The effect of coatings on the incendive properties of aluminum alloy 6061-T651 in air-6.4%CH4 was studied for collisions between rusted steel and both uncoated and coated projectiles with incident energies as high as 300 J (220 ft-lb) and velocities as high as 200 m/s (660 fps). These conditions were intended to simulate the rough handling of equipment in coal mines. The ignition probability using uncoated alloy projectiles increased with increasing relative humidity and appeared to be influenced by atmospheric ozone content. The incendive properties of both the uncoated and coated alloy depended on the type of rust used, but the dependence of the coated alloy was very different from that of the uncoated alloy. A number of coatings developed in the last 25 years were found to offer protection from ignition and to remain largely intact for occasional collisions or collisions randomly distributed over the coating surface, but probably not for repetitive collisions at any given point on the coating. These protective coatings utilize a hard anodized aluminum alloy surface coated with one or more layers followed by heat treatment of the coating. Coatings containing Teflon and MoS2 and thicker than 50 µm (2 mils) appear to be most effective.

The North Shore Inline Interceptor, Phase IA tunnel is a 8,550-meter (28,000-ft) interceptor tunnel currently being constructed by Traylor Bros./Frontier-Kemper, Joint Venture, using a 9.8-meter (32-ft - 4-in) diameter Robbins tunnel boring machine (TBM). This tunnel is being driven in Silurian age dolomite approximately 91.5 m (300 ft) below ground surface. Significant water inflows were encountered when the tunnel drive penetrated the thinly-bedded Waubakee Formation. Flow increases approaching 0.75 cu m per min per 30 m of tunnel (200 gpm per 100 ft) have occurred in this formation. After driving approximately 2,285 m (7,500 ft) of tunnel (200 m full face in the Waubakee Formation), total flows exceeded 12 cu m per min (3,200 gpm) with about 5.7 cu m per min (1,500 gpm) entering the tun¬nel from the 200 m (600 ft) of exposed Waubakee Formation. Additional water control measures consisting of increased pumping capacity, increased water treatment capacity, surface grouting ahead of the tunnel, grouting ahead of the tunnel face and panning to improve the working environment for installation of tunnel support, were implemented to deal with the large water inflows. Currently (January 24, 1989), 3,400 m (11,000 ft) of tunnel has been driven, total water inflows are in the range of 11.7 cu m per min (3,100 gpm) with only 6.8 cu m per min (1,800 gpm) inflow from about 1,220 m (4,000 ft) of tunnel driven full face through the Waubakee Formation.

It has been suggested that radicals on the surface of dust particles are key chemical factors in the pathophysiology which results from the occupational inhalation of coal and silica dust. In addition, oxygenated derivatives of arachidonic acid (eicosanoids) have been implicated as important biochemical mediators of mineral dust-induced lung disease through their role in bronchial and vascular smooth muscle reactivity, inflammation, and fibrosis. Therefore, we assessed eicosanoid production by the rat alveolar macrophage (AM) exposed in vitro to mineral dusts with varying surface chemical characteristics in order to determine if radicals associated with the mineral dub1 could influence the production of pro-inflammatory mediators in the lung environment. Rat AM were exposed to freshly fractured or "stale" bituminous coal dust, as well as untreated silica or silica calcined to 500°C and 1100°C. Prostaglandin E2 (PGE2) and thromboxane B2 (TxB2) levels in incubation medium were determined by specific radioimmunoassay. When AM were exposed to freshly fractured coal dust, PGE2 and TxB2 production were markedly increased. In contrast, exposure of AM to "stale" dust significantly reduced PGE2 and TxB2 production. In vitro exposure of AM to untreated silica resulted in a significant increase in PGE2 and TxB2 production compared to control. However, exposure of AM to silica calcined to 1100°C resulted in eicosanoid levels which were not significantly different from control. These findings suggest that radicals associated with respirable coal and silica particles may play a key role in the ability of mineral dust to activate AM eicosanoid production.

