Pictured on these pages are the eight RMCMI Scholarship Award Winners for the 1989-1990 year followed by a brief profile. All winners, except Emmet Roache from New Mexico, were present as guests of the Institute at the June convention in Steamboat Springs, Colorado to receive recognition at the Welcome Session Monday, June 25, 1990. Each state vice president served as the host for the collegiate winner. In addition to receiving a plaque from the Scholarship Chairman, Dr. Donald Gentry, each winner receives $750 tuition credit for the coming academic year. As this is a continuing award, the winners from the previous year will receive another $750 for tuition credit in their senior year if they have maintained good academic standing and are recommended by their university. Criteria for these awards to be made in the spring annually is (1) That the award be made to a sophomore student and used as tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the state involved. (3) That the recipient have good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. The scholarship program includes curricula other than those in the mining departments, but in the engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholarship program, and the various vice presidents contribute the travel expenses to conventions for these outstanding young collegiates. Profiles of the 1990 Scholarship Winners follow. [ ] Mildred Benally University of Arizona Tuscan, Arizona Mildred has attended San Juan College in New Mexico, and will graduate from the University of Arizona in May, 1991. Upon completion of her, schooling she hopes to pursue a career in the coal mining industry. In preparation for her goal, her work experience includes being a lab technician, a mining engineer intern, and a lab technician assistant; she also is very skilled in various computer applications. She has been a member of SME-AIME, and secretary to the U of A Student Chapter, and recipient of the SME Coal Division Scholarship and past recipient of the Navajo Tribal Scholarship. [ ] Joshua Olmsted Colorado School of Mines Golden, Colorado Josh is a sophomore majoring in mining engineering at the Colorado School of Mines. He is an outstanding student as well as an accomplished athlete. Josh was on the Academic Honor Roll 1988-1989 and has been awarded an athletic scholarship. He plays varsity soccer and intramural basketball.

The final session of the meeting was preceded by a movie, "Contact That Kills," which was a color film clearly pointing out various causes of electrical accidents in mines and how such accidents could he prevented. This film was made underground and produced by the U. S. Bureau of Mines for use in teaching accident classes. President R. R. Williams, Jr., called the meeting to order and introduced Mr. Leif Arentzen of the Lee-Norse Company, Charleroi, Pennsylvania, who spoke on "Coal Mining in Australia." The text of his address is as follows: "I arrived in Australia in February of this year-my father sent me over there for an installation. He preceded me as he does in most things, and set up a showing of our machine in Australia. We had 200 of the top level coal mining men visit this showing. They were interested in what the Americans are doing and what the American manufacturer had to offer them. Conditions in Australia are very similar to our mining conditions in the United States and they have looked to us, the coal industry in general, because we have the know-how in answering some of their problems. They feel that European methods and their type of machines are too inadequate to cope with their conditions. My visit was to South Wales, 60 miles south of Sidney. Their mining operation resembled mining coal in Florida. The work is on about a 500-ft. elevation about three miles from the ocean and when you turn around and see about 30 miles of beach, it is quite a picture - the Pacific Ocean is so blue. The coal seam is about ten feet of relatively clean coal. Labor relations are very, very taught right now. They are agitated by a strong Communistic influence and their weekly publication is known as the ?Common Cause,? which is against mechanization of coal mines." Mr. Arentzen enlarged on the fact that America was the example they held before them and described the Australian coal men and their character.

