"9.1. INTRODUCTIONIn Chapter 5 of Volume I royalties are dealt with and several topics would appear to be duplicated in this Volume. However, Volume I may be looked upon as a general guide, whereas this Volume is a reference volume. It deals in considerable detail with specific provisions and concepts relating to royalties between private parties. This does not, however, mean that Chapter 5 can be ignored. It should be looked upon as a source of general information concerning royalties between private parties and as a negotiating aid intended to give an overview of various topics. You may well find that in its general approach it will lead you to ask a question which, hopefully, will be dealt with in this Volume .It should be remembered that royalty agreements are agreements with a particular focus, and so the concepts set forth in Chapter 1 apply to them. This chapter addresses a few considerations specific to royalties that will usually form part of an agreement rather than a stand-alone agreement.9.2. FORMAT FOR ROYALTY PROVISIONSIn many of the cases where royalties arise, they are adjunct to, or part of, other arrangements. For example, a royalty may form part or all of the consideration to be given to an owner upon purchase of his property, or it may arise if a joint venturer ceases to contribute to the venture and has his interest converted to a royalty.1 It is with such situations that this section primarily deals; if the royalty is contained in an agreement that is singularly, or primarily, concerned with creating it, then it is just a normal agreement.Commonly, by the time the right to receive the royalty arises, at least some of the other provisions of the agreement have been performed and/or become redundant. For example, in an option agreement the royalty will be a continuing obligation of the optionee, usually arising only after the option has been exercised.2 In a joint venture agreement, a royalty will often arise where the interest of a non-participating venturer has been diluted and converted to a royalty, in which case the recipient will usually become a passive party, entitled only to his royalty, and most of the rights that he enjoyed as an active venturer will cease to be effective."

The selection of efficiency machinery for an underground mining system is a highly skilled art. Modern techniques of mining, based on sound engineering principles, increase the probability of success. These techniques alone, however, will not guarantee maximum productivity. Human judgement, based on experience with mineral seams and geological conditions, remains the single most important input of the decision-making techniques in selecting high production equipment. The myth of a "Scientific Selection Factor" is absurd. The belief that such a factor exists can waste the time and resources of mining management. Until now, mineral extraction from the original desposit has defied all attempts to systematize the knowledge. Computerized programs are excellent for solving underground transportation and ventilation problems. The variables can be defined by mathe¬matical techniques in this type of problem. By the same, token, "Trial and Error" is not an acceptable method in today's technology-minded world. The candid truth of the matter is that practically nothing is known of the phenomenon of extracting a mineral from the solid. Likewise, local conditions make it nearly impossible to predict accurately the reaction of surrounding strata after the mineral has been removed. The unpredictability of the environment resulting from extracting minerals underground will remain a challenge to mining engineers for many years. In fact, we are barely beyond the trial and error stage at this point in time.

New Mexico is the leading domestic producer of perlite, a hydrated volcanic glass that can be expanded thermally to form a white, very porous, lightweight material. The United States is the leading consumer and producer of perlite in the world (Pettifer 1981). New Mexico produced, at five mines (Fig. 1), about 86% of all domestic crude ore mined in 1984 (Meisinger, 1985). Perlite is mined in 6 other western states, ore is expanded in 33 states, and the expanded ore is consumed in all states (Meisinger, 1985). Gross value of domestic ore mined in 1984 was about $16,500,000 (FOB mine; Meisinger, 1985) with much value added by expansion and processing prior to sale to end users. In contrast to the ubiquitous nature of perlite products in the U.S. economy, facilities for testing perlite ore, expanded perlite, and perlite products are notably lacking on a commercial, cost-effective, or readily accessible basis. The New Mexico Bureau of Mines and Min¬eral Resources (NMBM&MR) established a perlite¬testing facility in 1984 to mitigate this lack and to further the mining of perlite in the state.

