This paper will address methods for minimizing liability and protecting materials from disclosure as result of self- evaluative audits and internal investigations. Specifically, the paper will cover the role of counsel in the investigative process and how best to design and conduct internal investigations to minimize the development of problematic material and disclosure of information. The paper will also address the extent of privileges that may be relied upon to protect materials and information from disclosure. These include the attorney-client privilege, the self-critical analysis privilege, and the attorney work product privilege. These privileges are qualified and understanding the limits of their coverage is essential to minimizing liability.

It is crucial to reestablish a domestic rare earths minerals production industry to help secure the Nation's clean energy future, reduce the U.S. vulnerability to material shortages related to national defense, and to maintain our global technical and economic competitiveness. Given that the Chinese dominance of the rare earths market has adversely impacted supply stability and endangers the United States and its allies' assured access to key materials, rare earths should qualify as materials either strategic or critical to national security. Further, the U.S. government should facilitate the reintroduction of a globally competitive rare earth industry in the U.S. Realization of this objective requires: ? Developing domestic processing capability so that the U.S. is not primarily dependent on China as a source of rare earth ore, and almost exclusively dependent of China for processing of the ores. ? Providing a mechanism where access to Federal lands for rare earth exploration and extraction is possible, and ? Training engineers to design and operate rare earth ore processing facilities

Mining and processing of minerals, metals, and fossil fuels can release selenium and arsenic into wastewaters. Both selenium and arsenic are difficult to remove to levels that meet current drinking water and discharge criteria. These metalloids can be used as electron acceptors by microorganisms transforming them back to reduced states, thus removing or stabilizing them. Bioremediation cost effectiveness will be discussed in terms of site information required, microbial populations, co-contaminants, pH, redox, and nutrients. Full-scale, economical ex situ and in situ biotreatments are possible and can produce 1,000’s of times less sludge than conventional precipitation technologies.

Proper illumination is critical to a miner?s ability to detect hazards in underground mines. Moving hazards are often located in the miner?s peripheral field-of-view, while slip/trip/fall hazards are often located in the forward field-of-view. The objective of the research described in this paper was to determine if light-emitting diodes (LEDs) improve visual performance as compared to traditional incandescent (INC) cap lamps. The research presented focuses on comparative studies of a National Institute for Occupational Safety and Health (NIOSH) prototype LED, a commercial LED, and an INC camp lamp. Thirty subjects participated in these studies; ten subjects in each of the age groups: 18 to 25 years, 40 to 50 years, and 51+ years. Visual performance was quantified by the subjects? speed and accuracy in detecting hazards, while visual performance for disability glare was quantified by the use of contrast sensitivity tests. Results suggest that LEDs with a visible spectrum containing a higher concentration of the shorter wavelengths can enable visual performance improvements with respect to disability glare, the detection of moving hazards in the peripheral field-of-view, and the detection of floor hazards in the forward field-of-view. The NIOSH prototype LED cap lamp provided the best visual performance improvements for the older age groups in every test. The surge of activity in the solar energy market, spurred by government incentives, has created new and more efficient solar technologies, but issues surrounding land- and water-use have backlogged the full-scale development of solar farms. This paper explores siting solar power plants on degraded or polluted lands, such as mine tailings impoundments. Historically, mining and has been integral to Arizona?s economy, but has dwindled in relevance due to urban pressures and environmental regulations. Currently, it is legal to site solar power plants on degraded or polluted lands, but the question remains whether the economics of this degraded lands solar development is more favorable than developing pristine land. Therefore, we explore economics of developing mine tailings impoundments at both the institutional and financial level. Methods of research for this paper were interviews with government regulators, environmental advocacy organizations, farmers, and mining company executives. Financial models using extant tax incentives show a positive net present value for the installation of solar power plants, even when accounting for the costs of land remediation.

Severe drought in the Colorado River Basin over the past 10 years has caused water levels to drop in Lake Mead by more than 113 feet. The current lake level is at elevation 1,112 feet mean sea level (msl). Lake Mead is the primary source of water supply for greater Las Vegas. Water for Las Vegas from Lake Mead is accessed through two existing submerged intake shaft and tunnel systems. If the water levels continue to drop in the lake, the Intake No. 1 will become inoperable below water level elevation of 1,050 feet msl. To sustain the current levels of water delivery to all member agen-cies in the southern Nevada region, the Southern Nevada Water Authority (SNWA) has decided to construct a third intake at a deeper depth in the lake to ensure better quality water and enhanced reliability.