The labor turn-over at coal mines has long been a fertile subject for parade by complaining coal operators, the question invariably occupying a place of prominence in the list of disabilities that tend to increase the cost of producing coal, adding likewise to the now startling number of accidents that occur in coal mines. This disability, however, is like the weather question, which some humorist once remarked of by saying, "The weather is something we all talk about, but nobody does anything to improve it." Endless compilations covering the shift of employment by coal mine labor have been made and published, and while the actual loss expressed in cents per ton in cost of coal produced has never been determined, the fact remains that such represents a substantial item, taking the mines of the country as a whole. Efficiency engineers who have made studies covering the cost of breaking in and training each new man employed in certain manufacturing industries, fix same as averaging not less than $100.00 per man, and when the character of mine employment is given due consideration, including its ever-present hazards, the difficulty of close personal super- vision of individual employes, and the, at times, almost impossible ability to transmit to men of many diverse nationalities understandable instructions, it is quite safe to say that the cost of securing and breaking in new men for underground mine work will fully equal that suffered by the factory managements. When we speak of mine labor turnover we must necessarily exclude the enforced shifting about of men who are laid off by the closure of mines due to accident or lack of market, con- fining ourselves to the turn-over occasioned by- (a) the dismissal of individual men or groups of men; (b) the voluntary resignation of the individual workman. It is these two methods of severance that the employer and employe alike suffer from; the item "Unclaimed Wages" carried in the accounts of every large coal company illustrative of the "quit this job, get another one" attitude of many workmen, who frequently, when leaving, fail to claim small sums due them, while others, in turn, leave a train of debts, large and small, behind. The twenty-ninth regular meeting of the Rocky Mountain Coal Mining Institute was called to order at 11:30 o'clock a. m., Monday, May 26, 1930, President B. W. Snodgrass presiding: PRESIDENT SNODGRASS (condensed report): The meeting will please come to order. As President of your Institute, I take pleasure in welcoming you to this convention, and to those who come from outside of the city, I take pleasure in Welcoming you to the city of Denver. This is the first convention at Denver in fifteen months. I hope that the annual rather than the semi-annual meetings will prove satisfactory to all, and that no mistake has been made in that respect. We are gathered together here to discuss problems common to all of us, and I am sure that we will profit by such discussion. We have with us, outside of the membership of our organization, representatives of two other organizations, Mr. Callbreath of the American Mining Congress, and Mr. Huntress of the National Coal Association. We will be honored by having them with us, and we shall expect to hear from them during this meeting.

Dear Mr. Shubart: At your request, am submitting to you several suggestions for the amendment of our safety code which you felt should be kept up to date. As before, am advising you that these suggestions do not have the approval of the entire Safety Committee, but rather are the individual opinions of several members who have expressed their wishes in the form of letters to me. I am particularly indebted to Mr. Dan Harrington and Mr. Wm. Littlejohn for their assistance. Would recommend the following amendment a to the various sections. Section 1. Wherever possible trolley wires should be securely hung to roof or timbers at a distance of not less than five feet and not more than six and one-half feet above rail and six inches to one side. Spacing of hangers should be from 20 to 25 feet apart. Section 2. 500 volts D. C. should not be allowed in any installations. Trolley wires should not carry a voltage of more than 250 D. C. Pumps, mining machines and other small machinery units where A. C. power is used should not carry a voltage of more than 220. Large units, such as pumps, motor genera- tor set and hoists, may use a voltage of 2,200. When power cables to operate same are of armored construction, cables should be securely buried at all crossings. Section 4. Where power lines pass through door frames or stoppings they should be properly insulated with porcelain or rubber tubing. Whenever men get on or off man-trips in vicinity of trolley wires same

The thirtieth regular meeting of the Rocky Mountain Coal Mining Institute was called to order at 11: 20 o'clock A. M., Wednesday, June 3, 1931, President G. A. Kaseman presiding: PRESIDENT KASEMAN spoke in part as follows: I have in mind to say a few words of welcome to the coal operators, but I am afraid that the words I might have said would be hardly appropriate, because I believe the coal operators are in the minority today. It demonstrates to my mind something that has been running through it for some little time. When the hard times came on a year ago, we thought we were going to get over it rather lightly. I recall at this time a year ago we thought that the depression was about at an end. The National Administration from Washington told us we had reached bottom and things were going to perk up, and for a few weeks or maybe a month or more there was a sort of optimism throughout the country. I had been East, and when I re- turned to Albuquerque I said to my friends and associates that things were getting better in the East and that they would soon be better out here and we will not have felt the hard times very much. But I have learned differently since. I have learned that hard times are no respecter of communities or corporations, or persons, or activities, and that we all suffer alike. On that account we find that our Institute is suffering just the same as other activities, whether national, state, local, social, or what- ever it may be. Our attendance is light or, that account. We all know when times are hard we have to stay at home and watch things closer than when they are good. And when they are good we feel that the machine will run of its own momentum and in this way we can get away to see what is going on in the world. When times are hard we have to stay at home and look after everything from day to day and hour to hour.

