Arbitration is a legally recognized alternate litigation for the resolution of civil disputes. The parties agree, either before or after a dispute arises, to submit that dispute to an independent third party for resolution. The decision of that third party is binding on the parties. A decision of an arbitral tribunal, typically referred to as an "award," cannot be reviewed by a court except on very limited grounds, such as fraud. See, e.g., Va. Code 8.01-581.010. Indeed, an arbitral award is typically less subject to judicial review than the decision of a trial court, whose decisions are almost always subject to appellate review as a matter of right. Arbitration is typically the result of a contractual agreement between the parties to submit disputes to arbitration. On occasion, arbitration can be required by statute. For example, the California Department of Transportation requires the arbitration of all disputes arising under its contracts. Public Contract Code, Article 7.1 (§§10240-10240.13). There may be a question whether statutorily required arbitration is truly arbitration or an administrative law disputes resolution procedure. The significance of the difference is that the decisions of administrative law bodies are typically reviewable by a court of law as a matter of right while, as set forth above, arbitral awards are almost never reviewable.

Measurement of rock fragmentation has evolved from a completely subjective and manual process to a statistically objective and semi-automated process. However, ultimately, the vision is to achieve a statistically representative and fully-automated process. From the blast optimization perspective, it is critical to receive reliable rock fragmentation results quickly to incorporate into the planning of subsequent blasts. Since manual rock fragmentation measurement methods tend to be time consuming, a fully-automated method is the practical way to meet these requirements.

State mining regulations in Queensland stipulate that a mine be provided with an earth installed on surface and that all underground equipment that needs to be earthed should be connected via a copper conductor to this surface grounding point. The regulations further require that all exposed metal surfaces in underground substations be connected to an earth. In a study of earthing conditions at Mount Isa mine it was found that the physical anchoring of metal work at substations (with rockbolts and associated steel mesh) also provides an excellent electrical connection to the country rock. It was established that not only is the mine's earthing system grounded at numerous underground locations but also that such anchor points offer, in general, a path to ground with lower resistance than does the legally required grounding point on the surface. It is recommended that metalliferous mines should utilise a multiple-earth system and not a run earth connected to a single, above-ground earth point

The center of Berlin is currently a huge jobsite, where international architects, designers, consultants, construction and ground engineers as well as investors take on the challenge of the biggest and probably most complicated projects in terms of soil conditions in Europe. The Berlin sand is generally suitable for foundation measures, but can be very tricky in deep excavation pits below the high ground water level. The reason for this is its uniform grading, medium dense stratification and lack of cohesion. The requirements for these deep pits are: - measurements in the range of up to 120 000 m2 per pit - depths up to 19 m below ground water level - lack of dense horizontal geological layers - no permission for lowering ground water levels - toughest ever European competition in construction. Sheet pile walls, sheet piles set into cut - off walls, secant pile walls, diaphragm walls, all with tie backs under high water pressure, are used as retaining sytems. The pits are closed at the bottom against water either by under water concrete, deep lying grouted cut - offs or high lying jet - grouted cut - off slabs. The huge dimensions of these excavation pits are a new challenge for ground engineers, and new technology had to solve the upcoming problems and resulted in new experience.

Large amounts of limestone fines co-produced during the processing of crushed lime-stone may be useful in the sequestration of carbon dioxide (CO2). Accelerated weathering of limestone (AWL) is proposed as a low-tech method to capture and sequester CO2 from fossil fuel-fired power plants and other point sources such as cement manufacturing. AWL reactants are readily available, inexpensive and environmentally benign. Waste CO2 is hydrated with water to produce carbonic acid. This reacts with and is neutralized by limestone fines, thus converting CO2 gas to dissolved calcium bicarbonate. AWL waste products can be disposed of in the ocean. Feasibility requires access to an inexpensive source of limestone and to seawater, thus limiting AWL facilities to within about 10 km (6 miles) of the coastline. The majority of U.S. coastal power-generating facilities are within economical transport distance of limestone resources. AWL presents opportunities for collaborative efforts among the crushed stone industry, electrical utilities, cement manufacturers and research scientists. There is a concern that CO2 generated from human activities is contributing to climatic and environmental changes. Approximately one-third of anthropogenic CO2 emissions come from burning fossil fuels to generate electricity. Each power plant is capable of emitting several million tons of CO2 annually. A variety of other industrial processes, such as cement manufacture, oil refining, and iron and steel production, also emit large amounts of CO2. The level of atmospheric CO2 can be reduced by capturing CO2 from point-source emissions and storing or sequestering it in isolation from the atmosphere (U.S. Department of Energy, 2003). In 1999, G.H. Rau and K. Caldeira proposed a geochemistry-based method that is referred to as accelerated weathering of limestone (AWL) in a paper titled ?Accelerating carbonate dissolution to sequester carbon dioxide in the ocean ? geochemical implications.?

