Water is a most remarkable substance, essential for life of all kinds. As well as needing water to survive, man has always used it for agriculture, transportation, recreation, and many other things. When our country was young and inhabited by few people, the streams, rivers, and lakes were able to provide all the clean water needed by man and take away all the wastes created. However, with our growing population and an ever-increasing demand for goods and services, the public, industry, and government at all levels have become acutely aware of the need to manage the nation's water resources more efficiently. Abundant energy from many sources has helped this nation to become the greatest industrial nation in the world. Coal has contributed a major portion of this energy, generating electricity, running railroads, and maintaining national security during wartime. The result has been the highest standard of living in the world and a time of widespread economic prosperity. The use of water in coal mining is somewhat different from its use in most industries. With the exception of water used in cleaning plants, for underground dust control, and for fire protection, most of the water en- countered in coal mining operations serves no useful purpose. In other words, it is an undesirable element and must be removed, otherwise it will interfere with operations, cause potential water quality problems, and may even stop operations by flooding. In the past, removing water from working areas of most mines was usually a fairly simple matter. Pumps with piping were installed at sumps or low spots in the mine and the water was pumped to the surface or to drainage control facilities constructed for the operation. Ditches were often used to collect and drain the water by gravity to the outside or to main sumps for pump discharge. In either case, the water was allowed to flow into the nearest stream or river. The porosities of fractured limestone reservoirs can be divided into two broad types in accordance with their effects on fluid distribution and fluid flow. In the coarse porosity, gravity segregation lakes place freely and the resistance to fluid flow is very small. In the fine porosity there is no segregation and a high resistance to flow, and it has relative permeability characteristics similar to tight sandstones. By analyzing the affect of the two porosities it is concluded that in some cases to recover the maximum amount of oil it is necessary to remove large quantities of gas from the reservoir by producing at high gas-oil ratios. In this manner the fine porosity is drained of its oil and the gas-oil contact drops slowly permitting higher production rates from the oil leg. Since this conclusion is contrary to widely accepted principles of conservation, a mathematical model (Fig. I) was constructed to duplicate the conditions desired. The behavior of the model indicates that under certain conditions it is possible to recover more oil by producing at high gas-oil ratios than by production at low gas-oil ratios, and that the rate of production is affected more by gas shut-offs than by the decrease in pressure (Figs. 2, 3, 4 and 5). INTRODUCTION It has been noted that certain limestone reservoirs behave in such a way as to indicate that there are two distinct types of porous spaces available for fluid storage and fluid flow. Regardless of the nature of these porous spaces the distinguishing characteristic is that in one type of porous space there is definite gravity segregation between the oil and the gas; while in the other, the gas evolved tends to remain distributed equally throughout the reservoir. For the sake of simplicity the porosity in which gravity segregation takes place at a fast enough rate to affect the behavior will be called "coarse po- rosity", while that in which this is not so will be termed "fine porosity". The behavior of a reservoir of this type would be different than that of a sandstone reservoir, especially if most of the oil is in the fine porosity. AN ESSENTIAL mental equipment for planning exploration is the fullest possible. knowledge of the way in which the orebodies occur in the region to be explored, also the realization that in no mining district is this knowledge complete, and that new: facts of importance will he revealed to the explorer in every exploration if he is in the proper frame of mind to grasp them. The geology, of the ore deposits of the Gogebic Range for a long, time was thought to be relatively simple, but work in recent years, by several men, has proved that this is not the case. We now realize that we are far from knowing all the factors that have resulted in the localization of ore deposits. For example, we have long known that the intersections of the dikes and. the foot wall were favorable places to look for ore, but only within the last few years have we learned that there are several horizons' in the various members, well north of the foot wall, that are likely to carry ore. The influence of the numerous cross faults on orebodies is not known or appreciated beyond a general realization that they are important. Just how they may be favorable or unfavorable to the localization of ore is not known. Such elementary information as the positions of these faults is just beginning to appear on the mine maps. Such being the condition, one can hardly overestimate the importance to the various operators and fee owners of careful studies of conditions in their properties for the purpose of assuring themselves that they are not missing valuable ore-that they are doing all the exploration that their situation demands in order to secure maximum returns. Valuable ores have been missed in the past and will be missed in the future. Only with a complete knowledge of all the factors that have united to produce ore could anything else be expected. The purpose of this paper is to call attention to these facts briefly and to suggest a few of the principles that should guide effective exploration. The foremost principle is that the man who starts out with the idea that he knows all about the mine geology of the Gogebic Range is starting with a heavy handicap.

