"10.1. INTRODUCTIONDefinitions are a necessary part of every agreement. Their purposes are to assist the reader in reading and understanding an agreement and to attempt to avert potential confusion and, therefore, disputes. In some circumstances, they may be critical in deciding a dispute. As they are often substantive, they should not be treated lightly.It is far easier and less confusing for a reader to read “the Company” or “the Recipient” than to be faced with “the party of the First Part”, or to see the “Jones Property” than “that part of the property hereinbefore described in paragraph 1.01 hereof”. It is also advisable not to use “-ee” and “- or”, as in payee and payor.One thing must always be remembered: once a word has been defined in an agreement, it will always have the defined meaning unless the contrary is clearly indicated or is required to make sense of a provision.2 It can be confusing for a reader if commonly used words are defined in other than ordinary terms. Unique words that will stand out in the text are more likely to be recognized as having special meaning. It is also good practice to identify defined terms by capitalizing them in the text of the agreement. Boldfacing of definitions is also sometimes used for this purpose but, as boldfacing is not easily identified in handwritten revisions, it can be missed in the press of negotiations, especially when several typists are involved. Lack of consistency in identifying defined terms is not a fatal mistake, but it can create confusion, especially if the reader is new to the agreement or is reading it in a highly technical manner, such as when there is a dispute.If definitions used in the main text also apply to a schedule, they need not be included in both. Omitting them from the schedule makes the agreement look shorter, which to some people is a benefit. If definitions are not repeated, make certain that the schedule clearly indicates that words defined in the main text have the same defined meanings in the schedule3 and are clearly identified as defined words. In considering whether or not to repeat in a royalty schedule definitions appearing in the agreement proper, think of definitions as an aid and a reminder to the reader. Repeating them will help a reader, if only by saving the nuisance of remembering where to find them in the main text and constantly turning to it. All the definitions needed to read the schedule will be right there, so that the schedule is a self-contained document. Just make certain that, if you do repeat a definition, you repeat it in identical terms. If you have to change any defined term to make it fit the royalty provisions, use a different word or phrase as the defined term to warn the reader that he is dealing with a different concept.4"

The location and shape of potential failure surfaces in soil slopes were directly determined based on the stresses induced in the soil mass and the strength of the soil itself. Stress calculations were carried out by the finite element method with the Drucker-Prager nonlinear material model. The Mohr-Coulomb failure criterion and Mohr's circle stress analysis were then applied to the calculated stresses to determine the characteristics of the failure surface.

A system of steel sheeting and multiple levels of high capacity double corrosion protected soil anchors were used to restrain a major slope failure that occurred at the base of the Watchung Mountains mid-way through construction of a 650,000 SF retail center along Route 22 in Watchung, New Jersey. The implementation of a design-build earth retaining structure was necessary to stabilize and repair the disturbed mountainside in a timely fashion to permit completion of the retail center on a fast track schedule. The tied back steel sheetpile wall was approximately 2,000 feet long and varied in height from 12 to 25 feet. The hillside extended approximately 350 feet above and 600 feet beyond the wall with the main failure scarp extending 50 feet above and 90 feet beyond. The wall was constructed in a top-down manner and required the installation of 475 anchors to resist loads of up to 70 kips/ft produced by the creeping hillside and groundwater flows from both a series of springs and steady state seepage through an inclined zone of fine sand. Incorporation of a unique tie point connection eliminated the need for a waler, facilitating and simplifying modifications to anchor locations based on anchor load test results and conditions encountered during construction. Post grouting also proved to be an essential element in the successful construction. This paper presents the design and the construction methods used to restrain the significant earth lateral loads produced by a slope failure using steel sheeting tied back with high capacity soil anchors with anchor loads distributed to the sheeting through a unique tie point connection on a fast track schedule. Installation techniques, testing programs, and construction quality control are also discussed.

"SynopsisRotary drilling with rolling tricone bits is the most widely used method for drilling large-diameter blast-holes in large surface mining operations. This drilling method is applicable to a wide range of soft to hard rock materials. This paper presents a fuzzy model for predicting the penetration rate of tricone rotary blast-hole drilling. The model is based on data obtained during the drilling of blastholes in rocks with various uniaxial compressive strengths in the Veliki Krivelj open pit mine, Bor, Serbia. The model was developed using the fuzzy logic toolbox of MATLAB with the Mamdani inference system. The fuzzy model was tested with 23% of the total dataset. The results obtained show the high reliability of predicting the penetration rates. Although there are possible limitations in applying the model to other open pit mines because of differences in rock properties, the prediction methodology applied in this paper can be used in many other predictions of the penetration rates.IntroductionAccording to Tamrock, rotary blast-hole drill operations depend on four important elements:•,Torque in the drill string drive sufficient to turn the bit in any strata encountered•,A high bit loading capability (pulldown force) sufficient for optimum penetration•,An air volume sufficient to remove chips generated during the drilling and to provide cool air to the drill bit bearings•,The selection of the proper type of bit for the material being drilled (Tamrock, 1984).The effects of rock mass parameters on the choice of the type of tricone bits were investigated by Kricak (1997)."