In New South Wales, development applications for major coal mining proposals are determined by the Minister for Planning and Environment and applications for mining leases and other mineral titles are dealt with by the Minister for Mineral Resources. The environmental conditions placed on the development consent, the coal mining lease and the approvals and licences under the pollution control legislation, amount to a substantial component of any new project's planning and commissioning considerations.An outline is presented of the framework within which various approvals are granted and conditions for environmental management are imposed upon mining projects. The principles and concerns, as perceived by the regulatory authorities, on which the majority of approval conditions are based are also outlined.No attempt has been made to analyse the extent to which these principles or standards are achieved in practice, nor to discuss the degree to which some of the conditions are achievable with the current status of technology and economics in the coal industry.

The heat balance and chemical equilibria involved in the production of blister copper from a chalcopyrite concentrate in a single operation are examined. It appears that two stages—one oxidising and one reducing—will be required. The analysis indicates that on thermal grounds the process is possible with a dry, high-grade chalcopyrite concentrate, if oxygen enrichment to about 30 per cent is used, but that copper losses in the slag will be serious and will require a secondary recovery operation. More extensive data on the activities of copper oxide in slags are required to elucidate this point more effectively

The paper describes solutions given to foundation problems during the reconstruction of a power plant set on fire, located adjacent to several still Working Units. After a detailed site and laboratory investigation, it was decided that it could be possible to include within the new foundations the preexisting cast in situ driven piles with enlarged base 50 cm in diameter and let them work with new 41 cm driven, cast in situ piles without enlarged base. Demolition of existing caps was carried out with expansive mortar in order to avoid any possible damage to piles, whose actual conditions were checked by several load tests. New piles were designed to support service load by shaft resistance, in order to limit total and differential settlement. When piles had to be driven adjacent to nearby structures, measurements of peak soil particles velocity were carried out while driving piles at decreasing distance from critical locations. By preboring most of the upper clay layer it was possible to reduce within safe limits for structures the induced vibrations.

The iron ore deposits of the Port Hedland district of North Western Australia are associated with band'ed sedimentary iron formations that form part of the local succession of folded and faulted Archaean volcanic and sedimentary rocks. The iron formations are regarded as the protore beds or sources of the iron which became concentrated by supergene processes to form commercial grade iron ore deposits.Iron oxide deposits occurring in situ within the protore beds are considered to be of residual-replacement origin, due to supergene leaching of gangue minerals and' deposition of secondary iron oxides in their place, Two types of deposit have been recognized. Lode deposits are deep lenses of massive hematite located adjacent to major faults. These deposits are thought to be very old and to have originated by supergene processes during the long period of erosion represented by the major unconformity between the Archaean rocks and the overlying Proterozoic beds. The other type, known as crust ore deposits, are shallow cappings of hematite and goethite on hills formed by the outcrops of steeply dipping protore beds. These deposits could have originated as far back as the early Mesozoic and it is possible that the ore-forming process is continuing at a slow rate at the present day.Deposits formed by erosion and re-deposition of material derived from pre-existing residual-type deposits are known as derived deposits. These include conglomerates and scree accumulations of various types and ages and pisolitic deposits formed by supergene leaching of transported detritus. Derived deposits range in age from early Proterozoic to Recent. For nearly two decades water scientists have been debating the need to use appropriate models for the questions being asked and the data available. This paper puts forward a rationale for a hierarchical framework for water balance modelling as it applies to mine sites. The hierarchy is based on the complexity of models and their data requirements. Scientific models are the most complex and require the most data; next is engineering models, then systems models and the simplest representations are given by conceptual models. A position is put forward that systems models have a range of uses that the others do not provide. A systems model, called SiteMiser, is described and its calibration illustrated. The model is applied to seven coal mines from the Northern Bowen Basin in Central Queensland. Currently, there is little relationship between total water use and coal production. This relationship is not any stronger when fresh (raw) water is compared to reused water. Leading practice water use levels are simulated for all sites. The simulation results demonstrate that there is considerable opportunity to reduce water consumption and, in particular, to import less fresh (raw) water to the sites.