Arthur Jarman, Sydney, New South Wales, Australia (communication to the Secretary*):—All designs for modern metallurgical and chemical laboratories should provide each student's desk with a hood or cupboard for the removal of fumes, but I doubt the advisability of placing air-baths and similar apparatus close to the hot plate. It seems to me that unless the draft be exceptionally strong the fumes from ordinary wet assay work will corrode the iron-work of the fittings, in which case the baths would have to be removed to a general desk in order to lighten the work of the laboratory attendant. Since the laboratory described by Mr. White has been in use for two years, I should like to ask if any inconvenience has resulted from this corrosion. If not, it is certainly an important improvement to have the air-baths and similar apparatus placed on the student's desk. The hoods described by Mr. White are supplied with a good draft by means of a fan, which gives them a great advantage

COAL EXPLORATION Coal exploration may be defined as the acquisition of data necessary to define and acquire a block of coal which can be mined at a profit. Unlike ore minerals, coal resources are widespread and relatively abundant with supply exceeding demand in almost every case. Thus simple discovery of coal is generally not enough. The chemical and physical variability of individual coal seams, the capital intensive nature of coal mine development, and the changing patterns of utilization require that a multiphase, three-dimensional evaluation be made of each potential reserve. Factors which must be investigated include not only the quantity and quality of the coal but also the geologic, hydrologic, and engineering characteristics of the seam and its surrounding strata. Acquisition of property to provide a secure base for exploration and mine development is equal in importance to the geologic and engineering programs. The successful development of a coal reserve requires that control of coal and, in the case of a strip mine, the surface be in the form of contiguous blocks of sufficient size to support mining. PHASES OF EXPLORATION The high capital risks of coal exploration and land acquisition dictate that a multiphase program be utilized to minimize initial risk. In such a program, phased development of the data insures that each increase in capital expenditures will be justified by a corresponding increase in the level of confidence in the ultimate success of the project. Each phase is designed to provide sufficient data and property control to facilitate the decision whether to proceed to the next phase of development or to discontinue the program (Table 1). LEAD stocks at the beginning of 1943 were comfortable when compared with those of other base metals such as copper, zinc and tin. This situation was early recognized by W.P.B. and other Governmental agencies and every effort was made to encourage the substitution of lead for these latter metals in all essential uses. Despite this apparently healthy condition, lead was not denied participation in the various measures inaugurated by the Government to relieve metal shortages. Thus in the Mexican trade agreement, effective Jan. 20, the tariff on two important classes of lead importss was halved. Similarly, in the setting up of B quota premiums, a B base was allotted to lead, with all pro¬duction above this figure receiving an additional payment of 2.75c. per lb., or a total payment of 11.75c. per lb. At about the same time it was announced that all quota transactions would be based upon the lead content as shown by the smelter settlement sheets. This basis was 86 percent of the lead content for all ores shipped to custom milling plants and 95 per cent for ores and concentrates shipped to custom smelting plants. The importance of this action can be appreciated when in the Coeur d'Alene it was estimated as equivalent to a 5 per cent increase compared to the previous base.

