Introduction The impact of the Comprehensive Environmental Response, Compensation, and Liability Act, or Superfund, as well as the Resource Conservation and Recovery Act (RCRA) and their state counterparts underscore the intention of the nation's lawmakers to reduce the risk from hazardous substance to American society. The promises and requirements embodied in these laws, together with their prospects for liability, will continue to have a very substantial impact on decision making in the mining industry. These laws present the prospects for staggering liabilities, often of an unquantifiable nature in terms of time and amount. It is therefore necessary to keep them in clear focus. This is particularly true in light of President Reagan's signing into law the Superfund amendments on Oct. 17, 1986, and in light of the Environmental Protection Agency's (EPA) major policy pronouncement of July 3, 1986, regarding solid wastes from extraction of ores and minerals. This article examines the general trends as well as the specific provisions of these laws in an effort to assess the prospects of liability for the mining industry of releases of hazardous substances into the environment. Hazardous substances vs. hazardous wastes The distinction between the terms "hazardous substances" and "hazardous wastes" is important to appreciate for the purposes of assessing the potential for liability for a mining operation. Hazardous substance is a term that appears in and is defined in the Superfund Act. In Superfund, it is defined by reference to other substances that have been declared to be hazardous under other federal environmental statutes, such as RCRA, the Clean Air Act, and the Clean Water Act. Hazardous waste is a term that is less all-encompassing than hazardous substance, as that term is defined by RCRA. Hazardous substances do not need to be wastes to be considered hazardous for the purpose of Superfund liability. A "release" of a hazardous substance into the environment can bring about potential liability under Superfund. Many mining wastes, even though they are not considered hazardous wastes by EPA under RCRA, have been determined by that agency to be capable of bringing about liability under Superfund if they contain chemical substances, such as the heavy metals copper, lead, mercury, zinc, silver, and others. Therefore, it is not sufficient for the mining industry to be able to answer whether one has hazardous waste at a mining site. That question only goes partway in addressing the potential for liability. The next question is, do one's solid or liquid mining wastes contain hazardous substances that could bring about liability under Superfund? Superfund 1980 law: A review Some provisions of Superfund as it existed before its recent amendments must be considered. The law provides that the owners and operators of mining sites, together with those who transport hazardous substances to such sites, can be held jointly and severally liable for the cost of cleaning up the site. The concept of joint and several liability means that one party, as among many, can be held totally responsible for the costs of cleanup. The construction of the La Joya hydropower plant (Costa Rica) was awarded by the Spanish power company, Union Fenosa, to the Italian Joint Venture formed by the companies SELI SpA and Ghella SpA. The project, located in a mountainous region of central Costa Rica, includes a 7.9-km-long head race tunnel having an excavation diameter of 6.18 m. A double-shielded TBM was selected to perform the tunnel excavation, which involved mainly volcanic rocks in variable but generally very weak conditions. The tunnel crossed long and continuous sections in completely weathered rock masses with no residual cohesion and with high water inflows. The paper describes and analyzes: The special methods adopted to overcome these sections with the TBM includ-ing face stabilization by chemical grout and foams as well small by-pass tunnels in the crown combined with TBM advance/support The grouting design and the grouting method that was implemented to meet the waterproof design specifications and restore the original groundwater level in the mountain The additional geological investigations performed to improve the knowledge of the rock mass in front of the TBM and the outcomes of these investigations The performance of the TBM in different ground conditions and on average along the entire tunnel Finally, the author’s comment about the possibility of implementing and improving the technologies experimented with in this project in future similar applications.

In underground mines, coal dust explosions are prevented by the addition of rock dust sufficient to render the coal dust inert. The National Institute for Occupational Safety and Health (NIOSH) developed a hand-held instrument that uses optical reflectance to measure the explosibility of a rock dust and coal dust mixture. This instrument is called the Coal Dust Explosibility Meter (CDEM). In this study, NIOSH personnel accompanied Mine Safety and Health Administration (MSHA) inspectors on their routine band surveys in five underground coal mines in MSHA District 2 (Pennsylvania) and three underground coal mines in MSHA District 11 (Alabama). While underground, NIOSH personnel and MSHA inspectors used the CDEM to assess the explosibilities of the dust samples. The values of percent incombustible content (percent IC) determined by the CDEM agreed well with those obtained later by low-temperature ashing (LTA) in both MSHA and NIOSH laboratories. Further, the meter identified some samples as potentially explosible that LTA analysis had found to possess sufficient rock dust for inerting. The CDEM provides more information on the hazards in the mine. Rapid identification of areas with explosible dust mixtures using the CDEM allows for immediate intervention rather than a wait of several weeks for laboratory analysis.

