The need for yieldable ground support, particularly in high stress or deep mining conditions, has grown in recent years. This paper highlights some of the current industry limitations and provides selection criteria for a new yielding ground support system, DSI?s Dynatork Bolt. This bolt distinguishes itself by withstanding 16 ? 30 kJ of energy deflecting loads anywhere from 7 ? 20 tons (depending on the energy). A summary of the laboratory test results and case studies will also be presented as a measure of the performance of this dynamic product.

This paper will address methods for minimizing liability and protecting materials from disclosure as result of self- evaluative audits and internal investigations. Specifically, the paper will cover the role of counsel in the investigative process and how best to design and conduct internal investigations to minimize the development of problematic material and disclosure of information. The paper will also address the extent of privileges that may be relied upon to protect materials and information from disclosure. These include the attorney-client privilege, the self-critical analysis privilege, and the attorney work product privilege. These privileges are qualified and understanding the limits of their coverage is essential to minimizing liability.

Introduction Precambrian shield terrains the world over are experiencing an unprecedented level of concerted exploration for lode gold deposits. Reasons for this include: • The increase in the price of gold (following 40 years at $1.13/g or $35 per oz) has transformed targets that were once unattractive into viable exploration propositions. • The relatively suppressed market for other metals produced from shields (base metals, nickel, iron, and uranium) has further focused exploration attention on gold. • The preeminence of gold production from rocks of early Precambrian age, as shown in Fig. 1. • The relatively high grade of gold in these mines (averaging about 10 Wt or 0.29 oz per st) permits profitable extraction even under depressed gold prices. A number of these mines have been in continuous operation for more than 50 years. • The recent discovery of the major Hemlo deposit, in well exposed rocks adjacent to the Trans Canada Highway, has had a world-wide impact. This demonstrates that a major new deposit can be found even in an accessible, well exposed area of a shield; gold mineralization is susceptible to rational exploration; and new target types for gold exploration exist. This paper reviews exploration activity for gold in shield terrains worldwide (Fig. 2), excluding Early Proterozoic paleoplacers of the Witwatersrand type. Emphasis is on the Archean, which is traditionally the most productive part of the Precambrian shields. There is also an emphasis on the Canadian shield (Fig. 3) because of its vast areal extent and exceptionally broad range of mineralization styles. Geological Approach A basic problem exists in gold exploration when compared to exploration for base metal massive sulfides that predominated during the 1960s and 1970s. Gold concentrations cannot usually be detected by airborne geophysical instruments. The majority of massive sulfide deposits were detected using airborne electromagnetic detectors and magnetometers. A full 75% of Canadian gold discoveries can be credited to surface prospecting. The percentage is even higher in other countries. This observation allows for great optimism for two reasons: • Large areas of shield terrain are obscured by either surficial deposits (glacial tills, clays, and desert sands) or deep surface weathering. This makes them inaccessible to prospectors. Logic dictates that such obscured areas should have the same potential for gold concentration as has exposed bedrock. • The Hemlo style of mineralization, a roughly tabular ore body where gold is associated with disseminated sulfides, is different from the traditional prospecting target. KEECO has developed the Silica Micro Encapsulation (SME) technology for the treatment of acidic, metal-laden waters. Utilizing a silica-based chemical formulation that entails chemisorption and micro-encapsulation of heavy metals in a permanent silica matrix, encapsulated particles settle quickly and are effectively isolated from the surrounding environment, producing a stable sludge that is characteristically non-hazardous. In a number of independently-verified pilot and full-scale applications (including the Bunker Hill Mine, Leviathan Mine, Wheal Jane Mine, and Meldon Quarry), SME has been proven highly effective. The theoretical requirements for the flotation d large particles are discussed. A flotation machine is described which has components which meet many of the theoretical requirements for the flotation of large particles. The machine's salient features include multiple fine-bubble attachment, froth level feeding, quiescence, shallow depth, and short flotation time. Test conditions and results are presented for the laboratory flotation of 10 mesh phosphate, 4 mesh potash, and 1/2 inch coal. In addition, test conditions and results of pilot plant flotation of minus 14 plus 35 mesh phosphate and minus 14 plus 150 mesh phosphate are also presented.