In the copper-mining district of northern Michigan a fair-sized mine usually operates two or more shafts along the strike of the lode, these shafts being usually at least 1,000 ft. apart. The tonnage to be hoisted from each shaft is large—from 13,000 to 25,000 tons per month. The hoisting-engines used are generally steam-driven, non-condensing, duplex engines with Corliss valves, supplied by steam from separate boiler-plants where the distance between shafts is great. In an attempt to centralize power-plants and secure central-station economies, the Winona Copper Co. installed an electric hoist of the Ilgner type, with Ward Leonard control. A brief description of this plant has already been published.' The only point of variation from the simple Ilgner set lies in the connection of two generators to a single induction-motor by flexible couplings. These generators serve motors which operate hoisting ing-drums at separate shafts, viz., No. 4 shaft, Winona, and No. 1 shaft, King Philip. The hoist for No. 4 shaft is about 1,700 ft. from the power-plant, arid in this building the motor-generator set is placed. No. 1 King Philip hoist is 1,500 ft. from the motor-generator set. The equipment of the motor-geaerator set is as follows: In the middle of the set is a 12-pole, 450-h-p., 600-rev. per min., 2,080-volt, three-phase, 60-cycle, variable-speed induction-motor, connected on each side to a 20-ton fly-wheel which is 10 ft. in diameter, and to a 6-pole, 170-km, 575-volt, interpole, direct-current generator. The many complexities arising from our present oil pool proration systems emphasize the need for a suitable standard of property rights. Attempts at conservation and unitization agreements have frequently failed because of the lack of such a standard. The necessity of reducing production to consumption has caused umpires, committees, commissions and other governing bodies to allocate the production of flush fields among the respective owners. The methods of allocation vary widely and conservation of underground reserves is frequently neglected or misused. Critical economic conditions increase, rather than modify, competitive methods. In some fields we have irregular and uneconomically close well spacing. Many operators drill unreasonably large holes, take excessive sand penetrations or leave their wells untubed in order to secure higher potential open-flow tests than their offsets. All of these practices result in economic waste and frequently damage to the pool. Regardless of our agreement with the fundamental principles of proration or unitization, both are actual necessities in many of our present economic situations, and we are in urgent need of a suitable standard of rights to facilitate and simplify their operation. The problems pertinent to unit management are simple and of daily use in many partnership enterprises, but the problems of fair and proper division of production under either proration or unitization are, as yet, subject to controversy. The rights of respective owners must be ascertained and standardized before we can eliminate wasteful practices and still preserve constructive competition in our industry. Valuation of Tracts In a recent unitization conference it was found that each participant had a different basis for calculating the relative values of tracts. Some of these assumptions were as follows: 1. Unrestricted open-flow operation to abandonment. 2. Current proration system to abandonment.

A SUMMARY of the consumption of coal in 1945 shows that the coke industry accounted for 17 pct of the total coal used. No substitute for coke and the blast furnace in the reduction of iron ore has gained sufficient prominence so far to be given serious consideration. However, while the same slot-type ovens are being built and used now as were in use a few years ago, the problem of obtaining suitable coking coals, both high- and low-volatile, has forced many operators to revamp coal-blending facilities. Until the beginning of World War II, high-temperature coke plants were able to secure the required high-volatile and low-volatile coals from two or three seams and from three or four mines. Thus, many of our coke oven plants were able to operate with storage bins for two coals only. The variance in raw materials was not great, and uniformity of blend was a relatively simple problem. Since the beginning of World War II, many and important changes have taken place. Demand for all coals increased greatly. Production, though kept as near maximum capacity as possible, could not meet the demands for coal generally, and particularly for the various kinds of coal which have proved to be satisfactory for specialized uses; coals were allocated as nearly as possible in the order of greatest need; storage piling was reduced to the minimum necessary to keep plants in operation; uniformity of quality could not be maintained, and with this last, uniformity of composition of blends for coking could not be maintained. Whereas before the war producers of metallurgical coke could fill their needs from three or four mines, by the end of the war it was not unusual to find shipments to a single coke oven plant coming from as many as 30 different mines, in a single month. Since many of the mines producing both high- and low-volatile coal for high-grade metallurgical coke are rapidly nearing depletion, the