If you have ever driven on the Autobahns of Western Germany, you are well acquainted with the "fast lane." There is no speed limit; there are only two lanes in the direction you are going, and if you choose to drive in the fast lane, you had better be prepared to drive faster than anyone or someone will tailgate you with a constant screeching horn until you move to the "slow lane." The prize for this mastery of the fast lane is some kind of a "macho" feeling and getting to your destination sooner than your competitor. This has some comparisons with today Is liquid-sol id separation. We've certainly had our moments in the fast lane but we've also had other countries forcing us into the slow lane at times. It can be very embarassing when someone almost runs over your back and then shakes a fist at you as you shakily scatter to the much slower and overcrowded lane. Because of necessity, there will be many new improvements and added requirements in the next decades into the 21st century and beyond. Those countries and industries that can maintain the pace in the fast lane will be successful while the others may well be relegated to the non-competitive lane. Before considering what will be the challenges in the future for competitive liquid-sol id separation performance, it would be wise to review progress over the past forty years in this area. The author has to admit his ancient age and believes he can act as an evaluator of these many advances. In the defunct Gorka quarry, there are situated both a waste disposal site of an area of 6.7 ha and containing approximately 1 million ton of high aluminium wastes and a pond of an area of roughly 3 ha, up to 15 m deep, with about 400000 m3 of polluted water. The reservoir is fed with the filtrates arriving from the disposal site mentioned, at a rate ~130 m3/day. An alarming phenomenon is the subsidence of the pond bottom and the infiltration of solutions into the Triassic and Jurassic water resources, assessed at ~40 m3/ day. The basic problem related to the effluents in the Gorka pond is their high alkalinity (pH 12-13.4) and variable pollutants whose level increases appreciably with the pond?s depth. The solution offered provides pumping out and treatment of about 500000m3 of effluents retained in the Gorka reservoir in an about yearly time. Effluents would be treated in a reverse osmosis plant, according to a process so far verified on a quarter-commercial scale. The treatment process by-product would be discharged into the Ropa stream. The brine solution (containing about 25% NaCl), whose amount may reach up to100000m3, might be supplied to the Debiensko Mine which produces technological salt from salt-bearing mine waters. Similarly, there would be provided an intake of underflows of infiltrates (by means of deep wells, and possibly girdling ditches) arriving from the high aluminum site, and such effluents would be subject to ongoing dilution in water courses. It would be possible to test the system of underflows reaching the Gorka reservoir by means of geochemical identification, previously performed. The next stage following the pumping, would be the utilization of approx. 50 000m3 of bottom slurry. Highly alkaline slurries would be utilized in the production of self-solidifying mixtures. Slurries would be pumped out and temporarily dumped on drying beds, located nearby the Gorka reservoir, and later on used successively for making self-solidifying mixtures in a plant similar to a concrete making seat. Those mixtures would be applied for sealing the bottom of the Gorka reservoir and the necessary part of the edges of the defunct quarry. An alternative solution is the utilization of slurries in the facilities of the Trzebionka Mining Works and the application of self-solidifying mixtures, made in the Trzebionka Works, for sealing the reservoir bottom.

1 - INTRODUCTION The Canadian Shield is well known as being among the older exposed areas of the earth's surface. Except for local zones, its extent from the Arctic to central North America is characterized by strong and durable crystalline rocks. It is generally regarded as highly competent for tunnelling and underground excavation and, as a result, many openings are excavated in it with minimal temporary support. If hydraulic efficiency is not a factor, tunnels do not usually require continuous concrete linings. A high percentage of the crystalline rocks of the Shield are of metamorphic origin and as such one of the dominant characteristics is their foliation. Zones of sheared or faulted rock are common in the Canadian Shield, particularly in association with foliation. These zones may be created during the late stages of the metamorphic process, leaving shear zones as an integral feature of foliated rock. As foliation is a preferred direction of weakness, deformation and rupture during subsequent tectonism may also create parallel shear zones. These "foliation shear zones", as described by Deere (1973), are an adverse feature of the otherwise durable rocks of the Canadian Shield. The zones may range from faults of major proportions to seams only a fraction of an inch thick. If fault gouge or alteration products exist in the zone the strength of the rock mass may be great1y reduced. As foliation is usually continuous, large unstable wedges of rock may be created if the opening is subparallel to the foliation. The effect on the construction of underground openings in terms of excavations, support and scheduling can be significant.