A critical element of the Transbay Transit Center Program, the Caltrain Downtown Extension (DTX) will extend commuter rail service into downtown San Francisco and accommodate future statewide high-speed rail service. The DTX project includes 1.8 miles of underground construction, comprising significant sections of mined and cut-and-cover tunnel. At the request of stakeholders, an updated cost estimate was prepared early in the project?s preliminary engineering phase. Unsurprisingly, this yielded a cost substantially higher than the available budget. This paper provides a summary of the management processes and planning decisions taken to bring the project back to budget, resulting in a configuration which derives maximum value from available funding and retains maximum flexibility for future system expansion.

When the price of gold cracked the US$9.60/g(US$300/oz) mark last year, the gold-mining industry began to crank up again. This followed several years of gold prices that had languished in the mid-200s. Existing mines increased production and mines that had lain dormant for many years were getting second looks. The United States still produces a large amount of gold. But not much of the new production is coming from that country. Instead, strict environmental regulations still have companies wary of trying to invest the millions needed to start a new mine or expand existing ones. And after years of studies and negotiations between legislators, environmental interests and the mining industry, the United States still has not crafted a new mining law.

The first version of the longwall strata control and maintenance system (LSCMS) has been successfully developed by the Strata Control Re¬search Team at the University of Alabama. The system includes a software package designed to monitor shield leg pressure, interpret the data and predict the forthcoming roof loads and the existence of geological anomalies. It can also detect maintenance problems of the face equipment. The LSCMS was installed underground and connected to the surface terminals at Drummond's Shoal Creek Mine in Alabama. The system has proven to be a useful and practical system for improving safety and efficiency in coal-mining operation. The Shoal Creek Mine is a new, large coal mine operated by Drummond with two longwall panels. The Blue Creek seam is the primary source of coal production. It is located at a depth of 275 to 440 m (900 to 1,450 ft) below the surface with an approximate 2% southwest dip. Typical strata conditions are represented by two stratigraphic columns (Figs. la and b). A fireclay/dark shale parting (called Middleman) 0.2- 0.7-m- (1- to 2.5-ft-) thick exists between the Mary Lee and Blue Creek seams. Mining conditions vary from area to area. This mainly depends on the Blue Creek seam thickness that ranges from 0.9 to 2.9 m (3 to 9.5 ft). The thickness of the Mary Lee and the parting is relatively consistent with a to¬tal of 0.9 m (3 ft). Although the occurrence of deposits of titanium minerals on Kenya’s present day beaches and adjacent dune systems has been well documented, the potential for older formations to host economically viable deposits had not been recognised until recently. The Magarini sands formation in Kenya has been found to contain deposits of ilmenite, rutile and zircon in quantities and grades that have the potential to be commercially exploited. Since 1995, Tiomin Resources Inc. has explored these deposits and has identified one deposit, the Kwale project, as being able to support the development of a mine producing some 300,000 tpa ilmenite, 75,000 tpa rutile and 37,000 tpa zircon. Tiomin plans to start production by late 2002. Construction of a US$137 million operation is set to commence in the first half of 2001.

This study focuses on the amosite mining region in South Africa and associated health effects, compared to other mined asbestos fiber types. Historically, dust and fiber levels were high in the amosite mills and mines, and many miners and members of the surrounding communities were exposed to the fibers. Research has shown that amosite produces both benign and malignant disease. Nevertheless, the mesotheliomagenic potential of amosite is several fold lower than crocidolite. The risk of disease associated with amosite exposure is difficult to quantify. Reasons for this include the scarcity of available information, including fiber measurements, and case ascertainment, as well as the juxtaposition of the amosite and crocidolite asbestos seams in South Africa. © 2007 Elsevier Inc. Since Sept. 11, 2001, the author has been asked by several mining companies and mining publications to share some of his insights on how the terrorist attacks on the World Trade Center (WTC) and Pentagon might affect the mining industry globally. Until now, the author has been reluctant to express his thoughts in a publication that could possibly fall into the hands of terrorists and give them some ideas that they may not have been previously considering. However, the author discussed the contents of this article with several friends and acquaintances in the international intelligence community. They said that nothing commented on here is new to the terrorists. Potential terrorist targets Sources within the worldwide intelligence gathering community have told the author that current intelligence data indicates that it is likely that the Islamic fundamentalist groups responsible for the attacks on Sept. 11, 2001will likely be directing their effort at foreign business entities. Any overseas or any domestic businesses of highly visible companies that are part of the anti-terrorism alliance should consider themselves a potential target.