This paper describing the methods employed in the purchasing and supply departments of the Miami Copper Co., Miami, Ariz., is one of a series being prepared for and published by the United States Bureau of Mines on office practice in mining operations. GENERAL DESCRIPTION The Miami Copper Co.'s plant is located about 1 mile from the town of Miami, in the Globe-Miami Mining District, Gila County, Ariz. The property consists of a complete mining plant, concentrator, high-pressure steam power plant, and many other attendant structures. In normal times the company employs about 1,500 men, and mines and mills about 6,000,000 tons of ore annually.

The productivity in coal mines, measured in terns of the output per manshift depends largely on the efficiency and speed of men and materials transport between working faces and the surface. The mechanization of coal winning and material handling processes has led to a great rise in the mine productivity (1). Early applications of power in U. S. coal mines were mainly electrical. The excellent traction available with the DC motor and the ease of the distribution of the DC power have made trolley wire installations for haulage very popular. In shallow mines with very limited emissions of methane it did not constitute a major hazard but as mine depths increased and corresponding emissions of methane also increased fire and methane ignition hazards have become very serious. Conveyors have proved economic where intense mechanization of coal faces generates a large output of coal from a single face, but the fire and respirable dust hazard associated with them are no less serious. Recognizing these shortcomings, the Federal Coal Mine Health and Safety Act of 1969 laid down numerous provisions for the safe use of trolley-wire haulage and conveyors (2) which generally improve safety but in some cases complicate mining operations and have decreased productivity significantly since 1969. In course of time as coal mines become deeper and hence gassier and as the emphasis on safety increases it would be inconceivable to use trolley-wire haulage under ground as already witnessed in several other countries with deep coal mines. With rising capital investments and cost of the protection against fire and respirable dust, the use of conveyors may also have to be limited to special areas, e.g. main entries. Indeed, there are only two alternatives available, namely; (1) Degasify the coal seams prior to mining and use conventional electrical power, or (2) Develop alternate sources of power which would be safer and yet efficient and cheap.

Synthetic fuels will be the first major development effort to feel the effects of a new set of opposition forces. These confrontations will not be of the same variety as those which occured in the 1970s. Instead the synfuels industry, particularly in the West, will find itself confronting a new coalition of local political, community, and state spokesmen. They will oppose synfuels because the projects will represent a threat to existing lifestyles, political structures, taxes, social life, water rights, economics, and other politically sensitive considerations. In short, they mean change -- usually dynamic, full of unknowns and always threatening. The battles themselves may be fought technically over environmental issues, law and regulations; often these will be the instruments of the opposition. The real underlying problems will likely lie much deeper. In many cases environmental groups will be enlisted as the standard bearers; however, this approach may simply reflect the fact that environmental objections are convenient or at times the only tools at hand.

The Bureau of Mines, as a result of its contract research program, is developing a retractable core bit for the wireline drilling system (Retractable Sit System, No, H0272004). The prime contractor, Longyear Company, Minneapolis, Minnesota, and the subcontractor, Doerfer Division, Cedar Falls, Iowa, have designed, fabricated, and are currently field testing the in-hole retractable bit system. he objective of the program is to develop a minerals exploration core drilling system that allows retraction of a worn out bit and insertion of a new core bit, without pulling the drill rods out of the hole. To date, the results of the project are encouraging, and the retractable bit contract is currently in the last phase of a four-phase program, which is on schedule and under budget.

The hydraulic movement of coal is here defined as the movement of all sizes of coal in pipes and open flumes, by gravity and against gravity. It is not restricted to coal which is in slurry form. In other words, it is not crushed to a size in the 8 to 20 mesh size range. The top size could be as high as 12 inches. The dewatering of coal which is transported hydraulically is carried out to restore the coal to a suitable form for further cleaning, or for transportation by other methods. The process involves complete separation of all the coal, wood and rock from the water so that the water can be recycled without undue damage to pumps, pipes and monitors.