Introduction A new technology is evolving as a result of growing industry and government concerns over the potential impacts of possible airborne emissions from uranium tailings piles. A major component of the technology is the use of earth covers to stabilize the tailings after mill operations have ceased. While various analytical models have been used to predict the thickness of required covers, experimental validation of the models has been necessary. This paper presents the results of a field program to select and test cover material to determine its suitability for eventual reclamation of a currently active tailings pile. The two main criteria guiding the study were the U.S. Nuclear Regulatory Commission radon flux requirements (reduction to less than twice background pre-1979, and to 2 pCi/m2 -sec above background post-1979) and the desire to employ locally available material. The methodology chosen for this study consisted of three main elements: o Determination of the background radon flux. o Determination of the radon flux from the tailings pile. o Experimental determination of the cover material diffusion coefficient and and calculation of cover thickness. The first two elements of the study are relatively straightforward, the last phase is discussed in detail. Background Radon Flux Measurements of radon-222 emanation rates from the surface of the ground were taken at three sampling locations. Samples were collected by means of the accumulator can method described by Wilkening, 1977. Both morning and afternoon samples were collected at each site to obtain an average. The measured fluxes were fairly uniform and did not differ greatly among sites. The overall average flux for all sites was 0.63[+]0.28(o) pCi/m2 -sec. This value is equal to the average radium-226 concentration determined in the soil, thus yielding a one to one ratio of radon-222 emitted (in pCi/m2 -sec) to soil radium content (in pCi/g). The identification of the real internal rates of return (IRR's) of a project is essential for its economic evaluation. The existing methods for the calculation of IRR's are both cumbersome and unreliable, mainly because of their inability to effectively isolate the real IRR's and incapability of discovering multiple IRR's of even multiplicity. In this paper, a concept of the 'cash flow pattern tree used for isolation of the real IRR's of a project is presented. This concept, combined with the Sturm procedure for counting the real distinct zeros of a polynomial within a specified interval, leads to the development of a method and computer program for isolation and calculation of the real IRR's of a project. The method examines whether or not real IRR's exist, and if they do, isolates them within bounded and narrow intervals in a mathematically founded way. The isolated IRR's, whether simple or multiple, are subsequently calculated either directly or by means of an appropriate approximation procedure. Numerical examples assist the development of the method and the corresponding computer algorithm. Because any Net Present Value treated as a function of interest rate can easily be transformed into a polynomial, the method presented also constitutes a method for finding the real zeros of a polynomial.

This paper will discuss the application of a continuous miner using a fixed drum milling type cutting head for the underground mining of hard rock and salt ores. Continuous mining machines of the ripper chain cutting head, oscillating milling cutting head and boring arm designs have been used in rock and salt applications with various degrees of success. The large boring arm miners have been successful in potash, trona and salt, but they have not been successful in mining rock materials like iron ore. The main method used in underground mining rock materials is the conventional drilling and blasting the ore from the solid. This is particularly true for the harder, more abrasive copper and iron bearing ores. The softer salt based ores of potash, trona and rock salt can use several underground mining methods depending on seam conditions. Several of these methods use underground coal mining equipment that has been extensively redesigned to adapt it for use in mining noncoal materials. Conventional mining methods employ the use of a universal cutting machine to undercut or topcut the ore body before face drilling and blasting takes place to produce a smooth parting of the ore. The boring arm continuous miner is widely used in underground mining of potash and trona ores. It produces a tunnel with a smooth semicircular contour which results in good rib and roof stability. The ripper chain continuous miner is also widely used in mining the salt based ores of potash, trona and rock salt. They are used more frequently in Europe than in the United States and Canada. Gold-silver and copper-gold deposits with high-temperature wallrock alteration of Ca-Mg-Fe-Al silicates occur in ca. 3.0 Ga old greenstone belts of the Yilgarn Block, Western Australia. The deposits are hosted by amphibolite-facies komatiites, basalts and BIF, controlled by ductile shear zones and located within the contact-metamorphic aureoles of composite granodiorite-granite batholiths. Disseminated sulfides and free gold form foliation-parallel ore zones in a gangue of anhydrous silicates (garnet, clinopyroxene, olivine), hydrous silicates (amphibole, biotite) and calcite. The deposits may be classified on the basis of their dominant economic metals as: 1(1) Gold skarns with substantial silver as by-product, represented by the Marvel Loch mine (production: 2,200,000 t at 3.5 g/t Au), and characterized by the mineral association pyrrhotite, loellingite, arsenopyrite, galena, gold and magnetite. (2) Gold skarns with low silver contents, represented by the Nevoria mine (production:1,850,000 t at 3.4 g/t Au), and characterized by the mineral association pyrrhotite, chalcopyrite, arsenopyrite, gold, Bi-tellurides and magnetite. (3) Copper-gold skarns, represented by the Elverdton mine (production: 850,000 t at .7 5 Cu, 0.81 g/t Au), and characterized by the mineral association magnetite, chalcopyrite, pyrrhotite, pyrite, gold and Ag-Bi tellurides.