Ceremonies for the induction of four mining industry pioneers into the National Mining Hall of Fame will be held Saturday, Sept. 13, 2008 at the Charles F. Barber Pavilion of the Museum Convention Center in Leadville, CO. This will be the 21st Annual National Mining Museum and Induction Banquet. The four inductees are Lew Eklund, 76, Carrie Jane Billings Everson (1843-1914), ?Colonel? William C. Greene (1851-1911) and Arthur L. Hawkesworth (1860-1905). Lew Eklund founded Eklund Drilling that is now based in Elko, NV. He invented many designs that play a major role in today?s mining industry. His Cyclo Blower and various sampling devices he designed helped to revolutionize gold deposit exploration by allowing mining companies to effectively sample microscopic gold. Carrie Jane Billings Everson discovered and proved a method for bulk oil flotation concentration of mineral ores, the precursor to modern froth flotation methods of minerals concentration. She patented her process in 1886. In the early 1890s, coworkers built and operated demonstration plants incorporating her bulk oil flotation process. ?Colonel? William C. Greene was responsible for the development of the great copper mining properties of Cananea, Mexico. In seven years, he went from ragged cattleman and adventurer to the greatest captain of industry the borderlands have ever seen. Arthur L. Hawkesworth was a master mechanic for Anaconda Copper. He invented the detachable drill bit. His invention generated tremendous savings for the mining industry in time, in dollars and in safer operating conditions underground. His bit?s long lasting contribution to improved mine economics is immeasurable. The 21st Annual National Mining Museum and Induction Banquet will begin with an open house and reception at 5:30 p.m. followed by the dinner and program at 7 p.m. The inductions will bring to 201 the number of mining ?greats? whose engraved photographs and biographical sketches are installed in the National Mining Hall of Fame.

China’s burgeoning economy is responsible for a major share of recent world mineral consumption increases. In addition to factors traditionally recognized in market economies1 and factors unique to specific commodities, Chinese consumption now plays a major and increasingly important role in energy and mineral markets for many commodities, such as aluminum, copper, iron and steel, and oil. China has the world’s second largest economy after the United States. And its long-term importance to the minerals markets is even greater than indicated by its gross domestic product (GDP), which is currently less than two-thirds of that of the United States (Table 1). This is because China’s rising standard of living is accompanied by rapid industrialization and urbanization. Its consumption of mineral materials for infrastructure development for its very large population is significantly greater per capita than that of such developed economies as the United States, the European Union and Japan. In other words, China’s per capita production is rising at a rapid rate and will probably continue to do so for many years.

Online education is not new. During the last decade, it has reached the stage where many universities offer a variety of courses, degrees and programs without any associated residency requirements. The most successful of the online universities, University of Phoenix, offers hundreds of accredited programs for close to 100,000 students throughout the world (www.phoenix.edu). Online education is considered to be a valid equivalent to traditional, classroom-based education. It is best suited to the needs of mature students with full-time jobs and a desire to deepen their knowledge. While most of the e-business has experienced severe setbacks during the last two years, e-education shows no signs of slowing down. On the contrary, the number of students and institutions offering online education keeps growing. The value of e-education associated expenditures was expected to reach $300 billion in 2001 (Sanoff,2001), making it a serious and mature industry.

Mining and processing of bastnaesite ore, (Ln)CO3F, for lanthanides extraction is investigated in this paper. This series of elements proved to be applicable for a wide range of high-tech uses. In spite of the strategic importance of lanthanides, no LCA and energy analyses of their extraction have ever been published. We perform in this paper a Life Cycle Assessment of the Lanthanide production cycle, based on available database and literature data from Mountain Pass mine (USA) and other worldwide mining and processing sites, most of which in China. We investigated three main steps: mining, milling (including transport, grinding and drying), and flotation (for lanthanide chloride extraction). We do not investigate here the separation of pure oxides from lanthanide chloride, a compound which is also marketed as such. The conventional LCA was integrated by means of energy and emergy evaluations, aimed at investigating respectively the global energy cost and the environmental sustainability of the process. Indicators of material intensity, thermodynamic efficiency, and environmental impact (including LCA and ecological footprint impact categories) are calculated and discussed.