problem of seeking new sources and of blending a number of coals in each plant for the production of high-temperature coke is facing practically every producer in the United States at the present time, and is one which will probably continue for many years to come. Midwestern by-product coke ovens in the Chicago and St. Louis areas use annually from 12 to 15 million tons of bituminous coals which are transported 500 to 700 miles from the Appalachian coal fields of Pennsylvania, West Virginia, and eastern Kentucky. Approximately two-thirds of this coal is high-volatile bituminous. The critical transportation problem confronting the nation in 1943, and the growing scarcity of the best Appalachian coking coals, prompted the Illinois Geological Survey to propose a research program in which would be studied the coking properties of blends of low-sulphur, high-volatile Illinois coal with the high- and low-volatile coals from the eastern fields. INTRODUCTION A major segment in a successful heavy equipment maintenance and repair program is the provision of well-laid out and well-equipped shop and service facilities The facilities described here will be those required for a large, high tonnage hard rock open pit mine utilizing rotary drills, shovels, haulage trucks, support equipment, and service trucks. The term support equipment covers the equipment required to support the drill, shovel, and truck operations, these are crawler tractors, road graders, front-end loaders, water trucks, rollers, rubber-tired tractors, etc. Service trucks are the automotive type consisting of rubber-tired over-the- road equipment. The primary structures generally involved in the total maintenance effort are as follows. (1) the main shop with an attached warehouse (the structure could also house the tire and lube shops plus the equipment cleaning stalls), (2) a service station with bulk petroleum product storage tanks, (3) a heating plant, (4) a security station (lf this is a corporate requirement), (5) operating department and employee assembly buildings, and (6) an electrical substation. Under certain conditions, many of these facilities with the exception of the substation could be combined In one or several structures. This arrangement could have a great advantage especially in areas where the heating of the structures is extremely critical.

Unlike the furnaces employed in the reduction of ores to mattes and metals, the foundry-cupola has only melting to do. This looks simple enough; and its development has progressed through centuries by cut-and-try methods; but there is still much to be learned concerning the causes which underlie the production of defective castings, even from first-rate materials. There are other differences between the smelter and the cupola. The former is usually, the latter rarely, run continuously. In the smelter there is some chance for experiment, since rich slags can be treated again; while in the cupola the metal must be good for casting from the first tap to the drop of the bottom ; otherwise, heavy damage will result. In the smelter, the object sought is the production of metal or matte with a minimum loss in the slag; whereas, in the foundry, a variety of castings of different compositions must often be run from the same heat, one after the other. Experience with the cupola has shown that the melting should take place, throughout the heat, in one zone, the zone of maximum temperature, which is clearly marked on the cupola-lining by the severe cutting action of the slag and iron oxide. The design and operation of the cupola must conform to this condition. This conformity having been secured, other considerations resolve themselves into those details of construction which will involve least trouble and cost of repairs. The very high temperatures required to melt iron and steel in the cupola, leaving the metal sufficiently superheated for casting, render the use of water-jackets inadvisable. It is always possible to patch up the lining at the melting-zone between daily heats; and the rest of the lining is seldom affected enough by abrasion and chemical action to require replacement oftener than once in nine months. The cupola is practically a shell of steel, lined with the proper refractory material, and provided with a sct of tuyeres for the admission of air to burn the fuel and melt the metallic

MY first Nevada City mining reminiscence is one of seeing Capt. Thomas Mein, over 52 years ago, in the old Wyoming mill on Deer Creek about a mile below the town of Nevada City. Captain Mein was then superintendent of the Wyoming mine, where the old fashioned Cornish pump was used, as well as hurdy-gurdy water wheels for power. This mill was one of the typical, up-to-date mills of that time and consisted of stamps, fed by Chinese hand feeders, who also cobbed the ore down to a small enough size to be fed into the mortars. Stamps at that time were of light weight and crushed about one ton to one and a half tons to the stamp, the pulp going over plates, then into sluices with self-raising gates. When a sluice became full the pulp was shut off and directed into the parallel sluice, also with a self-raising gate. The concentrate thus collected in the sluice was shoveled out and carried to Cornish buddles and there cleaned up, preparatory to being sent to a local custom chlorination works.