Several startup or longtime underground stone mines have experienced unanticipated roof control difficulties due to the variable geologic character of the roof strata. Careful mapping of roof conditions, and identification of controlling geologic and mine geometric factors, lead to an understanding of the mechanisms causing roof problems. Factors such as unexpected rolls of the roof strata resulting in a gradual change from strong to weak roof; encountering open water-filled master joints; roof strata delamination due to internal water pressures; local karst features with mud, sand, and water hazards; and sudden loss of limestone roof due to paleo-channel erosion are some recent problems described. Strategies for overcoming these problems are discussed and detailed.

For the 22nd year, the chance to exchange knowledge, experience and business cards drew hundreds of mining and phosphate professionals for a two-day regional Phosphate Conference in Lakeland, Florida Nearly 400 people participated in the October conference, which focused on the phosphate industry?s future success. There were 41 exhibitors, 13 program advertisers and 23 sponsors among those supporting the conference. It was chaired by David Gossett, 2006-2007 SME Florida Section Chairman. In the opening panel session that he chaired, John Garlanger (SME) of Ardaman and Associates posed the questions; ?How successful has the industry been? How do we measure it and what factors contributed to the industry?s success? How long will the ethanol boom last? Can the industry obtain the permits it needs to mine for the next 30 years? Can the industry attract and retain the quality of workers it needs??

A study has been conducted to control iron in copper electrolyte streams using Eichrom Industries’s new Monophosphonic /sulphonic acid resin. The resin strongly and selectively extracts ferric ion over copper and cobalt from highly acidic copper electrolytes. The resin has a loading capacity of 27 g/L of iron and can be readily regenerated. In addition, the new resin can be easily synthesized using commercially available starting materials. This paper presents the experimental results for iron control in copper electrolyte streams using the new resin and discusses its potential applications to other hydro-metallurgical streams.

Effective tools are not only essential for the design of practical and efficient underground mine ventilation systems but must also play an integral part in the operation of the mine. One such tool is VUMA-coal ventilation simulation software. VUMA-coal is Windows-based and has been specially designed for the simulation of underground coal mines and includes user-friendly coal specific interfaces and three-dimensional graphics designed to facilitate in the construction and analysis of networks. VUMA-coal can be utilised during the design phase of new collieries, be used to conduct ?what-if? and optimisation studies, and be integrated into the ?day-to-day? ventilation related operations. In addition, VUMA-coal can be used to simulate dust and gas distribution in a ventilation network, as well as predict the impact of control measures. This paper describes the interactive VUMA-coal ventilation simulation software and its underlying design features and outlines a case study of how VUMA-coal has been integrated into Anglo Coal?s Ventilation and Occupational Hygiene Engineering [VOHE] department as part of the standard planning and evaluation process in their operational mines as well as long term planning and future mining operations.

"A reliable supply of non-energy raw materials is a precondition for the functioning of the European economy. In line with its importance, the issue of raw materials supply has become more prominent in the past years, especially owing to turbulent raw material markets. However, these turbulences are not due to depletion of the geological resources but to a missmatch of (expected) supply and (expected) demand, with several interacting factors influencing the markets both from the supply as well as from the demand side. A recent evaluation, published in June 2010 within the framework of the EU Raw Materials Initiative, sought to bring together these two sides of raw material markets and asked the question "which raw materials are critical for the EU?" Herein we present the methodology used by the Ad-hoc Working Group on Defining Critical Raw Materials and the results obtained, complemented by results from the study "Raw Materials for Emerging Technologies"."

Appropriate seals, portal ground improvement, and compatible shaft construction techniques are vital elements for launching and receiving tunnels effectively in urban areas where adjacent property requires protection from excess ground movements. This paper focuses on seals and ground improvement along with shaft wall types, required to launch or receive tunnel boring machines within wet, permeable ground at the portal zone. The paper also discusses probing to verify suitability before the tunnel eye is cut. Methods addressed include: rubber gasket seals; soft eyes; double walls; top hats for reception; and, portal zone ground improvement (permeation grouting, jet grouting, un-reinforced slurry diaphragm wall panels, ground freezing, deep soil mixing, dewatering, and over-excavation and backfilling). This paper focuses on challenges with launch and reception of pressurized-face TBMs with precast concrete segment linings. Challenges related to pipe jacking are discussed in a separate paper titled ?Mitigating Microtunnel Launch and Reception Challenges? (Hunt and Finney 2008).

Clean Diesels fuel-borne catalyst, Platinum Plus, helps improve fuel economy for all engines up to 10 percent while reducing particulate emissions by up to 25 percent. When used with a simple diesel oxidation catalyst, particulate emissions can be reduced by 30 to 50 percent. The use of Platinum Plus enhances combustion in the cylinder, burning fuel more completely. This reduces CO2 and other greenhouse gases and lowers total operating costs by improving fuel economy.

