What are future prospects for U.S. mining? In many quarters the assumption is made that this country has passed its zenith as a mineral producer -- that it is in a period of decline and that it is becoming a have-not nation like Japan and much of Western Europe. These industrial rivals of ours must depend almost entirely on others for their mineral supplies. In trying to answer this question one must of course distinguish between resources and productive capacity. In today's volatile and competitive markets, the definition of what are reserves and what are merely identified resources becomes ever more difficult. Many large deposits have been found that are unlikely to be viable in the marketplace under normal conditions but that can be of significance to the nation's military and industrial security in times of emergency. I should like to draw on personal experience from World War I1 for illustration. 4fter Pearl Harbor great concern developed over the availability of a long 1ist of strategic materials for which this country was largely dependent on imports. Included were a number of minerals of which domestic deposits had been identified. Among these were chromite, manganese ore, mercury, mica and tungsten.

INTRODUCTION Coal ash, presently the fifth most abundant of the solid minerals produced in the United States, is expected to become the fourth most abundant by the end of this decade (1). The production of fly ash from the combustion of pulverized coal amounted to a total of 44 million metric tons (Mt) in 1977 and is expected to Increase to 91 Mt by 1985. Coal ash, which results from the Inorganic clay and mineral content of the coal, contains several elements and thus can be considered as a mined and crushed mineral resource rather than a waste material Furthermore, potential problems associated with fly-ash disposal ponds and the leaching of potentially hazardous elements through groundwater infiltration and/or rainfall provide additional incentive for processing fly ash for environ- mental control as well as for the recovery of certain metal values. Fly ash could provide an abundant domestic source of aluminum and several other metals Aluminum is now recovered from bauxite, and over 90% of this ore is imported since domestic sources are limited and cannot meet the U.S. demand There is a close relationship between the aluminum content of fly ash and the domestic consumption of this metal (Table 1).

We at Hughes Tool Co. are extremely proud of the quality of the hardware and techniques introduced through our efforts in tunnel-machine development and of the ready acceptance of them by manufacturers and contractors throughout the world. All of us who attended the conference and who are represented in the book, we believe, anticipate an increasing need for improved methods of underground excavation. The development of such methods will permit the further exploitation of our underground resources plus providing underground space for transportation and habitation at a rate compatible with demand. We hope that our comments, derived from the application of Hughes Tool Co.'s rotary boring experience, may provide a better understanding of the boring method as a possible avenue through which the desired improvement in underground excavation may be attained. We hope you may also become aware of some of the problems Hughes, as a pioneer developer of raise, shaft, and tunnel-boring equipment, must face prior to further major undertakings in this very interesting field. Our task is to acquaint you with the present status of the Hughes Tool Co. development program as it relates specifically to tunnel-boring machines. We feel this task can best be accomplished by a brief review of the general sequence of events leading to and constituting an equipment development program and more specifically the manner in which these events have occurred to either influence or further our boring-machine development program. The development of a machine to accomplish a certain function or series of functions is usually a very long and tedious process to which any number of individuals must contribute, perhaps over a period of centuries. Of particular irony is the fact that often those who contribute most generously do not necessarily reap the greatest immediate benefit. A marketable ma- chine will, however, result from a sequence of events such as these: 1) A problem or need is defined. 2) An idea is born to eliminate the problem.

As a part of the systematic study of the alloys of iron under the auspices of the Engineering Foundation, and preliminary to the commencement of comprehensive work on this larger subject, the authors have undertaken an investigation of the available literature dealing: with the alloys of iron and silicon. The purpose is to collect all the data in English and foreign languages and present them in two mono-graphs, one of a more scientific and the second of a more industrially useful nature. Of course, a great deal of information upon the constitution of the iron-silicon alloys was found specificially upon the changes of phase in the equilibrium diagram and the different phases present, such as solid solution, chemical compounds (iron silicides), etc. While no extended research was contemplated in the particular study undertaken, nevertheless the data collected proved to be so contradictory in many respects that a simple study of some of the outstanding problems involved in the constitution and equilibrium diagram was undertaken Because research was not a primary object of the work, and also because of the extreme industrial importance of the silicon alloys between 0.80 and 14 per cent. silicon, and finally because of the unsatisfactory state of knowledge existing as to these alloys, the experimental investigation was limited entirely to alloys with less than 10 per cent. silicon.

Also discussed are the factors influencing the selection of power supply and distribution arrangement, voltage levels, system grounding, distribution and utilization equipment such as switchgear, transformers, motor control, cable systems, motors. Short circuit calculation methods and system protection are discussed.

In late May, at its final session in Nairobi, Kenya, the UN Conference on Trade and Development (UNCTAD) narrowly rejected the US proposal for a new International Resources Bank suggested by Secretary of State Henry Kissinger. The proposal was defeated by a roll-call vote of 33 to 31, with most of the nay votes cast by communist countries, and with 89 of the less-developed countries abstaining or absent.