Herrmann of the Resolutions Committee presented the following resolutions to the group for their approval: RESOLVED: That the members of the Rocky Mountain Coal Mining Institute, in convention assembled, hereby ratify and confirm all official actions of the officers, the executive committee and other committees of the Institute between July 4, 1962, and the present time.

Wherever practical trolley wires should be securely hung to roof or timbers at a distance of not less than five feet and not more than six and one-half feet above rail and six inches to one side. Spacing of hangers should be from 20 to 25 feet apart. (Adopted.) Section 2. 500 volts D. C. should not be allowed in any installations. Trolley wires should not carry a voltage of more than 250 D. C. nominal voltage. (Referred back.) Pumps, mining machines and other small machinery units where A. C. power is used should not carry a voltage of more than 220. Large units, such as pumps, motor generator sets and hoists, may use a volt- age of 2,200. When power cables to operate same are of armored construction, cables should be securely buried at all crossings, on haulage-ways or where men travel. (Adopted.) Section. 4. Where power lines pass through door frames or stop- pings they should be properly insulated with porcelain compound or rubber tubing. Wherever men get on or off man-trips in vicinity of trolley wires same should be secure1y guarded and should also be protected with a cut- out switch, same to be pulled before men are allowed to get on or off trips. The Alamo Mine The Alamo mine is located about seventeen miles northwest of Walsenburg, Colorado, on the Loma Branch of the Denver and Rio Grande Western railroad, in the foothills of the Black Mountains of Huerfano County. Prospecting Mr. W. B. Lewis of New York City, president of the Oakdale Coal Company and also president of the Alamo Coal Company first became interested in this property in 1920. After all natural features of the surface had been carefully examined by Mr. Lewis, he was convinced that the property was underlaid with coal seams. Plans for prospect drilling were made at once and this drilling was started late in 1921. In all, eight drill holes were put down to the Trinidad sandstone which underlies the coal measures in this field. These drill holes in general, showed very satisfactory results. Two workable coal seams were penetrated by most of these drill holes, the upper seam being six and one half feet thick and the lower seam having a thickness of ten and one-half feet. The two seams are separated by forty feet of sandstone and shale. Analyses of the seams proved each to be of a very high grade bituminous coal possessing hardness much above other bituminous coals, and having very bright lustrous appearance. Tests of more than a year's duration proved the coal to store excellently in closed bins and also in open bins where coal is exposed to elements. The drill hole data further showed the coal seams to pitch more than fifty per cent or about twenty-six and one-half degrees. The pitch direction being approximately South 65 degrees East. The drill holes further proved the coal seams did not outcrop at any point on the property, and no evidence of coal outcrop has been found in near vicinity. A splitting and pinching out of seams was found to occur some two hundred to three hundred feet of theoretical outcrop at very Western boundary of property. The most Easterly or No. 6 drill hole has a depth of eight hundred fifty feet to floor of lower coal seam. The Trinidad sandstone was found to be immediately under the lower coal seam, and the Pierre shales lying under this sandstone. Plans for Development and Sinking Having obtained sufficient data, plans for development of the property were carefully made sometime in advance of the actual opening of the mine. Every condition was carefully studied and the maximum production of clean and well prepared coal at as low a cost as possible during the entire life of mine was kept uppermost in the minds of all. The life of mine is estimated at approximately fifty years. It was decided to open up the lower and thicker seam first, and due to the pitch and other conditions a slope opening was decided upon for its extraction. The pitch of the coal having been found to be from fifty to sixty per cent or twenty-six to thirty degrees, the plan of driving the slope directly down the pitch of seam was eliminated and a plan that would give a more economical grade was decided upon. To obtain a lesser grade, a point several hundred feet west of-and at a less elevation than the theoretical outcrop of coal seam was selected for the slope opening. (Fig. 18.) To have driven directly down the pitch of coal seam would also have given the slope an uneven grade as the pitch of coal seam varied as it approached the crop. From this point of opening, the slope was to be driven on a thirty-one per cent, or' about seventeen degree pitch to intersect coal seam in No. 6 drill hole, a distance through the Pierre shales and Trinidad sandstone of two thousand five hundred fifty feet, the slope to be driven practically due East