Recent advances in computing, rendering, and display technologies have generated increased accessibility for virtual reality (VR). VR allows the creation of dynamic, high-fidelity environments to simulate dangerous situations, test conditions, and visualize concepts. Consequently, numerous products have been developed, but many of these are limited in scope. Therefore, the National Institute for Occupational Safety and Health researchers developed a VR framework, called VR Mine, to rapidly create an underground mine for human data collection, simulation, visualization, and training. This paper describes the features of VR Mine using self-escape and proximity detection as case studies. Features include mine generation, simulated networks, proximity detection systems, and the integration and visualization of real-time ventilation models.

A study of the application of mine tailings as precast construction materials through alkali activation has been carried out, focusing on efficiently activating mine tailings, reducing alkali consumption, decreasing curing time and improving compressive strength. Firstly, the effect of temperature on the alkali activation of mine tailings was studied. Secondly, the impact of additives, i.e., calcium hydroxide and aluminum oxide, on the compressive strength of samples was investigated. Thirdly, the impact of forming pressure on sample strength was studied. Test results showed that unconfined compressive strength (UCS) of 40 MPa was achieved with the geopolymerization products through optimization. Finally, to elucidate the geopolymerization mechanism of mine tailings, microscopic and spectroscopic techniques including SEM/EDX, XRD, and FTIR spectroscopy were used to investigate the microstructure and the elemental and phase composition of the geopolymerization products. The findings of the present work provide a practical method for applying mine tailings as precast construction materials through alkali activation.

Real copper prices during the past several decades display two striking characteristics. First, they are highly volatile. Within a year or two, copper prices can rise or fall by 30% or more. Second, over the longer term, they are falling. Indeed, since 1970, the secular trend price for copper is down by more than 50%. Figure 1 highlights both of these characteristics. It shows the average annual US producer price for copper since 1970 measured in constant 2001 US dollars. While the London Metal Exchange (LME) copper price is not shown, it and the US producer price have for some time moved more or less together. So pronounced short-run fluctuations around a significant long-run decline describe copper prices, not only in the United States, but around the world.

Many countries, provinces, territories and states in the European Union, Australia, Canada, the United States and elsewhere have begun implementing sustainability programs. Most of those programs, however, stop short of sustainable management of aggregate resources. Sustainable practices do not always have to be conducted under the title of sustainability. This case study describes how Lafarge implemented the principles of sustainability even though there was an absence of existing local government policies or procedures addressing sustainable resource management. Jefferson County is one of three counties in the six-county Denver, CO, region that has potentially available sources of crushed stone. Crushed stone comprises 30percent of the aggregate produced in the area. And it plays a major role in regional aggregate resource needs. Jefferson County is home to four of the five crushed stone operations in the Denver region. Lafarge operates one of those four quarries.

A series of gas inrush events occurred during development at Grosvenor mine resulting in exposure to elevated levels of methane at the production face. A total of 22 gas inrush events occurred releasing between 15 and 130 m3 of methane during each event. The presence of an undrained seam in the immediate floor, geotechnical characteristics of the floor, and the stress environment all contributed to these dynamic floor events, while the geological characteristics of the seam below, such as the seam thickness and ash content of 75%, prevented effective pre-drainage. However, events only occurred in headings mined parallel to the principal horizontal stress direction. In cut-throughs (C/Ts) perpendicular to the principal stress direction, no events occurred, and higher methane levels were observed at the production face.

To exploit an underground mine effectively and safely, it is important to have a good understanding of the geotechnical behavior around underground excavations made in the mine. The aim of this study was to investigate the geotechnical behavior around a tunnel excavated in a metal mine in China at the three-dimensional level. Using the information available on lithology, geological structures, in-situ stress measurements, physical and mechanical properties of intact rock, discontinuities and interfaces between different rocks, a three-dimensional numerical model was built by using the 3DEC software to simulate a tunnel excavation under a high in-situ stress condition. Effect of the discontinuity network, possible intact rock and discontinuity parameter variability, representation of rock masses as discontinuum or continuum material and rock support system on the deformation, stress, failure zone and stability around the tunnel was investigated. A very good agreement was obtained between the collected field deformation monitoring results and the results of the conducted numerical stress analyses.