Hydraulic tailings fill in the Butte deep level mines was based upon studies made in 1958 by the Anaconda Company Mining Research Department, which published Bulletin No. 35, entitled "Hydraulic Stope Filling". Since then, many things have changed. At the time of the Research Departments study, dry mine tailings were hauled by rail cars from the Anaconda tailings ponds, twenty-five miles distant, to the underground mines' tailings fill plants at the Leonard Anselmo, and Mt. Con Mines. Now, with the installation of the new Weed Concentrator in Butte, tailings is delivered by pipeline to a cyclone at the Kelley Shaft, and stope filling has become more highly automated and streamlined. Presently, mill tailings at approximately thirty percent solids by weight, is pumped from the concentrator, eight thousand feet horizontally and upward, to the Kelley Fill Plant, where they are dewatered and deslimed by three Krebs Model D20B Cyclones, which discharge the material into the cased and grouted mine delivery bore holes at desired densities up to seventy percent solids. The vertical boreholes and four-inch rubber lined Victaulic pipe carry the material downward to horizontal distribution lines, which in turn tap into the stops-filling, three inch, unlined steel Victaulic pipelines. The slurry may travel several thousand feet before it finally discharges into the stope, where it lends support to the mined-out area.

Until the past decade, the energy-size reduction relationship was the dominant form of mathematical model used in the description of tumbling mill grinding processes (1,2). Typically, in these models some single measure of product fineness (e.g. the 80% passing size, the size modules, the specific surface area) is chosen as the dependent variable and the energy input per unit mass of material being ground acts as the independent variable. In some instances these models have been useful for the correlation of experimental data, but, invariably, they have been found to be inadequate for meaningful process simulation. During the last decade considerable advances have been made in the development of phenomenological grinding models derived from population balance considerations (3-7). In these models a set of dependent variables is employed, corresponding to the set of mass fractions which constitute the product size distribution, and energy input is abandoned in favor of "time in the mill" as the independent variable. The phenomenological models have been shown to provide accurate simulations of the entire size distribution of ground products produced in batch (8-10), locked cycle(11)and steady and unsteady state, open and closed circuit continuous grinding(12,13).

The U.S. produces about 34 percent of the world's aluminum yet must import 90 percent of the raw materials needed. There are abundant resources of aluminum-bearing minerals such as clay, anorthosite, alunite, shale, and dawsonite, but none of the numerous processes proposed for recovering alumina from them has yet proved economically competitive with the Bayer process using imported bauxite. To help develop an economically viable process for utilizing these resources, the Bureau of Mines is testing on a common basis several proudsing processing techniques. New improvements and approaches developed by industry and the Government are being evaluated on a mall scale to obtain enough information on which to form a judgment regarding the best processes for commercial adoption. A continuous miniplant having a feed rate of about 70 pounds per hour is being operated now to investigate the nitric acid process for recovering alumina from clay. Parts of this plant will be used subsequently for work on other processes for recovering alumina from clay, anorthosite, alunite, and dawsonite. Initial results of the operation and plans for the overall project will be discussed.

BITUMINOUS COAL production for 1937 up to Nov. 27, was 400,000,000 ions, an increase of 3.43 per cent over the comparative period in 1936. The in- crease in consumption, however, was not so great as the increase in production. Stocks of coal, mostly in the hands of consumers, on Nov. 1 were 57,000,000 tons, compared to 44,400,000 tons at the same periods in 1936. The prospects were that both production and consumption for December, 1937, would be lower than for the corresponding month of 1936. , Anthracite production for the period ending Nov. 20 was 43,900,000 tons, com- pared to 48,500,000 tons for the corresponding period in 1936, or a decrease of 9.5 per cent. PETROLEUM consumption during 1946 broke all previous records and further increases are expected during 1947. U. S. consumption amounted to an average of 5,280,000 bbl a day, of which 4,745,000 bbl was domestic crude oil, with the rest from natural gasoline production and crude oil imports. World consumption during the past year, excluding Russia, is estimated at 7,200,000 bbl daily. Forecasts for 1947 indicate a U. S. consumption of 5,425,000 bbl daily of petroleum products. This is expected to be made up of 4,655,000 bbl of domestic crude oil production, 340,000 bbl of natural gasoline production, 400,000 bbl of crude oil imports, and the rest from stocks. Petroleum's principal use is still as a fuel. The field remains highly competitive, but petroleum has been continuously progressing. Less than fifty years ago, oil supplied only one twentieth as much of the nation's total energy as coal, but today it supplies over half as much.

