This work is a codification and annotation of the Congressional enactments relating to minerals, mineral lands, and mining. It covers every enactment of Congress from the original ordinance of 1785 to the present time, as well as all sections of the Revised Statutes of the United States relating to these subjects. These laws are grouped according to their general subject matter, and are arranged thereunder in numerical or chronological order. Many of the mining statutes include matter not pertinent to the subject, and only those parts of such acts are quoted as will properly show their relation to minerals and mineral lands and indicate how they should be construed. Some mining acts have been repealed or have become obsolete, and others have become incorporated substantially in sections of the Re- vised Statutes; but these are retained in order to show the changes made, and the constructions placed thereon by the courts are given as aids in construing the new or repealing acts. The annotations consist of legal propositions abstracted from the decisions of the various courts and executive officers of the Govern- ment that have interpreted the sections and statutes so codified. These legal propositions are arranged under the different sections and acts with appropriate headings, titles, and subtitles, in logical order, exhibiting the present status of each particular section or act and its application to the subject of mines and mineral lands. The annotations do not purport to be abstracts of decisions on the sub- stantive law of mines and mining generally, but are limited strictly to the interpretation placed on a given section or act definitely re- ferred to by a court or executive officer by the number of the section of the Revised Statutes or the volume and page of the Statutes at Large in which the Congressional enactment is found. It may be observed that the legal propositions stated are not always pertinent to the particular section or act under which they are classed and of which they purport to give a construction. The arrangement, however, is not an arbitrary one, but is so made for the reason that the courts or officers in the construction of a particular section or act definitely referred to by number or volume and page incorporated in the decision matter not strictly pertinent to the par- ticular section or act so designated. This statement applies especially to the interpretations placed on the sections of the Revised Statutes. The value of brine analyses in the study of petroleum-engineering problems was recognized early in the history of petroleum. The Bureau of Mines before 1928 had indicated in several reports.3/ ways in which analyses might be used. Because of the confusion resulting from attempts to correlate the work of different chemists using greatly varying methods of analysis and systems of computation and expression of results, a paper presenting the methods used by the Bureau of Mines was prepared and published in 1928. This system of determining the characteristic constituents of oil-field waters and of calculating and reporting results has been widely adopted by the petroleum industry. The earliest and most obvious use of water analyses is determination of the source of water infiltrating into petroleum and natural-gas wells. For this purpose it is necessary that an analysis of the connate water of the formation from which the oil is produced be available and that an analysis of the contaminated water be made. By comparing these analyses with those of connate waters from formations higher in the structure, the formation from which the infiltrating water comes may be identified.

The major elements essential to plant growth are nitrogen, potassium, and phosphorus. These three constituents of the soil are removed relatively rapidly by growing crops and consequently are the main constituents of commercial fertilizers. Scientific studies, however, have progressively revealed the fact that a number of other plant foods, many of which are not necessarily supplied in commercial fertilizers, are necessary to assist plant growth and fruit production and that soils deficient in certain of these minor elements may be made much more productive by adding them. The farmer looks to the miner to furnish most of the elements requisite to plant growth, which have to be supplied through the medium of fertilizer additions. It follows that the mining industry should keep an eye upon developments in the fertilizer industry and in the results of soil studies as a possible outlet for mineral products. The important industries engaged in the production and marketing of the three principal pant nutrients have already been described in Bureau of Mines publications .3 The present paper discusses the commercial implications with respect to other elements that are now employed as soil additions.

As a follow-on to previous investigations, reduced treatment levels for the optimum fire retardant/preservative system were evaluated. An impregnation of 3.5 lbs/ft3 of Fyreprufe followed by 3.5 mils of Albi 107A plus an Albi 144 top coat provides adequate flammability and flame spread protection. However, there is a significant loss in compressive strength at this retention level, particularly parallel to the grain. A pilot-size pressure impregnation cell was installed for use in treating larger quantities of wood. Based on the optimum fire retardant/preservative treatment system - Fyreprufe/ACC impregnation followed by Albi 107A/144 intumescent paint - a model treatment pro¬cess was developed, capable of handling 3 million board feet per year. Associated annualized costs per thousand board feet (K bd. ft.) for treating 12" x 12" timber were calculated to be: Impregnation: $-63.00/K bd. ft. Coating: $112.00/K bd. ft. A literature search was conducted to identify materials and techniques suitable for a localized stench warning system for heated mine timbers. Based on this review, a number of stench warning concepts were developed. Those based on surface coating were given a preliminary laboratory evaluation.

