The discussion does not seem to perceptibly influence previously held views and I would not again break into print on the subject but for the urgent invitation of the Chairman of our Law Committee. This energetic and able member has firmly determined to secure a revision of the mining law and among other things to eliminate the so-called apex provision from the U. S. mining statutes. He is, however, fair about it and has invited me to make ((the strongest possible argument in its favor." I am suspicious that he is acting on the psychological principle that it is usually easier to convince an audience against a cause vigorously but unsuccessfully defended than against one wholly mute. Nevertheless, I realize that personally he wishes me no harm, much as he hates the apex law, and so am willing that the Institute have whatever benefit may accrue from my taking up again the unpopular side of the discussion. I say this because the attitude of a large part of our "articulate" membership seems irreconcilably hostile; their minds are made up; favorable consideration is foreclosed; and they become impatient and even sarcastic at any attempt to elucidate a favorable view of the apex law. The exact question for discussion at the present time is not whether on abstract, or any other considerations, the apex law is the best possible rule, but the very different proposition whether, after nearly 50 years of statutory life and much longer as a practically universal miners' custom, it is now just and expedient to repeal the apex law. At this point it seems to me that we may profitably devote a paragraph or two to the subject of the origin of law in general, as we are presumed to be considering the subject from the high viewpoint of the general welfare of the nation. The most comprehensive and accurate definition of law in the legal sense is, that it is the body of rules for the regulation of human conduct which is enforced by the State, that is, by the nation.l Legal