WE have already devoted two previous memoirs to this question. In the first we collated and discussed the existing literature on the subject; in the second, we described the crystalline forms obtained by the reduction, at different temperatures, of ferrous chloride by hydrogen or by zinc-vapor. The conclusion from these researches was that the three allotropic states of iron-a, stable below A2; 19, stable between A2 and A3; and 7, stable above A3-all crystallize in the cubic system. The differences observed were such as are customarily encountered in the crystallographic records of many minerals of which allotropic varieties or isomerides are not known, but did not conform to the ordinary definition of polymorphism. It is, however, improbable that allotropic transformations, which are placed beyond doubt by a series of positive facts, do not involve some changes in the intimate structure. As a matter of fact, the crystals we did obtain were too small to allow of a precise examination, and this might introduce an element of uncertainty in the firm establishment of our conclusions. Professor H. Le Chatelier was even led to think from some of our results that iron could very well be a rhombohedron simulating a cube, and not a true cube, and it will be remembered that the crystalline form of bismuth was for a long time incorrectly regarded as cubic. METHODS of coal preparation have been greatly developed and improved during the past few years. Under the pressing competition from substitutes that have been displacing coal as a source of heat or power, the coal industry has been able, in many cases, not only to hold its own but to regain much of the lost ground, by offering better products of a higher value. The purpose of this paper is to present, in a brief and simple form, the principles of the latest methods and machinery used in coal preparation, in order to enable the coal operator t0 select methods and equipment capable of solving his own problems in the most efficient and economical way. The paper will deal, in the main, .with coal cleaning. It must be emphasized, however, that a complete coal preparation study covers many other operations, such as handling, screening, de-dusting, dust-proofing, and ash-conditioning. Handling Coal From the producing face to the railway car, coal must be handled with great care, t0 prevent degradation, because the coarser sizes are not only easier to clean than fines but, for our markets, they are often the more valuable. Generally speaking, such care is less important or is unnecessary in the Old Country, where conditions are different. The best way to minimize breakage is to avoid gravity methods in coal transportation. All chutes in a preparation plant should be shaken mechanically, and cleaning processes requiring large surge bins must be avoided. De-Dusting De-dusting of coal is accomplished by the use of vibrating screens, fans, or classifiers, or by a combination of these. Fines below 1/32-in. (or coarser than this, with some coals) can very seldom be cleaned efficiently. Common practice is to discard them immediately, if the moisture content of the coal allows this to be done. Otherwise, they are liable to give unnecessary trouble, either in the form of dust or sludge, which are difficult to collect or to settle. Flotation is the only process which will effectively clean fines.