The Pipeline ore body was discovered in March 1991. The construction of the new mine and mill did not start until early March of 1996. Upon completion of permitting and corporate project approval, the 289 million USD project was “fast tracked”. The commissioning began 11 months after start of construction and the project ended 40 million USD under the budget figure. The objective of this paper is to review and highlight the Pipeline Project history from discovery, design, lawsuits, permitting, and re-design through to current - 1998operating practices. Particular emphasis will review the process design, design mistakes, and design successes. The paper will review project history, feasibility, design concepts, operator training, construction, financial and the current operation. Additional discussion will review what design features worked and which did not work within the process plant.

"Milling operations in northern Saskatchewan’s Athabasca Basin have produced uranium continuously since 1975. Over that period, the Athabasca Basin has been one of the world’s premier uranium camps, yielding more than 660 million lb of U3O8. In this paper, the author describes former and current milling operations and discusses why and how the milling process has changed and developed over the past 35 years. The author’s considerations for the future of uranium extraction in the Athabasca Basin close out the paper.INTRODUCTIONThe roughly oval Athabasca Basin in northern Saskatchewan occupies nearly one third of the surface area of the Saskatchewan Shield. Its sandstone-like deposits lie unconformably on the older basement. The basin hosts many high-grade unconformity-type uranium deposits(Saskatchewan Energy and Resources, 2010) for which the Athabasca Basin is world famous. Uranium production in the Athabasca Basin has come from four mills. In the order of startup these are Rabbit Lake, Cluff Lake, Key Lake and McClean Lake. General data (AREVA, 2010; Cameco, 2010; Denison 2010) for each mill are shown in Table 1."

The Late Miocene gold-silver bearing epithermal system at Waihi has some close similarities in its paleo-thermal and geochemical structure with modern, volcanic-hosted geothermal systems such as Ohaaki-Broadlands. At Waihi an extensive braided quartz vein system is enveloped by hydrothermally altered andesites with minor tuff breccias and tuffs. A main stage of vein filling consists of multiple phases of chalcedonic quartz and fine to medium grained quartz, which are accompanied by pyrite, sphalerite, galena, chalcopyrite and acanthite below the base of oxidation. Platy calcite is present locally. Fluid inclusion studies indicate that the main stage quartz was deposited at temperatures of 189¦-273¦C from dilute (Tm of -0.1 to -1.0¦C) fluids that were locally boiling. Homogenisation temperature Th versus Tm data points lie within the field enveloped by dilution and boiling/gas loss paths determined for the Ohaaki geothermal field, and indicates that the parent hydrothermal fluid for the Waihi epithermal system had a similar composition to that at Ohaaki, ie 0.2 wt% equiv NaCl and 3.3 wt% equiv CO2. The hydrothermal alteration mineralogy and the isotopic composition of vein calcite indicate that the hydrothermal fluid contained relatively high concentrations of CO2 , as at Ohaaki. Oxygen isotope analyses of main stage quartz range from 6.1 to 11.6 %0 and of vein calcite from 2.29 to 9.4%0. Calculated d18Owater values for the hydrothermal fluid that deposited the main stage quartz range from 2.0 to -5.7%0, with a trend to less negative values with depth. They are similar to those in the deep chloride fluid in active geothermal systems with a substantial fluid throughput. A high fluid throughput at Waihi system is also evident from the extensive high intensity hydrothermal alteration and large volume of quartz deposited in the vein system.