General economic conditions continued to improve in the second quarter of 1984 as real gross national product advanced at an annual rate of 7.5 percent (table 1). This followed an even larger first quarter annual rate increase of 10.1 percent. The slower second quarter growth was greeted as a sign that the economy is not over-heating. The signs of slowed growth in some sectors suggest that the recovery may continue well into 1985 without the inflation symptomatic of a rapid recovery. Most of the slowdown in growth was absorbed by business inventories, personal consumption of durable goods, and residential fixed investment. Business inventories grew by only 68 percent as much as in the first quarter, personal consumption for durable goods grew by 58 percent of the first quarter rate, and residential fixed investment slowed to only 44 percent of the first quarter growth. Sectors with accelerated growth in the second quarter included personal consumption of nondurable goods and of services, which increased at annual rates of 9.6 percent and 3.8 percent, respectively, and Federal purchases of goods and services, which increased at an annual rate of 47.9 percent.

"2.1. INTRODUCTIONNo agreement can be perfect in the sense that it contemplates and provides for all eventualities. Mineral acquisition agreements are usually negotiated and drafted at a time when an orebody is no more than a gleam in a geologist’s eye, so it is hardly possible to provide for development and operation in other than the most general terms. However, an agreement that stops short of contemplating the possibility of an orebody and production is ill-advised. Accordingly, it is important to provide procedures to make decisions that will let the project proceed, even in the face of a fallingout between parties. Whether the parties are shareholders in a corporation or venturers in a contractual common undertaking like a joint venture, differences of opinion and disputes will occur. Unfortunately, more and more are ending up before the courts. Besides greed and the growing tendency in society to fight rather than talk, there are other factors that contribute to the increase of litigation. In some jurisdictions, agreements have tended to become complicated, often defying interpretation, even by a lawyer, and explorationists want their budgets to go into the ground as constructive work rather than into a lawyer’s pocket. All this has led to a growing tendency for corporations to take the attitude that the chances of finding a mine are, at best, marginal and there are lots of earlier agreements in the files to draw from, so why not prepare their own agreements? As discussed in the preceding chapter, this can be folly. All these factors can quickly have parties facing each other in court while a project sits idle. Added to this is the problem that, in some jurisdictions, lawyers may take cases on a contingency-fee basis, sometimes promoting the pursuit of a nebulous claim.When an orebody is discovered, someone will always want some, or more, for himself. There is a breed of “prospectors” who prospect for legal actions, on the somewhat sound grounds that a major corporation will buy off nuisance litigation, rather than incurring the cost and effort of attacking even a poorly founded claim in the courts. They may even find a winner. Besides, it is far more comfortable and relaxing to prospect for problems and legal niceties than to prospect for an orebody.1 In short, it is appropriate to consider briefly some of the factors relating to lawsuits and judgments. Although many of the comments are made in the context of the common law and the Canadian legal system, most of the concepts and suggestions are applicable to any legal system."

The number of railroad coal cars (open top hoppers), dominated rail car orders and deliveries in 1975 according to announcements made February 11, by the Association of American Railroads and the American Railway Car Institute. Acting to keep ahead of increased coal production, the railroads installed 21,748 new coal cars in 1975, the most since 1957. The 1975 installation resulted in a net increase of 6,560 coal cars and an overall gain of 4.5 percent in the total capacity of the hopper car fleet. With most of the new coal cars going into unit train service --where car utilization is greatest --the railroads actual coal-carrying capacity was increased far more than 4.5 percent. The AAR estimated that unit train operations now move 50 percent of all rail-hauled coal compared to only 42 percent 2 years ago. COBALT - The Societe Miniere de Tenke Fungurume (SMTF) copper-cobalt project in Zaire reportedly was suspended in January for an indefenite length of time. According to officials, the deferment resulted from a number of adverse factors, one of which was exceptional increases in capital costs. The project was scheduled for completion in early 1978, with an eventual production of 14.3 million pounds of cobalt per year. Reserves of cobalt were reported to be 505 million pounds. SMTF is a consortium and includes American, British, French, Japanese, and Zairian interests.

Coal mines in the United States are the most productive in the world in terms of efficient labor employment. This is because of an abundance of workable coal beds, large infusions of capital, improved management practices and continuing competitive pressures. The standard unit of measurement for labor productivity is expressed as tons/manshift, although for underground mines, operators often refer to tons per machineshift. Articles written concerning labor productivity generally focus on measurement techniques, safety considerations, application of technology and training. This article will illustrate by example the impact of labor efficiency (or inefficiency) on the ultimate selling price of coal, f.o.b. mine site. During the past several years, the coal industry has seen significant improvement in labor use. Figure 1 shows the trends in productivity for all active mines in the United States from 1985 through 1994. Productivity in 1985 was 20.1 t/manshift (22.1 st/ manshift). This factor has increased almost linearly throughout that period to 37.5 t/manshift (41.2 st/manshift). This is a 7.2% annual compound growth rate.

