MORTENSEN: On behalf of the Rocky Mountain Coal Mining Institute, I take great plea¬sure in saying good morning to you at Vail. With a few clouds in the sky, at least we won't get sunburned. We won't have to worry about our kids in the swimming pool, perhaps. It is delightful for me to have been able to have represented the Rocky Mountain Coal Mining Institute for the year 1982-1983. This has been our 71st year and this is our 79th meeting. In recognizing the attendance here, that dinner we had last night, and some of our entertainment must have gotten to some of us, or it is a little early. But I'm sure as the day goes on, and with the speakers outlined, it will be very beneficial for those who do attend. We do appreciate your attendance. I'd first like to make an introduction of our head table. Doris Finnie, she is our executive secretary. As most of you are aware, Gussie Whiteside retired as secretary. This will be the first time since the Institute started that there has not been a Whiteside present at one of our conventions. I'm sure Gussie would appreciate any calls or letters that any of you would care to make to her. Doris, I might add, has been a great help to me and all of the people who have been working on the program for the Institute this past year. There's been lots of reorganization and we are very pleased with Doris's ability to take hold from Gussie without any waves. Much credit must be given to you Doris for this and we do appreciate the help you have given us and believe me she has kept us out of trouble. Next, we have Art Neill. He is our vice president of the Institute from Montana and he also works with Western Energy Company. We appreciate the help that all of these session leaders and chairmen give to us. We have other names on the head table, but they will fill in as the morning goes on, so we won't bother you with any of those at this time. To set the stage for business, first I would like to call on Doris for a motion to approve the minutes of last year. MS. FINNIE: Thank you, Vernal. Mr. President, I suggest that the reading of the minutes be dispensed with and that the members refer to pages 9 through 80 of the Proceedings for the 78th regular meeting of RMCMI, as published MR. E. H. DENNY (United States Bureau of Mines, Denver, Colorado) In the absence of Mr. Harrington it is my privilege to read his paper, which is in his usual, forcible and sincere style, and it is within the province of this Institute, certainly, to go into it as it concerns safety and efficiency in mining. He brings out some points in his paper that, I think, are well worth the consideration of the Institute. The figures he uses were compiled by Mr. Adams, of the Bureau, and cover a five-year period. However, examination of similar Bureau figures for a ten-year period, or any other long period on other bases brings out similar results. The figures in this paper have been based on the million hours of exposure of accidents, and the figures based on three hundred working-man-day basis, or on tonnage, brings out similar results. This paper is entitled "Accident Record in Western Mines," and it is, in a way, an amplification of Mr. Harrington's letter which was read at the Glenwood Springs Meeting.

CHAIRMAN I. N. BAYLESS: Will you come to order, gentlemen? They told me that you had a very interesting meeting yesterday and a good time last night. Our program is rather long this morning, and I am not going to take up any of your time, as we got started a little late. I will ask Mr. Marchant to make a few announcements. (Announcements.) SECRETARY MARCHANT: I just noticed in this morning's paper a rather serious accident at Hobbs, New Mexico, in which George Kaseman, a former President of the Institute, and a loyal member ever since its organization, was killed. I think that this meeting should go on record and prepare a resolution of condolence, etc., and with your per- mission we will have the Committee on Resolutions do that. I assume that will be all right. CHAIRMAN BAYLESS: Our first paper and discussion this morning will be Education of the Miner, by Thomas Allen, Chief Coal Mine Inspector of Colorado. Mr. Allen.

Railroads, attempting to increase their tonnage without adding new lines, have for some time realized there is a definite relationship between increasd haulage efficiency, and constant communication with each moving unit that operates along their roadbeds. Elaborate radio communication equipment has been devised for this purpose, and is rapidly being installed. Coal mines are faced with similar haulage problems and have sought this constant contact through the use of telephone systems, and dispatcher stations. Often the fixed mine telephone system is unsatisfactory, since the desired person is not present at the phone when needed. Dispatchers lose contact with a motorman as soon as he is out of sight, until he calls in from another telephone. The recently developed frequency-modelated radio phone which makes use of the trolleywire network in a mine as a carrying medium, permits instant and continuous contact between dispatcher and locomotives. The motorman can immediately contact another motor or the dispatcher regardless, of his motor's position on the trollywire system, whether moving or standing.