For the environmentally safe management of the sulphidic waste rock produced from the Stratoni mining facilities, TVX Hellas has examined, within the frame of the funded European research program ROLCOSMOS, the effectiveness of an alternative rehabilitation scheme involving the segregation of the sulphide rich components of waste rock and the engineered application of alkaline additives. The examined waste rock management scheme was evaluated with laboratory test work followed by pilot-scale field applications. In this paper, the results from the two-year monitoring period of the pilot scale application are presented.

As a step in the endeavor to reduce future tunneling costs in New York City, the Environmental Protection Administration, Dept. of Water Resources, instituted a program in 1972 to monitor the performance of the lining of one of its tunnels. A monitoring program was included as part of the contract specifications for the East Branch Interceptor Sewer tunnel for the Port Richmond Water Pollution Control Project in the hope that measured data would indicate possible future cost effective design or construction improvements. The monitoring program involved measuring ground deformations, circumferential liner stresses, longitudinal liner stresses, and jacking pressures. This paper presents some of the findings from these measurements, with emphasis on liner stresses. PROJECT DESCRIPTION The 3.05m (10 ft) diameter steel lined tunnel was constructed under two separate contracts. The easterly portion, Contract 3A, was approximately 3109m (10,200 ft) in length and constructed by Peter Kiewit Sons Co.1 The westerly portion, Contract 3B, was approximately 2160m (7100 ft) in length, and constructed by Richmond Constructors, a joint venture of Grow Tunneling Corp., MacLean Grove & Company, Inc., Grove, Shepherd. Wilson & Kruge, Inc., Morrison-Knudsen Company, Inc., and Andrew Catapano Co., Inc. Each contract included three test stations, hence a total of six along the tunnel route. Excavated material along the tunnel route consisted primarily of dense fine to coarse sand with varying percentages of gravel and silt with occasional boulders. Pockets of organic silt were encountered on Contract 3B and a large portion of Contract 3A ran through slightly weathered serpentine and schist. Overlying material and the groundwater level varied considerably along the route as did the height of overburden. Figures 1 and 2 show the generalized soil profiles for Contracts 3A (PK stations) and 3B (RC stations) respectively.

The Bowie chabazite deposit has yielded the most mined tonnage of any natural zeolite deposit in the United States. Since 1962 the deposit has yielded about 12,000 tons of crude chabazite, with an estimated market value of S30 million when sold as an activated molecular -sieve product. Between 1,000 and 1,500 tons of high-purity crude lump chabazite is now produced annually by stripping and selectively mining the lower, massive, half-foot-thick, "high-grade" bed. All of the chabazite is still shipped out of State for grinding prior to extrusion and activation. Zeolite minerals were discovered at the Bowie deposit in 1875, when Oscar Lowe identified a hydrous silicate related to chabazite or stilbite from a tuff bed that cropped out in the San Simon Valley. It was not until 1959, however, that chabzite, erionite, and clinoptilolite were positively identified as the principal constituents of an altered vitric-tuff horizon that crops out in the area originally described by Lowe. Shortly after the rediscovery of zeolite minerals in the San Simon Valley, several of the major producers of synthetic zeolites acquired land positions covering the outcrops, including projected extensions, and began exploration drilling. By 1980 all of the known chabazite reserves had been acquired by five companies and two individuals. The more than 3,000 holes drilled to explore the deposit and the excellent exposures provided by the strip-mined areas indicate that the chabazite-bearing horizon (known as the marker tuff) is confined to a flat-lying lacustrine section known to the operators as the Green Lake Beds. The deposition of the parent airborne vitric ash and subsequent zeolitic alteration was controlled by many factors, including the lake-bottom topography, depth and cation content of the saline-alkaline lake water, and proximity to post-depositional erosion surfaces. Zeolitic alteration was complete when an extensive system of younger paleochannels deeply eroded the Green Lake Beds. This left only a few erosional remnants of the marker tuff and the lower "high-grade-bed" that constitute the present deposit. Both the channel gravels and the Green Lake Beds are overlain by a section of halite-bearing brown mud-stones, known as the Brown Lake Beds. The bowie chabazite deposit can be used as a model to guide the exploration and development of other zeolite deposits that formed in saline-alkaline lacustrine environments.