Sixty percent of the mines responding to the sixth annual Mining Cost Service labor survey reported increases in wages averaging 3.4% over the preceding 12 months. Only one mine reported a decrease in wages and this was accompanied by initiation of a substantial profit-sharing plan. Thirty-nine percent reported no change in wages. Thirty-seven percent reported using some form of incentive bonus plan. Mining Cost Service annually surveys coal, metal, and industrial mineral mines throughout the United States. Information about wages, benefits, and incentive bonus plans is part of an extensive data collection program to monitor cost areas of significance to the mining industry. This year, 131 mines responded to the survey. The data is collected by sending questionnaires to personnel managers at active mining operations. The information included in this article was taken from the returned forms, from labor contracts provided by some of the mines, and from followup telephone calls. This year's data was collected between November 1988 and February 1989.

This paper presents a successful case history of the ground improvement efforts and excavation of twenty-three cross passages between twin bore tunnels driven by EPB tunneling machines in Los Angeles, California on Section 1 of the Westside Subway Extension. Unique and complicated ground conditions local to the tunnel alignment include San Pedro sands, siltstone/claystone Fernando Formation, and zones of “asphalt impacted soils.” To provide water cut-off and soil stabilization, jet grouting was performed prior to TBM excavation at the location of many of the cross passages. However, upon investigating the cross passages prior to excavation, the subsurface conditions required additional measures and SEM tools to ensure successful completion of the project.

Public-private partnership efforts are working to create green landscapes from abandoned industrial sites. Fabricated soils, potentially an essential element of such landscapes, are designed to substitute for topsoil on the areas free from ground cover and plant community. The aluminosilicate matrix and humus form the soil micelle - the primary unit of any soil complex. Humus formation is a process based on carbon-nitrogen interaction. Sources of carbon can be materials rich in easily composted products like cellulose and polyphenols (plant leaves) or aged lignin polymers (saw dust from different woody plants). The pathways of carbon-nitrogen complexes are discussed. Properties of the fabricated soil components were examined by bio-tests and plant models.

After forty years of exploration and development, the heavy mineral sand deposits of the Murray Basin are on the eve of substantial exploitation by Iluka Resources Limited, Southern Titanium NL and RZM/Cable/Bemax, whom plan to initiate mining and processing operations in 2005. A trial mining and processing operation was undertaken on the Wemen North strandline deposit in 2001-2003 by Murray Basin Titanium, a joint venture of Sons of Gwalia and RZM/Cable, which brought to light a number of mining and processing problems which have since been the subject of extensive studies and process development work. The mineralogy of these weathered strandline deposits is complex by industry standards due to the variety of the heavy minerals present, coatings on the mineral grains and the extensive weathering and alteration which has taken place during the past 50 million years. This paper provides an overview of the complex mineralogy that, in turn, dictates the processes that can be used to recover the valuable heavy minerals. The Murray Basin encompasses some 300,000 km2 and has been a depositional basin, often land locked, since the start of the Cenezoic Era. The economic heavy minerals include ilmenite, altered ilmenite, leucoxene of highly variable composition, rutile, and zircon. There are also other heavy minerals present such as cassiterite, chromite, and monazite in quantities that pose both problems and opportunities. The clay content and overburden thickness also play a major role in the selection of the deposits to be mined. Project Services Consultants (PSC) has undertaken the preparation of this paper as part of its ongoing participation in the mineral sands industry and in particular the project development activities in the Murray Basin region currently being undertaken by Iluka Resources. Seven legendary figures of American mining will be enshrined in the National Mining Hall of Fame in ceremonies on Saturday, Sept. 7 at the Little America Hotel in Salt Lake City, UT. The 15th annual induction banquet will begin with a reception at 6 pm, followed at 7 pm by the dinner and the program. Of the seven inductees, one is living. He is Alexander Murray (Bud) Wilson, 80, of Los Altos, CA. Wilson led Utah Construction (later Utah International) to become one of the world’s most diversified and successful mining companies in the 1960s and 1970s. It was acquired by General Electric in 1976.