The revised estimate of coal production in January 1977, is 39 million tons -- down 12 mi 11 ion tons compared with production in January of last year, largely as a consequence of the snow storms and cold. The major coal-hauling railroads operating in Eastern and Midwestern States reported to the Bureau of Mines that they loaded approximately the same number of cars for the week ended February 5, as in the preceding week. The Bureau of Mines estimates that U.S. coal production for the week ending February 5, 1977, was approximately 8.5 million tons, or nearly 3.5 million tons less than production for the corresponding week in 1976. Coal production from January 1 - February 5, 1977, was approximately 47.8 mi 11 ion tons compared with production of 63.5 million tons for the corresponding period in 1976. As of the first week in February, river and truck shipments of coal in the Eastern U.S. were about one-half of the normal traffic. Despite the freezing weather and ice and snow conditions of rivers and highways and reduced rail shipments, there was reportedly little or no shortage in coal supply to consumers. Inventories at electric utility plants and steel company coke plants at the beginning of the severe weather were sufficient in most cases for at least 30 days" operations. There have been no reports of coal shortages at other industrial plants.

The use of the National Science Teachers Association (NSTA) regional meetings as a forum to educate teachers on the role of minerals in our society has been immeasurably successful. Each year, on average about 3,500 to 4,000 teachers participate in each of the three regional NSTA meetings. At each of these meetings, nearly 2,000 teachers visit the “Minerals Coalition Booth” and receive free mineral samples and other educational support materials. Some rules of thumb for a successful booth at the NSTA are provided. Considering the level of effort for such a booth, are there alternatives? The NSTA also organizes a national annual meeting with attendance of about 20,000. All who have participated in a regional NSTA agree that the traditional approach of providing a mineral set and teacher materials for a substantial fraction of the 20,000 attendees is not feasible. Conceptual alternatives for minerals education at the national NSTA meeting are introduced and evaluated.

This report summarizes a systematic 20-year study of the organic sulfur compounds in Wasson, Texas, crude oil and, to a lesser extent, of three other crude oils, that has culminated in some 200 individual sulfur-compound identifications. The development and application of special separation and identification techniques generally suitable for the characterization of sulfur compounds in any crude oil are discussed. This report reviews early sulfur literature covering petroleum sulfur compound identifications completed before this study was begun, and cites 58 papers resulting from this work. The sulfur compounds in petroleum, both as to type and quantity, have long been of concern to the petroleum industry, and such compositional data are not only of theoretical interest, but also of practical value.

Previous laboratory and field experimentation has demonstrated the effect of several variables on drilling rate.1-5 These results have been incorporated into optimization theories6-" for the purpose of reducing drilling cost. Minimum-cost drilling theories rely on a combination of historical data and empirical prediction techniques for selecting optimum bit weight and rotary speed. Past solutions have required extensive use of computing equipment because of both the complexity of the mathematical formulations and the large number of parameters involved. Field attempts to apply these computed results have frequently failed because of the uncertainty of input data requirements. Humble has developed an on-site computer system to control bit weight and rotary speed and thereby implement the concepts of minimum-cost drilling. This system can (1) perform short interval drilling rate tests for formation evaluation, (2) use the results of these tests as input information to solve minimum-cost drilling formulas, and (3) control bit weight and rotary speed in accordance with these computed solutions. The purpose of this paper is to describe the computer control system and present results of initial field testing. Theoretical Considerations Minimum-cost drilling (MCD) requires a quantitative evaluation of the variables involved. Several forms of a basic mathematical model have been sug-gested.'?,' "he relationships reported here form the basis for the solution programmed in this work. Four equations are used, expressing drilling rate, bit bearing wear, bit tooth wear, and cost. A solution for minimum-cost drilling assuming constant bit weight and rotary speed over the entire bit life has been programmed for use in computing MCD schedules. This solution is subject to certain limiting assumptions such as those discussed by Graham et a1.I2: 1. Drilling cost is the summation of bit cost, rotating cost, connection cost and hoisting cost. 2. Diamond bits are excluded. 3. Bit life is limited by either bearing failure or tooth wear, or by a combination of operational factors that make it cheaper to pull an incompletely consumed bit. 4. Circulating hydraulics are adequate and do not limit drilling rate. 5. Bit weight considerations exclude hole deviation. 6. Drilling rate is a function of only bit weight, rotary speed, and degree of tooth dullness; that is, the effects of pressure, lithology, fluid properties hydraulics and drill string dynamics are ignored. Conceptual studies of the run of mine stockpiling and reclaiming requirements at Thiess Bros Pty Ltd South Blackwater coal mine commenced in 1975.Final selection of equipment was made in 1978 and the equipment was commissioncd in June 1979. Equipment selection was made after extensive investigation and visits to existing facilities throughout the world.The equipment selected is described and compared with the alternatives. Foundations were designed to minimise clean up effort and to ensure stabilily of equipment under design wind loading without storm bays. Programmable logic control enables the stacking and reclaiming facility to provide a blended feed to the coal preparation plant.