President W. K. Dennison, Jr., called the final session of the Rocky Mountain Coal Mining Institute to order, and introduced H. A. Cornell, Portland Cement Association, Ft. Collins, Colorado. Mr. Cornell explained that the Portland Cement Association was not a sales organization, but is supported by the major manufacturers of portland cement. The research laboratories of the association are constantly endeavoring to improve the quality of cement, as well as promote new markets, new uses, and new ideas. The association works with engineers, contractors and universities, making available to them the results of their research. Mr. Cornell stated that numerous booklets and bulletins were available on request for any phase of construction with concrete. Mr. Cornell presented a film, "How to Make Quality Concrete," to the members of the Institute. D. W. Lyke, General Electric Apparatus Service Shop, Denver, Colorado, was introduced by President Dennison, who presented a film, "A-Hunting He Would Go." Following the film, Mr. Lyke stated that his firm was not confined to electrical equipment, but to all types of equipment, and asked the members to feel free to call for assistance at any time. These two films concluded the Manufacturer's Hour, and President Dennison opened the final business meeting of the session. Robert F. Bowie, of the Auditing Committee, read the Treasurer's Report, and complimented Mr. Whiteside on the commendable state in which the books were found. The Treasurer's Report is as follows:

The Annual Business Meeting of the members of The Rocky Mountain Coal Mining Institute held during he 84th Regular Meeting of the Institute was called to order by the president, H. Dean Jacot at 11:30 a.m Tuesday, June 28. 1988 in Peak Room 5 of Beaver Run Resort at Breckenridge, Colorado. Twenty three were present and a quorum was established. The president stated the purpose of the annual meeting is to inform members of the status of the affairs and activities of the corporation during the year. It was moved by Loren Linville, seconded and carried to approve the minutes of the previous meeting as published in the 1987 Proceedings. The chair called for reports of the various com¬mittees and these reports will he placed on file in the RMCMI office. Bylaws and Resolutions. Chairman Loren V. Linville reported there were no bylaws revisions. He further reported that the Board had adopted two resolutions: (I) Noting the passing of members since the last convention-Richard T. Brownrigg. Don A Dewey, John T. Maulshy. Hugh D. Nyquist and Mike Zakotnik. (2) Recognizing the superior skills of J. Brett Harvey. RMCMI Vice President of Utah. For recruiting 26 new members from the State of Utah and named him as #1 Recruiter in the Institute?s 1988 membership drive. Linville further commended the Executive Secretary officers, chairmen and committees loran excellent job in planning the 84th Regular Meeting and convention. Membership. In the absence of chairman Ed Sullivan. the secretary reported there are currently 718 active or dues paying members, 51 Life Members and 250 delinquent in dues payment. In the 1988 membership drive. 132 new members have been recruited and 74 of them attended this convention making up 27V, of the total attendance. Patrons of the Institute. This report was given by the secretary for chairman Ira McKeever. A total of 124 plaques has been prepared during the low year life of the program. It has been culled to 119 possible donors as some firms have gone out of business or consolidated. Of this number 46 renewed their annual $100 donation and three new Patrons have joined prior to the convention for a total of 49. During the convention. four new Patrons donated $100 each. tour former Patrons pledged $100 each and seven would be-new Patrons pledged $100 each for a total of 15. This would bring the grand total to 64 if all pledges are received prior to the close of this fiscal year as opposed to 59 renewals in 1987. Program. Co-Chairman Pete Nielsen announced the convention program theme "Broadening OUR Horizons" was well received despite the loss of three speakers during the final days prior to convention. Because the remarks of the Monday luncheon keynote speaker ran over the first time-to-be-tried Monday afternoon Poster Session was delayed almost an hour in beginning. This well thought out feature will he run again next year but in a different time frame. Nielsen thanked his co-chairmen, Bill Balaz and the Poster Session chairman Marcie Greenberg. Publicity. Chairman Tom Egan reported three newsletters including the convention newspaper were sent members during the year. He and Bob Jacob of Bob Jacob Public Relations were at registration daily to secure business card ads and to solicit advertising for the Proceedings. Scholarship. Chairman Keith McGinnis reported that six of the seven scholarship recipients were present at the convention. The University of Arizona at Tucson was added this year and it was the only university visited this year by the chairman. Each scholarship recipient was introduced to the membership at the Monday morning Welcome Session, presented a plaque and responded. The input Iron each winner was most favorable to the program. Each was appreciative of the many contacts made and the educational seminars and programs. McGinnis noted that the mining engineering department at the University of Wyoming may be dropped during the coming year. Joe Dunlap suggested that every member rally support of this department. 