The Cigar Lake uranium deposit was discovered in 1981 at the south western end of Waterbury Lake, approximately 660 km north of Saskatoon in the province of Saskatchewan (see Figure 1). It is the largest undeveloped high grade uranium deposit in the world. It contains proven and probable reserves of more than 226 million pounds U3O8 at an average grade of 20.7%. The world average grade is less than 1% U3O8. [ ] The ore body is located about 450 m below surface at the interface between sandstone above and basement rock below (see Figure 2). The sandstone is fractured rock and saturated with water. This makes water inflow a real hazard at the mine. In fact there have already been two significant mine inflow events. The first of these occurred in October 2006 and resulted in the flooding of the mine. The second occurred in August, 2008 during mine recovery activities.

Grouting is mainly used to improve mechanical properties or decrease the permeability of rock mass around civil and mining projects. The purpose of this paper is to present the most effective factors on grout penetration depth in rock mass. Such factors are essential for reliable estimation of the grout penetration depth and the expense for cement take of any grouting project. In this paper, about 50 different types of the relations presented so far by various researchers to estimate the depth of penetration in fractured rock were studied. The effective factors are classified to rock mass properties, grout properties, and operational factors. Results show that firstly, the discontinuities aperture and Lugeon value are respectively the most investigated factors of rock mass properties influencing on penetration depth. Secondly, the yielding stress, viscosity, and density of grout are the most effective factors of grout properties. Finally, grouting pressure has an intense effect among other operational factors. INTRODUCTION In late 1970, an experimental geophysical program was undertaken at the Lake Huron Tunnel for the purpose of developing a geophysical technique that could be applied to determining the thickness of rock above the crown of the tunnel and identifying anomalous geologic conditions ahead of the face as the tunnel was advanced. The Lake Huron Tunnel is an 18.5 foot diameter machine bored tunnel having a total length of approximately 6 miles. The easternmost 4.5 mile section of the tunnel extends offshore beneath Lake Huron. At the time this study was started, approximately 1.5 miles of bore remained to be completed at the east end of the project. The tunnel is part of a raw water intake for the City of Detroit water supply. The Lake Huron Tunnel is bored in Antrim shale, a dense marine shale of Mississippian or Devonian age. The west end of the project encountered banded brown shale containing numerous calcareous concretions ranging in size from a few inches to more than 16 feet in diameter. As the tunnel was advanced in an easterly direction, a transition was encountered into very uniform gray shale. One set of prominent vertical joints was encountered with a strike running approximately 15 to 20 degrees askew of the tunnel axis. Bedding is essentially flat. Variable quantities of salt water and natural gas occur in the rock. The results of exploratory drilling carried out for preliminary design studies indicated that as little as 30 to 35 feet of rock cover could be expected under the lake at the east end of the project.

Limestone-based material shows great promise for removal of arsenic from water. In laboratory tests, it has removed more than 95% or arsenic and more than 99% of cadmium and lead. In addition, the waste material appears to be suitable for recycling or disposal in an ordinary landfill. However, the efficiency of limestone for arsenic removal could be improved. Recent research has shown that iron treatment of limestone can enhance its arsenic-removal efficiency greatly, increasing its attractiveness as an alternative to other methods.

The rheological properties of mineral suspensions affect the design and operation of transport, mixing, size classification, grinding, gravity concentration, flotation and de-watering systems. In many cases, the rheological properties can be modified to improve processing through the addition of chemical additives. These additives may be either organic or inorganic and generally affect the state of particle aggregation or dispersion. Inorganic modifiers act primarily by affecting the surface charge of mineral particles and thus control the magnitude of electrostatic attraction/repulsion between particles. The action of organic additives (polymers and surfactants) is a combination of electrostatic and steric forces – the latter being related to the molecular weight of these reagents. While low molecular weight polymers are dispersants (viscosity reducers), high molecular weight polymers are likely to induce flocculation and increase yield stress.