INTRODUCTION The tax structure of foreign mining investment into the United States has a significant impact on the financing and the profitability of the operation. For these reasons, it is critical for the foreign investor to develop and implement a well planned tax strategy that will enable its venture to: (1) reduce its U.S. income tax liability (2) lower U.S. withholding taxes when funds are transferred from the United States, and (3) decrease or defer home country taxation on its U.S. earnings ALTERNATIVE FORMS OF INVESTMENT A threshold business and tax consideration is the form in which the investment is to be made. The most common alternatives include: forming or acquiring a U.S. mining corporation, directly establishing a branch mining operation, or entering into a joint venture or partnership with a U.S. mining company. U.S. Corporations The most common structure through which foreign mining companies engage in business in the United States is to form a U.S. mining corporation. Forming a U.S. Corporation. If the investor decides to establish a new U.S. corporation the organization is relatively simple. No distinctions are made in the United States between "public" and "private" forms of incorporation. Minimum share capital is not usually required and share capital may consist of shares with no par value. Since corporate law is the responsibility of the individual states, the foreign investor must choose a state in which to incorporate. If appreciated mining property is transferred to a corporation solely in exchange for stock or securities in that corporation, and the transferors have control of the corporation (defined as at least 80 percent of all voting shares and at least 80 percent of all other shares) immediately after the exchange, no gain or loss will be recognized. However, if the transferors receive cash or other mining properties in addition to stock, any resulting gain may, in certain situations, be taxed to the extent of the cash and the fair market value of other property received. Acquiring an Existing U.S. Corporation. Acquiring an existing U.S. mining corporation is not as straight-forward as forming a corporation. This alternative may be accomplished through either a stock or an asset acquisition. Generally, with a stock acquisition the purchaser inherits all of the business and tax attributes of the former mining corporation. If the investor is able to acquire mining assets, however, the purchaser will usually be able to avoid any unknown or hidden liabilities that could be attached to an existing corporation. Another principal advantage in acquiring assets is that the purchase price may be directly allocated to the acquired mines or other mineral-related assets with the result that the assets' depreciable base may be increased. Assuming the domestic seller and the foreign purchaser can agree, it is generally advisable to allocate the purchase price in the sales agreement to specific individual assets. From the foreign investor's standpoint, it is preferable to allocate the purchase price to depreciable assets such as buildings and equipment versus an allocation to mineral land holdings or intangibles such as goodwill, which are generally not depreciable. It is not uncommon, however, for a seller mining company being acquired to insist for tax reasons that the investor purchase shares rather than assets. If the foreign

THE United Verde mine is in the north central part of Arizona, on the northeasterly slope of the Black Hills, near the town of Jerome. Ore was first discovered in the district about 1875, and the first mining claims were located by M. A. Ruffner and associates in 1877. In 1888 the late Senator William A. Clark secured control of the property and under his ownership it developed into one of the country's most important copper producers. The property was sold to the Phelps Dodge Corporation in 1935, and since then has been under this Corporation's management. Except for shutdowns caused by general world-market conditions, production has been continuous from 189o to date. GEOLOGY The mineralized zone ranges in area from approximately 12 acres to less than 5 acres. All mineralization occurs in the pre-Cambrian intrusives. The first intrusion, according to geologic records, was the quartz porphyry, which later was intruded by augite diorite. Following the diorite intrusion through a series of intrusions of lesser magnitude, a pipelike mass of