9:00 a.m., June 28, 1983 MR. MORTENSEN: Good morning ladies and gentlemen. Again, it gives me great pleasure to welcome you to another session of the 79th meeting of the Rocky Mountain Coal Mining Institute. The thing again that has always been impressive are the activities that we've had so far. The success in the meetings has been delightfully encouraging to all of our committee people. Please welcome the chairman of the session, Charlie Margolf. MR. MARGOLF: Thank you, Vernal. Good morning, ladies and gentlemen. It would be my privilege to serve as the session chairman this morning. To allow the maximum time for our speakers, I'll turn the microphone over to Bernie Bernstrom who will introduce our first speaker. MR. BERNSTROM: Thank you. As Vernal mentioned, Dan Jackson will be our first speaker. He is the Western Editor of Coal Age Magazine. Dan really doesn't need an introduction to this group. He's belonged to the Rocky Mountain Coal Mining Institute about 25 years. Dan is a native of West Virginia and he's an ex-coal miner. He graduated form West Virginia University as an electrical engineer and worked for Amherst and West Bending Coal prior to employment by Coal Age Magazine. Back in 1972 Coal Age moved him to Denver from New York City. MR. JACKSON: When Vernal Mortensen asked me speak to the members of the Rocky Mountain Coal Mining Institute earlier this year I found it impossible to say no to the guy because of what he has contributed to western coal. Little did 1 know that the subject he had in mind would be entitled, "An Outsider's View of Western Coal." At first I asked myself-I've been associated with the coal industry for some 38 years, 12 years in national operations and 26 years reporting on it. You might say that I've been married to two industries, coal and the business press for 26 years, but today I'll put on my business press hat and try to make an impression of what an outsider might think of western coal. But at the outset, let's get one thing straight: When you say press, whether it's business press, the media or whatever, and you heard some comments yesterday as far as what the media has done .to this industry and there's been some definitions bandied around as to just what an editor is. One of the most recent ones has defined an editor as a person who can talk on any subject with an open mouth. Now that's not my case. Secondly, I don't give long talks. Several years ago I was giving a rather lengthy talk to a group similar to this and it was halfway through the talk when I noticed one guy on my right looking at his watch quite frequently. I didn't mind that too much because all of us do that once in a while, but when he looked at his watch, took it off and shook it, I thought, "My God, better cut short." But for more than a decade western coal has enjoyed substantial annual increases in production from some 30,000,000 tons in 1970 to some 264,000,000 tons in 1981, but 1982 was a different story. We lost about 6,000,000 tons of production in that year. In 1983 it's expected to be a little worse than '82. Coal historically doesn't rebound from a recession as quickly as other industries. It takes about eight to 10 months longer for us to really get moving again and I'm afraid that you'll still have to don your fighting helmets and flack jackets when you go out into the market to sell your product. Western coal, as you know, has problems and al l of them are not going away when the recession ends and they won't go away overnight. I'm sure most of you are aware of what those problems are. Carl Bagge and Jim Harris, along with other speakers, at this meeting have educated us well on those problems and I'm sure you'll hear more from Jim Watt at today's luncheon. If everyone in this room were asked to list three orfourof the most serious problems facing western coal, I'd make book that the total of the answers wouldn't vary by more than 3 to 5%, if that much. But coal is not the only mining segment in the U.S. with problems. Metal and non-metal mining has its share, too. I'd like to step back into the past for a few minutes, if I may, to a time when our problems were just beginning. Since 1979 a third of the nation's mines, including coal, metal and nonmetal have been shut down. The total volume of all mining in the U.S. in that year totaled some $24 billion. Today that figure has dropped some 21 %. The after tax rate on return for mining companies has