Mr. Chairman and Gentlemen: I tried to get Benedict Shubart to have some fellow-some big fellow with a big voice-to read this paper for me, but he said there was nothing doing; [ ] that I would have to read it myself. I will try and not take up too much of your time. It is a pretty big subject, Mechanical Loading, and it covers a good deal of ground. I have merely touched on the high spots, as it were. A great deal has been preached and written in the last year or so about mechanical loading, and I doubt if any other subject in the mining industry has been discussed so freely and as often in the last few years. It is not the intent of this paper to dwell on the merits or demerits of any [ ] particular type of loader, that is, to say what the writer thinks is the most efficient or most inefficient machine. There are several types of loaders on the market to-day that are proving very successful in many mining districts. The ninth annual Mine Rescue Evaluation was held in conjunction with the RMCMI 2000 convention at the Sheraton Tamarron Resort, Durango, Colorado June 25 thru 27. The purpose of the mine rescue evaluation program is to provide an opportunity for mine rescue teams to learn new skills and improve their existing ones in a non-competitive environment. Several staged "disaster" scenarios were [ ] held where the teams are called upon to exhibit their life saving abilities. The evaluators meanwhile are offering suggestions, both verbal and written, to help the teams better understand the situations presented them. This non-competitive environment allows the teams to work together and share their knowledge with fellow mine rescue teams providing everyone with a positive learning experience. Mine Rescue Chairman Bill Balaz was in charge of coordinating the events. Seven teams consisting of seven to ten members each (totaling 63 members) participated in the two-day event. Each team was required to respond to three different real-life scenarios plus a written general knowledge test daily. This year's four professional evaluators included Art Saenz (Hazardous Materials) of Western Envi¬ronmental Associates; Guy Horton (Ropes), Guy Horton Rope Rescue; Mary Bailey (Medical), MBA Training and Ron Lauer (Confined Space) also lassos Western Environmental Associates. They cash prov- [ ] ided three different challenging mock situations per day per team. The teams had no prior knowledge of what the scenarios would be as details were provided only as they arrived. Ten volunteer victims added much drama and excitement to the event. Their realistic enactments, complete with false blood makeup and severed limbs, made for some very tense scenarios. The Mine Rescue Teams participating this year were BHP LaPlata, BHP Navajo, BHP San Juan, all from Farmington, New Mexico; Bridger Coal Co., Rock Springs, Wyoming; Sabine Mining, Longview, Texas; Solvay Minerals, Green River, Wyoming and Western Energy Co., Colstrip, Montana. Many new [ ] friendships were made and much knowledge shared. A swap meet was held Saturday afternoon for the teams to exchange miscellaneous equipment, hats, shirts, etc. The teams were asked to evaluate the program and the evaluators. Then responded with many positive suggestions that will help improve the upcoming events in the years to come. Culmination of the Mine Rescue program was a Tuesday morning awards breakfast where the teams were presented with plaques. The participating victims and evaluators were also commended for their outstanding efforts. Sponsors for the Mine Rescue program were Big Sky Coal Company, CMC Rescue, Magnum Metals, Inc., and Rocky Mountain Electric. Many hours of volunteer time and effort from various family members of participants helped make the 2000 event a huge success.