massive sulphide, quartz and rock was formed. The diorite forms the hanging wall of this mass, and the porphyry the footwall. Between the footwall and the sulphide a band of chlorite schist was formed, probably owing to metamorphic conditions. Commercial ore occurs along the contact of the schist and sulphide extending into the sulphide, sometimes entirely through the schist, and fingering out into the porphyry. The ore deposit was formed by replacement similar to deposits formed in limestone areas. Faulting and deformation occurred in pre-Cambrian times and again in the Tertiary period, removing approximately 2000 ft. from the top of the main United Verde ore body, forming the United Verde Extension ore body, the only other major ore body in the district. Major development work has shown that the sulphide mass extends to the 3300-ft. level, and diamond drilling below this level has indicated that the mass might extend below the 3700-ft. level, but in a diminished quantity. While many copper minerals exist in the mine, the chief commercial mineral is chalcopyrite. GENERAL DESCRIPTION AND PHYSICAL CONDITION OF MINE After over 50 years of active production, ore still exists on almost every level of the mine. This condition is due to many causes -mine fires, which broke out as early as 1894, caused the abandonment of certain areas; subsidence and ground movements retarded the cleaning up of others. Furthermore, in the early days there was such an abundance of ore that when mining became difficult it was a simple matter to replace the production by going to a deeper level. IT will be recalled that the first professor of metallurgy in the United States, appointed in 1855, never really gave any instruction in metallurgy and gradually turned into a professor of mineralogy. Metallurgy was included with. mining in the early curricula, two students who took the B.S. in mining engineering from the Polytechnic College of Pennsylvania in 1862 wrote their graduation theses on the metallurgy of copper and zinc, respectively. Even after Columbia School of Mines established, in 1868, a separate curriculum leading to the Ph.B. degree in metallurgy, very few students elected it,* preferring to take the mining degree, since they received in its curriculum nearly all the metallurgical instruction they would have in the metallurgical curriculum. For many years a large proportion of the men who attained prominence in metallurgical enterprises had taken mining rather than metallurgical degrees. METALLURGY Clifton Sorby's study of thin sections of rocks under the micro¬scope, beginning in 1850, and its subsequent development by Zirkel and others, had made microscopic petrography a recog¬nized department of geological research as early as 1873. . It was inevitable that the idea of studying polished metal surfaces-¬under the microscope by reflected instead of transmitted light would occur to investigators. Sorby himself did it in 1864, and Adolph Martens and Floris Osmond may -be especially named among the many European workers who, by the late eighties, had so developed the, necessary techniques that they were able to photograph polished metal surfaces at magnifications as high

IN order to secure cupels uniform in size, density, etc., I have arranged a machine which has proved quite satisfactory, and is so simple and inexpensive as to be within the reach of nearly everyone. It has been in operation here about four years, and with it all cupels used in the assay department of the School of Mines have been made. As shown in the accompanying figure, it consists of a common letter-press, the movable platen of which has been removed. In place of the plate, there is attached to the screw a plunger, which turns with the screw, moving up and down, and making the depression in the cupel. The ring holding the bone-ash is held in place directly underneath the plunger by a wooden guide fastened to the base of the press. There is also fastened to the top of the guide for the ring, at a distance above the base of the press equal to the height of the cupel-ring, a piece of mood about § inch thick, under which the ring will just slide into place, and through which there is cut a circular hole exactly fitting the plunger, guiding it in its downward movement always in the same vertical line; this last guide not only directs the plunger, but also prevents the lifting of the ring by the plunger, upon the raising of the latter.