fallen from 6'/% in 1980 to minus 3% in 1983. But that's really not where our problems began. They began 20 years ago when a profound change began taking place in the U.S. economy. Our economy had been growing at about 2'/-3% annually without exception except for the great depression. Our inflation rate was about I'/%, interest rates were running about 6%, and the federal budget was $77 billion, really great figures compared to today. From 1960 to 1980 the federal budget increased almost 1.000% and taxed paid by individual families increased by 700% during that same period. Despite the huge increases in taxes, the federal deficit kept getting larger and larger year after year and within this 20 year period the national debt climbed to a trillion dollars. Economic progress of this type can't continue indefinitely without some serious consequences. The result of that economy, well, you know what happened and there is a direct relationship of that

PRESIDENT HERRES: If you will come to order, please, we will get started on this morning's program. This morning's program takes up the matter of mechanized mining, particularly mechanical loading. There has been considerable progress made in the West with mechanical loading, but we are interested particularly in what is being done in other fields. We are particularly fortunate in being able to have with us Mr. G. B. Southward, Mechanization Engineer of the American Mining Congress. Mr. Southward has devoted his time for the past several years entirely to a national study of mechanized mining. He is the author of the Year Book published by the American Mining Congress, which is the authority for progress and development on mechanical loading. Mr. Southward has come here from Washington, D. C., particularly for this meeting. We have asked him to speak on the national phases of mechanized mining, and particularly on what is being clone in the East, since we are familiar with what is being done in the western field. I take great pleasure in introducing Mr. Southward. (Applause.) MR. SOUTHWARD: Mr. President and Gentlemen: Before starting on this gaper, I would like to express to all of you and to your President my appreciation in being asked to come here. It is a privilege. This question of coal mine mechanization, as you all know, is a big one. It is too big a problem for any one company to handle and it is through such meetings as these, through the co-operation of the various companies throughout the United States, that we have been able to make the progress that we have made. As Mr. Herres has said, I am not going to try to tell you gentlemen anything that is going on out here, in the West. You already know that yourselves. But he has asked me to give a brief resume of the progress that mechanization has made in the eastern coal states.

When it was announced that the economy grew at an annual rate of 4.7 percent in the Fourth Quarter of 1992, it appeared that our long awaited recovery from recession was here. Unfortunately that much growth proved to be unsustainable, and in the First Quarter of 1993, the number dropped to less than one percent. Today it is clear that the recovery is continuing, but at a very slow rate. One of the Most disturbing statistics during this recovery is that unemployment has not improved as one would expect but has been hovering around 7 percent for over a year, making this recovery a ?jobless? one. In a recent Harvard Business School presentation, a professor reported that the United States has slipped from its leadership position in almost every manufacturing category since World War II. From the production of cars to consumer electronics, we have lost significant world market share to others, most notably Japan and Germany. Obviously this is not new news, but the magnitude of the loss and the number of industries affected was surprising to me. The result has been that our negative balance of payments has soared, and the United States of America now has the dubious distinction of being one of the world's largest debtor nations. It has been common for politicians, and political want-a-be's, to blame all of our trade problems on industry. They say that the moguls of American industry spend too much time seeking short-term gain at the expense of long-term growth. They say that we are interested more in our own perks and economic security than in producing quality products that can compete in the world marketplace. One of the stared goals of the Clinton Administration is the targeting of strategic industries to receive help from the government so they can compete on the world stage more effectively. Personally. The Annual Meeting of The Rocky Mountain Coal Mining Institute was called to order by the President, John T. Atkins, at 2:00 p.m. Tuesday, June 26, 1984 in the Colorado Ballroom of the Marriott's Mark Resort in Vail, Colorado. There were 36 members in attendance. It was moved by Bob Diederich, seconded and carried to dispense with the reading of the 1983 Annual Meeting minutes as printed