Throughout the 2016/2017 financial year, the NSW Resources Regulator conducted an assessment of each underground metalliferous operation across the state to assess how each operation managed the principal mining hazard of ground and strata control. The assessment considered all aspects of the mining process, including all aspects of managing geotechnical risk within drawpoints. This assessment is ongoing and, therefore, this paper is limited to the first six mines assessed in the program.In 2015 there were three fatalities in and around underground drawpoints in Australian metalliferous mines. Whilst many of the systems of work around underground development are consistent across the industry, there are large discrepancies around how each underground mining operation manage the risks associated with drawpoints.For drawpoints to be effectively managed, their management needs to be considered at the earliest stages of the mine planning process. By using downholes and adopting remote systems of work – systems that are continuing to improve with technology – the risks drawpoints posed can be greatly reduced.The assessment by the NSW Resources Regulator revealed a number of common failings across the state in the management of the risks that drawpoints pose. The assessment also observed a number of innovative practices that particular operations have adopted in the wake of serious incidents occurring within drawpoints at their operation; however, these practices have not been communicated to other operations.It is hoped the learnings from the assessment can be considered by industry and reduce the risks drawpoints pose in underground metalliferous mines.CITATION:Hill, X, 2017. The original leases making up today's North Kalgurli Mines were developed by independent companies on an ad hoc basis. The major disadvantage which now arises is the varying levels of mining horizons. From Kalgurli Shaft in the south, through main Shaft and to Croesus Shaft in the north, there are three separate sets of levels. work has commenced to link the three areas with either common levels or new development which will facilitate common access and haulage via Main Shaft.Generally, the workings at North Kalgurli were established at the turn of the century. The introduction of techniques and equipment to bring the mine into the 20th Century has been difficult and slow. The general size of openings, a widespread workforce and complex ore distribution often make innovation and change more than a challenge.

Capricorn Copper Pty Ltd (CCPL) are operating the Capricorn Copper Mine located at Gunpowder, Queensland. As current holder of the environmental authority for the site, CCPL have obligations to rehabilitate areas of the mine that are no longer operational and have the potential to cause/contribute to environmental harm. CCPL sought a voluntary Transitional Environmental Program (TEP) to provide an agreed program of works to cap and rehabilitate the former Mammoth Tailings Storage Facility. The voluntary TEP contained conditions that were required to be met, to reduce the potential for environmental harm from the facility. The former Mammoth Tailings Storage Facility commenced use in the early 1970’s, and is an unlined valley in-fill structure, contemporary in design compared with other such approved structures of the era. The decommissioned Mammoth Tailings Storage Facility, now known as the Old Tailings Storage Facility (Old TSF), has been a legacy source of contamination due to the existing capping not meeting modern cover criterion, and allowing oxidisation and infiltration to the underlying acid forming tailings resulting in Acid and Metalliferous Drainage (AMD) from the facility. A cover design for the Old TSF, and other mine waste storages onsite that required clay capping, had been proposed by previous operators. Under the TEP cover design phase, it was identified that a key constraint was the lack of significant quantities of low permeability clay onsite. The lack of available clay prompted the consideration of alternate lining materials for the Old TSF, with a Bituminous Geomembrane Liner (BGM) being adopted as the preferred alternative. The BGM compared favourably with clay-based materials on seepage analysis, and led to other benefits by eliminating the need for borrowing clay off site, reducing the site’s environmental footprint, and reducing construction time. The BGM cover system on the Old TSF is being monitored with the intent to use this as a case study to confirm expected performance, enabling the cover design to potentially be adopted on the remainder of the site’s mine waste storages that require capping.

Legacy tailings storage facilities exist within operating mine sites across Australia. These tailings storage facilities are often viewed as rehabilitation liabilities but with considered assessment may prove to be a resource. Extraction of such a resource might add value to operations by providing cash flow during the development of new mines; providing supplementary mill feed for existing mines undergoing step changes in operations; and supporting mine closure activities. Hellyer Gold Mines is successfully extracting and reprocessing sub-aqueous material from legacy tailings storage facilities at their Hellyer operation in north-west Tasmania. The Hellyer tailings storage facilities contain poly-metallic material from the Hellyer and Fossey underground deposits dating back to the 1980s as well as material from tailings reprocessing activities by other operators of the Hellyer site. Hellyer Gold Mines is reclaiming sub-aqueous material using cutter-suction dredgers and reprocessing on-site. Hellyer is the only operation of its type in Australia and few such operations exist worldwide. Key learnings around the estimation of a resource for legacy tailings storage facilities have been acquired at Hellyer that can be applied to the assessment of other tailings storage facilities. The application of dredging as a mining method at Hellyer is delivered through collaboration with experts from outside the mining industry under the direction of a mining engineer. Key elements required for the planning and delivery of safe and efficient dredging inside tailings storage facilities have been identified at Hellyer and are presented to provide a road map to the development of other dredging operations.