The elimination of the incidence of silicosis in employees in industries such as mining and pottery is an ongoing international initiative. After many decades of industrial activity in these industries and many dollars spent on preventative measures, silicosis is still occurring. The exposure-prevention measures taken so far have certainly improved the working environment dust concentrations; however, the illness is still regularly diagnosed in workers. More funding is needed for interventions to improve working conditions. Many aspects of dust prevention and suppression will be researched and exposure assessment methodologies and equipment will need to be reviewed for the purposes of improvements in effectiveness. This paper presents results from laboratory tests carried out on gravimetric sampling pumps and cyclones. It highlights the erratic flow produced by gravimetric pumps of three different manufacturers who claim their respective pumps are equipped with flow stabilisers. The standard BS EN 1232:1997 is used as a basis for the tests. A method, albeit impractical for fieldwork, is shown for the elimination of the pulsation in the flow. This method serves to prove the method and protocol used in this study. The pressure loss caused air-flow resistance of cyclones is measured. The air inlet aperture size of cyclones is measured. The large discrepancy in the two criteria between individual cyclones is shown. The paper concludes that all the pumps tested failed the prescribed limits of BS EN 1232:1997 regarding the pulsation of the gravimetric sampling flow. The difference in flow characteristics of the cyclones, together with the erratic flow produced by the pumps, throws into question the accuracy of the exposure assessments. It is suggested that substantial resources be channelled towards solving these flow problems in parallel with measures taken to reduce exposure. In principle, the accurate assessment of exposure and dust concentration levels is a prerequisite for effective management of the problem of silicosis.

Underground mining method selection (UMMS) is one of the most important issues in mining engineering. Underground mining method should be primarily selected to make use of underground resources optimally. It is nearly impossible to change the mining method once selected by the reasons of rising costs and mining losses. Because of these reasons, UMMS process is extremely important in mine designs and economics. The strategy of underground mining method selection has been studied by different researchers in the literature. Boshkov and Wright (1973) proposed a classification system; Morrison (1976) suggested a selection chart; Laubscher (1981) proposed a selection methodology; Nicholas (1981) presented a classification system; Hartman (1987) developed a selection chart and Miller-Tait et al. (1995) modified the Nicholas? system and developed the UBC mining method selection process. In reality, UMMS is one of the important Multiple Attribute Decision Making (MADM) problems and mining engineers have always some difficulties in making the right decision in the multiple criteria environment. To make a right decision on UMMS, all known criteria related to the mining method selection should be analyzed and the problem solved according to suitable decision making techniques. A review of the literature reveals that decision making techniques have been used for UMMS applications. Kesimal and Bascetin (2002), Bitarafan and Ataei (2004), Bascetin et al. (2006), Alpay and Yavuz (2007), Karadogan et al. (2008) and Samimi Namin et al. (2008) used decision making techniques in UMMS applications. In this paper, two different MADM methods: Analytic Hierarchy Process (AHP) and Fuzzy Multiple Attribute Decision Making (FMADM) are applied to select the optimal underground mining method for a chromite mine and final solutions are then compared. THE AHP METHODOLOGY The AHP method developed by Saaty gives an opportunity to represent the interaction of multiple factors in complex unstructured situations (Triantaphyllou, 2000). The method is based on the pair-wise comparison of components with respect to attributes and alternatives. A pair-wise comparison matrix n×n is constructed, where n is the number of elements to be compared. The method is applied for the hierarchy problem structuring. The problem is divided in to three levels: problem statement, object identification to solve the problem and selection of evaluation criteria for each object. After the hierarchy structuring, the pair-wise comparison matrix is constructed for each level where a nominal discrete scale from 1 to 9 is used for the evaluation as shown in Table 1 (Saaty, 1980; Saaty, 2000). The next step is to find the relative priorities of criteria or alternatives implied by this comparison. The relative priorities are worked out using the theory of eigenvector. For example, if the pair comparison matrix is A, then, [Amax=××- [1] ] To calculate the eigenvalue ??max? and eigenvector w=(w1, w2,..., wn), weights can be estimated as relative priorities of criteria or alternatives. [ ] Since the comparison is based on the subjective evaluation, a consistency ratio is required to ensure the selection accuracy. The Consistency Index (CI) of the comparison matrix is computed as follows: [CImax--= [2] ] where ?max is maximal or principal eigenvalue, and n is the matrix size. Capital investments are made for a variety of purposes, from providing incremental capacity at existing operations to developing and implementing new technologies intended to radically improve a company's capabilities. These projects generate very different business opportunities and create value in distinctive ways. For incremental improvements, the capital budgeting process assures at least a loose fit between short-term goals and readily available resources. However, the criteria used to evaluate capital projects often prevent a company from committing to more aggressive goals that lie beyond the firm's current abilities or resources. Such projects may not have clearly identifiable future cash flows, and the degree of interaction with other projects and the nature of the risk incurred may be difficult to estimate. Additionally, by focusing only on quantifiable benefits, the budgeting process often fails to recognize "soft" improvements such as increased operating flexibility or new knowledge generated by such projects. By rejecting these projects, the capital budgeting process may actually harm the company's future competitive position.