INTRODUCTION This presentation will address changing trade patterns in lead and zinc from the mid 1980's to the early 1990's. Lead and zinc deposits are developed where they are found in many parts of the world. As many are not in major consuming areas, there is significant international trade in both lead and zinc concentrates and in refined metal. Forecasts of mine production have been analyzed, primary and secondary refining capacity and future consumption levels have been estimated, to arrive at the changes in trade patterns expected during the next half decade. This paper will first address concentrate and metal trade patterns for lead, then for zinc, and finally some remarks will be made on captive mine/smelter agreements, on regional trade agreements, and on barriers to trade. I would like to note that. there is only a small international trade in semi-fabricated products such as zinc die-cast alloy, zinc oxide, lead oxide or rolled lead and zinc. Most of the world's zinc and lead trade is in concentrates or refined metal. LEAD TRADE PATTERNS Lead Concentrates Six countries are exporters of lead concentrates. Three countries are in the Americas - Canada, Mexico and Peru, with two in Africa - Morocco and South Africa (including Namibia), and Australia. Due to the limited growth in lead consumption and consequent minimum investment in new production facilities expected, mine and metal production levels and future consumption levels are not forecast to change much between now and 1990. Accordingly, the tonnage of lead concentrates exported will remain essentially unchanged from these six countries. In total they have exports of 480,000 metric tonnes (metal content)* and by 1990 this figure is forecast to rise only slightly with the only increase taking place in Mexico. The concentrates are exported mainly to Western Europe & Japan. Apart from these six main lead concentrate exporting nations, a significant change is expected in the United States. The Bureau of Mines is currently investigating the geophysical application of Tomography to monitor leachate during in-situ mining. Determining the location of the leachate is important for both economic and environmental reasons. By analyzing a sequence of tomographic images, we can determine where highly permeable/fractured regions are located and hence, major flow paths. Since BOMTOM (Bureau Of Mines TOMography - Tomographic Reconstruction Program), and BOMCRATR (Bureau Of Mines Curved RAy Tomography - Tomographic Reconstruction Program) are sensitive to user-selected ray path arrival times, we are also investigating the use of neural networks to automate the process of recognizing this feature. This paper presents a technique for detecting fracture zones and their orientations in a region between two boreholes, by using a motion analysis study of a sequence of tomographic images. It also addresses the need for an automated/unbiased method to pick crosshole seismic arrival times using a trained neural network. In exploration geophysics, the picking of first break arrivals represents a pattern recognition task. The neural net paradigm has proved to be a good method of solving this type of task. To pick the first arrival peak of a trace, the network is trained with a set of known (user selected) first arrival peaks by creating a binary image of a set of traces. Once trained, the neural net correctly picked first arrivals of the remaining traces in the set.

Conventional zinc concentrates generally contain 5 to 10% Fe, while bulk concentrates can contain up to 20% Fe. As a result, the disposal of iron bearing residues is an integral part of zinc refining operations. The quality of iron residues must comply with ever changing and increasingly stringent environmental legislation. Zinc has been recovered from sulphide concentrates by a hydrometallurgical route for almost one hundred years. The disposal of iron was a major difficulty for the industry for many decades and was directly responsible for low overall zinc recoveries. The introduction of the jarosite process in the mid 1960's allowed for the treatment of neutral leach residues and the precipitation of iron in an easily filterable form. Subsequently, three additional iron precipitation processes have found commercial application in the zinc industry: the goethite process; the paragoethite process; and the hematite process. The Sherritt Zinc Pressure Leach Process has been developed for integration with existing roast leach electrowin zinc plants, or as a stand alone facility for the treatment of a wide variety of zinc bearing feed materials. It is essential that these processes allow for the disposal of iron residues in an environmentally acceptable form. This paper describes the integration of the Sherritt Zinc Pressure Leach Process with commercially proven iron precipitation processes. The results of laboratory testwork and data from operating plants are presented.

Longwall mining is considered to be the most efficient underground coal-mining technique in terms of coal extraction ratio, production rate and safety standards. Due to the increasing demand for higher coal production, the recent trends have been to use wider panels and to maintain a faster face movement. For these reasons, longwall mining can result in unexpected roof falls, excessive face convergence, shield damage and numerous maintenance problems, which can cause sudden interruption of coal production as well as serious safety hazards. Recent work at the University of Alabama has been dedicated to the development of a longwall strata-control and maintenance system that can integrate real-time shield monitoring, data presentation, analysis, forecasting and warning modules. This integrated system has been called LoSCoMS. The main objective of the system is to provide minute-by-minute stability and maintenance information such as the following: high-load, low-setting pressure, leg leakage, etc.; the analysis of various mining and geological parameters to determine past and present roof characteristics; and the forecasting of loading patterns for the following mining cycles, the next periodic weighting, etc. By using this unique system, mine operations personnel are well aware of past, present and future roof-loading patterns at the longwall face and, thus, proper safety measures can be taken ahead of time.