THE crystallography and morphology of 0-Al,Fe precipitates in an A1 + 0.5 wt pct Fe alloy have been studied by transmission electron microscopy. The alloy was cast in cylindrical ingots, 15 cm in diameter and 60 cm in length, and cooled slowly. The measured composition was 0.527 wt pct Fe, 0.001 wt pct Mg, and 0.003 wt pct Cu. Spectrographic analysis revealed no additional trace impurities. Thin slices were cut from the ingot and reduced by more than 95 pct by rolling to a thickness of 0.1 mm with no intermediate annealing treatments. These thin sheets were then vacuum-annealed for 1 hr at 612°C and air-cooled in their capsules. Thin foils for examination in the electron microscope were prepared by electropolishing. The precipitate is found in the form of oval platelets on the (110) planes of the matrix. The major axes of the platelets are parallel to the (110) directions of the matrix, and vary in length from 1/2 to 2 p. The thickness is about 1/10 p. Examples of platelets, both in the plane of the foil and normal to the foil, are shown in Figs. l(a) and l(b), respectively. lack' found that ?-A13Fe (more correctly All13Fe4) belongs to the monoclinic system. Using Black's structural data and simultaneous electron-diffraction patterns from the matrix and precipitates, the habit planes and directions were determined to be: (00l)? || (110)Al [100]? || [001]Al The orthogonal crystallographic axes of the precipitates are accurately in the habit plane, while the measured coincidences of the directions are only within 10 deg. The major axis of the platelet is parallel to [010] in the 0. This orientation corresponds to the direction of nearest registry of the lattices.

EACH year we gather in this auditorium to honor the memory of a . distinguished American metallurgist and educator. I cannot bring to you reminiscences of Prof. Henry Marion Howe as other lecturers have done. It was not my good fortune to enjoy the privilege of studying and ,working under his direction. As I have reflected on the published works of Professor Howe, it has seemed to me that his mind was trained on the nature of metals and on the mechanism which produced known but unexplained effects. He was interested in controlling and regulating the causes so as to produce specific effects, useful in serving mankind. I recall an afternoon in May, 1925, when, at the invitation of Mrs. Howe, I visited his former home, Green Peace at Bedford Hills, N. Y. The purpose of my visit was to receive at the hands of the widow -an engraving of Professor Howe, a reproduction of a painting from life. Mrs. Howe showed me his study. The walls of this large attractive room, brilliantly illuminated by the spring sunshine, were literally covered with the scrolls of honors and of decorations which had been conferred on Professor Howe by governments, academies, universities, societies and. institutions the world over. As we walked about the room, she pointed out the significance of each honor and recited a few details of each occasion. I sensed the pride with which Mrs. Howe, then in the late autumn of her life, told me of her husbands' achievements, of his struggles, of his disappointments and of his successes. There was a surprisingly familiar note in the recital to which I was listening. I have found the same theme running as a disconnected thread through the written accounts of the lives of most men of science. We then went to the drawing room to chat for a few minutes before I said my farewells. As we seated ourselves, Mrs. Howe turned to me and asked: "Mr. Lucas, what of this great microscope of yours? Cannot it be applied to the study of disease? What a great blessing it would be if it could be directed to relieve the suffering of mankind."

THE renewed interest in titanium, resulting from its increasing application as a structural material, has stimulated basic deformation studies on this metal. In the course of our work, we have developed a dislocation etchant and applied it to a perfection study of melt-grown single crystals as well as to a preliminary investigation of plastic deformation in titanium. The etchant, Keller's etch (21 cu cm HF, 64 cu cm HC1, 106 cu cm HNO3, and 160 cu cm H20), reveals the emergence of both grown-in and fresh dislocations on pure titanium and a-phase Ti-Al single crystals. Pits are produced only on surfaces within a few degrees of the basal plane; the more exactly parallel to a basal plane the surface is, the more distinct are the pits. The observed pit density, however, does not appear to depend on the surface orientation; the pits simul- taneously become less distinct as the misorientation from a basal plane increases. Etch times are short, a few seconds, for pure titanium; longer times are necessary for alloy crystals.

THE iron deposits of the Imataca Range of Venezuela, which occur along the Orinoco River, in the northern border of the Guayana High-lands, have lately attracted attention on account of their economic possibilities. Many deposits occur in this area; some of slight economic importance and others that may rank with the largest masses of high-grade iron ore of the world. The geology and the character of the ores seem to be remarkably similar to those of the large iron deposits of Brazil. In the investigation of the Venezuelan deposits a definite relationship has been found between the mineralization of the large orebodies and igneous intrusions, especially norites and granites. The following paper is the result of a field and laboratory investigation of the ore deposits. The field work was done during the months of February and March of the year 1929, partly in the company of Prof. W. H. Newhouse. The laboratory studies have been made in the Massachusetts Institute of Technology, under the supervision of Profes-sor Lindgren and Professor Newhouse.