The rocks of Waihi and the surrounding district are almost entirely rhyolitic and ande5itic in character. Sedimentary rocks, with the exception of some surface deposits of clay loosely compacted conglomerate, etc., and one or two thin and broken beds of a very poor lignite, occasionally changed by igneous agencies into a bituminous coal, are almost absent. In the shafts sunk by the Waihi and Grand Junction companies outside the outcropping andesitic area of the Martha Hill, more than one old surface or lake bottom has been passed through. At these points layers of sand, consolidated volcanic mud and tuff, accompanied by numerous broken fragments of imperfectly silicified wood have been enccuntered, but these occurrences may, for the purpose of this paper, be neglected.The youngest rock of the district are rhyolites, probably of Pliocene age. At least three distinct classes of rhyolitic lava, each possessing features of unusual interest, may be made out. None of these, however, is gold-bearing. The youngest flow, a light-coloured, fine-grained rock, is remarkable owing to its enclosing at times fragments of carbonised wood, varying in size from mere specks up to quite large pieces of almost pure charcoal. Rhyolitic tuff is also met with. Leaching experiments were carried out on a spent catalyst sample with a honeycomb structure, containing 47.5% Ti, 5.8% Mo, 2.7% Si, 2 035 ppm As, 52 ppm Pb and 8.8 ppm Hg. More than 93% of the Mo and As was removed by direct alkaline leaching after grinding to 80% -36 micrometres. The residue contained 0.3% Mo and 60 ppm As. To obtain a TiO2 matrix with 30 ppm As, acid leaching at controlled pH with 90 kg/t Al scrap was followed by oxidising alkaline leaching. Treatment of the direct alkaline leach solution or of the mixed solutions from the two-stage process involved two successive operations: purification by neutralisation with Al(OH)3 addition to raise the Al concentration to 4 g/l, and ion exchange on Amberlite IRA 94 S resin. Whatever the type of solution treated, elution with 200 g/l NH4OH solution gave an eluate of very high purity containing 164 g/l Mo, less than 70 mg/l V and less than 2 mg/l As

The Ilo Refinery was commissioned in 1975, with a cathode production capacity of 150,000 tpy. In 1994, Southern Perú Copper Corporation (SPCC) purchased the Refinery from Minero Perú SA. Subsequently, in November 1999, Grupo Mexico acquired control of Southern Perú. The anode production facility is located at the Ilo Refinery. A number of effective operating and quality control practices have been developed that have improved anode quality, as well as increasing anode production capacity to 350,000 tpy. These, and other optimization actions have allowed for a current density increase from 213 A/m2 to 275 A/m2, while maintaining current efficiency at 98% and sustaining the high quality of the cathode. The paper will outline the scope of operational practices in the Anode Plant and provide some discussion on the Ilo Smelter modernization project, and the resulting impact on the existing anode plant.

STATISTICAL evidence shows that continued efforts made by Government and industry to make mining safer during the last two decades have had most favorable results. In the copper-mining industry an accident frequency of 146 per million man-hours worked in 1925 dropped 71 per cent by 1945 to 43. This downward trend was relatively consistent except for a high period in 1937 which was probably due to a resumption of large-scale operation with many untrained miners. The iron-mining industry showed a similar trend, but at the relatively lower accident frequency of 66, which dropped to 24 in 1945. The close relationship between the steel and iron-mining industries may be one reason for the lower accident frequencies, because the steel industry is noted for its greater recognition of the fact that safe working conditions are an important part of labor-management relations.