on pages 105 thru 109 of the 1983 Proceedings. In keeping with the printed agenda in the convention program/ticket booklet, the President called for reports of standing committees as follow: 1. Bylaws & Resolutions - Loren Linville, Chairman Linville noted that the committee had been working for two years on bylaws changes and concluded a corporate lawyer specializing in nonprofit organizations be engaged. He then introduced Mr. Peter B. Nagle of the Denver law firm of Sherman and Howard who outlined the major changes in converting the Institute's current status of 501(c)(6) to 501(c)(3). He pointed out that such a conversion would give the Institute a proper legal status, would give individual contributors to the scholarship or other programs a personal income tax deduction, would qualify the Institute for the postal nonprofit mailing rate and the Institute would achieve the advantage of limited liability inherent in a corportion and would insulate its members, officers and directors from liability for corporate obligations. Copies of the Articles of Incorporation as well as the Bylaws were available for all members. A discussion ensued and the following resolution was moved by Bob Diederich, seconded and carried: RESOLVED, that the unincorporated association known as the Rocky Mountain Coal Mining Institute be, and hereby is, dissolved and in its place, and to carry out its objectives, shall be formed a nonprofit corporation under the laws of the State of Colorado, which corporation shall also be known as The Rocky Mountain Coal Mining Institute, and to which shall be transferred all of the assets and liabilities of this association. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to execute and file with the Colorado Secretary of State, Articles of Incorporation in a form substantially similar to those prepared for this association by its counsel, and the names of the individuals identified in such Articles of Incorporation as the initial Board of Directors of such corporation, which names were proposed and recommended by the Nominating Committee of this association, are hereby approved. FURTHER RESOLVED, that the proper officers of this association are authorized and directed to do all acts necessary or convenient to carry out the terms of the preceding resolutions. (Articles of Incorporation and Bylaws as adopted are printed following these minutes.) Additional resolutions were read by Linville as follows: Item 1: WE RESOLVE herein that in the year since the last convention of the RMCMI, the Institute and the coal industry have suffered the loss, through death, and the services of: Lloyd W. Item 2: RESOLVED, that in recognition of their long and faithful service to the coal industry that the status of Life Member be conferred upon: Bernard Bernstrom Roy Coulson Shirl C. McArthur Item 3: RESOLVED, that we commend and express our gratitude to our Executive Secretary, officers, chairmen and committees for an outstanding job in presenting. the 80th RMCMI meeting. Introductory Remarks PRESIDENT MARKS: We have made special assignments for the discussion of this paper, and I believe these discussions are to be answered in sections, and as the different sections are read applying to this paper, we will just have a brief discussion on that particular point and proceed to the next and try and expedite this discussion as much as possible, be- cause I realize a good many of you have something to say. The first discussion is by Mr. Frank A. Rank, of the General Electric Company, Salt Lake City. MR. F. A. RANK (General Electric Company, Salt Lake City, Utah) : Mr. Chairman, while my name has been put on the program as being the one to discuss this paper, I believe Mr. Jones of our company has prepared a discussion on it, and therefore will let him talk in my place. MR. A. L. JONES: I think that it is passing the buck. However, Mr. Rank sent me a copy of the paper, and I read it over with a good deal of interest. There is one thing I want to say: Mr. Shubart, in his breezy letters, stated this paper was to be written by Mr. Harrington, assisted by a number of manufacturing and operating companies, among them the General Electric Company. We did not function. The paper was completed, and we were not consulted, and I believe that is true of the others. After reading the paper over, I dictated a few notes which I want to read, to give you the view-point that we have on the subject We do not want to minimize electrical dangers, or in any way slow down high-grade construction maintenance, but there is such a thing as overstating the case. It is so full of condemnation of most existing practices and conditions that it reminds me somewhat of the nerve-racked mother who sent an older brother to see what Willie was doing and to tell him to "stop it." His recital of electrical dangers is harrowing and if I felt it were a true picture I should feel that any of us having anything to do with the recommending or selling of electrical equipment for mines would be party to a crime.