It may seem necessary to offer an apology for presenting for consideration a process which is conspicuous by its absence in the literature of the Institute, and which may be thought by some to belong to the past in metallurgy, and to have been already superseded. But the large capital invested in puddling calls for a careful consideration of the question whether the time has certainly arrived when the puddling furnace must be replaced by the converter and open-hearth furnace. May there not still be a place for puddled iron alongside of molten iron and steel, and is not the improvement of the puddling process itself worthy the attention of engineers equally with the Bessemer and open-hearth processes? The changes involved in the conversion of pig iron into wrought iron are well understood and need only be briefly alluded to. The patent of Henry Cort bears the date of 1784. Since that time * the improvements in the process have mainly consisted in the replacement of sand by iron bottoms by Samuel Baldwyn Rogers in 1818, and the still more recent substitution of iron oxide for the refractory materials used for the rides and bridge of the hearth, which distinguishes the wet or boiling process from the dry or pnddling process. Chemically, the process consists in the removal of the metalloids from the pig iron, a result effected mainly by the iron oxide. Silicon is first oxidized, then the phosphorus, and finally the carbon. The silicic and phosphoric acids produced pass into the cinder and the carbonic oxide burns as it escapes from the bath of metal. RECENT completion of a $40,000 lubricating oil plant will make it possible for students in the School of Petroleum Engineering at the University of Oklahoma to carry out on a large scale the entire process of refining crude oil, from the time it is received in tank cars and pumped through the 1/4-mile University pipe line to storage tanks on the campus until the various products appear in finished form. This plant is part of a $100,000 expansion program which this school has been carrying out during the past year. Approximately 2000 years ago, the Lord admonished the scribes (lawyers) and pharisees (religious leaders of that time) that they had paid the tithe but had omitted the weightier matters of law, judgment, mercy, and faith. (Matt. 23:23) I want to talk about "The Weightier Matters of Law." In a situation where big government is trying to have an effect on even small details of a work activity, otherwise simple situations become complex. Regulations are written to such detail that constant compliance with strict interpretations can be a nightmare-not to mention off the target of the intended purpose for the regulation. One soon recognizes the onerous characteristics of federal statutes. Another admonition the Lord gave those lawyers and pharisees back then was that they tended to strain at a gnat and swallow a camel! He meant that the pharisees were given to devoting themselves to the strict interpretation of law by writing hundreds of subrules or interpretation to law. In doing so they eventually lost sight of the original purpose of the law. I think they were being told, keep the law-but don't neglect to humanize it Keep it simple Recognize the purpose of why the law. "Mix in" a common sense approach. Someone once said, "Common sense is instinct -enough of it is genius." Today, as 2000 years ago, we need more "genius" displayed by legislators in considering the weightier matters of law. First of all true legislature genius calls for a declarative statement about the purpose of the statute and a fair, objective analysis of the ground rules by which it will be implemented. In the Health & Safety Act of 1969, the "findings and purpose" as set forth in Section 2 do define its purpose. I believe most of us affected can be in accord with the reasons advanced for the legislation. However, beyond those well-intentioned few paragraphs, we very quickly run into trouble. Congress complicated the simplicity of the statement of purpose by mandating government intervention into areas that cannot be effectively legislated, nor even should be legislated. The Act provided for broad gaged regulation which is unnecessary, inappropriate, and tremendously costly. Frankly, it detracts from a constructive, cooperative effort by the parties involved. These are strong negatives which characterize inappropriate legislation. Appropriate legislation and subsequent regulation, which is realistically conceived and practically enforced must be born of an honest desire for improvement, based on a working knowledge of common problems which are thoughtfully analyzed. Then the legislation must be written in clear concise language so that there can be little or no doubt as to its literal meaning and intent. To be practically enforced, it must be understood by all who will enforce it and by all who are subject to it. That is to say, an effective law or standard cannot be fixed or inflexible so that it cannot be tempered in human judgment. There must be an elasticity in the statute to provide for consideration of all of the relevant facts of a given situation. Such elasticity makes the compliance effort as meaningful as it can be for the time and dollars invested. Meaningful compliance requires room for common sense. Today, we in business along with our associates in government and labor, urgently need to pause, and assess our current situation. The problems arising from the 1969 Act have been intensified through the Mine Safety & Health Act of 1977. After reading the "findings and purpose" of this legislation, and by process of elimination, we should all clearly see what is and is not the purpose of the Act. 1) It is not to turn the management of private industry over to government. 2) It is not to impair the efficient operation of business. 3) It is not to reduce productivity and profits. 4) It is not to reduce national unemployment. 5) It is not to perpetuate the bureaucracy. 6) It is not to increase the tax burden on an already overburdened people. 7) It is not to increase our balance of payments deficit. 9) It is not to replace management/labor relations in working together to solve problems.