The ability of computers to create synthetic representations of the real world in virtual reality offers a number of opportunities to enhance training methods used in the mining industry. Unfortunately, the training effectiveness of virtual reality systems currently used in the mining industry has received only limited testing. Miner Simulation (MinerSIM), an augmented reality system with integrated hypermedia suitable for training underground miners in the basics of using a jackleg drill to install rock bolts in a virtual mine environment is in its evaluation process at the University of Missouri-Rolla Experimental Mine. This paper discusses evaluation methodologies of the MinerSIM system, which consists of experimental and control groups with control students learning via traditional lecture and text formats. Preliminary results from usability tests of the first part of MinerSim, which is an online tutorial on underground rock bolting, are presented.

Ventilation is an expensive prerequisite for underground mining. Current mining trends, including increasing depth and mechanization and more stringent health regulations would generally dictate that more air volume is required in order to provide good working conditions underground. However, any increase in the mine’s intake airflow can produce a disproportionate increase in power consumption and hence operating costs due to the cubic relationship between the sup-plied air power and the airflow (Power a Flow3). Furthermore, forecasts of significant increase in energy prices and new commitments with regard to reductions of greenhouse gas(GHG) emissions, determined the mining industry to look into developing new concepts, design tools and incorporate the latest mining technologies in order to lower capital and operating costs while meeting commitments regarding GHG emissions. The advances in computing power and modelling software now make it possible to design, model and schedule a mine from opening to closure. A developing trend is to design and plan the mine by means of orebody modelling software, followed by using discrete-event simulation techniques to predict production rates and evaluate various operating scenarios throughout the life of the mine. The authors are currently evaluating how such process simulators could be adapted in order to forecast the need for materials or a specific resource, and one of these would be the mine’s “life-cycle” airflow demand as a function of scheduled production rates and mine operating characteristics. Further to this, based upon the mine’s life-cycle airflow demand schedule, the ventilation system could then be designed using a mine ventilation simulator. This new design approach would integrate in parallel the development of the ventilation system with the current mining conditions, therefore, heading towards “develop-as-you-go” as opposed to developing the system for final requirements with high upfront costs. This new ventilation system design criteria would also incorporate the use of the “ventilation-on-demand” technology, which will further lower development and production costs and implicitly, the mines’ GHG emissions.

Many investigators measured surface forces between hydrophobic macroscopic surfaces using atomic force microscope (AFM). Some investigators observed long-range attractions and attributed them to the presence of hydrophobic forces, while others suggested that they are artifacts of the nano-bubbles and cavities associated with the hydrophobic surfaces. Still others suggested that the long-range attractions are due to the electrostatic interactions between charged patches present on opposing surfaces and hence are unrelated to surface hydrophobicity. In the present work, we have measured long-range attractions between gold- (or silver-) coated surfaces hydrophobized in potassium ethyl xanthate (KEX) solutions at pH 9.2 under controlled potential conditions. The results of our AFM force measurements are consistent with those of the contact angle and voltammetry experiments, indicating that the long-range attractions are hydrophobic forces.

"The Vietnamese economic growth of more than 5% per year leads this country to an enormous demand for raw materials. In the duration of ongoing expansion, the big challenge in the coming decades will be to make this process as sustainable as possible when it comes to economic, environmental and social objectives. Risk management especially in occupational safety and health (OSH) in enterprises is one of the most important tools to achieve this aim. But until now, this has not been taken into priority by Vietnamese coal mining enterprises. Main reasons for this situation can be found in deficient legislative conditions and in non-synchronized risk management systems. In contrast, Germany has implemented an adequate legal system and the German mining industry has gained lots of experiences in risk management, especially in occupational safety and health. This paper seeks to point out specific challenges how to improve occupational safety and health in Vietnam by transferring and applying German methods and standards."