"The Republic of Colombia on December 30, 1919, enacted a new petroleum law. The Act is expressly limited to mineral oil, natural gas, bitumen, wax and fossilized resin and to asphalt intended for export.The law is not only intended to encourage local investors, but to attract foreign capitalists for oil development. Provision is made for a special edition ion of the law in such languages as the Government may deem necessary to give it extensive circulation within the country and abroad. The published editions must contain the provisions of the law relating to alienship and naturalization.All public lands, or what are termed unclaimed lands, are open to flee prospecting for the purpose of discovering the deposits named in the law, A prospector must obtain from the Government a, license which binds him to deliver to the Government topographic plans of the lands prospected, together with reports of their prospective yielding capacity. This license does not vest the li¬censee with any preferential right for contracting or leasing and may be drawn by the Government at any time.If a discovery is made by a licensee of any of the deposits named and he desires to exploit the same, he must present a memorial or application to the Ministry of Public Works, stating:- (a) the location and municipal district in which deposit beds are found; (b) boundaries of the zone of exploitation, which shall not be more than 5,000 or less than 1,000 hectares; (c) the names and nationality of all persons for whom the lease is sought and the action and time within which,they propose to make the exploitation; (d) the name of the corporation and its legal representatives with their residences; (e) if an alien, he must state his willingness to comply with the law relative to alienship and naturalization; (f) agreement to abide by all of the provieions of the law with regard to Government supervision, payment of taxes, rate of lease and causes of forfeiture; (g) the rate of rent or royalty that the applicant offers to pay, together with any other circumstances that may make the proposed lease advantageous to the Nation."

Underground mining of stone in the US is increasing, as is the depth of overburden above the mines. Data gathered from mine visits, maps, discussion with operators and numerical simulation have been used to investigate pillar design and recommend safe practice. Many pillars have slender shapes with relatively large adjacent mine openings: width-to-height ratios range from 0.54 to 3.13 and extraction ratios from 0.56 to 0.91. The pillar material is often very strong and average overburden only 80 m, but occasional failure due to excessive local stress has occurred where pillar size had been unintentionally reduced, overburdens were greater than 200 m, width-to-height ratios were less than 1.25 or extraction ratios were greater than 0.83. Pillars with width-to-height ratios of less than 1.5 appear more likely to fail under excessive stress. When width-to-height ratios fall below 1.0, defects such as through-running discontinuities can have a significant influence on stability. Dip, orientation and material properties are also important

"Abstract - A heavy mineral survey of beach and dune sands including geochemical analysis for trace elements was undertaken to evaluate the economic potential of the sands and to understand the nature and distribution of the heavy minerals relative to potential source rocks. Results indicate that heavy minerals are generally derived from outcropping volcanic rocks that comprise a proportion of the hinterland in the south part of our survey area. The most abundant minerals are magnetite and pyroxene. The morphologies of the heavy mineral grains are angular to subangular, suggesting that they were transported short distances from the source rocks. Factors controlling heavy mineral distributions include wave and wind action, proximity to provenance, the fluvial drainage network, and longshore currrents.The most economically important mineral is ilmenite. Zircon and rutile concentrations are relatively minor and thus have lower economic potential."

A small static bed was used to study the thermal cycles required for the heat hardening of pellets based on synthetic magnetite concentrates and a naturally fine hematite. This apparatus can be employed to yield broad process data for the design of a recuperative strand system operating on the magnetite concentrates.Various alternatives are given for a process to heat harden the hematite ore but a preference is given to the production of a self fluxing pellet. Bond types and general mineralogical structures are interpreted against the optimum firing cycle necessary to produce a defined quality of pellet.INTRODUCTIONThe work reported in this paper extends that on the "Heat Hardening of Artificial Magnetite Pellets", which was described at the International Symposium on Agglomeration, sponsored by the American Institute of Mining, Metallurgical and Petroleum Engineers at Philadelphia, U.S.A. in April 1961. Whereas that work was of a more basic nature, serving to illustrate the suitability of artificial magnetites with various admixtures, to the application of heat hardened pellets, on this occasion the aim is to illustrate the procedures which were used to establish the dimensions of commercial recuperative strands for Australian raw materials.The nature of the pellet feed, Le. relatively uniform spheres of + i in.-Yi6 in. diameter, makes it possible to use small scale static pots for test work. The work included an extensive information search, novel analyses in rock flow theory, cost and time estimation for shaft and raise construction methods, and development of design criteria for the are pass proper, dump point, and draw point.