This paper was written from conditions existing in the Cumberland Mines of The Union Pacific Coal Co., with my impressions and cause of same. These mines are located on a branch line of the 0. S. L. R. R., about sixteen miles south of Kemmerer, Wyoming. The mines are the property of The Union Pacific Coal Company with headquarters at Rock Springs, Wyo. There are two mines, No. 1 and No. 2, located about two miles apart in a seam of coal averaging about 16 feet thick which is split with a parting of rock from 4 feet to G feet from the bottom, averaging from 4 inches to 5 feet thick, mostly of soft fire clay, with an average pitch of 21 degrees to the west. The lower coal below the fire clay band being of a soft nature, much softer than the coal above it. The cover or roof next to the coal is of a massive sandstone formation from 4 feet to 60 feet thick while the floor of the seam is of a soft fire clay as far down as has been prospected. These mines are also of a dry and dusty nature, they generate lots of fire damp and are subject to fires from numerous causes. These mines were opened up in 1900 with five openings each, Main Slope, North and South Manways and North and South Aircourses driven parallel directly on the pitch of the seam which is fairly regular, entries being turned North and South at right angles off the slope about 300 feet apart. The entries were driven double 10 feet wide with chain pillars from 20 feet to 30 feet thick. The main entries are used for haulage and main intake, back entries for return aircourses. Rooms are turned on 50-foot centers and 20 feet wide, directly on the pitch Galvanized sheet iron chutes are used in the rooms. The slopes were driven down in No. 1 mine about 4,000 feet, in No. 2 mine about 5,000 feet where the cover would be about 1,400 feet in No. 1 mine and about 1,700 feet in No. 2 mine approximately. When a point about 2,000 feet on the slope had been reached with cover, 600 or 700 feet squeezing became noticeable on the entries and room pillars with slight bumps which extended clear to the upper entries of the mines and continued to get worse as the mines got deeper and with more cover as no pillars had been removed at this time. It should be stated here that faulty ground was found on the south side of No. 2 mine and on the north side of No. 1 mine, in some places looking like a fault of a down throw, some places like a want and other places like an erosion. The latter theory seems to be correct from prospecting and drilling. The mining of entries and rooms became more difficult with more squeeze and bumps of increased pressure which closed entries and aircourses and finally caused the lower workings of the mine to be abandoned. It was then decided to open up the entries from the 6th up, or approximately half way up the slope. The opening of these entries was started with the intention of extracting pillar coal but considerable danger was met with for the entries .were squeezed tight and when they were disturbed, bumps and squeeze conditions had to be contended with, also gas and fires due to the continued grind on the pillars due to overhead pressure bringing on friction which caused innumerable fires to start in the bottom coal. Bumps being so extensive at times as to close up aircourses for 500 or 600 feet, also discharge timber, coal and rock from the rib of slope and entries for hundreds of feet, dislodging tracks and throwing mine cars around just as if an explosion had taken place, filling places with gas and throwing dust into the atmosphere so that you could cut it with a knife. It became necessary to discontinue the use of black powder and naked lights entirely as a safety precaution. Permissible Powder Monobel No. 5 and Wico Electric Safety Lamps were installed. All coal was shot off the solid whenever it was necessary to shoot. ' In opening up these entries it was found that practically all of the weight was centered on room pillars up to the first crosscut chain pillars and barrier pillars between top of rooms of entry below and the one above which averaged 30 feet thick and in all practically 120 feet of ground. The rooms were mostly open from the first crosscut up to the face which showed that the points mentioned had taken the weight. It was found impossible in some of these entries to drive double entries again as the bumps and squeeze made it impossible to maintain them. This made ventilation quite a problem, small booster fans and flexoid tubing being used for ventilation until one entry could be connected with the one above which has solved most of our ventilation problems so far.

Looking Down the Road: The Environmental Side of the 1990s and Beyond Environmental Social Responsibility Love Canal, Buffalo Creek, Widow Combs, Bohpal and Three Mile Island are familiar names to all of us-names which evoke memories of environmental tragedies. These memories, as well as memories of other environmental disasters, lead us to pose this question: What is the nature of the environmental social contact between industry and society? The manner in which one answers this question will. in large measure, answer the question of where one thinks environmental issues will go, or should go, in the 1990s and beyond. The history of the evolution of the environmental movement will be helpful in defining and under- standing just what society's environmental responsibility is and, perhaps, what it will be. To Define the Future Start With the Past The common law, which most of the United States adopted from the English system of jurisprudence, traditionally considered pollution control and other environmental issues to be a matter of determining the relative rights of private property owners and of individuals. Legal and equitable theories, such as nuisance, negligence, trespass and the law of riparian rights, were utilized to allocate responsibilities between parties under the common law. The discharge of pollutants into streams and into the air was by and large considered acceptable, at least up to the point that another's "reasonable" use of the same air or waterway was significantly impeded. Further, the judicial decisions interpreting the applicability of the common law to the protection of the environment generally reflected the social and economic pressures of the age. During the Industrial Revolution, the decisions and policies had a marked tendency to favor industrial development. Jobs and industrial growth are deemed as important, and in some cases more important, than the protection of people and property. Additionally, the idea of a social responsibility, beyond that owed to a competing land or water user, was nearly alien to the early common law.' One could even go so far as to say that, had there been a social environmental contract under early common law (which, of course, there was not); but if there were, it would have been to promote actions which facilitated industrial development, even at the expense of the environment. Post-World War LI industrial expansion brought with it a growing awareness of limits on the environment's ability to absorb increasing levels of pollution. Thus evolved an era of social and political adjustment, as society began to shift away from supporting big business and industrial development and toward supporting domestic government programs and limits on industry. States gradually stepped in with efforts to address environmental issues. The Pennsylvania Clean Streams Law and the West Virginia Surface Mining Act of 1939, while lax in comparison to today's standards, nevertheless marked definitive efforts toward altering the balance between industrial development and environmental protection Pollution control continued to be viewed as a state responsibility through the 1950s, until Congress began, for the first time, to allocate funds for federal research on air and water pollution and to implement