Mining of low grade deposits along with the necessity to design and operate flotation plants with high throughput presents unique metallurgical and environmental challenges that need to be addressed to reduce project risks, improve project economics and to sustain the profitability of operations over the life of a mine. Some of the key challenges include poor recovery of valuables and concentrate quality issues due to complex mineralogy, the need to use poor quality water such as brackish or sea water, reduce environmental impact from the process, integrate flotation with hydrometallurgy to maximize precious metals recovery, escalation of capital and operating costs, use of unproven technology and constant use of larger equipment, high ore variability, worldwide constraints on resource availability and an ever increasing need for reliable metallurgical input to financial models to evaluate economic viability of projects. The need to develop effective solutions to these problems in a short time frame is becoming a key to the success of any new project and for sustaining the profitability of a mining operation. An integrated multi-disciplinary approach to problem solving is crucial with the need for a more lateral thinking along with strategic partnerships and collaboration involving the right players. Discussion of the paper of D. W. Brunton, presented at the Spokane meeting, September, 1909, and published in Bulletin No. 33, September, 1909, pp. 837 to 855. WILLIAM' KENT, New York, N. Y.:-The Institute may congratulate itself on the opportunity of reading the splendid address of President Brunton. It is au admirable summary of the progress that has been made in the mining and metallurgical arts in recent years. The paper rightly give's the chief credit for this progress to the aid which has been rendered to these arts by the advances in mechanics, chemistry, and electricity. It is notable that most of the headings in Mr. Brunton's address refer to the work of the mechanical engineer, the electrical engineer, and the chemist, rather than to that of the specialist in mining-operations. It seems that. the most successful mining engineer of the present day is the one who makes the most intelligent application of the inventions and designs of engineers and others who are not directly engaged in mining. A tabulation' of the headings of the address, grouped as below, shows this most clearly. Work of the Mechanical Engineer-Rock-drills, hoisting-machinery, tramming, pumping, ventilation, dredging, sampling, concentration, briquetting, fume-recovery. ALLUVIAL gold was first discovered in Guiana in 1852, in the sands of the Arataye river; by Paulino, a Brazilian convict. During the following years, gold was found also in the rivers Orapu, Cirubé, etc. In 1873 the famous placers of the Sinnamary system were opened: Saint-Elie, Dieu-Merci, Adieu-Tat, and Couriége. This group of mines has produced nearly $10,000,000, according to official records, not including the gold that escaped the taxes. The discoverer was a mulatto named Vitalo. Except in a few rich spots, the gold was rather evenly distributed along the creeks. In one instance, gold was found in the red dirt from the slope of a hill, which, after transport to the creek, gave an amount of 150 kilograms. The placers of the Mana system, Enfin, Elysée, Pas-Trop-Tot, date from 1878, and their production has been about $5,000,000. In 1888, the Awa placers, along the boundary between the French and Dutch Guianas, on the Maroni and its tributaries, were discovered. They have yielded $12,000,000. The only industrial company,, the Dutch Guiana French Mining Co., produced in 15 years about 2,500 kg. of gold, worth $1,500,000. From 1893 dates the famous Carsewene discovery, in territory then in dispute between France and Brazil. A settlement was made recently in favor of Brazil, by arbitration of the Switzerland State Council. Carsewene is said to have pro-duced about $18,000,000 in six years (1894-1900), but not even one-fourth of the production went through French Guiana and

In 1985, ZC Mines (now Pasminco South) had been unprofitable for some years due to a combination of high operating costs, low metal prices, low head grade and an aging and inadequate mining infrastructure. However, the resource of metal in the ground was still of world class, even after some 80 years of mining. A major study, which was to be of two years duration, was therefore commenced to establish a practical and profitable long term mining strategy and to cost the infrastructure options needed for its support and thus form the justification for a capital expenditure program to take the mine profitably into the 21st century and its second century of operation. This paper discusses the rationale behind the methodology adopted and the nature of the results achieved in one aspect of the study - the determination of the mineable resource and the relationship between the head grade/quantity of the economically mineable resource and the variables of cut-off grade, cost structure, annual production rate and metal prices/exchange rates. The basis of the study was the designing of some 5000 scopes to mine out the entire resource for a range of cut- off grades and the assembly of the detailed physical data thus obtained in a stope-by-stope data base for financial and other analysis. Those scopes which were shown to be economically mineable were then scheduled for two optimum annual production/cut-off grade/metal price combinations to provide life-of-mine cost and value of production cash flows.

In turn , a feeling among employees that the company really has their interests at heart has a wonderful psychological effect . It is bound to bring forth more and better work and to attract and keep workmen of the better class . There is keen competition between the various branches of this corporation for a trophy that is awarded each year to the one having the best accident record . This trophy was won by the Nacożari branch of the Moctezuma Copper Co. in Mexico in 1926 and 1927 , and the Morenci branch won the trophy in 1928 and 1929 .