In recent years rehabilitation of mine sites has become a principal focus of mining legislation in Victoria. In previous eras, managed rehabilitation commenced, if at all, towards the end of mining operations. Planning for rehabilitation works now commences before an exploration licence is granted.The paper gives a brief overview of the requirements for rehabilitation under the Mineral Resources Development Act 1990, Extractive Industries Act 1966, and related environmental planning legislation including rehabilitation bonds and enforcement provisions.A brief review of the current taxation provisions is also included.

The introduction of legal certification of mine managers is a matter of history. It was introduced as part of legislation for mine safety. It has been said that such legislat- ion was written in blood. Like all legislation this legislation is divided into three sections; commands, obligations and sanctions. While legislation in all States on this subject is similar, the differences are great enough to have prompted the preparation of a Uniform Code by the Annual Conference of Chief Inspectors of Mines. This Uniform Code has not been adopted fully by any State to date. Legal certification of mine managers has made managers more aware of the requirements of the legislation covering their industry, legislation that reads as a summary on past accidents and methods of preventing them. While budding managers spend considerable' time in their early years in the preparation for certification, history has shown that the industry has benefited from their efforts. A better knowledge of the safety acts by the managers has produced safer operations, and a higher standard of management has raised the technical standards of mining operations to a stage where Australia can be proud.

The role played by lawyers in business has, in the course of the last 15 to 20 years, changed perceptively. This development has coincided with, and indeed has been a reflection of, the changing nature of Australian business, especially as the mining industry established its predominance in the Australian economy. The nature and extent of governmental regulation of business, too, has changed markedly. As a consequence, there has been a qualitative'change in the nature of commercial law practice. For the needs of business to be met, lawyers have had to develop specialist skills in new areas. Furthermore, there has been the emergence of the "in-house" lawyer, who increasingly plays a primary rather than a subordinate role in corporate law practice. There is no evidence to suggest that this trend, which is by now so well established, will prove to be ephemeral. Instead, with all indications pointing towards even greater governmental regulation of business activities, the intimate role of the lawyer in business seems entrenched.

Legislation for control of ventilation in New South Wales coal mines is contained in the Coal Mines Regulation Act, 1912, as amended. The standards set down in that Act were based on the needs of the industry at the turn of the century. Changes and additions to the original standards have been made to cater for mechaniz- ation of the industry and the introduction of modern developments such as the use of diesel equipment. Technological progress has been recognized by the requirement for monitoring of machines and return airways. The passing of the Coal Mines Regulation Act 1982 has ensured that there will be a revision and modernization of the regulations affecting day to day operations of the industry.

Gas drainage has been practiced for many years mainly for safety reasons in various countries in Europe, in the U.S.A., the U.K. and Japan. Legislation has been developed to control the production, transport- ation and utilisation of methane and associated gases. Gas drainage is now being carried out at some Australian Collieries, but as this is a new venture little specific legislation is available. This paper briefly describes the drainage methods and legislation applied overseas, gives a brief history of gas drainage in N.S.W. and indicates the deficiencies of the present legislation. It outlines the approach to new legislation which will deal comprehensively with gas drainage operations and utilisation in New South Wales.

Safety and health at work is about people. It is about people who plan for work, organise work and perform work. It is about those who come in contact with the workplace and those who are responsible for the workplace. There are wider ranging safety and health obligations that are imposed on the industry stakeholders that span all phases of the production process. In all cases, those responsible for discharging the obligations must ask the questions: Is what we propose safe?, can it be done safer? and are we sure? What we learn from recent legal cases before the courts is that it is essential that all stakeholders work together in a collaborative way when discharging these obligations. Safety and health at work cannot become an issue that is viewed only through the eyes of a single stakeholder group. The reason for this is quite simple. The interrelatedness of the responsibilities that are imposed on each of the stakeholder groups, means that the performance based legislation simply wont work, where an active model of communication and consultation is not in place.