Chemical grouting has been successfully used for over forty years to control the movement of groundwater in a wide variety of applications including tunnels, subway systems, sanitary sewers, mines and construction projects. This paper illustrates the versatility of chemical grouts by reviewing three projects where chemical grout was utilized to address some very difficult water control challenges. The featured product is acrylamide which can be used alone or in conjunction with other types of grout such as cementitious products. Acrylamide grout is injected as a two component product that will react and form an impermeable gel when the components combine. There are notable differences between the acrylamide based products and cementitious products. The most notable and significant difference is that acrylamide is a true solution grout that contains no particulates and has a viscosity of 1-2cps. This feature enables the acrylamide grout to penetrate very small geological features that other grouts could not penetrate and to seal small cracks and fissures where groundwater seepage is occurring. The product also has an adjustable gel set time from a few seconds to several hours which enables the operator to determine the product travel before it forms a gel. When properly applied the product has a half-life in the soil of 362 years (per testing by the US Department of Energy).

In 1995 I was asked to participate in a litigation matter between a corporation and its insurance carriers concerning insurance coverage for remedial costs at a large, environmentally contaminated closed-down former industrial facility. One of the buildings on this site became known to the lawyers representing the company as “the infamous Building 8”. This building housed millions of documents retrieved from various locations at the facility while it was being shut down. It became apparent that the facility management had no document destruction policy, and thus Building 8 contained internal memoranda, notes, copies of correspondence, permits, operating records, inventory records, and the like from fifty years of operation. Needless to say, some of these documents, all of which were subject to discovery by the insurance companies in the litigation, contained material that was less than helpful to the company’s case. Of course, there were also a few helpful documents, but the overall usefulness of these records was outweighed by the negative impact they had on the conduct of the litigation. A second example involves e-mail. Several years ago, acting on an anonymous complaint that we later discovered was made by a disgruntled former employee who had been fired, a small army of federal environmental investigators descended on a client’s operating facility and, armed with a search warrant, literally commandeered the facility’s EH&S department. The investigators impounded the computers of the EH&S personnel and extracted all of the data from the hard drives of those PCs, as well as all EH&S related files from the hard drives of several servers used by the facility. These computers contained many years’ worth of stored e-mails, draft letters and memoranda, and other documents that provided grist for a four and one-half year criminal grand jury investigation of the facility and its EH&S staff. Both of these companies would have benefited from following a rigorous, enforceable, corporate records policy. Here is a third problem. My client had, during the 1960s, made a brief, and unprofitable foray into the nuclear fuel processing business. It ultimately sold the subsidiary, and was forced to give the purchasing company a broad indemnity against future liability. As might be expected, years later the facility was found to have considerable soil and ground water contamination both by chlorinated solvents and low-level radioactive material. Several years into the remediation program, my client discovered a tractor-trailer load of files, apparently removed from the subject facility, sitting in a parked trailer in a company-owned lot 300 miles away from the facility, where they had been for nearly thirty years. These documents were not helpful to the client, but had to be reviewed, at considerable cost, by paralegals. Moreover, several of the boxes turned out to have been mildly radioactive, setting off a chain of health and safety issues that consumed tens of thousands of dollars of legal expenses before they were resolved. Today, formal, enforceable corporate records management programs have become an extremely important element of overall corporate management. What was for most of the last century little more than a low level warehousing function is now a critical, actively managed, operating function that affects every level of corporate management. The rapid assimilation into corporate culture of electronic document management and the prevalence of e-email as the primary means of internal communication have created records management complexities the likes of which were not even conceived of fifteen years ago. Record preservation and destruction are no longer matters that can be handled on an ad-hoc decision making basis. Because