Cementitious seals are made of foamed cements with strength ranging from 100 to 600 psi. These cementitious seals are usually used at locations where the seal will be subjected to some convergence, assuming that this material can absorb entry closure without compromising the structural integrity of the seal. Prior to 2006, Lake Lynn Experimental Mine (LLEM) conducted full-scale tests on various cementitious seals designed to meet or exceed the 20-psi horizontal static load requirements of the old 30 CFR1 75.335. Both hydrostatic and dynamic loading tests were conducted. The structural response (pressure and displacement readings) obtained from these tests were recorded. The stability of the cementitious seal is based on balancing the load applied to the face of the seal from the explosion against the shearing resistance at the seal/rock interface. Therefore, the properties of the seal/rock interface, such as stiffness, cohesion, friction, etc. are critical to determine the stability of a cementitious seal. These properties are usually assumed by the researchers in their models. This paper emphasizes the importance of having the correct properties of seal/rock interface in the numerical modeling. FLAC 3D models were developed to simulate Celuseal2 cementitious seals subjected to both hydrostatic and dynamic loadings. Using the hydrostatic and dynamic loading test data conducted at LLEM, the static and dynamic properties of the seal/rock interface were back calculated. The FLAC 3D models showed good agreement with the test results.

ON MAY 22 the American Institute of Mining and Metallurgical Engineers will commemorate the sixtieth anniversary of its founding at Wilkes- Barre, Pa., in May, 1871. The Directors have transferred the May meeting of the Board to Wilkes-Barre, and the Pennsylvania Anthracite Section has invited as many members of the Institute as can to be present at this time and to join with their fellow-engineers at Wilkes-Barre in the inspection trip through a portion of the anthracite district that has been planned. Ac- cess to Wilkes-Barre is easy, from nearby points, over excellent automobile roads, or by train. The distance from New York is only about 140 miles. , It is hoped to engage a special car for those travelling by train from New York, which will leave the Pennsylvania Station over the Lehigh Valley Railroad at 11:50 p.m., arriving in Wilkes-Barre the next morning. Return can be made from Wilkes-Barre by sleeper the same evening, arriving in New York Saturday morning. Other trains are available for those who prefer a daylight journey.

Up to the end of World War n, flat-back cut and fill stoping with or without square sets was the universal method of ore extraction. Rapid changes in practice occurred during the post-war years; first, ore extraction was fully mechanized; secondly, the stope design for new levels, notably No. 17 Level Zinc Corporation Ltd. and No. 19 Level New Broken Hill Consolidated Ltd., was modified to suit this mechanization; and thirdly, sub-level and shrinkage stopes were developed in orebodies where cut and fill methods would be uneconomical. The following is a brief survey of the changes that have occurred-most of which were inaugurated during the last five years.ROCK DRILLINGDuring 1951 open stoping was investigated in detail. In order to reduce steel handling problems, forged steel onepass detachable bits were introduced, but were soon superseded by the "Swedish method". Investigation showed that when using a bar and arm mounted 3-in. drifter the overall drilling time was approximately 6 min. per ft. compared with 4 min. per ft. using the light jackhammer-airleg combination with 1-in. hex. by 4-in. collared shank tungsten carbide-tipped steel.Although competitive with tipped steels on a cost per foot drilled basis (excluding miner's time), detachable steel bits proved most unsatisfactory for hard drilling conditions.Rapid blunting necessitated frequent bit changes and thus caused lost drilling time. "Virtual reality, a 3D computer-generated environment, has become a recognized delivery system for many forms of education. This paper describes the application of virtual reality to mineral processing education. An interactive mineral processing visualization module developed at the University of New South Wales, Australia, provides users with an overview of a base-metal concentrator and details about how the mined ore progresses through stages in processing. The module also involves developing instructional based plant layouts and flowsheets in the virtual environment. The simulated environment is achieved through technologies such as 3D graphics, audio feedback, and special peripheral devices to produce interactive environments.Virtual reality has been used in diverse fields including medicine (Riener & Harder, 2012), entertainment (Hsu, 2011), military (Manojlovich, Prasithsangaree, Hughes, Chen, & Lewis, 2003), manufacturing (Zimmermann, 2008; Jiang, 2011), and chemical processing (Squires, Andersen, Reklaitis, Jayakumar, & Carmichael, 1992; Schofield, Lester, & Wilson, 2005). Virtual reality is also becoming the recognized delivery system for education in many fields, including engineering (Bell & Fogler, 1996, 1998; Shin, 2002). For example, VR laboratories have been designed and developed to teach users fundamental features of heterogeneous catalytic mechanisms and absorption columns (Bell & Fogler, 1995), the multi-phase and multi-component blast furnace iron-making process (Babich & Senk, 2009), and to guide users to identify various safety measures while working in a real laboratory (Bell & Fogler, 1996)."