For mining engineers and geologists accustomed evaluating metallic mineral deposits, the problems inherent in determining the worth of non- metallic industrial minerals deposits for the chemical processing industry often comes as a rude shock. These difficulties lead to different, and often much greater, problems in financing the development of such deposits than would normally be anticipated for economic sources of copper, molybdenum, iron, nickel and other metallic minerals. The chemical processing industry is one of the two principal consumers of non-metallic mineral production, the other being the construction industry. In the last decade, the volume of industrial minerals consumed by chemical processers has in- creased by 30%, and further increases are forecasted. To satisfy this growing demand, many new sources of these minerals must be found and developed. For those of us who will become involved in such work, the following brief analysis of the major problems to be expected may be of help in developing a realistic approach to evaluating and financing such a deposit and selling the product to consumers.

With the increasing power of computers to simulate and control processes in the mineral industry, predicting the potential use of computers in the minerals field is not a hazardous enterprise, but predicting the timing of their use is. Like the railroad industry, technology invades the mineral industry, rather than being an industry like electronics that creates technology. Because of this invasive nature of computer technology in the minerals field, this paper predicts what will be possible to do effectively and economically with computers in the mineral industry. Moreover, this paper explores the problems of using the emerging computer technology in the mineral industry. For example, if not now, it soon will be possible to control the output of a mineral processing circuit - high grade, high flow or a mixture of it - to meet the daily market conditions and to sell each day that daily "mill" output as "mill" futures on the commodity market. Finally, suggestions are made which may be done to prepare the industry for the computer revolution in the mineral industry.

The processors of Florida phosphate rock face constraints similar to those of other mineral operations--leaner ore, more complex treatment schemes and a product which sells for a penny a pound. IMC Fertilizer is a dominant producer in this market with its current operation of five processing plants. An emphasis by their management in maintaining and improving plant performance has continued unabated for some 15 years. This has resulted in a commitment to the importance of routine automatic sampling of product and in process streams, the generation of reliable assay and size distribution data, the accurate measurement of process flows, and the computerized "rendering" of this information into weekly and monthly material balances which provide consistent measures of process performance. In addition, there has been a parallel program to monitor and improve the performance of flotation reagents and to evaluate process modifications or changes in equipment. This paper will describe the evaluation techniques that have evolved over this period and indicate how the historical data base is used to identify plant problems early and help in their solution.

The producers of mineral sands on the East Coast of Australia might be regarded as having a simple task of selling Rutile and Zircon. Such is not the case. Differing quality and grain size requirements plus the dramatic increase in the percentage of mineral sold in a processed form have meant a large increase in the number of different end products handled. The resulting sales control problems are compounded by the need to be able to deliver against a large number of separate contracts which may relate to spot or long term sales in small quantities or in bulk shipments. Methods of helping management control this situation have been devised and incorporated into a suite of computer programs. Experience with the approach has been very satisfactory. The effect of changes to shipping schedules, commitment to new or changed orders, or proposed changes to production can be evaluated as and when necessary with little bother. The effects of postmining land use planning are addressed in this paper. These effects may include savings in reclamation costs and increased value of reclaimed land. However, this may result in greater planning costs and possible delays in production. Therefore, an economic analysis was undertaken in an effort to determine the importance of each potential result and to quantify the overall economic impact of postmining land use planning. A discounted cash flow analysis was performed using a surface mine cost model to analyze the sensitivity of selling price to changes in various postmining land use planning parameters. As a result of this analysis, it was determined that the profitability of a project is most sensitive to delays in production, particularly if the delay occurs after major investments have been made. Many methods have been proposed for evaluating postmining land use alternatives (Sweigard and Ramani, 1981). Both quantitative methods, such as benefit-cost analysis (Brock and Brooks, 1968), and nonquantitative methods have been proposed. The application of one specific analytical method is pursued in this paper.