of regulatory requirements affecting various classes of documents and the litigation consequences of ad hoc retention and destruction of corporate business records, and the need to have the ability to quickly retrieve documents in either a litigation or business negotiation context, a set of records management norms have evolved over time that have become the core elements of virtually every corporate records program. How does SME-AIME cope with profound changes in technology, markets - and most importantly - in employment patterns facing its membership today? This is the question that prompted the Society's Board of Directors to appoint a Long-Range Planning Commission (LRPC) (see ME, Feb. 1984, pp. 118 and 128). This is also the question addressed most particularly by the LRPC's Scope Committee. The Committee started its deliberations by asking such basic questions as "Who are we?" and "What is our business?" The Scope Committee then reviewed the findings and recommendations of other more specialized committees to develop and integrate their concepts of the Society's business for the next 10 years. The policy-making suggestions of the LRPC were reviewed and acted upon by the Board of Directors at its open meeting in Los Angeles on Feb. 26, 1984. At the Oct. 23-26, 1984 SME Fall Meeting in Denver, the Board will again review LRPC recommendations. In answer to the question "Who are we?" the Scope Committee proposed description, which was accepted by vote of the board of directors: . . A technical and professional organization that consists of individual members, namely those mining engineers, metallurgists, geologists, earth scientists, economists, managers, educators, and other professionals concerned with all facets of exploration, production, distribution, and using of mineral commodities. "These mineral commodities include all metals; industrial minerals, including construction materials and fertilizers; coal, oil shales, tar sands, and other mined fuels. Among the earth's mineral resources, only wellpumped oil and gas lie outside the Society's specific purview. "Traditionally, SME members work in the fields of engineering, technology, exploration and discovery, development, construction, mining, quarrying, beneficiation and processing, handling and transport, equipment manufacturing, sales and marketing, data processing, safety, land reclamation, environmental protection, taxation, administration, and management of these elements. "Members practice their professions in industry, in universities and research institutions, and in government. They may be operators, manufacturers, sales persons, contractors, consultants, analysts, researchers, educators, advisors, regulators, or members of supporting staffs. "The members of the Society are leaders in dedication to their crafts, in innovation, and in the pursuit of excellence. Among their numbers they count the most distinguished of engineers, applied scientists, and managers. "The Society is based in the United States, is active on a worldwide basis, and is open to nationals of any country. Certain qualifications must be met for attaining and maintaining membership." Purpose of the Society As to the question "What is our business?" the Scope Committee restated our purpose in light of current practice and the constitution of AIME and the bylaws of AIME and SME. The Board of Directors accepted the following proposed purpose of SME: "To further the professional development and well-being of its members by publishing and distributing technical writings, news, and information; by sponsoring meetings of members; by providing forums for discussions and for continuing education; and by fostering communication on the subjects within its purview. The Pennsylvania Department of Environmental Protection (PaDEP) has been issuing surface mining permits since 1984 that authorize remining in areas that will affect preexisting pollutional discharges. These permits require the mine operator to employ best management practices to reduce pollution loading from abandoned mine discharges. A total of 110 completed mining operations with 233 discharges were evaluated to determine the impact to water quality. Overall, acid loading from these discharges was reduced by 7,200 kg (15,900 lbs) per day or 61%. Metals loadings were also reduced. For acidity, 49% of discharges improved or were eliminated, 52% showed no significant change, and fewer than 1% got worse. Loading reductions resulted from a combination of reduced concentrations and lower flows.

Domestic production of industrial sand and gravel in 2004 was about 29 Mt (32 million st), a 6-percent increase from 2003. This increase was buoyed by a robust construction sector of the U.S. economy. U.S. apparent consumption was 30.3 Mt (33.3 million st) in 2004, an in-crease from 2003. Imports were about 490 kt (540,000 st) in 2004, an 11-percent increase from 2003. Imports of silica are generally of two types. They include small-quantity shipments of very-high-purity silica or a few large shipments of lower grade silica that were shipped only under special circumstances (such as very low freight rates).