There exist several legislative provisions in N.S.W. which work together to control surface subsidence due to extraction of coal by underground methods. The important ones are the Coal Mining Act, Coal Mines Regulation Act, Mine Subsidence Compensation Act and Dams Safety Act. In addition, there are guidelines laid down by the Chief Inspector of Coal Mines for mining under and in the vicinity of tidal waters and the ocean. There are also conditions of coal mining leases and conditions of approvals given to undertake various methods of mining which stipulate further controls. The legislative provisions and relative controls are designed to minimise surface damage, ensure safety , of major public utilities, control- surface land use and compensate damage caused by subsidence as a result of coal mining operations. They aim at balanced and responsible development of our valuable coal resources consistent with adequate safeguards to surface improvements and natural features. The paper discusses in detail these legislative provisions and the mechanics of their operation with a view to emphasising the fact that underground coal mining operations are undertaken responsibly and in a planned and rational manner for the overall benefit of the community. Further, the paper aims to demonstrate the need for legislative measures and conditioning of mining operations to keep abreast of developments in the knowledge and skills of mining and subsidence engineers and continuing improvements in mining technologies. Likewise there is a need on the part of engineers and those associated with introduction of new technologies to appreciate the requirements and existence of legislative and other measures having a direct or indirect association with surface subsidence as a result of coal mining operation.

Addressing nutrient deficiency, among other factors, is vital to the growth and establishment of plants in mine spoils and tailings ponds. Although several organic amendments are available for this purpose, it is important to determine the appropriate ameliorant for the selected plant species. This research examined the effect of different amendments on the growth and ground cover of Centrosema molle, Calopogonium mucunoides and Sorghum spp. in copper/gold tailings. Plant growth and ground cover drastically increased with the application of organic ameliorants, especially manure. Among the three plants, Calopogonium exhibited the best growth and has shown its capability to establish a dense ground cover even in unamended tailings. Results suggest that the plant species and the ameliorants used in this study could be effective in a low-input approach to mine rehabilitation.CITATION:Domingo, J P T and David, C P C, 2014. Some four hundred million tonnes of low rank sub-bituminous coal occurs in four separ rate lobes at Leigh Creek. These deposits are in a sparsely populated pastoral area remote from industrial centres. Early development was retarded because of high mining and haul- age costs and the availability of other fuels. The search for additional fuels after the second world war led to thorough investigations into the burning characte-,istics of the coal and the discovery of shallow coal suitable for open out mining. The development of the field included the establishment of water supply, improved rail facilities and a town.

Since 1978, the nickel concentrator at Leinster has been subject to continuous change. In 1971 a significant nickel sulphide deposit was discovered on Leinster Downs Station, within three years the extent of the deposit was determined. In 1978 the Agnew Mining Company began production of nickel concentrate from the Perseverance Mine and continued to do so until production ceased in 1986. In 1988 WMC purchased the mothballed project and began the first phase of many expansion initiatives. Milestones in the life of Leinster have included:open cut mining of the Perseverance orebody and the discovery of the RockyÆs Reward orebody, as well as the metallurgical challenges in treating each of these; underground mining at both Perseverance and RockyÆs Reward; construction and commissioning of the WMC grinding and flotation circuits; variations in the reagent schemes, including the introduction of æliquidÆ reagents; development of mill linings to reduce maintenance; circuit re-configuration and simplification; development of Harmony open cut; strategies for increasing throughput at the drier; and changes to tailings facilities to cope with increased throughput. This paper outlines the steps which have been required to expand the Leinster Nickel Concentrator from 650 000 tpa to 2.5 Mtpa and those steps which will be required in the future.

The Beverley uranium mine û now in production in the remote north of South Australia at1000 tonnes per annum û was established to meet a projected, but little-recognised shortfallin primary supply of uranium for the nuclear industry in the early part of the 21 st century. Inthe context of AustraliaÆs lack of bi-partisan support for uranium mining and the nuclearindustry, a four to five year window of opportunity existed from 1996 to establish the mine.During this period, Beverley achieved a number of firsts including: the first ISL mine inAustralia; the largest ISL mine in the world and the first to produce more than 500 tonnes ofuranium in its first year; the first to be established under a new Native Title regime in SouthAustralia; and the first to be established under a revised South Australian Mining Act.Beverley was brought into production against the background of: hostile opposition fromanti-nuclear activists; a suspicious and at-times hostile media; a regulatory and politicalcommunity that was unfamiliar with ISL mining; commercially unsophisticated Aboriginalgroups; an inexperienced engineering industry; and the vagaries of development in a remote,semi-arid location with neither population nor infrastructure. The lessons that can be learnedfrom Beverley showed that û like much in life û flexibility and timing are crucial.

The Vale Ferro Carajßs S11D project in northern Brazil is based on the movement of unprecedented volumes of waste and ore for mobile in-pit crushing and conveying or ætrucklessÆ systems. In peak years, the system is intended to handle a combined 160 Mt of material.The planning and implementation of the first such system for Vale, in a remote greenfield site, utilising the services of a range of international study, design and supply partners has provided a unique set of technical and project delivery challenges. The lessons from these are of value to the industry as the trend to remote and high-volume operations continues.This paper describes the key features of the mining system and documents the challenges and mitigations for important technical, cultural and project delivery issues that have arisen.