When the National Forests were created, all lands embraced in their boundaries were exempted from all forms of entry, except mineral claims. Later, by Act of June 11, 1906, and as amended by Act of Aug. 10, 1912, provision was made allowing homesteads on areas chiefly valuable for agriculture and not necessary for the public use. Patents to mining claims in the Forests are granted the same as on land not in the Forests, irrespective of timber or other values. It is the policy to encourage the highest use of the Forests. As a business proposition, it is a good policy to have mines developed in the Forests. Their development in remote or inaccessible regions causes the country to be opened up and, in addition to the local market which the mines create, means of transportation are afforded to outside markets. No examination of mining claims is made until patent has been applied for, unless they are actively interfering with the administration of the Forest. In this case, an examination is made, and if there is evidence that the claims are being held in good faith they are in no way interfered with. Timber is never sold from a mining claim except with the consent of the claimant, or unless it is clearly shown, after an examination, that the claim is abandoned. In the case of fire-killed timber, which rapidly deteriorates by standing, a contract bond arrangement can be made for the sale of the timber which protects the interests of both the mining claimant and the government. The promiscuous locating of mining claims has in the past caused considerable trouble. It has been, and still is, the custom in some parts of the West to locate a mining claim when the surface rights of any particular area are desired, irrespective of the mineral character of the ground. This has been done to hold power sites, town sites, summer residences, springs, etc. When the ground is desired for any of these purposes, what is known as a Special Use Permit will be issued at a nominal sum, to legalize the occupancy. In most instances, it is far cheaper to take out one of these permits than to do the annual assessment work on a mining claim, but, of course, patent to the ground cannot be obtained in this manner. If mineral were discovered on the land covered by a Special Use Permit, it would ordinarily be the policy to cancel the permit if it were clearly

In this paper the authors aim to chronicle the experience and salient points brought out in changing flotation reagents at a concentrator which had probably been using a minimum amount of oil at a minimum cost per ton, to a more complicated system requiring a partial chemical control. The original oils were coal tar and pine oil. The new reagents are lime, xanthate and pine oil. It was found that there were no insurmountable difficulties and eventually the cost of the new reagents per ton of ore proved to be very little more than that of the old. Lime Plant When the question of handling lime came up there were two propositions open: (1) to handle the lime dry; (2) to handle it wet in the form of an emulsion. Granting that a dry lime feeder would function properly, delivering lime uniformly, the chief objection was the dust that would be raised when these feeders were being charged or operated, as the only possible location was on a gallery beneath which men were working. With this objection the handling of lime as an emulsion seemed to be the better scheme. The lime plant which was first installed was for experimental work on one section. This was gradually changed and developed until it was of sufficient size to accommodate 20 sections. The various changes will not be discussed and the following description deals only with the fully developed plant. Crude as it is, and perhaps somewhat expensive to operate, the lime-handling plant has been quite successful. Much has been learned which will pave the way for a better installation in the future. Burnt lime is received loose in standard gage box cars. This is the product of the kilns and has had no screening or sorting. A grab sample is taken from each car as it is unloaded. An average of the analyses of samples from 44 cars gave the following: Available CaO Total CaO, Oxide and Hy- MgO, Fe²O³ + Al²O³, Insoluble, Per Cent. drate, Per Cent. Per Cent. Per Cent. LIQUID-OXYGEN explosives commonly consist of a carbonaceous absorbent enclosed in a canvas wrapper and soaked with a liquid con-taining more than 90 mol per cent of oxygen. Investigation of these explosives in this country was initiated in 1917 by George S. Rice, then Chief Mining Engineer of the Bureau of Mines. The early development is summarized in two papers.1,2 Their characteristics, advantages and disadvantages were considered in a recent bulletin of the Bureau of Mines.3 Other publications of this Bureau4,5 treat the technology of these explosives and contain adequate references to pertinent literature. These investigations defined the properties of liquid-oxygen explosives and improved them greatly; however, an outstanding disadvantage is their high inflammability, a property of critical practical importance. These explosives as hitherto prepared are easily inflamed; the combustion resulting from an accidental ignition is particularly dangerous because of the ease with which it passes into detonation. For this reason the Bureau of Mines undertook a cooperative investigation, which has resulted in the development of fire-retardant treatment for the minimiza-tion or elimination of this hazard without materially impairing the explosive properties, including the ease of detonation. This presentation will offer a general description of the investigation and the outstanding results. Further phases will appear in subsequent short papers, and the entire investigation including the results of detailed experiments will be available in a forthcoming bulletin of the Bureau of Mines (Bull. 429). The effects produced by fire-retardant treatments of the carbonaceous absorbent and of the canvas wrappers were investigated separately, and the efficacy of combinations of these treatments with particular reference to the possibility of inflammation and to the development of detonation from inflammation was studied. US 4,181,520 - Direct reduction of iron oxide ore to sponge iron in a rotary kiln. Ore is fed into the kiln along with coal briquettes and passed through a preheating zone and then a reducing zone countercurrent to the flow of a kiln atmosphere which includes air or other oxygen-containing gas. The agglomerated coal is heated at such a rate that it disintegrates into fine particles in the preheating zone. INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation.