The Coal Mining Section of the National Safety Council has selected hand and finger injuries of coal miners as a major topic for safety policy analysis [Tinney, 19851. So that facts about hand and finger injuries can be used to guide the Committee's work and the work of policy-makers, we present in this paper detailed analyses of the following factors related to hand and finger injuries received by coal miners between 1975 and 1983: occupations of the injured miners; activities of the miners when injured; machines involved; objects, substances, exposures, or bodily motions that produced or inflicted the injuries; principal physical characteristics of injuries; and events directly resulting in the injuries. We analyze hand injuries for underground and surface mines separately because of the remarkably different production methods and hazards evident in these two operating environments. We do not, however, provide information about hand and finger injuries that occurred in surface operations at underground sites (such as yards, shops, or tipples), auger mining operations, culm banks, dredging operations, mill or preparation plants, offices, or laboratories. The most comprehensive information about the safety of coal mining in the United States is assembled by the Health and Safety Analysis Center (HSAC) of the Mine Safety and Health Administration of the United States Department of Labor. Mine operators in the United States report to HSAC all injuries as required under Part 50, Title 30, of the Code of Federal Regulations (mandated by Section 103 the Federal Mine Safety and Health Amendments Act of 1977, Public Law 95-164). These regulations stipulate that injuries must be reported within ten days of their occurrence on a United States government data collection form, Mine Accident, Illness and Injury Report (MSHA Form 7000-1). "Impact and Benefit Agreements (IBAs) are intended to be a negotiated agreement between an industrial proponent and a community, local or regional citizens’ organization. Although the elements have grown over the past two decades from a simple agreement to exceedingly complex legal frameworks, the intention remains the same: to outline the roles and responsibilities of the two stakeholders and the natural resource development on their lands beyond environmental assessment. These agreements were born out of comprehensive indigenous land claims and have become the cornerstone of community engagement today in most indigenous nations. In the case of mixed communities, those that have beneficiaries of land claims and those who are not, social acceptance remains uneven and reflective of an unequal distribution of decision-making power (political ecology). This Differential Social License can cause conflict and a breakdown of the societal fabric that binds communities of diverse populations, resulting in inequality, fictitious wealth generation and failure of infrastructure. This paper presents a case study of how the development of Differential Social License developed in the Hamlet of Cambridge Bay, Nunavut as a result of an IBA negotiated between Tahera Diamond Corp. and the Kitikmeot Inuit Organisation in 2004 for the Jericho Diamond Mine.Introduction / Background Social license (social license to operate or SLO) has become an essential part of the social governance ‘toolkit’ demanded by mining stakeholders in today’s world. Stakeholders are now insistent that companies operate more closely under the tenets of sustainable development and provide for an increased level of community participation. Social license is not simply a matter of communicating with a community, to earn its consent for or acceptance of a project. It requires that we engage with the individuals and organisations who ally themselves with communities, or who sometimes side with dissident factions of a community. SLO is a process associated with and informed by political ecology or the recognition that unequal decision-making power exists amongst stakeholders."

Experts, like many of the speakers at the SME Annual Conference, are frequently called upon by lawyers to assist them in litigation. Due to the technical nature of many cases, the testimony of an expert with knowledge and experience in a particular field is necessary to help a judge or jury understand and decide certain issues. Environmental litigation is no exception. Experts routinely are called upon to offer testimony to establish the existence of contamination and its source, as well as the potential health and environmental risks associated with the contaminants. This article will briefly discuss the factors courts apply to determine whether to admit expert testimony after the recent Supreme Court decision in Daubert v. Memell Dow Pharm., Inc., 509 U.S. 579 (1993). The Court's decision in Daubert overruled a long-standing test that had based the admissibility of scientific evidence on its "general acceptance" in the field in issue. Next, the article will discuss in general terms what a party must do to "link a particular defendant's conduct to the contamination involved in order to recover from that defendant. This link, known as causation, varies depending upon the type of claim being asserted. Expert witnesses are used extensively to help establish causation. JUNK SCIENCE OR GOOD SCIENCE- HOW DOES A COURT DETERMINE WHAT TO LET IN A frequent complaint in litigation involving technical or scientific issues is that one party or another is trying to use so-called "junk science" to prove its case. While some expert testimony might be so clearly lacking in support or so "off the wall" that a court can easily determine to exclude it, other testimony, especially testimony on the "cutting edge," is much more problematic. In 1923, the District of Columbia Circuit Court of Appeals decided the case of Frye v. United States, 293 E 1013 (1923).