WITH the acquisition of the Nichols Copper Company ' and the development of the large Copper Products manufacturing and selling organization, the Phelps Dodge Corporation had attained two of its important goals. But at that particular time both its immediate and long-range prospects were giving the company serious concern. The financial panic that began late in 1929 was growing worse instead of better. Neither raw materials nor finished products could find a market. In 1932 the price of copper fell to the almost unprecedented figure of four and eight tenths cents a pound. Domestic production of copper in the United States was further threatened by a large low-cost output from the mines of Africa and the Andes. Canadian copper mines, with their large yield of other valuable metals from the same ores, added to the difficulties of the American companies. After a hard-fought campaign, however, the producers of domestic copper finally induced Congress to levy a duty of four cents a pound on copper imported into the

Transition in the underground coal industry, begun with the passage of the Federal Coal Mine Health and Safety Act of 1969, should be completed midway in the 1972-80 period. Surprisingly, many of the far reaching effects of this act have been, for the most part, beneficial to the industry from the standpoint of health, safety and basic operating standards. Production has dwindled, but the next few years will see production declines level out. Average declines of approximately 27% have been recorded since passage of the 1969 act, with costs increasing an average of $1.50 per ton throughout the industry. Nationwide averages presently are in the range of 14 tons per man-shift, and by 1980 this may be further reduced to a 10-ton per man-shift average for the industry. But in spite of the many temporary set-backs affecting the industry, the marketing opportunities are clearly visible. Due primarily to the energy squeeze facing the U.S. over the near term, the 'underground coal operator is and will be enjoying unusual leverage in selling his product.

Limited geographically by size and geo-logically by origin, smaller countries and territories of the Caribbean are nonetheless engaging in efforts to encourage the initiation of mineral and mineral-related industries. Petroleum dominates the minerals sector, which otherwise consists principally of minor quantities of construction-oriented materials, usually for local consumption. The increased cost of petroleum has adversely affected most of the world, but these islands with their economies precariously balanced on the uncertainties of agriculture and tourism are especially vulnerable to petroleum's direct and indirect costs. In 1975, the Government of Antigua acquired the financially troubled West Indies Oil Company refinery at St. Johns. The refinery ceased operations in 1976. In 1979, negotiations were underway to sell Ashland Oil Co. an interest in the small, 20,000-barrel-per-day refinery for $6.6 million. In 1977, Antigua granted petroleum exploration rights to the Antigua Mineral Exploration Company, which planned to drill in an undefined offshore area, possibly between Antigua and Barbuda. The company expected to spend about $200,000 per year through 1982. There have been no reports on its activity.

The world energy crisis has created a greatly expanded exploration program for energy fuels. The demand for materials required for drilling operations such as barite, which is the primary component of drilling fluids, has increased proportionally. As in the case of many other minerals, existing high grade barite mines are no longer capable of producing the required tonnage. Consequently, exploration and development of lower grade ore bodies has been increased. The need to produce a high quality product at maximum recovery rates, along with the ever changing economics affecting both selling price and production costs has triggered accelerated research programs toward more sophisticated and efficient beneficiation methods. Taking into account the specific gravity differential between barite (4.5) and the normal gangue minerals such as silica and calcite (2.7), gravity concentration methods are the prime consideration with flotation as a scavenging process. Greater emphasis on particle size liberation, size reduction and concentration is also indicated. In order to accomplish these objectives, it has been necessary to revert back to the old adage, "Recover your minerals as soon as they are free."

For the past decade, demand for Australian resources has reached unprecedented levels, thanks mainly to the emerging superpowers of China and India. Meeting demand has meant miners and governments alike have ploughed billions into capital expenditure projects for logistics infrastructure such as roads, rail and ports, to support the ever expanding number of mines and mineral volumes. In more recent times, however, the effect of the global economic crisis has led to a decline in demand for Australian minerals. The downturn has seen companies lay off workers in droves, and delay or cancel expansion projects, in an attempt to preserve cash flow. Whilst the current economic cycle has hit the mining sector hard, it is an opportunity for companies to take stock of their existing operations and plan for the future. As mining companies grapple for scarce capital resources, it is inevitable that industry consolidation will ensue. This presents challenges and opportunities for both buyers and sellers alike, looking to expand operations, or sell off assets to raise cash.

The stockpiling and reclaiming of bulk materials can be a challenging task for engineers seeking the optimum solution for plant needs, reliability, and at lowest unit cost. The objective of this paper will be to expose advantages, disadvantages and limitations of many storage and reclaiming systems to the responsible engineer and management. The paper will emphasize the practical aspect of stockpiling and reclaiming methods. Many valuable and interesting papers are available dealing with the theoretical viewpoint and application of a particular manufacturer's machine. Several of these are mentioned in the bibliography. As many practical parameters as possible will be given. After twenty years in the field of designing and selling bulk materials handling systems, the needs of the user and the plant are recognized and reasonably understood. This paper cannot give solutions to all problems In this vast field but will stress practical applications and examples of various installations. The evolution of advancements in materials handling is based upon not only technological innovations, but learning from many experiences of others and utilizing them as stepping stones to improved installations.
